SAN JUAN COUNTY COMMISSION MINUTES OCTOBER 5, 1987

The San Juan County Commission met in regular session October 5, 1987 at the hour of 10:00 A.M. at the San Juan County Courthouse, Monticello, Utah.

The following members were present: Commissioner Black

A motion to approve the minutes of September 28, 1987 as corrected was made by Commissioner Maryboy and seconded by Commissioner Black. UNANIMOUS.

COMMISSIONER CALVIN BLACK'S REPORT

Carbon Dioxide Proposal - Escalante Residents - A letter and additional information was received requesting the support of the San Juan County Commissioners on Alternative 5, the drilling for Carbon Dioxide near Esclante and Boulder in Garfield County. Commissioner Bailey made a motion in support of this proposal. Commissioner Maryboy seconded the motion. UNANIMOUS.

Governor Norman Bangerter - Southern Utah Visit - Governor Norman Bangerter visited Southern Utah Saturday, October 3, 1987 making stops in Kanab, Panguitch and Blanding. The purpose of the visit was to announce an initiative to exchange scattered State sections within other Park Service units for Federal land on Lake Powell for possible private enterprise. The Governor was also asked about other State issues during a question and answer period. Commissioner Black will be going to Salt Lake this week to meet with the director of the Salt Lake Chamber of Commerce and other groups to get support from the Wasatch Front for the land trade issue.

Integral Vista Meeting - Commissioner Black will attend a meeting October 27, 1987 in Panguitch with regard to the Integral Vista issue. Commissioner Black would hope a final draft would acknowledge where the pollution is coming from, that there is no pollution locally contributed, so there is no need for Integral Vista protection with any more limitations on siting of facilities in Southern Utah.

Mental Health - Medicaid Agreement - An updated copy of the Memorandum of Agreement between San Juan County Health Authority and the Division of Health Care Financing for services to be delivered under Medicaid was received by the Commission. Commissioner Bailey made a motion supporting this agreement and authorizing Commissioner Black's signature. Commissioner Maryboy seconded the motion. UNANIMOUS.

Commissioner Black will be attending a meeting of the Mental Health Authority Representatives from the State and the State Mental Health Board this week on a new funding proposal. We are presently receiving $210,400 from the State. They want to cut funding to $152,800 in 1988, $130,819 in 1989 and $108,000 in 1990, about half of what we are receiving. This is a per capita type funding. Commissioner Black indicated the State Mental Health Board is using state money which is to provide equal services to everybody. If the Mental Health Board does not comply with that they may be faced with a Civil Rights Lawsuit.

COMMISSIONER KENNETH BAILEY'S REPORT

Impact Wrench Bid - Commissioner Bailey informed the Commission of the W. W. Granger Company as the low bidder on an Impact Wrench at $289.33.

BIA, Eastern District, Maintenance Agreement - Commissioner Bailey made a motion to accept a BIA, Eastern District, Maintenance Agreement and authorize Conmissioner Black to sign said agreement. The motion was seconded by Commissioner Maryboy. UNANIMOUS.

TV Site South of San Juan River - Commissioner Bailey would like to recommend a remote W site somewhere south of the San Juan River. He feels such a site would improve reception in Bluff, Aneth, Montezuma Creek and the Red Mesa area. Commissioner Maryboy was asked to explore the possibilities with Bill Bayles.

Red Mesa Road Oiling - Bernal Bradford will have the oiling at Red Mesa completed this week.

Pioneer Estates Road - The Road Department will propose to Blanding City that we change the formula to a 50/50 participation for the Pioneer Estates Road.

COMMISSIONER MARK MARYBOY'S REPORT

Aneth Yellow Flashing Light - Some Aneth residents are requesting a flashing yellow light to be installed by the Thriftway Store because of excessive traffic. Commissioner Maryboy will contact Dyke LeFevre of the State Roads with this request. Mr. LeFevre is also waiting for a contract to install a flashing yellow light at the Montezuma Creek school zone. Commissioner Maryboy will contact the school board and Bill Todachinnie to get this project completed.

Oljato Road Proposal - Commissioner Maryboy will follow-up on the resolution for the Oljato Road Proposal as it has not been received by the Commission.

Commissioner Maryboy will also contact the Arizona Commissioners to address the problems in Monument Valley that Jim Dandy was willing to do at the Ranger Station.

Reservation Roads - Commissioner Maryboy wil meet with the Chapter Officials and make recommendations to UNDC on priority road requests for the Reservation. These need to be received by the Commission by the first of the year.

ADMINISTRATIVE ASSISTANT - RICK BAILEY'S REPORT

Utah Local Governments Trust - Liability Meeting - Rick Bailey attended the Liability Meeting of the Utah Local Government's Trust Friday, October 2, 1987 in Salt Lake City. It was very well attended and a very informative meeting. The background information that was presented at the meeting indicated that to date they have had 216 claims filed with a payout of $800,000. They have $2 to $3 million dollar reserve to cover their risks. At the present, San Juan County has a $250 deductible with $1,000,000 basic coverage and from $1 to $5 million umbrella type coverage. It's costing Utah local Government's Trust 20% of everyone's premiums to buy this extra coverage from Lloyd's of London. There has only been two claims in the history of government coverage of over $1,000,000. Utah Local Government's Trust has a problem of raising the reserves to meet State Requirements and still maintain coverage at a reasonable rate. The basic proposal presented at the meeting was:

1. Put everyone based on size and need on one or two amounts of deductible, $1,000 for larger entities and $500 for smaller entities in order to unify this part of the policies.

2. To build up the reserves, increase the rates to two and a half times the 1984 rates, a 50% increase. They would not offer the $1 to $5 million additional coverage unless the entities want to pay for it.

The participating Counties own the reserve funds and Utah Local Government Trust may discourage pull-out from the Trust by implementing regulations prohibiting reentry into the program once a County discontinues coverage.

State Alchol & Drug Provider Board Member - A letter dated September 29, 1987 was received from Mark Lyman stating he will accept the appointment as a board member of the State Alchol and Drug Provider Association.

Impact Board - Rick Bailey informed the Commission that the Impact Board is concerned that they will be receiving a number of requests from different counties to fund and construct jails. There would have to be some priorities to monitor those requests. Pursuant to a request to the Impact Board for just such a request on the Montezuma Creek Jail the Commission felt that a preliminary report be obtained from the engineers so that this request could be submitted as soon as possible.

Personnel Policy - A revised version of the San Juan County Personnel Policy is to be given to each employee in a three-ring binder so that up-to-date pages may be added as changes occur.

OTHER BUSINESS

John Fellmeth - Hospital Administrator - John Fellmeth informed the Commission that Margaret Bronson, business office manager, will be retiring December 1. Sue Morrell has been promoted and will be training for Mrs. Bronson' s position. Lou Rogers will be promoted to fill Mrs. Morrell's position. Mr. Fellmeth was given permission to advertise and hire a replacement for Lou Rogers position by November 1st.

Blanding Health Care Agreement - All proposals pertaining to the Blanding Clinic will be discussed at the November 20th meeting of the Hospital Board before an agreement will be signed. Two or three parties have expressed interest in this issue.

Emergency Room Coverage - John Fellmeth, San Juan County Health Care Administrator, will contact other rural hospitals in the State with operations similar to our area concerning compensation for doctors covering Emergency Roan coverage.

Blanding Hospital Feasibility Study - the final draft of the feasibility study of a Blanding Hospital will be presented at a meeting on November 15, 1987.

Indian Health Services - the Indian Health Services will not pay for services to Native American Indians at the local hospital if it is not an emergency situation. When John Fellmeth, San Juan County Health Care Administrator, contacted the Indian Health Service they indicated that if an OB doctor and a Pediatrician were at the hospital a contract could be obtained. However, a similar situation at the Monument Valley Hospital did not result in such a contract. Indian Health Services would prefer to build up the Shiprock Hospital as the regional referral center for all Native American Indians. Commissioner Maryboy will try to arrange a meeting with the Chapter Officials and an IHS Official and others to discuss common problems.

Public Safety Building - Computer System - Rick Bailey and John Fellmeth met with Millard County and Sevier County officials to observe and receive information on the types of computer systems they are using in their jails. The system has the Motorola name on it but it was developed by PMS of Utah. Mr. Bailey and Mr. Fellmeth also went to Salt Lake where they met with PMS personnel to discuss their computer systems. Mr. Bailey indicated that the present computer system in the jail will be obsolete at the first of the year because the State is changing their system and a new machine will have to be purchased. If the County purchases the PMS system it also has the capability of being expanded for other County needs as the present system becomes obsolete. The price discussed with PMS was $47,000. Mr. Fellmeth felt that other systems could be purchased at a less expensive price but would not have the capabilities, ease of use and expandability of the PMS system. Mr. Bailey will make further inquiries of Motorola and other computer centers to facilitate the Commission making the best possible decision regarding the required computer system.

Sheriff's Department - Sheriff Claude Lacy reported that the Historical Society would like to move the old jail in Bluff to a permanent site on the Monticello Park grounds for use as a tourist promotion. Originally it was the first jail used in Monticello and later moved to Bluff. The Historical Society will fund the project. The Commission approved the project.

The Sheriff's Department is still having problems getting money out of Towaoc for some prisoners they had there last year. Sheriff Lacy will pursue this problem.

The Sheriff's Department is losing money on civil process as the collecting of fees has been neglected with the changeover of personnel. Policy is being revised and the fees collected.

An air inspection was made on the Bartley - Rockwell property in Colorado and pictures revealed items in their possession being sought by San Juan County Sheriff's Department. The County Attorney of Colorado is holding up the process of obtaining a search warrant in this matter.

Student disturbances at Whitehorse High School have called for Sheriff's Deputies to attend school functions to keep order. Sheriff Lacy will contact the Navajo Police, school officials, parents and Chapter officials to see what can be done to alleviate the problem.

Fire Board Problems - Rick Bailey, Administrative Assistant, reported on the method of fire control used by Millard County. They have set up a County Fire District as an alternative to a State Fire Board System. After discussion Mr. Bailey recommended that if the Commissioners decide to go with a County Fire District that it be implemented before the first of the year in order to train personnel, etc.

Sewing Machine - Extension Service - Commissioner Maryboy made a motion to approve the purchase of two Singer Sewing machines for the Extension Service. Commissioner Bailey seconded the motion. UNANIMOUS.

Development Board Member - Commissioner Bailey made a motion to approve the appointment of David Guymon to the San Juan County Board of Development Board. Commissioner Maryboy seconded the motion. UNANIMOUS.

Beer License - Robert L. Mueller - Commissioner Maryboy made a motion to approve a beer license for Robert L. Mueller dba Lee's Guest Ranch. Commissioner Bailey seconded the motion. UNANIMOUS.
