SAN JUAN COUNTY COMMISSION MEETING August 24, 2009 The regular meeting of the San Juan County Commission was held at 10:00 A.M. in the Commission Room at Monticello, Utah. Present: Bruce Adams, Chairman Kenneth Maryboy, Vice Chair Lynn Stevens, Commissioner Rick Bailey, SJC Administrator Norman L. Johnson, SJC Clerk/Auditor Dawn Shaw, SJC Deputy Clerk Attendees: Jerry McNeely, Charlie DeLorme, Cyndi Eldredge, David and Tammy Gallegos, Howard Randall, Evan Lowry, Dave Cressler, Scott Burton, Frank and Sue Morrell, Kathy Rogers, Debbie Rush, Carla Sorrell, Greg Adams, Sharon Smith, Allan Tracy, Scott Mitchell, Vern Shumway, Chance Shumway, Dan Shumway, Mike Lacy, Richard Thobe, Ben Musselman, Jeff Nielson, David Bronson, Todd and Desi Calvert, Lynn Laws, Eric Lozoya, Bob Turri, Dean Collard, Curtis Palmer, Ferd Johnson, Bruce Black, Brent and Cindy Johansen, Edwin Hawkins, Jon Hunt, Brooke Williams, Joe Lyman, Merle McDonald, Wendy Johnston, David Okkema, Larry and Teverly Langford A motion to approve the minutes of August 17, 2009 was made by Commissioner Lynn Stevens. Commissioner Kenneth Maryboy seconded the motion. None opposed. Commissioner Bruce Adams declared the motion carried. Brent Johansen – SPEAR Brent Johansen, along with several members of SPEAR, reported to Commissioners about various road and trail closures, by the BLM and Forest Service, to motorized vehicles. The concern is that there are trails that are “temporarily” closed, with no signs of being opened again. Commissioners asked SPEAR members to be the eyes and ears of the county and let them know when there are new closures. It is Commissioners plan to strongly oppose any closings. Greg Adams – SJC Planning and Zoning Greg reported to Commissioners that the issue of David Cressler’s proposed evaporation ponds went before the Planning and Zoning Commission. It was recommended by P&Z to not approve the evaporation ponds due to health concerns, property values and possible contamination to the neighboring ground. Greg stated there is nothing to say that the ponds would be harmful to anyone’s health or the ground. Commissioners asked Greg to get more information and bring this back to them at the September 8th Commission Meeting at which time a decision can be made. Eric Lozoya – SJC Resident Mr. Lozoya reported to Commissioners that he felt he had been mistreated by some of the county employees. He stated that he bought some property and moved here because he loved the area. His concerns were for his family and property. Commissioners requested a statement, in writing, from Mr. Lozoya stating what he would and would not permit the county to do on his property in case of an emergency. Cyndi Eldredge – SJC Personnel Cyndi presented a request to hire Dustin Fife as the Library Director. This would be in addition to his current job as the Blanding Librarian. Dustin would move from Step 47 to Step 118. A motion to approve the request was made by Commissioner Lynn Stevens. Commissioner Kenneth Maryboy seconded the motion. None opposed. Commissioner Bruce Adams declared the motion carried. Lynn Laws – SJC Road Superintendent Lynn reported to Commissioners about an issue over D road wilderness area and some people wanting permission to get in there to clean out old drilling holes. Commissioners asked Evan Lowry, SJC Planning/GPS to look into this and get back with Lynn. Rick Bailey – SJC Administrator Rick presented three building permits for approval. Robert Myers – Covered Patio – La Sal, UT Karl Larsen – Greenhouse – Moab, UT Luis Nieves – Residence – Hwy 191, Wilson Arch Resort Community A motion to approve the three building permits, provided all appropriate signatures are in place, was made by Commissioner Lynn Stevens. Commissioner Kenneth Maryboy seconded the motion. No opposed. Commissioner Bruce Adams declared the motion carried. Rick reported to Commissioners that they received the bid proposals for the Monticello Library parking lot. He presented a request to have the low bidder, LeGrand Johnson, do the project at a cost of $30,160.10. A motion to approve the request was made by Lynn Stevens. Commissioner Kenneth Maryboy seconded the motion. None opposed. Commissioner Bruce Adams declared the motion carried. Norman L. Johnson – SJC Clerk/Auditor Norman reported to Commissioners that the state coyote bounty is ready for approval and signature however it is only $4,000 instead of the $5,000. A motion to sign the bounty was made by Commissioner Lynn Stevens. Commissioner Kenneth Maryboy seconded the motion. None opposed. Commissioner Bruce Adams declared the motion carried. Jerry McNeely – SJC Liaison Jerry reported to Commissioners about the Spanish Valley Water and Sewer meeting he attended Thursday. Commission Reports Commissioner Adams plans to be in the county and can be reached by phone. Commissioner Stevens plans to attend SITLA in Salt Lake Thursday and a CEU Board of Trustees meeting where he has been appointed a Chairman of Trustees. Commissioner Maryboy reported that the Navajo Nation session ended last weekend the Navajo Summit starts next week. He requested a letter from Commissioners Stevens and Adams wanting to get on the RAC Board. He plans to be in the county this week. Adjourn 12:14 P.M. 1
