SAN JUAN COUNTY COMMISSION MEETING MINUTES SEPTEMBER 9, 1985
The San Juan County Commission met in regular session on September 9, 1985 at the hour of 9 a.m. in the San Juan County Courthouse at Monticello, Utah.
The following members were present: Commissioner Calvin Black, Chairman
Commissioner Kenneth R. Bailey Commissioner Jerry Holliday
Minutes of September 3, 1985 meeting were approved as corrected on the motion of Commissioner Holliday. The motion was seconded by Commissioner Bailey. UNANIMOUS.
Utah State Commission
The Commission received a letter from the Utah State Commission scheduling a meeting between the State Tax Commissioners and county officials. The time will be September 12, 1985 at the Library Conference Room, 37 South 100 East, Moab, Utah. From San Juan County, Bruce Halliday, County Attorney, Marian Bayles, County Treasurer, Barbara Montella, County Assessor, Calvin Black, County Commissioner, will attend.
Canyonlands National Park Service - Resources Management Plan and Environmental Assessment
The commission received a letter form Pete Parry, Superintendent National Park Service in response to the written comments made by the commission with regard to the Resources Management Plan and Environmental Assessment for Canyonlands National Park. Mr. Parry stated, "We have corrected the wording 'Canyonlands is to be basically maintained as a primitive park with development kept to a minimum' so that it reflects the wording contained within the 1978 GMP." The letter is on file.
JP Court Report for the Month of August 1985
The Commission reviewed the JP Court Report for the month of August. There was a total of 758 traffic cases filed; 89 criminal misdemeanors, and case receipts totaled $23,546.94.
County Hiring Practices - Sheriff's Department
Commissioner Black reported there was a complaint of a possible violation of county hiring practices in the Sheriff's Department. Commissioner Black sent County Sheriff Rigby Wright a letter requesting procedures used in hiring new employees. Also the commission requested Sheriff Wright bring to Commission Meeting September 16. 1985, documentation of applications, interviews, advertisements, etc., as required by county policy.
UNDC Tax Settlement - Transfer of Montezuma Creek Property
The commission received a letter from Eric Swenson, Attorney, stating the title transfer of Montezuma Creek property to the State of Utah need to take place this year. He stated that he is having difficulty and a delay in negotiations with the State of Utah.
San Juan County Recreation Board
Commissioner Holliday reported that the Recreation Plan will be presented to the School District at their Board meeting September 16, 1985 at 4 p.m.
Muhlestein Salary Increase Request
Judge Muhlestein met with the commission regarding his request for a salary increase. The minutes of September 10, 1979 were reviewed by the commission and Judge Muhlestein, wherein the minutes state that he will be responsible for clerical help; that the salary increase made at that time was to cover clerical help. Judge Muhlestein agreed that the minutes were correct. Gail Johnson, County Clerk/Auditor, reviewed the information she had collected from other comparable counties in the State. Commissioner Black stated that he felt the amount of revenue generated should not determine the amount of the salary; that the responsibility and the time element should be the determining factors.
Discussion was had on the possibility of moving JP operations to the courthouse on an 8 to 5 work day. Al-so the possibility of hiring a part-time secretary and have the Judge on a full-time schedule; or having the Judge on a part-time schedule and a full-time secretary. It was decided not to make any changes at this time.
The commission reviewed the workload over the past two years and felt there was not enough information to justify a salary change at this time. The commission suggest that Judge Muhlestein keep a record of his time for the rest of the year. Judge Muhlestein agreed to do this.
Top of The Hat - Beer License
Gail Johnson, County Clerk/Auditor, met with the commission to present the request for issuance of $200 Class C Cabaret license for the last four months of the year. Motion was made by Commissioner Bailey to approve the request pending no objection from Sheriff Wright. Commissioner Holliday seconded the motion.-UNANIMOUS. The certificate of acknowledgement was signed by Commissioner Black.
Governor's Youth Alcohol Council
Bruce Shumway, Social Services Director, met with the commission regarding the Governor's Youth Council on Alcoholism. Mr. Shumway reported that the council at it now stands is under the authority of the county commissioners. The State has requested that each county have a local task force. After some discussion it was decided that the administration of the program would be best coordinated under the direction of the Mental Health Care Services and that all information would be forwarded there. Mr. Shumway will advise the commission with regard to the board meetings.
State Mental Health Board
Bruce Shumway, Director of Social Services, met with the commission to notify them of a meeting this Thursday of the State Mental Health Board in Moab.
Mental Health - County Match
Commissioner Black asked Bruce Shumway, Director of Social Services, about the county match for mental health services. He wanted to know about the $16,000 carryover as mentioned in the Interagency Meeting minutes. Mr. Shumway explained that that money was discretionary monies.
Mental Health - Handicapped Services
Bruce Shumway, Director of Social Services, requested authorization from the commission to use the monies left in discretionary funding ($16,000 carryover monies and $4,000 uncommitted) to be used for the remodeling of the old Blanding Clinic and start-up funding for special equipment. Motion to approve the

proposed expenditures was made by Commissioner Bailey and seconded by Commissioner Halliday. UNANIMOUS.
Bluff - Mosquito Problem
Commissioner Holliday reported that Jim Heaton of the Weed and Rodent Department will check into the matter with the possibility of using Blanding's sprayer and the county provide the chemical.
Road Department - Montezuma Creek Bridge
Commissioner Bailey said he will check into the problem of potholes around the detour of the Montezuma Creek Bridge.
Road Department - Montezuma Canyon Crossing
Commissioner Bailey reported to the Commission that he is now in a position to obtain a right-of-way from Richard Perkins at the lower Montezuma Canyon Crossing. Commissioner Bailey will investigate the oil companies with regard to providing three cattleguards.
High Level Nuclear Office - Davis Canyon Study
Rick Bailey, Administrative Assistant, informed the commission that proof of labor has been filed on the Davis Canyon claims.
Recapture Road
Commissioner Bailey reported that Doug Pehrson said it would be a problem putting in that road. After sane discussion, the commission decided to make an estimate to Norman Nielson on the cost of the road, but they felt the county itself could not afford such a road.
Elected Officials Meeting - September 16, 1985
Items that will be discussed at the elected officials meeting next week will be:
1. Budgeting Process
a. 15% cut for next year
2. County Hiring Policy and employee terminations.
UNDC
Mr. Tully Lameman of the UNDC met with the commission and reported on the last UNDC board meeting. Mr. Lameman said the board had elected to eliminate the commission representative as recommended by the commission. However, they would like the recommendation in writing. The new elected UNDC members are:
Vote Chairman - Jonas Mustache of Red Mesa
Vice Chairman - Wilbert Willey of the Navajo Tribe
Secretary - Walter Atene of Oljato
Water System at Train Rock
Mr. Tully Lameman of the UNDC reported that the water system at Train Rock will be installed by Health Care Services. Commissioner Bailey said he thought they were considering incorporating all the water systems in that area. Commissioner Bailey also thought a study of the aquifer should be done. Mr. Lameman said this had already been done by the Indian Health Service and based on that information, they feel they can increase the usage.
Right-of-Way on Road No, 424
Herb Clah of the UNDC reported to the Commission that George Cisco from Kayenta complained about the road north of Oljato Wash down Higahto. The road is on Mr. Cisco's property and he does not want the county building or maintaining a road there. The commission explained to Mr. Clah that this is a county road serving the people in that area; that if it is taken off the county system, then the county could no longer maintain it; then they could no longer run the school buses to those people. Commissioner Black said that under the Memorandum of Understanding, that road is under the jurisdiction of the county and has been an accepted right-of-way since 1969. Mr. Clah said he would work with Mr. Cisco on this and that it will be handled through the Tribe and local chapters.

MINUTES OF THE SAN JUAN COUNTY BOARD OF EQUALIZATION
SEPTEMBER 9, 1985
The San Juan Board of Equalization met on Monday, September 9, 1985 at the hour of 1 p.m. in the Commis-sion Room of the San Juan County Courthouse, Monticello, Utah.
The following members were present: Commissioner Calvin Black, Chairman
Commissioner Kenneth Bailey Commissioner Jerry Holliday
Also present was Barbara Montella, County Assessor.
Equalization Hearings
After some discussion and after receiving a legal opinion from the County Attorney, motion was made by
Commissioner Holliday to extend the equalization hearings for another two weeks. The motion was seconded by Commissioner Bailey. UNANIMOUS.
The following statement was prepared for publication in the "San Juan Record":
1985 PROPERTY TAXES
In determining the value of your property from your tax notice, take the
figure on the upper left corner of your tax otice under market value, which
is really the assessed value, and do the following computation to arrive at the tax commission's estimate of current market value:
For your land, take the value on the left side of the tax notice x 6.25 which equals current market value.
For commercial buildings, take the value on the left side of the tax notice x 6.25, which equals the current market value.
For homes or residential land and buildings, take the value on the upper

left corner of the tax notice x 8.33, which equals current market value.
If after you make these computations, you feel that the figure used by the State Tax Commission for your assessment is too high, you will need to furnish the Board of Equalization with some evidence substantiating the lesser value.
An appraisal by a private, competent appraiser.
Documentation of a sale or purchase of similar property or some other documentation which tends to prove or substantiate a lesser value will be helpful and ultimately necessary to justify a reduction.
