MINUTES OF THE SAN JUAN COUNTY COMMISSION MEETING APRIL 8, 1985

The San Juan County Commission met in regular session on April 8, 1985, at the hour of 10:00 a.m. in the San Juan County Courthouse at Monticello, Utah.

The following members were present: Commissioner Calvin Black, Chairman

Commissioner Kenneth R. Bailey Commissioner Jerry Holliday

Minutes of the previous meeting were approved with the specified corrections on the motion of Commis-sioner Holliday. The motion was seconded by Commissioner Bailey and carried unanimously.

GRAND COUNTY WATER CONSERVANCY REPRESENTATIVE MEETS

David Bretzke from the Grand County Water Conservancy District met with the Commission to request an easement on the following property for a water line.

SECTION 1, T27S, R22E, S.L.B. & M.

A 20 ft. wide strip of land parallel to and adjacent on the South to the South right-of-way of the Old Airport Road, 10 ft. on each side of the following described centerline: Beginning at a point which bears South 1123.6 ft. to a point on the East line of the N.W. 1/4 of said Section 1 which bears South 1145.7 ft. and East 1323.3 ft. from the Said N.W. Cor., Section 1 as shown on the attached plat.

Commissioner Bailey explained to Mr. Bretzke that he will need to contact the Road Department for an Encroachment Permit. An additional easement will not be required.

APPOINTMENT RECOMMENDATION FOR STATE FAIR BOARD

Sue Morrell met with the Commission to report that the term for the San Juan County representative to the State Fair Board will expire soon. Mrs. Morrell further stated that Ruby Bronson is the present representative and does not wish to be reappointed. Mrs. Morrell is requesting the Commission recom-mend her for this appointment. The Commission agreed to send a letter to Governor Bangerter recommend-ing Mrs. Morrell for this position.

PRAIRIE DOG PELLETS DISCUSSED

The Commission authorized Rick Bailey to order 20 cases of l'fume for Prairie Dog control.

COUNTY HANDICAPP REGULATIONS APPROVED

Rick Bailey, Commission Assistant, met with the Commission to submit the completed draft of Handicapp Regulations. The County must adopt certain Handicapp Regualtions in order to comply with Revenue Sharing Regulations (31CFR Part 51) relative to Fiscal Assistance to State and Local Governments; Discrimination on the Basis of Handicapped, the following policies and procedures, personnel rules and regulations, and transition plans. Commissioner Holliday made a motion to adopt these regualtions retroactive to October 17, 1984. The motion was seconded by Commissioner Bailey and carried unanimously. Among the plans adopted were:

Facility Handicapped Accessibility Review and Transition Plan

Prohibition of Handicapped Discriminations and Action Plan Policy and Procedure

Handicapped Grievance and Appeals Policy and Procedure

Handicapped Nondiscrimination and Employment Practices

A copy of the adopted regulations are on file in the Clerk's Office.

LETTER TO DOE RE: NUCLEAR WASTE REPOSITORY

The Commission signed a letter to Ben Rusch, Director of the Office of Civilian Radioactive Waste Management. This letter supports the recommendation by the office of Technical Assessment to have a fourth site included in the repository site characterizations.

HOVENWEEP NATIONAL MONUMENT DRAFT RESPONSE APPROVED

The Commission approved the following comments on the Hovenweep National Monument Plan:

The present management concept of the National Parks and Monuments in this area is not efficient or manageable. The National Parks and Monuments are Hovenweep National Monument, Natural Bridges National Monument and the Needles District of Canyonlands National Park.

At the present time, Hovenweep is managed from Mesa Verde National Park and Natural Bridges and the Needles District are managed from Canyonlands National Park headquarters in Moab, Utah.

With the certain location of these three federal recreation areas, the San Juan County Commission proposes that these areas be managed from one central location in Monticello, Utah. This would offer a central point to all three areas and would not cause a need for new hirings or placements. Federal personnel could be shifted from both Canyonlands and Mesa Verde Parks to Monticello.

With the central management, a consistent plan then could be developed to insure proper and needed development of all the areas. There is a great need to make both Hovenweep and Canyonlands more accessible to the general public and this will only be accomplished by a management concept geared to include these areas into one plan. Their geographic similarities would be greatly enhanced by this management concept.

There is also a need to improve visitor access through centers, tours, drives, facilities, etc. at these parks. Especially in the Square Tower area. We strongly propose the financial help from the Park Service in promoting and constructing all weather roads to the monument from both the Utah and Colorado sides. Unless this is accomplished there will not be a continued growth of visitation.

PERSONNEL POLICY DISCUSSED

Rick Bailey, Commission Assistant, met with the Commission to report that the personnel policy draft will be ready by next week. Mr. Bailey further reported that the policy has been divided into two

separate policies, one for Health Care Services and one for the rest of the County employees. Mr. Bailey and Rayburn Jack will meet with the Commission next Monday to review the drafts.

BLUFF COMMUNITY BUILDING DISCUSSED

Rick Bailey and Bruce Shumway have scheduled a meeting in Bluff on April 12th with some of the residents of Bluff to discuss their problems and concerns regarding the Bluff Community Building.

HEALTH CARE SERVICES COMPUTER SOFTWARE PROPOSALS REVIEWED

John Fellmeth, Rayburn Jack and Norma Hobbs met with the Commission to discuss a proposal for the purchase of software. The proposals are as follows:

Health Systems Group

Patient Accounting and Integrated Medical Records

(1) RPG II Product

(2) Full-blown Medical Records

(3) Sane operator help

Price: $25,000 and install $4,000 - $9,000; support $300/month

The Resource Group

Patient Accounting with DRG Grouper and Abstracting Module

(1) Cobol Product

(2) Limited Med/Rec

(3) Low level operator help

Price: $17,500 and install $2,000 to $6,000 plus Cobol $2,500; support $225/month

After reviewing the features of both programs Mr. Fellmeth recommended the software be purchased from Health Systems Group. Mr. Fellmeth based his recommendation on the features and the capabilites of this program which he feels will justify the additional cost. The Commission agreed to defer action at this time and consider the matter further at the Health Care meeting.

HEALTH CARE SERVICES DISCUSSED

Rayburn Jack, Health Care Services Director, met with the Commission to request approval for the installation of ceiling tiles in the East Wing of the Nursing Home. The total cost for materials will be $653.16, and the work will be done by employees so there will be no labor costs. Commissioner Holliday made a motion to approve this request. The motion was approved by Commissioner Bailey and carried unanimously.

Rayburn Jack presented the Commission with a request for kitchen equipment for the Nursing Home. The total cost for the purchases is $558.18. Commissioner Bailey made a motion to approve this request. The motion was seconded by Commissioner Holliday and carried unanimously.

Mr. Jack reported that Dr. Nicholson will be leaving the area the 1st of June so he will not be coming to Monticello at all. Mr. Jack further reported that Dr. Sandy Nielson will come to Monticello if he can sell his home. He has set a target date of between July 1st and July 15th. Dr. Steve Warren will be in the County the 1st of July.

OLD CLINIC BUILDING IN BLANDIMG

Herb Clah and John Stash from U.N.D.C. met with the Commission to discuss the lease request for the old clinic building in Blanding. The Commission reported that they are still waiting for a decision from the County Attorney on whether they can lease the building rent free to UNDC. Mr. Clah reported that UNDC may want to lease the building from UDIA.

Reese Thomas from the San Juan School District met with the Commission to discuss the lease request for the old clinic building in Blanding submitted by the School District. The Commission reported that they are still reviewing the matter with the County Attorney.

SANDY WOOD MEETS

Julie and Sandy Wood met with the Commission. Sandy Wood reported that she will be a participant in the Miss Utah Pre Teen Contest. Miss Wood would like to have the County be a sponsor. The Commission reported that they would not mind being a sponsor as long as no funding was involved. They feel that if any funding was involved it would set a precedent. Miss Wood will try to obtain sponsor funds from other sources.

RECREATION BOARD APPOINTMENTS

Commissioner Holliday made the following recommendations for appointment to the Recreation Board:

Bruce Adams - Monticello

Doug Eldridge - Monticello

Randy Bayles - Blanding

George Jones - Blanding

A representative will also be appointed from the southern part of the County.

Commissioner Holliday made a motion to approve these appointments. The motion was seconded by Commis-sioner Bailey and carried unanimously.

RECREATION DIRECTORS HIRED

Commissioner Holliday reported that after reviewing all of the applications received the Recreation Board approved the hiring of Dennis Jones for South Recreation Director and Eddie Allred for North Recreation Director. The salaries approved were $1,100. per month.

INTERLOCAL AGREEMENT WITH MONTICELLO DISCUSSED

Rick Terry, Monticello City Administrator, met with the Commission to report on a call he received from the Department of Community and Economic Development. Mr. Terry reported that the city put the proposed jail site in as a slum and blight area on their CDBG grant application. The Department of Community and Economic Development will need a copy of an Interlocal Governmental Agreement between Monticello and the County pertaining to taking care of the slum and blight area. The Commission approved an agreement of this type and authorized Commissioner Bailey to sign it.

HEARING SCHEDULED RE: NEWSPAPER ROCK STATE PARK

Commissioner Bailey reported that he will be attending a public hearing on April llth regarding the management concept for Newspaper Rock State Park at 7:00 p.m. in Monticello. Commissioner Bailey will present the Commission's position that the Commission will support the expansion if the State Park Service will take Lloyd's Lake and Recapture Reservoir.

HEARING SCHEDULED RE: GOOSENECKS STATE PARK

Rick Bailey, Commission Assistant, will attend a public hearing in Mexican Hat on April 10th regarding the management plan for Goosenecks State Park.

COOPERATIVE AGREEMENT WITH UDOT APPROVED/MONTEZUMA CREEK BRIDGE

Commissioner Bailey made a motion to approve a cooperative agreement with UDOT for construction on the Montezuma Creek Bridge and road approach and authorize Commissioner Black to sign it. The agreement provides for a matching amount from San Juan County in the amount of $106,444. The motion was seconded by Commissioner Holliday and carried unanimously.

PROPOSAL FOR NURSING HOME GENERATOR BUILDING DISCUSSED

Commissioner Holliday reviewed a proposal by Jay Nelson for a cinder block building to enclose the generator at the Nursing Home. The Commission authorized Commissioner Holliday to negotiate with Mr. Nielson and obtain a written proposal to be submitted next week.

BLUFF DUMP DISCUSSED

Commissioner Holliday reported that he has received some complaints on the Bluff Dump. Commissioner Bailey will contact Bernal Bradford on this matter.

PUBLIC DEFENDERS BILL RECEIVED FROM DNA

Gail Johnson, County Clerk, met with the Commission to discuss a bill submitted by DNA for public defender services. Mrs. Johnson reported that the bill is for a fee of $50 per hour. The Commission instructed Mrs. Johnson to give the bill to the County Attorney for review.

PROPOSED COUNTY JAIL DISCUSSED

Commissioner Bailey reported on the jail facilities he has toured.

John Peterson from Dana Larson Roubal and Associates Architecture and Engineering Firm, met with the Commission to present a proposal for professional services regarding the new jail facility. Among the proposed services are:

Schematic Design

Design Development

Construction Documents

Bidding and Construction Phase

Programming the requirements of the project

Financial Feasibility

Site evaluation and comparative studies of prospective sites

The fee for the above services would not exceed 7.0% of the construction cost. Mr. Peterson will draft a contract proposal to be reviewed by the Commission.

COUNTY ROAD DISCUSSED

Commissioner Black reported that Dan Shumway contacted him regarding a fencing agreement.

INDUSTRIAL REVENUE BOND ALLOCATION REVIEWED

Commissioner Black reported that he received the following information from the Department of Cortmunity and Economic Development regarding Industrial Revenue Bonds authorized for 1985.

San Juan County - $524,175 Blanding - $697,175 Monticello - $145,950

These allocations are based on the State's response to the Tax Reform Act of 1984 as in HB 195 which passed the legislature.

COMMISSIONER BLACK REPORTS

Commissioner Black reported that he received a letter from Senator Hatch informing him of the avail-ability of a Rural Resource Guide. The Guide is a directory of public, private and technical financial assistance available to small communities.

Commissioner Black reported that he will be participating in a symposium on April 13th at the University of Utah on the Burr Trail.

Commissioner Black reported that there will be a dedication of the Arizona Strip Wilderness Bill on April llth.
