SAN JUAN COUNTY COMMISSION MEETING December 15, 2008 The regular meeting of the San Juan County Commission was held at 10:00 A.M. in the Commission Room at Monticello, Utah. Present: Bruce Adams, Chairman Kenneth Maryboy, Vice Chairman Lynn Stevens, Commissioner Rick Bailey, SJC Administrator Norman L. Johnson, SJC Clerk/Auditor Dawn Shaw, SCJ Deputy Clerk Attendees: Scott Burton, Stuart and Pat Smith, Mike Lacy, Brad Randall, Scott Mitchell, Howard Randall, Charlie DeLorme, Tammy Gallegos, Cyndi Eldredge, Lynn Martin, Greg Adams, Paula and Jack Randolph, Wanda Franklin, Lynn Laws, Walter Bird, Evan Lowry, Paul Barr A motion to approve the minutes of December 8, 2008, with corrections, was made by Commissioner Lynn Stevens. Commissioner Kenneth Maryboy seconded the motion. None opposed. Commissioner Bruce Adams declared the motion carried. Commissioner Bruce Adams abstained because he was not present last week. Cyndi Eldredge - SJC Personnel Cyndi presented a request to hire Patricia Smith for the Monticello Librarian Assistant, a part time Grade 1 Step 1 position. A motion to approve the request was made by Commissioner Lynn Stevens. Commissioner Kenneth Maryboy seconded the motion. Non opposed. Commissioner Bruce Adams declared the motion carried. Cyndi presented an distinguished achievement award from UCIP to the county and county Commissioners. This award is for meeting 100% in workers comp and multiline best practices programs. The counties credit from this is $12,556. Commissioners thanked Cyndi for all her hard work on these programs. Howard Randall - SJC Assessor Howard reported to Commissioners that Encana has been charged twice for taxes once on central assessed and again on local assessed and they have paid both. Howard requested that Encana be refunded the overage. A motion to approve the request was made by Commissioner Lynn Stevens. Commissioner Kenneth Maryboy seconded the motion. None opposed. Commissioner Bruce Adams declared the motion carried. -1- Tammy Gallegos - SJC Administrative Assistant Tammy reported on the status of her aging program and says there will be significant cuts in funds from the State. Tammy states that there are areas in her budget she can cut to help offset this. The primary cut will be $50,000 for the Bluff Senior Center addition. Norman L. Johnson - SJC Clerk/Auditor Norman presented several Beer License renewals for approval and signature. List: Line Camp Steakhouse, Old Bridge Grill, Hatch Trading Post, Valle's, San Juan Inn and La Sal Store A motion to approve the renewals was made by Commissioner Lynn Stevens. Commissioner Kenneth Maryboy seconded the motion. None opposed. Commissioner Bruce Adams declared the motion carried. Norman reminded Commissioners about the public hearings, concerning the budget, starting at 10:45 a.m. and continuing until 11:00 a.m. next Monday in the Commission Room. Lynn Laws, Wanda Franklin and Paula Randolph - SJC Road Department Lynn, Wanda and Paula presented bid requests for the following; Batteries: from Standard Battery as they were the only bidder Oil, grease and Antifreeze: from BCL as they were the only bidder Corrugated Steel Pipe: from Big R and Contech. Contech was the low bidder. Filters: from Monticello Home and Auto and Page Brake. Page Brake was the low bidder by $656.51 however Monticello Home and Auto is local and can save in the long run on shipping and other costs. A motion to approve the bids was made by Commissioner Lynn Stevens. Commissioner Kenneth Maryboy seconded the motion. None opposed. Commissioner Bruce Adams declared the motion carried. The Commission had a discussion with Lynn Laws and representatives from Crownquest. There will be a written agreement prepaid by Crownquest on the road work to be completed by SJC to the damaged roads. Rick Bailey - SJC Administrator Rick presented one building permit for approval and signature. Curtis Wilcox - Residence - La Sal A motion to approve the building permit was made by Commissioner Kenneth Maryboy. Commissioner Lynn Stevens seconded the motion. None Opposed. Commissioner Bruce Adams declared the motion carried. Rick presented a list of applicants, for the 2009 Special Service District Appointments. -2- Following a discussion a motion to approve the following applicants was made by Commissioner Lynn Stevens. Bluff Water Works: Melvin Gaines and Steve Simpson Eastland SSD: Billy Richardson San Juan Health SSD: Allan Barry and Doug Allen San Juan Transportation SSD: G.O. Foushee San Juan Water Conservancy: J. Merlin Grover Rick reports that he has submitted a permit with the Army Corp of Engineers for the Montezuma Creek Bridge. Rick presented a request to apply for funds in the amount of $23,000 for this project. A motion to approve the request was made by Commissioner Lynn Stevens. Commissioner Kenneth Maryboy seconded the motion. None opposed. Commissioner Bruce Adams declared the motion carried. Open Time and Other Business Charlie DeLorme, SJC Ec. Development, reported to Commissioners that his office will be closed December 26, 2008 and January 2, 2009, for the Holidays. He states that everyone will be taking personal preference or vacation time. Howard Randall, SJC Assessor, presented a request to close the building at noon on December 24, 2008, with pay, for the Holiday. Commissioners agreed to close the administration building Wednesday December 24, 2008 at noon. Stuart Smith, SJC Resident, discussed with Commissioners the possible acceptance of roads in Elk Meadows subdivision to the county road system. He requested that even though these roads have not been accepted by the county as of yet, would Commissioners authorize the Road Department to plow two of them. A motion to plow the Elk Ridge and Blue Mountain roads was made by Commissioner Lynn Stevens. Commissioner Kenneth Maryboy seconded the motion. None opposed. Commissioner Bruce Adams declared the motion carried. Commissioner Adams abstained from the vote due to his relationship to the owner of the subdivision. Rick Bailey will set up a public hearing date regarding official county action on the Elk Meadows roads. Craig Halls, SJC Attorney, presented a request to purchase a new computer. A motion to approve the request was made by Commissioner Lynn Stevens. Commissioner Kenneth Maryboy. None opposed. Commissioner Bruce Adams declared the motion carried. Commission Reports Commissioner Stevens reports he plans to attend meetings in Salt Lake Wednesday and Thursday and also a CEU Board of Trustees Meeting. -3- Commissioner Maryboy attended meetings in Salt Lake last week. He plans to attend a Utah Navajo Commission meeting in Red Mesa this week and plans to visit the Bluff Elementary School Wednesday. Commissioner Adams plans to be in the County all week.
