MINUTES OF THE BOARD OF COUNTY COMMISSION MEETING HELD ON NOVEMBER 6, 1978

Minutes were read and approved on a motion by Commissioner Black and seconded by Commissioner Guymon. STEVENS ROAD

Several residents of Stevens Road met with the Commissioners to present a petition asking the County to upgrad Stevens Road. This road needed to be crowned for draining, graded and graveled. They also stated that the school bus driver will not come down this road to pick up the children because the road is not graveled. The commissioners stated that this problem would have to be taken up the the Superintendent of the School District.

STEWART SUBDIVISION #2

Mr. L. C. Stewart met with the Commissioners to present the plat for the Stewart Subdivision Part 2. This was approved with the addition of the following: Such acceptance is predicated on the completion by the sub-divider of the access and internal roads to County standards and approved by the County Engineer and the County Commission. The motion was made by Commissioner Black and seconded by Commissioner Guymon and passed unanimously.

4-H BANQUET

Mrs. Helen Neal met with the commissioners to invite them to the 4-H leader banquet and to ask one of them to speak at the banquet. The commissioners had to refuse with regret because they had another meeting that all of the Commissioners had to attend.

COUNTY ROAD

The commissioners discussed the road which Vint Jones asked to have put back on the county system. It seems that it has always been a county road but it never got put on the State Maps as a county road. When the state comes around with their map inventory Lynn will be sure that it gets on the state map. It is only a county road up to the corral.

COMMISSIONER BLACK REPORTS

Commissioner Black reported that it is the recommendation of the Tax Study Committee that the state sale tax on food be phased out over a four year period. This will be rebated instead of simply taken off at the grocery store because of the complications that it will cause because most grocery stores carry a combination of grocery and nongrocery items. They will also expand the existing circuit breaker to all of those with an income under $10,000 beginning this year. The arrangements will be made to deduct the money when it is paid to the county rather than on a rebate arrangement.

Renters can file and get a credit back on their income tax. They also want to increase the state participation in the school prgram from 68% to 70% to 75%. Commissioner Black stated that he wonders how the state will impliment this program without raising taxes in other areas to cover the amount that they will be deducting in the above areas. He also stated that there will be a Homestead credit for those with incomes over $10,000. This will start as a $50.00 rebate. Commissioner Black stated that they had discussed this ideas at the AOG board meeting. He stated that one thing was totally ignored in this committee and that was the shifting of the tax burden from income producing property to nonincome producing property (Homes). He stated that the reduction of revenue that would come as a result of these reductions would probably be made up by increasing the valuation on homes. He wants the state to re-evaluate its methods of assessing utilities and railroads.

WESTERN REGION CONFERNECE

Commissioner Black reported that he had attended the Western Region Conference where they discussed

varous public lands issues such as the Forest Services RARE II, the BLM Wilderness proposals and

Park Service proposals. They also discussed the Western States Strategies to deal with these proposals,

ROAD INTO MONUMENT VALLEY

Commissioner Guymon reported that Lynn Adams, Doug Pehrson, and himself had met with the BIA people and had driven over the road into Monument Valley. They wanted to get this road fixed up and then put on the county maintenance agreement. Lynn had word from the BIA that they would prefer to wait and see about this road another time.

WINTERIZATION

Commissioner Guymon reported that he had gotten the golf course pickup from Grant Leavitt and had turned it over to Vet Bradford so that he could get started on the Winterization Program.

UTAH DEPARTMENT OF TRANSPORTATION ROAD MEETING

Commissioner Boyle reported that he had attended the meeting of the Utah DOT. He had asked various questions with the results as follows: Cow Canyon road will be advertised for bids this winter and completed in 1979. The Recapture Road and Dam are still being held up by the Environmental Impact Study. The Monticello South, US 163 will be advertized for bids in 1979 and be done the same year. U. S. 666 will be let for Bid in about a month and finished in 1979.

The UDOT wanted to know who owns the 01 Jato Airport. The airport is on Navajo Land but is covered by the County's Memorandum of Agreement with the Navajo Tribe.

POSSESSION & ENTRY TAX

Ronald B. Bruckman met with Commissioner Boyle during last week stating that the Navajo Nation was charging an Possession and Entry Tax. The Oil Companies feel that this is double taxation and that they will be paying their taxes under protest. Marian Bayles met with the commission to discuss this and she stated that when someone pays their money under protest then the money can't be used for 90 Days if no action is taken, if is taken then the money can't be used until the action is settled.

CONSOLIDATED PROTEST

The Commissioners received a letter from the Utah Assocation of Counties asking that the Commissioners sign a letter protesting the underpayment of the Payment-In-Lieu. The counties are asked to consolidate their protest. The Commissioners signed the letter protesting the underpayment on a motion by Commissioner Black and seconded by Commissioner Guymon and passed unanimously.

LETTERS

The Commissioners received a letter for the United State Nuclear Regulatory Commission in Washington, D. C. thanking them for the letter which they sent in behalf of Energy Fuels Nuclear, Inc. in Blanding.

The Commissioners also received a letter from the Bendix Corporation thanking them for the help and cooperation in the seal and chip coat road project into the old Monticello Mill Site.

The Commissioners received a copy of a letter to Mr. Calvin Sudweeks at the Bureau of Water Pollution Control in Salt Lake City. This was from Mr. Gene Foushee. This was asking for help in forming an improvement district to help carry on the sewer idea. The Commissioners will not form a district at this time because the request for a special district must come from all of the people.

BLUFF TO MONTEZUMA CREEK ROAD

Commissioner Boyle contacted Eckhoff, Watson and Preator to find out the status of the Bluff to Montezuma Creek Road. Mr. Praetor stated that he had turned into the State a Plan in Hand Review on the Bridge and the section from west of bridge to the intersection at Montezuma Creek about the middle of October but that he hadn't received any thing from them since.

MONTEZUMA CREEK SWIMMING POOL

Mr. Broberg met with the Commissioners to discuss the Montezuma Creek Swimming Pool. The Commissioners authorized rebidding the swimming pool and bidding it in 2 separate packages. The pool will be bid in two packages, the pool and the buildings are separate. The motion was made by Commissioner Black seconded by Commissioner Guymon and passed unanimously.

DETENTION CENTER

Sheriff Wright and Bruce Shumway met with the Commissioners to discuss a detention study that had been made by the Utah Council on Criminal Justice Administration. There is a need for a Detention Center. The Sheriff suggested building a separate building to house the increased load for both hard and soft detention and also to house a "detox" center if the law is passed making this manditory. Sheriff Wright and Bruce are to work on this and let the Commissioners know the angles next week

BLUFF MULTIPURPOSE CENTER

The Bluff Multipurpose Center has been approved. Al Haskins and Bruce Shumway are to work together on the specifications of the Bluff Multipurpose Center. They are to get with the Committee in Bluff to do this.

POLICE CARS

Sheriff Wright presented a bid by Redd Motors for 2 police cars at 6,382.76 per vehicle. This was accepted on a motion by Commissioner Black seconded by Commissioner Guymon and passed unanimously.

LOW INCOME HOUSING

Al Haskins stated that the county would be getting aobut &9,000.00 for low income housing.

CIVIL DEFENSE

Mr. Haskins stated that Civil Defense will be under a new agency called FEMA (Federal Emergency Maning Agency). This agency will coordinate any relief in a disaster area.

BUILDING INSPECTOR

On a motion by Commissioner Guymon Phil Acton was hired as the San Juan County-South Building Inspector. This was seconded by Commissioner Black and passed unanimously.

Commissioner Black made the motion to adopt the Moab building fee schedule. This will be retroactive to Sept. 25, 1978. The commissioners asked the deputy clerk to send a letter explaining the new fee system and a fee schedule to all contractors in the county.

Commissioner Black stated that this would have to be discussed further and then a resolution would have to be made.

ABATEMENTS

Abatements for Ellen P. Johnson of Blanding, and Gladys F. Evans of Bluff were approved by the Commissioners.

TRANSIENT ROOM TAX MEETING

Commissioner Boyle opened the meeting and welcomed the motel owners. Dixie Barker was unable to attend this meeting. The following people were present: Robert Rhodes, Jeri Anest, Bill Davis and John Burden. Mr. Victor Schafer was present and presented varous aspects of the Tourist Budget and the Transient Room Tax. John Burden asked what Grand County's Transient Room Tax Percent is. Commissioner Boyle stated that Grands was 2.5 percent. Mr. Burden stated that we should have the same Tax as Grand County so that we can be competitive. Mr. Rhodes stated that the Travel Council should have enough money to do what needs to be done. The general Consensus of opinion among the motel owners was that if the raise in the Transient Room tax was not added to the budget as an additional amount then there was no sense in raising the Room Tax.

MINUTES OF THE SAN JUAN COUNTY ROAD MEETING HELD NOVEMBER 6, 1978

B. Bradford, A. Holden, L. Adams.

Minutes were read and approved. Motion by Dave, seconded by Calvin.

Teek reported the water wagon engine had thrown a rod. He said Wheeler estimate was approximately $10,000 to rebuild. Lynn was instructed to check on a water wagon at Wheeler Machienery and see if a good deal could be made on it.

Bernal requested a 90 Day raise for Johnie Jones, also a 1 step to 24-2. This was approved by the Commission.

Ace requested Karl Barton be started at 26-2 starting salary. K. S. Barton will be eligible in 90 days for the probation raise (Permanent employee).

Bernal requested Brett Lyman be raised to 26-1. This was approved by the Commission. Doug was instructed to proceed with design on the sand island road. Meeting adjourned at 10:00 A.M.
