SAN JUAN COUNTY COMMISSION MEETING July 13, 2009 The regular meeting of the San Juan County Commission was held at 10:00 A.M. in the Commission Room in Monticello, Utah. Present: Bruce Adams, Chairman Kenneth Maryboy, Vice Chair Rick Bailey, SJC Administrator Dawn Shawn, SJC Deputy Clerk Absent: Lynn Stevens, Commissioner Attendees: Marilyn Boynton, Howard Randall, Carmella Galleg, Bryan Goode, Charles Laurencis, Kathy Goode, Frank Darcey, Karen Hostetter, Marlene Huckabay, Gail Darcy, Lannie Yeager, Louetta Edwards, Ken Hostetter, Guy Thompson, Janice Knight, Charlie DeLorme, Maxine Deeter, Jerry McNeely, Evan Lowry, Jeff Nielson, Pam Hanson, Susan Taylor, Walter Bird, Bruce Bunker A motion to approve the minutes of June 22 and July 6, 2009, with corrections, was made by Commissioner Kenneth Maryboy. Commissioner Bruce Adams seconded the motion. None opposed. Commissioner Bruce Adams declared the motion carried. Lynn Laws – SJC Road Department Lynn, along with Val Dalton, reported to Commissioners that they received the necessary information from David Bronson to move forward with the land trade that was discussed at the March 16, 2009 Commission Meeting. Lynn stated that the trade is beneficial to the county and all that was needed was for Mr. Dalton and the county to draw up deeds to finalize the trade. A motion to proceed with the land trade between San Juan County and Val Dalton was made by Commissioner Kenneth Maryboy. Commissioner Bruce Adams seconded the motion. None opposed. Commissioner Bruce Adams declared the motion carried. Charlie Delorme and Pam Hanson – SJC Ec. Development Charlie presented a procurement request for a 2009 Toyota Prius from Tony Divino Toyota in the amount of$24,095. A motion to approve the request was made by Commissioner Kenneth Maryboy. Commissioner Bruce Adams seconded the motion. None opposed. Commissioner Bruce Adams declared the motion carried. Charlie presented an out of state travel request for Pam Hanson to New Orleans, LA for a Travel Events and Management Seminar in the amount of $1,199. A motion to approve the request was made by Commissioner Kenneth Maryboy. Commissioner Bruce Adams seconded the motion. None opposed. Commissioner Bruce Adams declared the motion carried. Lannie Yeager – SJC Resident Mr. Yeager along with several county residents, reported to Commissioners that there is a sand and gravel pit (San Juan Gravel) being built and used by Kevin Carroll in Spanish Valley. They stated their concerns over Mr. Carroll having the appropriate permits and authorization to be proceeding with this business. Among their concerns were air quality, noise, invasive species, wetlands and visual aesthetics. They requested the Commissioners to have Mr. Carroll cease all operations until the requirements were met and asked that the Commissioners come down to the properties in a timely manner to view the area for themselves. After a lengthy discussion Commissioners explained that if Mr. Carroll followed county rules then the county could not shut him down. The next step would be for Mr. Carroll to go through the regulations set by the State. Commissioner Bruce Adams stated that he would be by to tour the area this Thursday morning. As far as any recourse the residents feel they need to hire an attorney. Marilyn Boynton – SJC Resident Marilyn reported to Commissioners that after doing some research into the matter of the tamarisk beetle she fears that the beetle will destroy needed habitat for birds and other animals. She stated that she would like to have something done so that the beetle doesn’t make its way to the San Juan River in Bluff. Jerry McNeely, SJC Liaison, reported that the tamarisk beetle only eats the tamarisk and that it takes up to five years for the trees to die. When they do the native trees such as the willow will grow and provide the habitat needed. He also stated that the tamarisk is detrimental to the water supply because they soak up so much more water than the native vegetation. Rick Bailey – SJC Administrator Rick presented four building permits for approval and signature. Shawn Morris – Barn with Living Quarters – Elk Meadows, Monticello Mark Lewis – Garage – S Tera Dr, Spanish Valley Franklin Hawkins – Addition – S Hwy 191, Blanding Steve Barry – Residence – Eastland A motion to approve the building permits, provided all appropriate signatures are in place, was made by Commissioner Kenneth Maryboy. Commissioner Bruce Adams seconded the motion. None opposed. Commissioner Bruce Adams declared the motion carried. Rick presented the Aging Legal Services Contract with Utah Legal Services Inc. in the amount of $1,300 for approval and signature. A motion to approve the contract was made by Commissioner Kenneth Maryboy. Commissioner Bruce Adams seconded the motion. None opposed. Commissioner Bruce Adams declared the motion carried. Rick presented the Medical Aging Waiver for approval and signature. A motion to approve the waiver was made by Commissioner Kenneth Maryboy. Commissioner Bruce Adams seconded the motion. None opposed. Commissioner Bruce Adams declared the motion carried. Rick presented a grant application for a Montezuma Creek Ambulance in the amount of $100,000 from USDA. Rick presented a grant application for the Eastland Fire Station in the amount of $84,000 from USDA. A motion to approve the grant application was made by Commissioner Kenneth Maryboy. One for a 2008 CAT 226B2 CL Steer Loader with a 66” bucket in the amount of $23,000 from Wheeler Machinery and one for a 14’ Swenson V-Box Stainless Steel Spreader in the amount of $11,985 from AG Truck. A motion to approve the requests was made by Commissioner Kenneth Maryboy. Commissioner Bruce Adams seconded the motion. None opposed. Commission Reports Commissioner Maryboy reported that the Navajo Nation Summer Session was beginning with a horseback ride from Hovenweep to Window Rock which he plans to attend and then will attend UAC in Logan Friday.
