MINUTES OF THE SAN JUAN COUNTY COMMISSIONERS MEETING HELD

AUGUST 9, 1982

Time: 10:00 a.m. in the Commissioners Room at the Monticello Courthouse.

Members Present: Chairman Calvin Black and Commissioner Robert Low. Commissioner Kenneth R. Bailey was excused for an appointment in Salt Lake City.

Minutes of the prevoius week were read and approved upon the motion of Commissioner Low and the second of Commissioner Black and it carried unanimously.

BLM MEETING REPORT;

Commissioner Low reported on the recent meeting with the Monticello BLM Office. The BLM office reported that they have identified the property they will be putting up for sale this fall. The Office is currently in the process of assessing the priorities of the County's requests for land use permits and identifying them on their maps.

COUNTY AGENT MEETS WITH THE COMMISSION:

County Extention Agent, Bob Thompson, met with the Commission to relate to them some of his

personal background, so that they might.be better acquainted, and to inform the Commission of

some of the programs his office is planning. Mr. Thompson was raised in Wyoming and he has a Doctorate

in Animal Nutrition. Before coming to San Juan County, Mr. Thompson taught for a junior college

in Wyoming, and the University of Afghaistan. He has also worked in Uganda, and was previously

a County Agent in Preston, Idaho. Mr. Thompson would like to organize a 4-H Council to coordinate

the 4-H activities, and to raise and administer program funds. Mr. Thompson also invited the

Commissioners to participate in the voter awareness program which will begin September 30th.

COLLEGE OF EASTERN UTAH MEETS WITH STATE PARKS:

Chairman Black reported that on August 5th, he took representatives from the College of Eastern Utah-San Juan Center to Park City, Utah, to meet with the State Parks and Recreation Department. They discussed the possibility of the San Juan Center contracting with the State to operate the Edge of the Cedars Museum. The State Parks Department will consider the request at their next Board meeting.

NUCLEAR WASTE REPOSITORY DINNER IN MQAB:

Chairman Black reported on his attendance at a dinner held in Moab on August 7th. Senator Orin

Hatch was one of the invited guests and,at that time, he was presented a petition containing

1,700 signatures infavor of continued testing at the Gibson Dome site.

Chairman Black also reported that while he was in Moab he was interviewed by a reporter from the

Washington Post concerning the issue of the proposed spent nuclear fuel repository in Utah.

BLM LAND USE PERMITS;

The Commission requested that Mr. Al Haskins complete the necessary forms for all BLM lands that the County has made application for this year. Mr. Haskins will also help Cleal Bradford identify the BLM lands at Montezuma Creek, as the Ute Council would like the BLM to consider some of these lands for future community development.

"HEAD START"PROGRAM FUNDS:

Mr. Al Haskins reported that the Head Start Program for Emery, Grand, Carbon and San Juan Counties

will receive $588,626.00.

STATE RETIREMENT SYSTEM REPORT REQUESTED;

Mr. Al haskins reported that he is requesting a report from the State Retirement System. Several Hospital Employees have not been accepted back into the State Retirement system after withdrawing their invested portion in 1981. The Commission is concerned about the situation and will be interested in the report.

HEALTH CARE SERVICES TRANSFER OF FUNDS DISCUSSED:

County Treasurer, Marian Bayles, met with the Commission to discuss the transfer of Health Care Service funds to their seperate bank account. She reported that the county's funds are currently invested and the Commission authorized her to wait until the T.C.D.'s have matured before transferr-ing the Health Care Service funds. Marian Bayles will transfer the Health Care Service and Trust funds as soon as possible.

The Treasurer also presented the indigent abaitments for the Commission's authorization.

SHERIFF WRIGHT REPORTS:

Sheriff Rigby Wright met with the Commission to review the status of beer Ordinance violations. Sheriff Wright reported that his office will conduct spot checks twice a year for any beer Ordinance violations involving vendors.

NUCLEAR WASTE INFORMATION MEETING:

At 1:00 p.m., the Commission met with Alvin Rickers, director, State Office of Nuclear Waste, and the following elected officials: Ray Tibbets, Chairman of the Grand County Commission; Bill Hance, Grand County Commissioner; Tom Stocks, Moab City Mayor; Cleal Bradford, Blanding City Mayor; Kieth Redd, Monticello City Mayor.

Mr. Rickers reported on the State Department of Energy's meeting with the Federal Department of Energy in Reno, Nevada, on August 4, 1982. The two departments are proceeding with the development of a Memorandum of Understanding and Mr. Rickers feels any problems can be worked out. Mr. Rickers discussed with the Commission the State's concern that a national plan for nuclear waste repositories be finalized. The group also discussed the need for an E.I.S. in connection with an exploratory shaft at the Gibson Dome site, and reasons why the Elk Ridge site was not selected for further testing. Mr. Rickers was highly informed on the nuclear waste issues and he welcomed the opportunity to meet with representatives from Grand and San Juan Counties.

COUNTY ATTORNEY REPORTS AND ADVISES:

County Attorney, Bruce Halliday, advised the Commission on the indigent abaitments received, and

discussed the status of the beer Ordinance violations. The Commission requested that Mr. Halliday

review the County's Beer Ordinances and prepare a revision which would address the current issues

of concern.

The Commission also asked Mr. Halliday to review the County ordinances concerning any regulations

which would apply to a Friends of the Earth rally scheduled for August 23rd at Gibson Dome.

Mr. Halliday reported that the Computations are correct for the WEXPRO Division Order. Commissioner

Low moved to approve the Division Order and authorize Chairman Black to sign the Order in behalf of

San Juan County. The motion was seconded by Commissioner Black and it carried unanimously.

BEER LICENSE APPROVED;

Commissioner Low moved to approve a Beer License for Oren Story doing business at Fry Canyon Store.

The motion was seconded by Commissioner Black and it carried unanimously.

AIRPORT HANGAR RENT DISCUSSED;

The Commission agreed that the rent on the airport hangars, beginning October 1, 1982, should

include the monthly charges of the electrical meter bases installed for the hangars.

DEVELOPMENT BOARD TELEPHONE CREDIT CARD;

The Commission authorized the San Juan Development Board to request a credit card from Continental

Telephone Company of the West.

CORRESPONDENCE;

A letter was received from Dolores Bench Limited and it was referred to the County Attorney.

A letter was received from Mark E. Peterson of Montezuma Creek suggesting the County conduct a survey on the effect to the County's tourist industry if the sale of beer were prohibited in all unincorporated areas. Chairman Black will respond to the request.

A letter was received from the San Juan Nursing Home requesting that it be clarified that they did not receive a 10% salary increase. As Health Care Service employees for the county, they received from between a 5% and 8.15% salary increase. However, they do receive a sick leave benefit which is double that received by other county employees.

A Cultural Resource Inventory of the Bluff to Montezuma Creek Road was received from Asa Nielson. The report will be forwarded to the County Engineer.

The County Attorney, Bruce Halliday, sent a letter to the Utah State Tax Commission to request a formal hearing before the Tax Commission to protest the additional tax levy.
