MINUTES OF THE SAN JUAN COUNTY COMMISSIONERS MEETING HELD FEBRUARY 7, 1983

The Board of County Commissioners met in regular session on Monday, the 7th day of February, at the hour of 10:00 a.m. in the County Courthouse at Monticello, Utah.

On roll call, the following members were present: Commissioner Calvin Black, Chairman

Commissioner Kenneth R. Bailey Commissioner Robert Low

Minutes of the previous meeting were read and approved upon the motion of Kenneth R. Bailey. The motion was seconded by Commissioner Low and carried unanimously.

COUNTY CLERK REQUESTS APPROVAL FOR PURCHASE OF MICROFILM READER/PRINTER

County Clerk, Gail Dalton, requested consideration for the purchase of a Minolta RP407E Microfilm Reader/ Printer. The Clerk feels the Reader/Printer is necessary to help alleviate record storage problems and to permit retrieval of a hard copy of documents. The Commission felt that equipment should be standardized in all County departments with due consideration given to future needs of the County. It appears that the microfilm readers the County now owns are seldom used because they do not have the capability to print a copy of a document. A motion was made by Commissioner Low to purchase two Minolta RP407E Microfilm Reader/ Printers, one for the Clerk's Office and one for the Recorder's Office and to trade-in or sell the readers currently owned by the County. The motion was seconded by Commissioner Bailey and carried unanimously. Funding will be allocated from the respective Department Budgets. Two microfiche attachments were also approved.

COUNTY RECORDER REQUESTS PURCHASE OF A BACK-UP COPY MACHINE

The County Recorder, Mary Lou Mosher, requested that the County purchase a desktop copy machine to be placed in the Recorder's Office and used as a back-up copier. This would be an I.B.M. Executive 102 copier which would use the same toner as the main copy machine. The Recorder's Office will investigate the possibility of raising the copying fee to $1.00 per copy. A motion to approve the purchase of a back-up copy machine was made by Commissioner Bailey. The motion was seconded by Commissioner Low and carried unanimously.

RICHARD PERKINS ROAD - MONTEZUMA CREEK

Richard Perkins is in favor of completing the road project proposed for his property in Montezuma Creek. Commissioner Bailey is to resolve road route problems and report back to the Commission.

LAW ENFORCEMENT IN MONTEZUMA CREEK DISCUSSED

Letters were written by Commissioner Black to the County Sheriff, the Bureau of Indian Affairs, the Navajo Police, the State Liquor Control Commission, the Utah Highway Patrol and other State law enforcement agencies, outlining problems related to alcohol abuse in the Montezuma Creek area. Cooperation of various law enforce-ment agencies is needed to help solve jurisdictional and law enforcement problems. The County Sheriff has been instructed to increase patrol time in the Montezuma Creek area.

UTAH ASSOCIATION OF LOCAL GOVERNMENTS LETTER DISCUSSED

A letter was read from William Howell of the Utah Association of Local Government to the National Park Service relative to proposed action by the Park Service on an Environmental Impact Statement pertaining to potential development of tar sands resources in the tar sands triangle of Wayne and Garfield Counties. The Association of Local Governments strongly supports multiple use management of the land and mineral resources within the four counties, and supports prompt action on the required EIS. The Association suggests that consideration be given to the economic effects and impacts of not developing the resource, including both national and local economic concerns as well as national strategic concerns.

UTAH ASSOCIATION OF COUNTIES MEETING DISCUSSED

A Utah Association of Counties Meeting for Commissioners and Assessors is to be held on February 17, 1983. Commissioner Black recommended that the following topics be included on the Agenda for that meeting:

1. Review position on Project BOLD.

2. Update on proposed regulation to change some methods of assessment on State assessed property, specifically metaliferrous and non-metalifferous mines.

3. Concurrent jurisdiction with the National Park Service on law enforcement.

MULTI-COUNTY MEETING DISCUSSED

A multi-county meeting will be held for County Commissioners and travel personnel from San Juan, Grand, Garfield, Wayne, Kane and Piute Counties. This meeting will be held for the purpose of looking at develop-ments in Southern Utah to help counter the downturn in the mining industry. Various Recreation Area im-provements will be considered as well as a joint advertising promotion effort.

LETTER TO STATE TAX COMMISSION DISCUSSED

Commissioner Black read a letter he had written to the State Tax Commission and the Utah Mining Association, regarding Utah Statutes of 1896 and 1898 applicable to the methods adopted by the Legislature initially for the taxation of mining properties.

LETTER TO STATE LEGISLATORS REGARDING PROJECT BOLD DISCUSSED

A letter written the State Legislators by Commissioner Black was reviewed. In essence, the letter stated that the San Juan County Commission will oppose the implementation of element one of Project Bold until and unless a comprehensive and total State payment in lieu of taxes bill is passed. The Commission would not oppose element two as it now stands, but would reserve the option to oppose exchanges in San Juan County. With respect to element three the Commission believes no general exchanges should be made on checkerboard lands at the present time.

HIGHWAY ZONING PROCEDURES DISCUSSED

Commissioner Low requested information regarding zone changing procedures. It was noted that a formal written request for a change in zoning must be submitted to the Commission and then public hearings must be held.

REDCLIFF RODEO GROUND REQUESTED

The Redcliff Rodeo Club requests that an area 500 feet by 700 feet be cleared and leveled. The Recreation Board will need to approve this request and allocate the necessary funds and then the work may be done.

BLUFF TO MONTEZUMA CREEK ROAD DISCUSSED

Doug Pehrson, County Engineer, is running the final slope stakes for the Bluff to Montezuma Creek Road and work will proceed on this road project.

ARTICLE IN MOAB TIMES INDEPENDENT CITED

In an article appearing in the Moab "Times Independent" newspaper, Commissioner Low was inacurately quoted as having said that the Commission was opposed to placing a regional minimum security prison facility in San Juan County. Commissioner Low restated the Commission's position that a 288 bed facility was felt to be too large for this area and that a 50 to 75 bed facility would be more in keeping with the County's present and immediate needs.

VOLUNTEER FIRE TRAINING SEMINARS HELD

John Baker, County Fire Warden, reported that volunteer fire training seminars were recently held in LaSal, Cedar Point, and Mexican Hat. Forty-three persons received fire training in these seminars.

BOR FUNDS TO BE APPLIED FOR BY COUNTY

The Bureau of Outdoor Recreation this year has $800,000.00 available in funding. Counties may apply for a portion of these funds. San Juan County needs to determine a sponsoring agency and file an application to be considered for this funding. Applications are due by March 1, 1983. If received, these funds would be used for the Recapture Recreation Area Project. Also, an application may be made later for funding from the Economic Development Adminstration.

FUNDING FORMULA CHANGE PROPOSED FOR AGING PROGRAM

A letter was received by Al Haskins, Assistant to the Commission, from the Salt Lake City, Human Services Department proposing a plan for changing the funding formula for the Aging Program. San Juan County would lose $29,593.00 or 57% of our present funding each year, if the proposed formula change is made. Al Haskins is to draft a letter stating that the County Commission is very much opposed to this proposed change.

ANNUAL BID FOR PETROLEUM PRODUCTS, ETC. DISCUSSED

Bids will be requested for gas, diesel, oil, propane, tires, culverts, grader blades, etc. A Public Notice on the bid opening needs to be posted in the San Juan Record.

COUNTY PERSONNEL POLICIES TO BE CONSOLIDATED

Efforts are underway to consolidate personnel policies for the Hospital and Nursing Home, as well as other County facilities, into a single comprehensive policy manual with a special addendum for Hospital and Nursing Home employees. Sick leave and Vacation policies will be analyzed so that differences may be resolved. Al Haskins, Assistant to the Commission, and William Reger, Executive Director of the San Juan Hospital, will continue to work on this policy manual.

HEALTH CARE SERVICES BOARD DISCUSSED

William Reger, Executive Director of the San Juan Hospital, pointed out that the Hospital and Nursing Home are separate Corporations and he recommended that Health Care Services be made a Corporation also. Mr. Reger is to make a study of the facts and present his recommendations to the Commission at a later date.

INSURANCE SPECIFICATIONS PRESENTED

John Fogg of Central Utah Insurance Agency, Moab, Utah, presented bid specifications prepared by his company for the annual County insurance bid proposals. Doug Boyle, Insurance Agent for Farm Bureau Insurance, stated that he felt the specifications as prepared were standard and self-explanatory. Copies of the bid specifications will be sent to insurance companies with a letter asking for comments on the specifications. Also a public notice will be issued from the Clerk's Office announcing the Bid Opening at 2:00 P.M. on March 28.

WEATHERIZATION DIRECTOR MEETS WITH COMMISSION

The Weatherization Director for District 7, Mary Slama, met with the Commission to discuss possible expansion of the Weatherization Program. Candidates for this program will be considered by the Commission on a case by case basis.

TELEPHONE SERVICE AGREEMENT APPROVED

A motion was made by Commissioner Low to approve a Telephone Service Agreement and to authorize Commissioner Bailey to sign the Agreement. The motion was seconded by Commissioner Black and carried unanimously.

BUILDING PERMIT APPROVED

A motion was made by Commissioner Bailey to approve a Building Permit for Kedric Redd, of Blanding. The motion was seconded by Commissioner Low and passed unanimously. The Building Permit was signed by Commissioner

Bailey.

LETTER FROM EMPIRE ELECTRIC DISCUSSED

A letter written to the Commission by Everett C. Johnson, of Empire Electric, was discussed. The letter was written regarding the transformer near the Golf Course in Monticello, and stated that either the transformer would need to be removed, or rebuilt for proper safety at a total cost of $4,734.85 plus interest. The Commission elected to have the transformer removed and a letter will be written to Empire Electric requesting removal.

COUNTY ATTORNEY MEETS WITH COMMISSION

County Attorney, Bruce Halliday, met with the Commission to discuss several topics of concern. Mr. Halliday pointed out that individuals who are able to pay, may be billed by the County for the cost of sanity evaluations. The County Clerk's Office will send bills to individuals which the Commission believes would be able to pay.

Reference was made to a request by Lawrence Wert of Denver, Colorado, for an oil and gas lease from the County. A letter will be written to Mr. Wert asking for a proposal from him for this lease.

1982 GENERAL BUDGET ADJUSTMENTS MADE

Commissioner Kenneth Bailey moved to adopt by Resolution the following General Budget adjustments pursuant to Section 17-36-23, Utah Code Annotated, 1953. The motion to adopt the Resolution was seconded by Commissioner Robert Low, and it carried unanimously.

County Attorney, Bruce Halliday, requested that the Commission approve payment of several bills for the Mexican Hat Water and Sewer Project. These expendatures by the County will be reimbursed by grant monies from HUD. Commissioner Bailey moved that the Commission approve these bills for payment. The motion was seconded by Commissioner Robert Low and carried unanimously. (Bills are listed under "Bills Approved for Payment".)

COUNTY BEER ORDINANCE DISCUSSED

County Attorney, Bruce Halliday is in the process of rewriting the County Beer Ordinance and is to present

a draft of this Ordinance at the next Commission meeting. The Commission is deferring a decision on a

request for a Beer License by Carl Wallace, Navajo Trading Company, until a new County Beer Ordinance is adopted and until the State Legislature acts on House Bill No. 48.
