SAN JUAN COUNTY COMMISSION MEETING AUGUST 4, 2003 The regular meeting of the San Juan County Commission was held at 10:00 A.M. in the Commission Room at Monticello, Utah. Present: Manuel Morgan, Vice-Chairman Ty Lewis, Commissioner Melissa Begay, Administrative Services Manager Norman Johnson, County Clerk LaVee Scherick, Deputy Clerk Absent: Lynn Stevens, Chairman Rick Bailey, Administrative Assistant A motion to approve the minutes of the July 21, 2003 meeting as amended was made by Commissioner Ty Lewis and seconded by Commissioner Manuel Morgan. None opposed. Commissioner Manuel Morgan declared the motion carried. Hassen Estate Lot #3 Replat County Building Inspector Bruce Bunker presented for approval a subdivision amendment for Hassen Estate Lot #3. They have met all the requirements. Commissioner Ty Lewis made a motion to approve the subdivision change subject to receiving a new plat mylar with proper signatures. Commissioner Manuel Morgan seconded. None opposed. Commissioner Manuel Morgan declared the motion carried. Building Permits Building Inspector Bruce Bunker presented the following building permits for approval: Lynn Atwood for a shed on LaSal Mountain; Doug Christensen for an addition to existing home in Blanding; Bryant & Colleen Cornelius for a new home in Pack Creek; James Shepherd for a manufactured home in Spanish Valley; Lonnie Hammer for a manufactured home in Spanish Valley; and Tom Vowell for a new home on Reservoir Rd, Blanding. Commissioner Ty Lewis made a motion to approve the building permits and authorize Commissioner Manuel Morgan to sign the permits. Commissioner Manuel Morgan seconded. None opposed. Commissioner Manuel Morgan declared the motion carried. PERSONNEL DEPARTMENT REPORT Request to Hire/GPS Crew The names of Brandon Powell and David Dakoski were presented to be hired as full time, temporary, laborers for the GPS crew at Step 29 at $7.91 per hour effective August 4, 2003. Commissioner Ty Lewis made a motion to approve the hires. Commissioner Manuel Morgan seconded. None opposed. Commissioner Manuel Morgan declared the motion carried. An emergency hire request was presented for Pete Steele to be a hired as a member of the GPS crew at Step 93 at $10.61 per hour effective July 1, 2003. Commissioner Ty Lewis made a motion to approve the hire. Commissioner Manuel Morgan seconded. None opposed. Commissioner Manuel Morgan declared the motion carried. Payroll Change/Road Laborer-South Road Dept A payroll change was presented for Robert Winn to be moved from temporary to permanent status as a road laborer. This would move him from Step 29 at $7.91 per hour to Step 29 at $1371 per month effective August 1, 2003. Commissioner Ty Lewis made a motion to approve the payroll change. Payroll Change/Probationary Raise-Road Dept The following names were presented for probationary raise changes effective August 1, 2003: Bobby Benally from Step 102 at $1915 per month to Step 108 at $1973 per month; Russell Bradford from Step 129 at $2175 per month to Step 135 at $2236 per month; Lambert Cly from Step 98 at $1881 per month to Step 104 at $1933 per month; Richard Garner from Step 121 at $2094 per month to Step 127 at $2155 per month; Pieter Haller from Step 104 at $1933 per month to Step 110 at $1988 per month; Val Hurst from Step 102 at $1915 per month to Step 108 at $1973 per month; Kedric Musselman from Step 137 at $2257 per month to Step 143 at $2323 per month; Mike Shupe from Step 57 at $1558 per month to Step 63 at $1602 per month; and Manuel Valdez from Step 123 at $2111 per month to Step 129 at $2175 per month. GPS Crew/Resignation Personnel Secretary Lillian Bayles reported that Pete Steel, GPS crew, resigned effective August 1, 2003. PLANNER EDWARD SCHERICK'S REPORT Out-of-State Travel Planner Scherick reported that he was invited to a meeting in New Mexico to present the County RS2477 Road Strategy presentation but was not contacted with details until last week. He had already made other commitments. Planner Scherick requested that Bill Redd, Public Lands Council, be allowed to give the presentation. Commissioner Ty Lewis made a motion to allow Mr. Redd to travel out of state to give the presentation. Commissioner Manuel Morgan seconded. None opposed. Commissioner Manuel Morgan declared the motion carried. Drought Relief Planner Scherick reported the County received $60,681 interest money from San Juan Water Conservancy District to help complete the drought projects in the County. The County transferred $10,000 to the Eastland Water District. Other entities involved are Monticello City, Navajo Mountain, Oljato, and Monument Valley. Southern Utah Wilderness Alliance Planner Scherick reported the County received a fax indicating that Southern Utah Wilderness Alliance is trying to persuade the governor to stop the San Juan ATV Safari. Shooting Range Grand County and Moab Sportsman have requested the County support them in their effort to establish a shooting range. The BLM has asked the County to apply for a Recreation Public Purposes lease which would turn in to a patent. The County does not want the liability. No decision was made. Newspaper Rock/Road The road near Newspaper Rock washed out over the weekend. ADMINISTRATIVE SERVICES MANAGER MELISSA BEGAY'S REPORT UAC/Transient Room Tax Study Utah Association of Counties has requested funding to conduct a study on transient room tax. Commissioners Lewis and Morgan are opposed to the idea. The County will conduct their own study. Library Ordinance Administrative Services Manager Melissa Begay reported the Library Board met and reviewed the proposed Library Ordinance. The Board doesn't have any problems with it. Deputy Attorney Bird will look in to the advertising process before an action is taken. UAC/Amended Interlocal Cooperation Agreement Deputy Attorney Walter Bird presented the amended Interlocal Cooperation Agreement with UAC. They are changing the name from Utah Association of Counties Insurance Mutual to the Utah Counties Insurance Pool. They have add language in the agreement from the by-laws that were not in the original agreement. Commissioner Ty Lewis made a motion to approve the resolution agreement. Commissioner Manuel Morgan seconded indicating that Deputy Attorney Bird has reviewed it and indicated there are no significant changes. None opposed. Commissioner Manuel Morgan declared the motion carried. The resolution is as follows: RESOLUTION NO. 2003-01 AMENDED INTERLOCAL COOPERATION AGREEMENT RESOLUTION APPROVING AND AUTHORIZING THE EXECUTION OF AN AMENDED INTERLOCAL COOPERATION AGREEMENT WITH OTHER MEMBERS OF UTAH ASSOCIATION OF COUNTIES INSURANCE MUTUAL, RELATING TO THE ESTABLISHMENT, FUNDING AND OPERATION OF UTAH ASSOCIATION OF COUNTIES INSURANCE MUTUAL WHEREAS, pursuant to the provision of the Interlocal Cooperation Act, Title 11, Chapter 13, Utah Code Annotated, 1953 as amended, and the Utah Insurance Code, Title 31A, Chapter 5, Utah Code Annotated, 1953 as amended, public agencies, including political subdivisions of the State of Utah as therein defined, are authorized to enter into mutually advantageous agreements to provide services and facilities; and WHEREAS, the Board of County Commission of San Juan County, Utah, has determined that the interests and welfare of the public within San Juan County's jurisdiction will best be served by an Amended Interlocal Cooperation Agreement with other members of Utah association of Counties Insurance Mutual relating to the establishment, funding and operation of Utah Association of Counties Insurance Mutual. NOW, THEREFORE, be it resolved by the Board of County Commission of San Juan County, Utah, that San Juan County approve and authorize the Commission Chair to execute an Amended Interlocal Cooperation Agreement with other members of Utah Association of Counties Insurance Mutual relating to the establishment, funding and operation of Utah Association of Counties Insurance Mutual. Bird, Deputy County Attorney For: Craig Halls, Attorney, San Juan County Lisbon Valley Road Phase II/Project Administrative Services Manager Melissa Begay stated that it was agreed by the Commission to pay for the design engineering for Phase II of the Lisbon Valley Road Project using county funds. The estimated cost is $120,000. Commissioner Ty Lewis made a motion to approve Creamer & Noble to complete the engineering design on Phase II of the Lisbon Valley Road Project. San Juan Foundation/Monument Valley Land Melissa Begay reported on the memo concerning the denial from State Trust Lands on the request from the San Juan Foundation to purchase land for an amphitheater. Steve Simpson, Attorney for San Juan Foundation, wants to schedule a meeting with State officials on August 22, 2003 to discuss the proposal. Tri-County Meeting/National Park Service The Tri-County meeting with the National Parks Service will be held on September 10-11, 2003 at Wahweep Lodge. Aging Contract/FY2002-03/Medicaid Waiver Administrative Services Manager Melissa Begay presented the Medicaid Waiver contract for January - June 2003 for approval. Aging Contract/Utah Department of Human Services-FY 2003-04 Melissa Begay presented the State Aging Contract for FY 2003-04 in the amount of $33,000 for approval. Aging Contracts/Rocky Mountain Home Care Administrative Services Manager Melissa Begay presented the following contracts for FY2003-04 with Rocky Mountain Home Care for approval: 1)Respite Care; 2)HIIP Program; 3)Ombudsman; 4)Home & Community Based Alternatives Program; and 5)Medicaid Waiver. Road Meeting Business School Bus Route Maintenance Contract Commissioner Manuel Morgan presented the BIA School Bus Route Maintenance Contract in the amount of $81,000 for approval. Bid/Oil Dispenser Bids were presented for an oil dispenser for the South Road Department from Kar Products at $1175.40; Motor Parts Co. at $1850; and from Northern Tool & Equipment at $1089.97. Bid/Airless Paint Sprayer Bids were presented for an airless paint sprayer for the North Road Department from Bookcliff Sales at $499.99; Motor Parts at $399.99; and Northern Tool at $539.99. COMMISSIONER TY LEWIS' REPORT Commissioner Ty Lewis received a call from Senator Bennett's office concerning Reclamation projects. The Navajo Revitalization meeting will be held this afternoon at 1:00 P.M. in Blanding There will be a San Juan County Substance Abuse/Mental Health Board meeting this afternoon at 4:00 P.M. in the County Courthouse. COMMISSIONER MANUEL MORGAN'S REPORT Commissioner Manuel Morgan was invited to ride his horse in the Days of '47 Parade in Salt Lake. However, he had problems with his trailer and did not make it to the parade. Commissioner Morgan will attend the Navajo Revitalization meeting this afternoon at 1:00 P.M.
