SAN JUAN COUNTY COMMISSION MEETING September 15, 2008 The regular meeting of the San Juan County Commission was held at 10:00 A.M. in the Commission Room at Monticello, Utah. Present: Bruce Adams, Chairman Lynn Stevens, Commissioner Rick Bailey, SJC Administrator Norman L. Johnson, SJC Clerk/Auditor Dawn Shaw, SCJ Deputy Clerk Absent: Kenneth Maryboy, Vice Chairman (excused due to other County business) Attendees: Cyndi Eldredge, John Fellmeth, Evan Lowry, Linda Larson, Maxine Deeter A motion to approve the minutes of September 8, 2008, was made by Commissioner Lynn Stevens. Commissioner Bruce Adams seconded the motion. None opposed. Commissioner Bruce Adams declared the motion carried. John Fellmeth - SJC IT John presented a procurement request for a Garmin GPSMAP 60GSx GPS Receiver for the Planning Department in the amount of $293.98. A motion to approve the request was made by Commissioner Lynn Stevens. Commissioner Bruce Adams seconded the motion. None opposed. Commissioner Bruce Adams declared the motion carried. Cyndi Eldredge - SJC Personnel Cyndi presented a Resolution, for proper procedure of filing claims against the County, for approval and signature. Resolution No. 2008-_____ RESOLUTION TO COMPORT WITH THE GOVERNMENT IMMUNITY ACT OF UTAH IN HANDLING CLAIMS FOR INJURY MADE TO BY OTHERS TO SAN JUAN COUNTY, UTAH THAT: WHEREAS, every year San Juan County, Utah (hereinafter "County") receives various claims from private and public companies, private persons, and occasionally other governmental agencies for injury to either person or property; WHEREAS, in the past, the County has collected the information about the claim and submitted -1- the claim directly to its insurance carrier; WHEREAS, pursuant to the Governmental Immunity Act of Utah subsection 63G-7-401(2), Utah Code Annotated (1953, as amended), "[a]ny person having a claim against a governmental entity, or against its employee for an act or omission occurring during the performance of the employee's duties, within the scope of employment, or under color of authority shall file a written claim of notice with the entity before maintaining an action, regardless of whether or not the function giving rise to the claim is characterized as governmental"; and WHEREAS, the County has been advised by its insurance carrier Utah County Insurance Pool (UCIP) to comport with the Governmental Immunity Act of Utah in the handling of claims made by others to San Juan County, Utah. NOW, THEREFORE, BE IT RESOLVED BY THE COUNTY LEGISLATIVE BODY OF SAN JUAN COUNTY, UTAH, THAT: The Board of San Juan Commissioners resolve to follow and comport with the Governmental Immunity Act of Utah in handling claims for injury made by others to San Juan County, Utah. Jason will be at a Step 169 with no benefits. A motion to approve the request was made by Commissioner Lynn Stevens. Commissioner Bruce Adams seconded the motion. None opposed. Commissioner -2- Bruce Adams declared the motion carried. Evan Lowry - SJC Planning Evan presented a proposal from the Forest Service to authorize uranium exploration activities by Old La Sal. There are roads leading into the area and these are places that have been drilled before. A motion to approve the proposal was made by Commissioner Lynn Stevens. Commissioner Bruce Adams seconded the motion. None opposed. Commissioner Bruce Adams declared the motion carried. Evan states that Bob Turri has worked on contract with the County for several years and requested that they increase his compensation by $10/hr. A motion to approve the request was made by Commissioner Lynn Stevens. Commissioner Bruce Adams seconded the motion. None opposed. Commissioner Bruce Adams declared the motion carried. Linda Larson - SJC EMS Linda presented four procurement requests. One for a Life Pack 12 AED in the amount of $18,297.80 from Physio Control. One for a Mobile Projector in the amount of $999 from Toshiba. One for three Panasonic Toughbook 52 Highlights in the amount of $2587.50 from Panasonic. One for an Airway Management Unit on the amount of $732.38 from Bound Tree Medical. A motion to approve the procurement requests was made by Commissioner Lynn Stevens. Rick Bailey - SJC Administrator Rick made the recommendation to approve Jim Hardin to the SJWCD Board. A motion to approve the recommendation was made by Commissioner Lynn Stevens. Commissioner Bruce Adams seconded the motion. None opposed. Commissioner Bruce Adams declared the motion carried. Rick presented an agreement from the SJC School District pertaining to recreation funds for approval and signature. A motion to approve the agreement was made by Commissioner Lynn Stevens. Commissioner Bruce Adams seconded the motion. None opposed. Commissioner Bruce Adams declared the motion carried. Open Time and Other Business Maxine Deeter gave the Commissioners a brief update on the Cal Black Airport and the Blanding Shooting range. -3- Commission Reports Commissioner Stevens attended a Client Committee Meeting last week. He intends to be in the County all this week and next week he will be in Midway for a UAC Conference. Commissioner Adams plans to attend AOG Thursday and a UAC Joint Highway Meeting on Friday.
