MINUTES OF THE SAN JUAN COUNTY COMMISSION MEETING NOVEMBER 5, 1984

The San Juan County Commission met in regular session on Monday, November 5, 1984, at the hour of 10:00 a.m. in the San Juan County Courthouse at Monticello, Utah.

The following members were present: Commissioner Calvin Black, Chairman

Commissioner Kenneth R. Bailey Commissioner Robert Low

Minutes of the previous meeting were approved with the specified corrections on the motion of Commissioner Bailey. The motion was seconded by Commissioner Low and carried unanimously.

AL HASKINS REPORT

Al Haskins met with the Commission to report that auditors and evaluators were here last week reviewing the Aging Program. Mr. Haskins further reported that he has not received the final report yet.

AMENDMENT TO AGING CONTRACT APPROVED

Al Haskins met with the Commission to discuss an amendment to the Aging Contract. The State has authorized additional funding of $1,968. Commissioner Low made a motion to approve the amendment and authorize Mr. Haskins to sign it. The motion was seconded by Commissioner Bailey and carried unanimously.

SHERIFF WRIGHT MEETS

Sheriff Rigby Wright met with the Commission to discuss a proposal from the Forest Service to lease a four-wheel drive vehicle for use by the Sheriff's Department. The Commission authorized Sheriff Wright to proceed.

LAWSUIT REPORTED

Sheriff Wright reported that a lawsuit has been filed against San Juan County, Calvin Black, Robert Low, Kenneth R. Bailey, Rigby Wright, and Robert Bellman by Mary Tsosie. The lawsuit is regarding the suicide of Calvin Tsosie in the San Juan County Jail. The suit is asking for $500,000. in compen-satory damages and $500,000. punitive damages. Sheriff Wright will contact the County's insurance company.

HUMAN SERVICES BOARD MEETING SCHEDULED

A Human Services Board meeting is scheduled for November 8th, at 2:00 p.m. in Blanding.

AUDIT PROPOSALS DISCUSSED

John Fellmeth, Chief Deputy Auditor, met with the Commission to discuss obtaining audit proposals for a 3 year time period for all County entities. The Commission authorized Mr. Fellmeth to proceed.

PUBLIC HEARING RE: REZONING Of LEROY BRIGHT'S PROPERTY

A public hearing was held at 11:00 a.m. to discuss the request for re-zoning the following property belonging to Leroy Bright:

Beg. at a pt. which is S 926.0 ft, of the NW cor. of the NW1/4SE1/4 of Sec. 23, and rng. th E 420.0 ft, th S 19 W 208.71 ft, th W 353.0 ft, th N 196.0 ft, to the pt. of beg.

Mr. Bright is requesting the zoning be changed from commercial to industrial. Commissioner Bailey made a motion to approve the zoning change. The motion was seconded by Commissioner Low and carried unanimously.

COMMISSIONER LOW'S REPORT

Commissioner Low reported that he has received some complaints from the residents in Bluff regarding their lack of recreation equipment. Commissioner Black will check on this matter with the Recreation Director.

Commissioner Low reported that a right angle caution sign is needed in Mexican Hat. The Commission will contact the UDOT about this request.

MONTICELLO CEMETARY DISTRICT APPOINTMENTS

Commissioner Low made a motion to approve the following appointments to the Monticello Cemetary District. The motion was seconded by Commissioner Bailey and carried unanimously.

Paul Dean Black - 6 years

Darroll Young - 4 years

Joe Reed - 2 years

WEED BOARD MEETING REPORTED OH

Commissioner Bailey reported that the Weed Board is working on a map of the heavily infested weed areas that the Weed Department is currently working on. Commissioner Bailey further reported that the Farm Bureau is going to help the Weed Board identify these areas.

PAIRIE DOG CONTROL DISCUSSED

Commissioner Bailey reported on a new product for pairie dog control called Epibloc. Commissioner Bailey further reported that the Board is attempting to get San Juan County designated as a test plot for Epibloc.

JOINT ROADS COMMITTEE MEETING SCHEDULED

Commissioner Bailey reported that a Joint Roads Committee Meeting is scheduled in Delta on November 8th and 9th.

CEDAR POINT ROADS DISCUSSED

Commissioner Bailey reported that he met with the residents of Cedar Point to discuss their concerns regarding the roads in that area last week.

BUILDING PERMIT DISCUSSED

Wayne Perkins from Blanding met with the Commission to protest the investigation fee of $24.00 charged on his building permit. Mr. Perkins reported that he made several trips to Monticello in an effort to obtain a building permit but was unable to meet with the Building Inspector. The investigation

fee is only charged if the building project is started without a permit. The Commission stated that because Mr. Perkins attempted several times to obtain a permit they would dismiss the investigation fee.

STATE INDIGENT MEDICAL ASSISTANCE PROGRAM CONTRACT APPROVED

Rayburn Jack, Health Care Services Executive Director, met with the Commission to discuss the contract with the Utah Department of Health Indigent Medical Assistance Program. The costs for indigent medical care from January 1983 to September 1984 were reviewed. Commissioner Low made a motion to approve the contract which will be effective March 1, 1985. The motion was seconded by Commissioner Bailey and carried unanimously.

ISURANCE COVERAGE FOR COUNTY EMPLOYEES DISCUSSED

Mr. Jack met with the Commission to discuss his request for insurance coverage for part time employees with less than 30 hours per week. Commissioner Bailey made a motion to approve insurance coverage for Health Care employees to 24 hours per week if the employee pays 20% of the premium which would then put them on the same basis as employees that work 30 hours per week. The motion was seconded by Commissioner Low and carried unanimously.

PERSONNEL POLICY CHANGE

The County personnel policy mistakenly states that employees with 30 hours per pay period qualify for insurance coverage when it should state 30 hours per week. The Commission has instructed that this be corrected.

RESOLUTION 1984-8 RE: PUBLIC HEARING METHANOL PRODUCTION CORP.

Commissioner Bailey made a motion to approve the following resolution. The motion was seconded by Commissioner Low and carried unanimously.

RESOLUTION OF THE BOARD OF COUNTY COMMISSIONERS OF SAN JUAN COUNTY, UTAH, SETTING A PUBLIC HEARING IN CONNECTION WITH THE ISSUANCE BY THE INDUSTRIAL DEVELOPMENT AUTHORITY OF ITS IN-DUSTRIAL DEVELOPMENT AUTHORITY OF ITS INDUSTRIAL DEVELOPMENT REVENUE NOTE OF 1984 (METHANOL PRODUCTION CORPORATION PROJECT)

WHEREAS, the County of San Juan (the "County") is a political subdivision of the State of Utah and is authorized and empowered under the Utah Industrial Facilities Development Act, constituing Chapter 17 of Title 11 of the Utah Code (the "Act"), to issue its revenue bonds for the purpose of financing any "project" as defined by the Act and of paying the cost of such financing; and

WHEREAS, Methanol Production Corporation, a Colorado corporation (the "Company"), in furtherance of the goals and intent of the Act has proposed to construct a Modular Gas Plant for the production of Methanol Gas to be located near Lisbon Valley in San Juan County, Utah, and is considering acquisition of certain items of capital equipment to be located at the plant site (said equipment hereinafter referred to as the "Improvements); and the cost of the construction of the facilities and the cost of the Improvements and expenses incidental thereto is estimated not to exceed $10/000/000; and

WHEREAS, certain provisions contained in Section 103(k) of the Internal Revenue Code of 1954, as amended (the "Code") , as said Section was enacted by Congress under the Tax Equity and Fiscal Responsibility Act of 1982 ("T.E.F.R.A.") , required that a public hearing be held in connection with the authorization and issuance of any industrial development revenue note for a project and that an elected representative be appointed to approve such issuance of industrial development revenue note; and

WHEREAS, the County has been requested to hold a public hearing pursuant to Code Section 103(k) for the issuance of and sale of one or more issue series of bonds (the "Revenue Bonds") pursuant to the Act in an aggregate principal amount agreed to by the County and the Applicant not to exceed $10/000/000 and to expend the Revenue Bond proceeds to finance all or a protion of the cost of the facilities and the cost of the Improvements all upon the terms, conditions, interest, and repayment schedule as shall be agreed to by the County and the Applicant; and

WHEREAS, it is in the public interest, for the public benefit and furtherance of the public purposes of the County, and will serve the purposes provided in the Act that such public hearing be authorized and a date be set for the holding of same.

NOW THEREFORE, BE IT RESOLVED, DETERMINED AND ORDERED BY THE BOARD OF COUNTY COMMISSIONERS OF SAN JUAN COUNTY, THAT:

Section 1. Pursuant to the Act, the County is legally authorized to issue notes and to use the proceeds thereof to finance all or a portion of the cost of the acquisiton and construction of the Facilities and the cost of the Improvements by the Company.

Section 2. The Board of County Commissioners constitutes the governing body of the County and may provide for the approval of the issuance of Revenue Bonds by the County through the Chairman of the Board of County Commissioners.

Section 3. The project that shall be the subject of the public hearing consists of the construction of a Modular Gas Plant for the production of Methanol Gas to be located near Lisbon Valley in San Juan County, Utah; and is considering acquisiton of certain items of capital equipment to be located at the plant site (said equipment hereinafter referred to as the "Improvements"); and the cost of the construction of the facilities and the cost of the Improvements and expenses incidental thereto is estimated not to exceed $10/000/000.

Section 4. The issuance of the Revenue Bonds may be authorized by appropriate resolution or resolutions of the County after the conclusion of the public hearing thereon at a meeting or meetings to be held for such prupose, subject to the execution of appropriate aggrements by the company and the County.

Section 5. Pursuant to the requirements of Code Section 103 (k), the Board of County Commissioners hereby authorizes the public hearing in connection with the project described in Section 3 to be held in accordance with said Code Section 103 (k) on December 3, 1984, at the hour of 1;00 p.m. in the Board of County Commissioners Chambers for the purpose of considering the public benefits and public purposes to be furthered by the financing contemplated by the action of the County pursuant to this Resolution for the issuance of industrial development revenue bonds by the County pursuant to the Act. The public hearing shall be held at the hour and on the date herein provided for siad project. The Board of County Commissioners hereby authorizes and directs the Clerk of the County

to publish a notice of public hearing substantially in the form of the notice attached hereto as Exhibit "A" and incorporated herein by reference and made a part hereof for the poject described

in Section 3 by at least on (1) insertion in the San Juan Record at least fourteen (14) days prior to hearing date.

Section 6. The public hearing shall also consider the appointment of, and if deemed advisable, shall appoint an elected representative to approve the issuance of industrial development revenue bonds for the project.
