SAN JUAN COUNTY COMMISSION JUNE 8, 1987
The San Juan County Commission met in regular session on June 8, 1987 at the hour of 10 a.m. at the San Juan County Courthouse, Monticello, Utah.
The following members were present: Commissioner Black, Chairman

COMMISSIONER CALVIN BLACK'S REPORT
Brown's Canyon Road - Commissioner Black reported that Doug Pehrson, engineer/surveyor, is getting right-of-ways for the Brown's Canyon Road, south of Blanding, so the road can be widened.
State Land Exchange - Commissioner Black reported that Governor Bangerter and Secretary of Interior Hodell signed a memorandum of understanding to start the process of exchanging state lands that are locked up in National Parks, Monuments, Military and Indian reservations.
UDOT Highway Extension - Commissioner Black reported that he talked to Caine Alter, UDOT, about the proposal to extend U.S. highway 666 to extend from Blanding to Richfield. It was turned down because it is a circuitous route and has low traffic volume. Commissioner Black said they plan to re-submit the proposal again next year. Also, the proposal to extend U.S highway 163 from Bluff through Kayenta, Arizona to I 15 near St. George was not submitted formally because of the lack of concurrence of Arizona and Colorado. They plan to resubmit a proposal from Kayenta to St. George but will not resubmit the proposal from Bluff to Cortez.
COMMISSIONER MARK MARYBOY'S REPORT
UNDC Board Meeting - Commissioner Maryboy reported that UNDC is holding a special board meeting to discuss
the 40% budget reduction. UNDC is proposing a 10% cut instead of 40%.
Navajo Police - Cross-Deputization - Commissioner Maryboy reported that last week he met with the
executive director of the Navajo Tribal Police. The contract for cross-deputization has been revised to
let Navajo police handle only traffic violations rather than major problems. Commissioner Maryboy said he
is scheduled to meet with the Tribal Police next week to resolve this matter.
Bluff family grazing problems - Commissioner Maryboy said he has been meeting with the BLM and Navajo
Tribe Land Administration to discuss some grazing problems with a Navajo family in Bluff. The family has
been grazing on BLM land near Bluff for many years and so have some ranchers. Conmissioner Maryboy said
he is scheduled to meet with the Tribal Land Administration on this matter next week.
Fair Board Meeting - Commissioner Maryboy said the county fair board met last Tuesday. The board agreed
to combine the fair and rodeo in Monticello on August 13, 14 & 15.
Montezuma Creek - Flashing School Light - Commissioner Maryboy reported that he received a letter from
UDOT stating that they will install a flashing light at the Montezuma Creek school if the county will
provide cross guards. Commissioner Black said the county has never had to provide cross guards in the
past and told Commissioner Maryboy to check on this matter with the school district or community groups to
see if they would accept this responsibility.
TAX RATES for 1987
Gail Johnson, clerk, met with the Commission to set the 1987 tax rates. Commissioner Maryboy made the motion to approve the following tax rates and authorized Commissioner Black to sign the summaries. Commissioner Black seconded the motion. UNANIMOUS.

FAIR BOARD - JR. LIVESTOCK - RODEO
Jr. Livestock Building - Jim Keyes, county agent, Joan Wilcox, chairman elect of the fair board, met with
the Commission to discuss the fair and rodeo. The Jr. Livestock plans to build onto the old horse barn at
the county fair grounds. Mrs. Wilcox said pipe has been donated from Union Oil and they hope to get other
donations for the roofing. Monies raised by the Jr. Livestock will be used to finish the building and
there will be no expense to the county. Commissioner Maryboy made the motion authorizing the construction
of this building. Commissioner Black seconded the motion. UNANIMOUS. The Commission authorized them to
use county equipment to help with the construction of the building and told them to talk to Merz
Hugentobler, the road foreman.
Rodeo - Mr. Keyes said the fair board would like to sell beer at the rodeo and hopefully profit from the
sales. The Commission said that since the fair grounds are in the city limits, it's up to the City of
Monticello to approve the selling of beer. The Commissioner told Mr. Keyes to also talk to the Sheriff
about it.
Fair grounds Needs Improved - Mr. Keyes said there are piles of dirt and gravel at the fair grounds that
need to be removed and will talk to Merz Hugentobler, foreman, about this matter. Also, the restrooms are
in bad shape and the 4-H advisory council received a donation from Chevron Oil to renovate the fair
grounds and want to use the money to fix up the restrooms. Mr. Keyes they would like to have someone
maintain the restrooms during the fair and rodeo. Mrs. Wilcox said the lights above the arena need to be
overhauled and will contact Empire Electric to see if they will repair them as a donation to the fair and
rodeo.
Rodeo Queen Royalty - Mrs. Wilcox said that since there is not going to be a county queen pageant this
year could the fair board use the budgeted fund for a Rodeo Queen Pageant. The Commission said this
should be the decision of the fair board.
REGION CORRECTIONS FACILITY
The Commission received a phone call from the Division of Facilities reporting that five people will be in Monticello this Friday to look at the proposed site for the Region Corrections Facility. Joe Slade and Winn Wescott will organize this event.
HEALTH CARE - HILL-BURTON OBLIGATIONS
The Commission received a letter from the Department of Health & Human Services regarding the Hill-Burton obligations on the nursing home. The letter states that since the nursing home was sold to a proprietary entity the recovery claim was $116,195, plus interest from November 26, 1986 and if the trust waiver option was selected, $321,057 would have to be placed in an irrevocable trust. The option for establishing the trust has now expired and is no longer available. The Commission will have Ted Stagg, CPA, check into this matter in as much as we are still waiting for a response to our last letter.
HEALTH CARE - NURSING HOME SALE
John Fellmeth, deputy auditor, met with the Commission to discuss the proceeds of the sale of the county nursing home. There are two approaches in handling this money, either restricting part of the general fund balance or set up a separate trust fund. Mr. Fellmeth recommended that the county restrict part of the general fund balance. After talking to the State Auditor it was clarified that the county has a higher level of restriction on funds that are set up in capital projects fund. A public hearing has to be held and a resolution or ordinance has to be adopted to set up a capital project fund. The Commission
agreed to hold a public hearing to set up a Health Care Capital Fund.
HOSPITAL BOARD MEETING
The Hospital Board will meet on Wednesday June 24 at 6 p.m.
BLANDING HEALTH CARE COMMITTEE
John Fellmeth, hospital administrator, said that he plans to attend the Blanding Health Care Committee meeting tomorrow night to discuss alternatives of having a hospital built in Blanding. Mr. Fellmeth asked the Commission if the county is willing to expand services into the Blanding area. The Commission agree that better services are needed in Blanding.
UTAH WILDLIFE RESOURCES
Recapture Lake - Doug Messerlyf game warden, met with the Commission to discuss the problem at Recapture
Lake with the garbage pick up. Mr. Messerly said there are garbage cans around the lake for the trash but
they are not being emptied. The Commission told him to check with the city of Blanding and the San Juan
Water Conservancy District to see who has the responsibility of picking up the trash.
Elk Transplant - Mr. Messerly said they are waiting on the Forest Service's approval on the proposed elk
transplant.
HAULING OVERWEIGHT COUNTY ROAD
Ralph Dunn met with the Commission to explain that he is hauling at the Small Fry stock pile near Rio Algom. The resource belongs to Hecla Mining Company and since it is low grade they sold it to Merve Lawton of Rio Algom. Mr. Dunn said he is hauling on a mile and half of county road but the state highway patrol has been ticketing his trucks for overweight and making them run the bridge formula. Commissioner Black said he would talk to Sam Taylor, UDOT, to see if the county can get an exemption for the bridge formula and weight limitations, if Mr. Dunn agrees to repair any damages done to the road. Mr. Dunn said he would agree to patch and repair any damages done to the road. Commissioner Maryboy made the motion that the county waive the bridge and weight limitations on approximately 1 1/2 miles of county road, near Lisbon Valley area, during the duration of the hauling for Mr. Dunn's trucks only. And in consideration, Mr. Dunn agrees to repair any damages done by his trucks on this section of county road. Commissioner Black seconded the motion. The Commission will have the County Attorney draft a letter of agreement on this matter.
PERSONNEL POLICY - PROBATIONARY PERIOD
Claude Lacy, Sheriff, told the Commission that he is in the process of advertising and hiring of jailers, matrons, and deputies but there is a problem with the personnel policy 90-day probation period. Mr. Lacy said this is not enough time to evaluate employees because of the training time and asked the Commission to make an exception for the sheriff's department employees and have the probation period for one year. Commissioner Maryboy made the motion to approve the sheriff's department probationary period to one year. Commissioner Black seconded the motion. UNANIMOUS. A memo will be sent out clarifying this change.
PERSONNEL - SALARY ADJUSTMENTS - Olivia Blake, Dell Hunter & Tierre Patterson
The Commission reviewed several proposed payroll changes for county employees. Commissioner Maryboy made the motion to approve a probationary raise for Olivia Blake from a grade 1 step 3 (857.00) to grade 1 step 4 (893.00). Retroactive to the date February l, 1987. Commissioner Black seconded the motion. UNANIMOUS.
Commissioner Maryboy made the motion to approve a promotion in grade for Tierre Patterson from grade 11 step 9 ($1635.00) to grade 13 step 10 ($1853.00). (Mr. Patterson is now shop foreman for the south district.) Also, Commissioner Maryboy made the motion to approve a promotion for Dell Hunter from grade 6 step 8 ($1275.00) to grade 16 step 2 ($1504.00) (Mr. Hunter is over the custodial and maintenance of the courthouse, public safety building and both county libraries.) Commissioner Black seconded the motion approving the dollar amount but with question to the grade designation. UNANIMOUS.
The Commission deferred salary adjustments for Eddie Allred and Edna Rogers for further discussion when all the Commission is present.
Commissioner Black said these salary changes are being made only with respect to promotions only which include increased responsibilities. These are vertical promotions of grade increases not merit increases. The Commission is not giving any salary increases for doing a good job in the same areas that employees are already doing a good job in. Ninety percent of the county employees are doing a good job and deserve a raise but the county is not giving merit increases, cost of living increases, or increases for good honest conscientious service. The Commission is aware of the good county employees who probably all deserve increases in pay but because of the drop in assessed value the county can not do it. The sheriff's deputies were given an increase in salary recently because they were so far below comparable positions in comparable areas. If it can be shown that the county has other areas that are below similar comparable positions these will be looked at with the possibility of making adjustments.
PUBLIC DEFENDER - HEALTH INSURANCE
The Commission approved payment of the insurance premium cost to Carbon County for Keith Chiara the public defender. The county will pay Mr. Chiara's cost of $110.40 monthly and he will pay the remaining amount for the family rate.
SOCIAL SERVICES CONTRACTS - Alcohol & Drugs - Mental Health
Bruce Shumway, Social Services, met with the Comnission for approval of two contracts. Commissioner
Maryboy made the motion to approve the following contracts and authorized Commissioner Black to sign them.
Commissioner Black seconded the motion. UNANIMOUS.
Utah Division of Mental Health and District 7B Mental Health Authority, San Juan County for the period
July 1, 1987 to June 30, 1988. The state will reimburse the county $152,800.
Utah Division of Alcohol and Drugs and District 7B Alcohol and Drugs Authority, San Juan County for the
period July 1, 1987 to June 30, 1988 and the county will be reimbursed by the state for $101,331.
Mental Health Budget - Fiscal Year 1988 - The total budget for Mental Health Budget for the fiscal year
1988 is $226,500.
LEE RANCH - VALLEY OF THE GODS
Cody Bearclaw met with the Commission to inform them that he purchased the Lee Ranch near Valley of the Gods and plans to build a movie town for tour operators. There is a county road going through the property and asked if he needed a right-of-way from the county. The Commission said there is no problem. Mr. Bearclaw said he is applying for a state liquor license and also a county beer license for the restaurant and diner he plans to have built. There will be several bus tours but there are very few accommodations in Mexican Hat and so he has them stay in Blanding or elsewhere. Mr. Bearclaw said there is a need for more motels and plans to build a 50-unit motel and two hotels with 25 units each. The Commission told Mr. Bearclaw he would have to get building permits and to see Greg Adams, state building inspector. Mr. Bearclaw said he wants to keep the town small, but accommodating so that the people will stay in the area and not have to go somewhere else.
