SAN JUAN COUNTY COMMISSION OCTOBER 6, 1986
The San Juan County Commission met in regular session on October 6, 1986 at the hour of 10 a.m. at the San Juan County Courthouse, Monticello, Utah.

1987 TENTATIVE BUDGETS
Gail Johnson, clerk, asked the Commission if they had any requests to the department heads on submitting their tentative 1987 budgets. The Commission said they request that each department hold to a conservative budget and figure them on this year's valuation and also budget the salaries on the same current salary basis. The Commission will discuss any salary raises with department heads prior to the final approval of the 1987 budget. Mrs. Johnson will send a memo to all department heads asking them to submit their budgets by October 20, 1986.
PERSONNEL POLICY AMENDMENT - PROBATIONARY RAISES
Commissioner Bailey made the motion to approve the following amendment to the personnel policy on probationary raises. Commissioner Holliday seconded the motion. UNANIMOUS.
TO: ALL DEPARTMENT HEADS
RE: Personnel Policy - Probationary Raises
Effective October 1, 1986, all probationary raises will be based upon whether the probation ends in the first or second half of the month. If the probationary period ends in the first half of the month, then the probationary raise will be effective for the entire month. If the probation period ends in the second half of the month, then the probationary raise will not be effective until the following month.
This policy will be followed for all employees hired after October 1, 1986. Department heads must still remember to submit a request for the probationary raise to the commission prior to payroll time.
San Juan County Commission The memo will be sent to all department heads and signed.
LAKE POWELL BOATING REGULATIONS - PARKS & RECREATION
Gail Johnson, clerk, told the Commission that there is a new State Park Officer at Lake Powell who will be enforcing the boating and off-road vehicle regulations and asked if the Commission would allow him to accept cash bail. The Commission said they would prefer that he does not accept any cash bail. Commissioner Black said he feels that this a duplication of the National Parks' responsibilities and is a waste of state money.

Eddie Allred, director of county-wide recreation, and Tauna DeGraw, CEU, met with the Commission concerning the recreation department paying Ms. DeGraw $100.00 a month for secretary services. The Commission said this causes a problem because there was no request for employment brought to the Commission and there was no advertising. Ms. DeGraw said she discussed this with Lynn Lee, president of CEU, and he said that the college participates in the additional funding of the county recreation program but this does not include her secretary services. The Commission said that one of the justifications given to them for funding of the Human Services Grant was that Ms. DeGraw spent a lot time helping the recreation department. The Commission said they would like to discuss this with Mr. Lee next week.
RESOLUTION - ANNEXATION SAN JUAN COUNTY WATER CONSERVANCY DISTRICT
Pursuant to Section 11-23-6 Utah Code Annotated, Commissioner Bailey made the motion to approve Grand County's Resolution No. 2065. Commissioner Holliday seconded the motion and carried unanimously.

BLM LAW ENFORCEMENT AGREEMENT
Gene Nodine, BLM, met with the Conmission concerning the cooperative Law Enforcement agreement between the BLM and San Juan County Sheriff's Department. The agreement provides for adequate protection of persons and property on public lands and roads administered by the BLM. Commissioner Black said he does not like the federal government having federal police but agrees that law enforcement should be under a cooperative agreement. The BLM receives a monthly report from the county sheriff on the hours and time spent on federal lands. Sheriff Wright recommended to the Commission that the agreement be extended. Commissioner Bailey made the motion to approve the agreement and authorized Commission Black to sign the contract and Commissioner Black seconded the motion.

JAIL SERVICE AGREEMENT - UTE MOUNTAIN POLICE DEPARTMENT
Sheriff Wright asked the Commission to approve the following agreement to supply jail services. This agreement is temporarily until B.I.A. standard form #32 can be completed by both parties.
The Ute Mountain Police Department shall house violent and sentenced prisoners at the San Juan County Jail Facility in Monticello, Utah at the rate of $10.00 per day, per prisoner. The Ute Mountain Police will be responsible for all transporting of their prisoners,, to and from the facility except in the cases of emergency medical treatment.
If emergency treatment is required the San Juan County Sheriff's Officer will supply transportation for the prisoner to the San Juan County Hospital for treatment. The Indian Health Services shall pay any and all costs for such emergency (life threatening) treatment. Subject to 30 day cancelation and space limitations.

EMERGENCY MEDICAL TECHNICIAN OF THE YEAR 1986 - PAT COOK
The Commission awarded Pat Cook, Bluff, the Utah Emergency Medical Technician of the Year 1986 on behalf
of the Utah Department of the Health Bureau of Emergency Medical Services. Commissioner Bailey attended
the award's ceremony in Salt Lake because Mrs. Cook and her husband were out of state and were unable to
attend. The Commission congratulated Mrs. Cook for her dedication and devotion in providing quality
services to the county. The Commission presented Mrs. Cook with a plaque from the state.
The Utah Peace Officer's association donated $2,500 of emergency equipment to the county's ambulance
service.
UNDC'S REPORT - TULLY LAMEMAN
Tully Lameman, UNDC, met with the Commission to report that his term on the PIC board expired in July and
Bill Howell, AOG, said the UNDC board needs to make a recommendation to the AOG board. The Commission
said they approve the recommendation to re-appoint Mr. Lameman to serve on the PIC board.
Dentist - Montezuma Creek Mr. Lameman said UNDC is recruiting for a dentist in Montezuma Creek. The
last several years UNDC has had a contract with Monument Valley dental services. Indian Health Service
requires a dentist to be in the area and will provide the service if UNDC fails to locate one.
Range improvement project is going on at Cajon Mesa. There have been a few neighbors complaining that
this is their use area and it was taken to the Shiprock department and was determined that these people
don't have use rights in the area.
Four corners project in control grazing & reseeding. Mr. Lameman said they are doing sane control grazing
plus reseeding and cross fencing.
Road projects on reservation. Mr. Lameman said that UNDC would like a report from the county of the road
projects on the reservation at the next UNDC board meeting. Commissioner Bailey said he will attend the

meeting and that will be be sending a copy of a letter to the Navajo Tribe on the progress of the bridge
at Oljato wash and the road to Pauite Farms.
Housing projects Herb Clah and Tony Dayish, representing UNDC, went to Washington, D.C. to accept an
award for housing projects - building homes at low cost. (This is on a national competition basis)
Rural Community Assistant's Program is sponsoring a banquet in Blanding on October 23 for Harold Drake of
Navajo Mountain and the Commission are invited. Mr. Drake is the Chapter President at Navajo Mountain
and has contributed a lot to the community development of Navajo Mountain.
PROBATIONARY RAISE - SENIOR CITIZEN BUS DRIVER - GEORGE KENSLEY
Rick Bailey, Administrative Assistant, recommended to the Commission that they approve a probationary raise to George Kensley, the Monticello senior citizen bus driver. Commissioner Bailey made the motion to approve a probationary raise to a Grade 1 step 5 for George Kensley. Commissioner Holliday seconded the motion. UNANIMOUS.
SAN JUAN WATER CONSERVANCY DISTRICT - BOARD
The Commission sent a letter to Norman Nielson, chairman of the San Juan Water Conservancy District, stating that two members submitted their resignation from the board and that all the terms have or will expire in the near future. The Commission request that the District provide any recommendations to the Commission by October 16. A notice will be placed in the local San Juan Record for individuals to submit recommendations.
PUBLIC SAFETY BUILDING
Rick Bailey, Administrative Assistant, said they are moving fast on the designing of the public safety building. John Peterson, architect, will be down next week to go meet with each department head to go over the detail drawings. The county has received the grant money to purchase the property and before closing it out officially Mr. Bailey said he wants to know if the Anastasio Lopez's property is going to be released. Commissioner Bailey said they will release this property and work around it.
NURSING HOME CLOSEOUT
Rick Bailey reported that he and Commissioner Black met with Reuel McPhie, manager of the nursing home, and said that the closing out of the nursing home is not complete yet. The loan to purchase the nursing home has been approved but they are waiting on title insurance and the survey. Rick said he will contact Doug Pehrson concerning the survey. The Commission agreed that Terra (buyer) should be paying interest on the lease and will calculate the interest into the amount due.
BLANDING CLINIC AND NURSING HOME AGREEMENT
The Commission approved an agreement between San Juan County and Auburn Manor Holding Corp as follows:

SECTION ONE
PARTY WALL DECLARATION The wall shall be a party wall, and the parties shall have the right to use it jointly.
SECTION TWO EXTENSION OF WALL
Either Party or his heirs or assigns, may in connection with extension of his respective building, extend the height of the wall up to a maximum height of mutual agreement, so long as the extension is the same width as the existing wall and does not impair its strength or injure the foundations of the buildings.
The other party shall have the right to use the extended part of the wall and to join it by paving the construction party mutual agreed upon one-half of the cost of such part of the wall as he shall use.
Any extension of the wall shall be a part wall and part of the existing wall.
SECTION THREE REPAIRING OR REBUILDING
If it becomes necessary or desirable to repair or rebuild the whole or any part of the wall, the repairing or rebuilding expense shall be borne equally by the parties, or by their heirs and assigns who shall at the time of the repair or rebuilding be using it, in proportion to the extent of their use. Any repairing or rebuilding of the wall shall be on the same location, and of the same size, as the original wall or portion thereof and of the same or similar material of the same quality as that used in the original wall or portion thereof.
SECTION FOUR
ARBITRATION
Any controversy that may arise between the parties with respect to the necessity for, or cost of, repairs or with respect to any other rights or liabilities of the parties under this agreement shall be submitted to the decision of three arbitrators, one to be chosen by each of the parties hereto and the third by the two so chosen. The award of a majority of such arbitrators shall be final and conclusive on the parties.
SECTION FIVE
BINDING EFFECT
The benefits and obligations of the covenants herein shall run with the land herein described so long as the wall of any extension thereof continues to exists, and shall being the reprective parties hereto, their heirs, legal representatives, and assigns.

MENTAL HEALTH, ALCOHOL AND DRUGS - AGING PROGRAM
The following letter was sent concerning the Commission's stand of the State Social Services wanting to change the mental health, alcohol and drugs and the aging programs.

Dear Mr. Angus:
The San Juan County Commission has reviewed the information sent to us dated September 9, 1986 regarding the position of mental health, alcohol and drugs and the aging programs.
It appears to the Commission that the Aging program will best remain as the discussion papers indicates as a State Division. We would also agree on the need to reduce staffing to a level that would provide satisfactory service to the Area Agencies. It is agreed however, that the staff be required to "narrow its current focus and reinforce its thrust to support requirements of the Federal Older Americans Act" as outlined in the discussion. Additional requirements to meet other reporting requirements from the State office should be eliminated. The Commission feel that in the Aging network, that representation is accomplished from all areas of the State of Utah through the Advisory Council. The size of this board could be reduced and the schedules that they meet on could altered to accomplish significant cost savings while allowing the council to remain. It is also recommended that the State Board be encouraged to become more of a working board that they are at the present time.
The Commission feel that the Division of Alcohol and Drugs and Mental Health can and should be combined into one division. While sane differences and problems do exist, none appear to be substantial enough that they cannot be worked out to allow the joining of the two divisions. They are combined at some local levels and have proved to work satisfactory. It is however, the position of the San Juan County Commission that this division should be operated and managed and funded from a State level rather than a County level. There are many reasons as to why this would be the preferred alternative. If the State had the responsibility for the division, less total overhead would result from a staff reduction such as the Aging and Adult Service division will have, than to have each county within the State to have the administration and overhead to operate and manage these services. It will be difficult for the County in the State to find and maintain proper people to operate these programs, and it will require a substantial increase of work load for the people in recruiting and administrating programs in which most County Commissioners do no and will have not experience or knowledge in a Mental Health and Alcohol and Drug program. The State through a network of Community Operation offices could easily implement the programs into existing offices that are throughout the State and provide staff with proper guidance and administration.
Mr. Bailey summarized the county's aging program with the Commission. One of Mr. Bailey's recommendations is to hire part-time directors for the three senior citizens centers in the county. The main idea would be to provide more activities and utilize the centers more instead of all-day bus trips. Mr. Bailey said he presented this to the Monticello and Blanding Senior Citizens and they felt this was what they wanted to do. Mr. Bailey prepared a draft job description of the responsibilities of a part-time director, the position would also qualify for the job training program which would pay half of their salary for six months. Community Nursing Service said they can take over as part of this program by January 1, 1987. The Commission feel this is a good idea and told Mr. Bailey to talk this over with Bruce Shumway the director of Social Services. The Commission would also like to meet with Mr. Shumway after he is briefed on this proposed change.
SAN JUAN COUNTY HISTORICAL COMMITTEE
Commissioner Bailey reported that he received a letter of resignation from Doris Valle of the San Juan County Historical Committee. The Commission will take recommendations for a replacement from the Historical board.
HALLS CROSSING AIRPORT - BUZZ HUNT - CREAMER & NOBLE ENGINEERS
The Commission wrote a letter to Buzz Hunt, Phase II Consulting, concerning the slow progress of work to be done at the Halls Crossing Airport. The Commission request that immediate efforts be placed on this project to be completed by November 20, 1986. The Commission also wrote a letter to Creamer & Noble Engineering concerning this issue and stated that things should have been completed by now.
GOULDINGS - HELICOPTER PAD
Commissioner Bailey said that Gerald LaFont said he would work out a cooperative agreement with the county to build a helicopter pad at Monument Valley. Mr. Gouldings has put a lot of his own money into it and needs cooperation from the Utah State Division of Aeronautics. Rick Bailey will write a letter to Ron Theobold to follow up on this.
JOINT ROADS COMMITTEE MEETING
Commissioner Bailey reported on the Joint Roads Committee meeting he attended.
The money that the state highway patrol will receive in 1987 as a diversion from road funds was jumped by
Governor Bangerter from $4,234f700 to $10,126,500 to balance the budget. A couple of years ago the
Governor's office agreed to bring these diversions down and did but it was brought up a little in 1986 and
the 1987 budget has skyrocketed to over $10 million on the highway patrol diversions. Commissioner Bailey
said that what happens is the highway user revenue is tapped and then the state highways and local roads
receive less money. It's not right that for the state to take the gas tax money to spend on budgets other
than road projects.
Stop Signs The state turned the stop sign responsibility over to the cities and counties. The committee
is going to try to stop the state from doing this.
UDOT Committee The county will write a letter to Governor Bangerter in support of Dell LeFevre to be
appointed to the UDOT committee. Commissioner Black said Clan Church, UDOT member, submitted his
resignation but the Governor will only accept his resignation when he is no longer able to serve. The
Commission will ask the Governor that when the vacancy occurs they will be in strong support of Dell
LeFevre.
BIDS OIL, GREASE & ANTIFREEZE

Commissioner Holliday made the motion to award the low bid to Black Oil Company. Commissioner Bailey seconded the motion. UNANIMOUS.
BIDS AWARDED ON TIRES AND STEEL PIPE
Commissioner Bailey made the motion to award the low bid on each of the tires. Commissioner Holliday seconded the motion. UNANIMOUS. Commissioner Bailey made the motion to award the bids on the corrugated steep pipe to Wheeling Corrugating Company from Grand Junction. Commissioner Holliday seconded the motion. UNANIMOUS.
EMERGENCY SERVICES - DEPARTMENT OF PUBLIC SAFETY
The Commission received a letter of explanation from Lorraine Campus of the Department of Public Safety as to why they are not going to fund the county any more on the Federal Emergency Management Agency. The other counties in the state received federal support monies (EOC) to help build their emergency centers and priorities are given to these counties. San Juan County did not receive federal money, but last year the county received $7,400 on a 50-50 match for emergency services and next year the county will receive nothing. Rick Bailey said that by not participating it would hurt the county if there was a national disaster in the area, because these are the people to go through for federal assistance. Commissioner Black will contact the Governor's office to appeal this, the county will accept a cut in funds as should the other counties.
COUNTY ROAD EMPLOYEES ON CITY STREETS - SUPERVISION
Commissioner Black said there is a problem in Blanding as to the supervision of county road employees working on city streets. Commissioner Bailey said it is entirely the county's responsibility. There have been complaints of no supervision of county employees and this will be checked on.

CONSORTIUM BOARD - DOCTOR
Commissioner Holliday reported that he attended the Consortium meeting on September 25. The county has three members on the board; Rayburn Jack, Commissioner Holliday and Ty Lewis and in two months a new Commissioner will need to be appointed to serve on this board. Mr. Jack expressed that he would like to continue serving on this board. Commissioner Holliday said that in two years the county would be eligible for a consortium physicians but could apply immediately for one now. The Commission said that everything should be done to locate a physician for the county.
PILT PAYMENT
The county received $370,153.00 for the 1986 payment in lieu of taxes. This is a 4% cut because of Gramm-Rudman. The amount of money is based on $. 75 per acre less any shared receipts subject to a per capita population limit. (This is for all federal lands in the county excluding the reservation.)

BLM PROPOSAL OF LAND SELL - NAVAJO TRIBE
The BLM is proposing to sell 120 acres of public land near Blanding, Utah to the Navajo Tribe. The land is being offered as a direct sale to the Navajo Tribe in accordance with 43 CFR 2711.3-3 (a) (5). For a period of 45 days interested parties may submit comments to the District of Manager of the BLM.
