The San Juan County Commission met in regular session on April 7, 1986, at the hour of 10 a.m. at the San Juan County Courthouse, Monticello, Utah.

The following members were present: Commissioner Black, Chairman

Commissioner Bailey Commissioner Holliday

KIRK RIDING - SELF-FUNDED INSURANCE

Kirk Riding, RMB/APA, made a proposal to the Commission to provide the county employees a plan of employee benefits through a partially self-funded stop-loss insurance method of funding. Mr. Riding explained that the program uses a 125 cafeteria plan that would save the county and employees money because the premiums would be tax exempt. The Commissioners said they will be making a decision on county employee health care coverage by April 21, 1986.

WAGE FOR ELECTION INTERPRETER

Gail Johnson, county clerk, met with the Commission to ask what a fair wage would be for an election interpreter. Mrs. Johnson said that she hired an interpreter to record some tapes to air on radio stations explaining the election procedures in the Navajo language. The Commissioners recommended that Bruce Halliday, county attorney, write an "independent contract" at a mutual acceptable rate.

COURTHOUSE TELEPHONE - MAE SYSTEMS

Commissioner Bailey reported he received the Mae Systems contract for the courthouse telephone system. Commissioner Bailey made the motion to approve the contract and authorized Commissioner Black to sign it. Commissioner Holliday seconded it. UNANIMOUS. Commissioner Bailey will have Bruce Halliday, county attorney, and Gail Johnson, clerk, go over the contract.

PAUL BARR - FIRST WESTERN BANK

Paul Barr, manager of First Western Bank, met with the Commission to discuss the county investments. Mr. Barr complained that he had not been contacted in the last few years from the county when they make investments. Commissioner Black said that the county treasurer was told to contact both banks before investing any money. Mr. Barr said he felt the county should invest their money locally. The Commission explained a desire to do business locally, but if a greater return on investing money was available elsewhere, there is a responsibility to all tax payers.

JOHN ATLANTIC BURR FERRY

Commissioner Bailey said he felt that the county needs to publicize the John Atlantic Burr Ferry more. State highways in the area need to have more signs installed to promote the Ferry. Commissioner Black suggested that the local businesses train their employees on giving tourists helpful information about the areas sights. The Commissioners will talk to Peggy Humphreys, county travel agent, to see that some brochures and posters are handed out.

JIM KEYES - COUNTY AGRICULTURE AGENT

Jim Keyes, county agriculture agent, met with the Commission. Today was his first day in the extension office. Mr. Keyes said the chemicals for the mosquitoes in Bluff will be here Thursday. The Commissioners told Mr. Keyes that he needs to get licensed and distribute the prairie dog control poison. The Commissioners said that a buyer must show that he is certified before purchasing the poison. Commissioner Holliday made the motion to approve the poison at: if you buy one you get one free, with a limit of four bottles. Commissioner Bailey seconded the motion. UNANIMOUS. Mr. Keyes said that USU is going to hire Lois Palmer part time, to work in the 4-H department to work on her internship, and will be paid by Utah State. They are also hiring a full time home-economist on June 1, 1986.

NURSING HOME - KAMAR MEDICAL MANAGEMENT COMPANY - Reuel McPhie

Commissioner Bailey reported that he, Commissioner Holliday, and Rick Bailey met with Reuel McPhie, Martin Harmon, and William Tulberg to discuss the future sale of the nursing home. Mr. McPhie indicated he would prepare the agreement for sale between the county and Terra, a Ltd. Partnership; a managements agreement between the county and Kamar Medical Management Service Inc., and an agreement for escrow of the warranty deed between the county and Terra. Rick Bailey will pick the contracts up in Salt Lake this week and will begin to work on them with the Commission and Bruce Halliday the county attorney. The group toured the

nursing home and met with Rayburn Jack, CEU, and the county Health Care Services. Mr. McPhie said he plans on having a full staff by May 1 and is also planning on having a full time physical therapist. The Commissioners will remove all the county financial and employee records and make an accounting settlement with the employees within a 30-day period.

STATE LAND BOARD MEETING IN BLANDING

The State Land Board will be meeting in Blanding on April 9, 10, & 11. Commissioner Black said they will meet Wednesday at the Edge of the Cedars for a briefing session. On Thursday there will be a field trip to Bluff, Monument Valley, Cedar Mesa and will look at the wilderness study areas and school section at the Monument Valley junction on the reservation. The Land Board is going to consider a resolution requesting the BLM to prepare an EIS based on the state keeping its scattered sections of land in the proposed wilderness areas. On Thursday night the public is invited to hear Energy Fuels give a presentation on their operation on the Arizona strip. Energy Fuels is having trouble from the environmentalists. They can't get their mines in production and need the public's support.

BEEF BASIN - HABITAT AND DEER

Commissioner Holliday reported that he went to Beef Basin with the Division of Wildlife and the BLM to check the natural habitat of the area and the deer herd. Commissioner Holliday said they counted approximately 340 deer and that the Wildlife figures show there are 2,362 deer in the area (1100 to 1600 of these are does). Last year the division of Wildlife held a doe hunt in which 100 does were killed. The Commissioners believe if does need to be removed from Beef Basin, they should be trapped and transplanted to areas in the county where there are less deer and the habitat will support. Commissioner Black said he feels that transplanting will not hurt the herd, but there should a united position by local people to be effected.

COUNTY WIDE RECREATION - EDDIE ALLRED - Montezuma Creek Baseball Field

Eddie Allred, recreation director, met with the Commission to discuss the county installing lights at the Montezuma Creek baseball field. Mr. Allred said that he budgeted for these lights and Utah Power & Light has agreed to set the poles up and supervise the volunteer help that will do the project. The Commissioners said they would like to wait on this to make sure the county has a valid lease on the baseball park. Mr. Allred said he will check to see.

MONTICELLO BASEBALL FIELD DUGOUTS

The following bids were received for construction of two new dugouts at the Monticello baseball field:

Bruce Bunker Construction - $2,735 Young Builder's Inc. - $2860

Commissioner Bailey made the motion to approve the low bid of Bruce Bunker Construction with a 60-day completion date of June 1, 1986, and a 10% deduction of payment if the project is not completed by this time. Commissioner Holliday seconded the motion. UNANIMOUS.

AGREEMENT BLM AND SAN JUAN COUNTY SHERIFF - LAW ENFORCEMENT SERVICES

Rigby Wright, county sheriff, met with the Commission and asked them to approve and sign an agreement between the BLM and the San Juan County Sheriff for Law Enforcement Services. This agreement provides for the adequate protection of persons and property on the public lands and roads administered by the BLM and the BLM agrees to reimburse the County up to a maximum of $5,000 per Federal Fiscal year. Commissioner Holliday made the motion to approve this agreement and authorized Commissioner Black to sign it. Commissioner Bailey seconded it. UNANIMOUS.

ALCOHOL DUI TASK FORCE

Rigby Wright, county sheriff, asked the Commission to approve and sign a grant application of $40,000 for a three-year contract with the Alcohol DUI Task Force which starts in May. Commissioner Bailey made the motion to approve this and authorized Commissioner Black to sign it. Commissioner Holliday seconded it. UNANIMOUS.

coUNTy HOME HEALTH

Jill Bayles, home health director, and Rayburn Jack, Nursing Home Administrator, met with the Commission to discuss the county home health. Mrs. Bayles said Jan Treml, executive director of Community Nursing Services (in Salt Lake), is proposing a contract to serve the county. Mrs. Bayles said she feels Mrs. Treml is very progressive and would do a good job. The Commissioners said that they are putting the home health with the hospital and will talk to Mrs. Treml before making any decision.

NURSING HOME FUNDS

Rayburn Jack, Nursing Home Administrator, asked the Commission what the county was planning on doing with the special funds in the Nursing Home when they sell the facility. Mr. Jack said that the nursing home set up a special fund with the money that was given by patients' families, money earned from garage sales, handicrafts, etc. and is used to enhance the facilities. Mr. Jack said that there is about $3,900 in the account. The Commissioners said that this money should be put in a separate trust account.

AMBULANCE FUND £ EMS GRANT

Rayburn Jack informed the Commission that April 9, 1986, is the deadline for the application for the Emergency Medical Services Grant which is for the 1987 funds. Mr. Jack said he would like to purchase another ambulance and needs some money for training. The Commissioners told Mr. Jack to meet with Rick Bailey, Administrative Assistant, and go ahead with submitting the budget.

PIUTE FARMS MARINA ROAD

Conmissioner Bailey reported that he met with Representative Howard Nielson, John Shopman, Gerald LaFont, and others at Gouldings on April 3 to look at the access road to Piute Farms and the marina sight. The group are going to Piute Farms Marina to select a permanent site and a permanent access road to the new site. (The Park Service does not agree on where the Marina should be.) On April 23-25, 1986, the Park Service Superintendent John Lancaster, Joe Miller, and John Shopman are going to meet at Gouldings and then go on the lake to select a permanent site for Piute Farms Marina. The Commissioners are invited on the 23rd to meet with them.

Commissioner Bailey said that Willie Grayeyes called him about this road and said that he was going to take this matter to the Tribal Road Committee immediately.

LLOYD'S LAKE ROAD

Commissioner Bailey said the road department needs authorization from the Commission to go ahead with the road to Lloyd's Lake as soon as Clyde and Karl Barton sign a right of way agreement with the county. The road department is going to destroy the present road and redesign it, also plant new grass and install culverts. The county will also put up signs that say; "This is private property" on both sides of the road. The Commissioners gave the road department authorization to go ahead with the construction when the agreement is signed.

HIGH DESERT ADVENTURES

Commissioner Black reported he received a brochure from High Desert Adventures. It is a wholesale tour operation out of Salt Lake promoting Southern Utah's river running.

WESTERN REGION CONVENTION - Colorado Springs

Commissioner Black reported on the Western Region Convention he attended last week in Colorado Springs. Commissioner Black and others met with Connie Brooks of the Mountain States Legal Foundation with respect to possible future belitigation on BLM/Wilderness designations. Ms. Brooks said they have a good case against the BLM because they have not followed the criteria; one issue to use is the EIS not dealing with state lands. Two, is the proposed wilderness areas are not roadless; three, the noise (solitude). Ms. Brooks told them to be very thorough in their response to the EIS.

NACO

Commissioner Black said that NACo is drafting a resolution that is going to be brought up at the NACo convention in July. The resolved is: Therefore be it resolved that the National Association of Counties is firmly opposed to and deems to be unconstitutional; one, any law or court decision which would allow any government to impose taxes or other laws or regulations of any nature when any of those on upon whom the laws or taxes are imposed have no right to elect the governmental officials who impose those laws or taxes; two, any law or court decision which would authorize the election of governmental officials who would not be subject to the laws or taxes imposed by the government body; three, any law or court decision which would permit tax revenues to be used for any purpose except to provide services to those upon taxes are imposed.

HUNTING AND FISHING RIGHTS ON RESERVATION

Commissioner Black said that another issue discussed at the conference was the hunting and fishing rights on the reservation. A report from the Colorado Southern Ute Reservation was that in 1874 the treaty says the Indians have a right to hunt and fish forever. This treaty was not known until an Indian was caught shooting a buck and was given a ticket. The Indian hired an attorney, the treaty was brought out in court and he won the case. The Colorado Fish and Game and the BLM worked out an agreement to manage the lands and the Indians have to buy a permit from the tribe to hunt.

BLM/FOREST LAND EXCHANGE

Commissioner Black said another issue at the seminar was; the proposed BLM/Forest Service land exchange in which they are proposing to deduct cost of management before they share mineral money and will be able to deduct the cost of timber.

BILL IN SENATE

Commissioner Black said that Republican Senator Chaffee has introduced a bill to the Senate that would limit federal funds and permits for activity that would be considered harmful to wildlife, scenic vistas, the environment, and limiting tax deductibility on credit for development activity on adjacent lands.

KEUD PANEL ON FUTURE DEVELOPMENT AND ACTIVITY

Commissioner Black reported that last Friday he was invited to be on a KEUD panel to talk about the future development and recreation activities in the state of Utah.

LAW SUITS and the LIABILITY CRISIS

There is a White House briefing session on Friday April 25, 1986, that will be presented by the Attorney Generals Administration and is on the liability crisis and law suits.

BLM 43 CFR 2450,4 (a) - EARTH STUDIES - Recreation and Public Purposes

The Commission received a letter from the BLM on their decision on Sec. 15, T27S, R23E that was petitioned by Earth Studies, Inc. for Recreation and Public Purposes (U-57094). The BLM classified the land as unsuitable for lease or sale for recreation and public purposes under the Recreation and Public Purposes Act of June 14, 1926.

HOVENWEEP NATIONAL MONUMENT

Commissioner Holliday said that Ed Sherick, BLM, said the Hovenweep expansion is still in effect and is going in from the Colorado side. Commissioner Black said that letters need to be written to the Congressional Delegation opposing any enlargement on the Hovenweep National Monument because most of it is in San Juan County.

ATLAS MINERALS

Commissioner Black received a phone call from Richard Bluebau, Atlas Corporation, and he said that Senator Domenici is introducing an amendment to Senate Bill 1004 on the Uranium Revitalization and Tailings Reclamation Act of 1986. Mr. Bluebau said there will be a hearing Thursday for comments. This bill will require 50% of all uranium used in domestic power plants to be mined and milled locally. And the reclamation of old tailings will be paid 1/3 by the federal government, 1/3 by utilities, and 1/3 by the producers. An agreement will be that the Department of Energy is to reduce their enrichment debt to the treasury and commercialize enrichment programs.
