SAN JUAN COUNTY COMMISSION MEETING MINUTES

NOVEMBER 4, 1985

The San Juan County Commission met in regular session on November, 1985 at the hour of 10 a.m. at the San Juan County Courthouse, Monticello, Utah.

The following members were present: Commissioner Calvin Black, Chairman

Commissioner Kenneth Bailey

Commissioner Jerry Holliday

Minutes of the October 28, 1985 meeting were approved on the motion of Commissioner Holliday. The motion was seconded by Commissioner Bailey. UNANIMOUS

BEEF BASIN - ROBERT REDD

The Commissioners invited Robert Redd to meet with them to discuss the closing of the county road into Beef Basin. Commissioner Holliday feels that the road is in need of major construction, and that the county will have to close the road while repairs are made. Commissioner Black asked Mr.Redd if this would cause any problem since Mr. Redd runs his cows in Beef Basin. Mr. Redd said he is opposed to the county closing the road since he uses this road for access in and out of Beef Basin. The Commission informed Mr. Redd that they will notify him if they decide to close the road.

UNDC - TOLLY LAMEMAN

Tully Lamaman, Deputy Director of UNDC reported to the Commission that UNDC is having a Board of Directors meeting tomorrow. Mr. Lameman reported that UNDC is closing clinic services in Halchita and that the Indian Health Service have issued a contract to Monument Valley Hospital for the clinic services.-Mr. Lameman said that UNDC is encouraging everyone to use these facilities. UNDC is working on cross deputization for police officers in the area but there is a problem in that the State Police Academy will not recognize the Navajo Tribe's Academy because the course requirements are different. UNDC wants the state to work with them on these differences so that police officers in Montezuma Creek can be cross deputized. Commissioner Black said he will check this and see what he can do to help.

UNDC is trying to get the Navajo Farms along the San Juan River rehabilitated and the Navajo Tribe wants UNDC to manage the farms on a contract bases. The Navajo Tribe will help form a farm co-operative system to help improve the area.

EMERGENCY MEDICAL SERVICES

Rick Bailey, Administrative Assistant, reported that the Health Care Services was awarded a grant from Emergency Medical Services. $12,911 was given toward the purchase of a new ambulance, $4,500 for EMT Training and $4000 to Monument Valley hospital for a study grant.

FOREST SERVICE - DARK CANYON

Rick Bailey, Administrative Assistant attended the Forest Service field trip. The concern the Forest Service has, is that the trail into Dark Canyon Wilderness Areae is in bad shape and are open for suggestions. One suggestion was instead of fixing the road it be left the way it is and post it stating the condition must be traveled at own risk. The Forest Service wants to close the road to vehicles having a tread width of 48" or smaller, which eliminates motorcycles, three wheelers, etc. The Commissioners are opposed to this action, they feel that any vehicle should be allowed in as the road was designated by the Congress to be allowed and cherry stemed into the wilderness area. Rick Bailey, Administrative Assistant, will write a letter to the Forest Service on this matter and cover other items.

TED STAGG MEDICAL FACILITIES

Rick Bailey, Administrative Assistant contacted Ted Stagg, CPA developer for Nursing Home. Mr. Stagg has agreed to review and assist the Commissioners in evaluating the companies that submit proposals on San Juan's medical facilities. Commissioner Bailey asked Mr. Bailey to get in contact with the companies that were sent information to get a rough idea of who are interested in submitting a proposal.

COUNTY COURTHOUSE - Telephone system

Gail Johnson, County Clerk, reported that she received a letter from Mytel in Florida and was informed that they have distributor in Durango, Colorado. The letter states that Mytel offers training sessions in various places and would recommend a weeks training in order to certify a Mytel repairman.

LLOYD'S LAKE ROAD CONTRACT

Doug Pehrson, County Surveyor,Engineer reported on the road under contract to Lloyd's Lake, pointing out that the road does not adequate compaction in places with soft spots on the shoulders. Mr. Pehrson talked with the Commission about the problem and the Commission asked Mr. Pehrson to put the alleged deficiencies in writing and give to the contractor.

BLUFF -MOSQUITO CONTOL, ROADS, AIRPORT

The Commission met with Eugene Foushee from Bluff on the problem of mosquitos in the Bluff area. Mr. Fous-

hee is concerned that something needs be done now so that when summer comes the mosquito problem will be

under control. Commissioner Holliday and Mr. Ralph Home, District Supervisor for the Extension Service

were in Bluff recently and took samples from the ponds in the area. Commissioner Holliday said that

Mr. Ralph Horne would be willing to certify citizens of Bluff so that they can spray the stagnant ponds to

help defray the cost. The county may be able to furnish the chemicals.

Also of concern of Mr. Foushee was the road from Anneth to Cortez. Commissioner Black says they have been

working with Montezuma County on improving this road but the process has been slow.

Next issue discussed was the Bluff Airport concerning the proper way to put tie downs so the weeds can

still be cleared. Commissioner Holliday suggested spraying the weeds instead of clearing them which would

also be more permanent.

TENTATIVE BUDGET FOR 1986

Gail Johnson, County Clerk and John Fellmeth, Deputy Clerk/Auditor met with the Commissioners to go over the tentative budget for 1986. The Commissioners will meet with each department to go over their budgets. The Public Budget Hearing will be December 12, 1985 at 6:00 p.m.

BEEF BASIN ROAD

Commissioner Holliday said the county road that goes into Beef Basin is dangerous and needs to be closed for repair and maintenance purposes, because of hazardous curves,sliding rock, etc. Commissioner Holliday

made a motion to adopt a resolution that county road 104 be closed from November 8 to November 18 for major repairs. The voting was as follows:

Commissioner Black - in favor

Commissioner Holliday - in favor

Commissioner Bailey - opposed

Bruce Halliday,County Attorney was asked to outline in detail exactly what the road department needs to do on signs, notices, etc. and Doug Pehrson,County Surveyor will post the area. Notices will be put in The San Juan Record newspaper and broadcasted on the radio about the closing of the road.

JIM BLANKENAGEL EXTENSION OFFICE

Jim Blankenagel met with the Commissioners asking if they would write a letter of recommendation for him for the job of Extension Agent - Agriculture, Utah State University. Commissioner Black commented that if any individual commissioner would like to write a letter it would be appropiate. Mr. Blankenagel was also concerned about the qualifications required which is a minimim of an M.S. Degree, stating that he is working on his M.S. and will not receive it until next year. Commissioner Black said he will look into this to see if this qualification can be eliminated or worked around. The Commission indicated they strongly support a local person for the position if they are qualified, and also understand a B.S. is accepted in sane parts of the state for this job and is the Commissions recommendation that it be for San Juan Coutny area.

COUNTY JAIL

Anastasio Lopez and his wife Yolanda met with the commissioners regarding their property that the county wants to buy for the jail. Mr. Lopez has a family and said they use this property for a large garden.-Rick Bailey, Administrative Assistant commented that since it is such a small piece why not see if the architect could work around this area. Commissioner Bailey said that the county will have to meet with the architect to see if this will cause any problems. The Commissioners assured Mr. Lopez the matter will be further dicussed with him before a final decision is made.

UNDC - EQUIPMENT

Chuck Harrison, Utah Navajo Industries of UNDC met with the Commissioners to explain that in their educational division they are sponsoring a vocational education training program. UNDC's wants to train any interested people on heavy equipment so that more people in the area will be available for jobs. Mr.-Harrison asked the Commissioners if the county would be interested in helping train some of these people.-Commissioner Bailey commented that the road department's equipment is limited as well as their time but will look into it. The Commissioners suggested Mr. Harrison also talk to private operators.

HOSPITAL WATER PROBLEM

Commissioner Bailey reported that the watering at the San Juan Hospital is running thousands of gallons of water behind the Elementary School. Commissioner Bailey said the area is very swampy already, and this watering increases the problem. Commissioner Bailey will meet with Doug Pehrson,County Surveyor to see what can be done to correct this problem.

BLANDING LIBRARY

Gene Hacking, Blanding Librarian was honored for 23 years of service as librarian at Blanding. Commiss-ioner Bailey made a motion that Gene Hacking be put on the Library Board for a three year term which begins December 1, 1985. Commissioner Holliday seconded it. UNANIMOUS

NUCLEAR WASTE INFORMATION

Commissioner Bailey asked Carl Eismann,Nuclear Waste director if he would send any information he as on Nuclear Waste to the Blanding Library. Mr. Eismann said he would do this.

BLM ROCK PERMITS

Commissioner Bailey reported that the BLM does not want to give the county any more permits for rocks until those at Bugg Point are closed. Commissioner Bailey said that he will write a letter saying that the county will close the rock pits as soon as the project is finished.

BIA CONTRACT

Commissioner Bailey made the motion for approval of the Contracts with BIA Eastern District in the amount of $38,000 to the county for road maintenance. Commissioner Holliday seconded it. UNANIMOUS

MONTEZUMA CREEK BRIDGE - payment

Commissioner Bailey made the motion of the second payment on Montezuma Creek Bridge for $39,330.84. Commissioner Holliday seconded it. UNANIMOUS

LA SAL COUNTY ROAD

Commissioner Bailey received the following letter.

Commissioners;

I wish to go on public record protesting the closing of County Road 149 by Zane Chartrand for the follow-ing reasons;

l.My residence and business is located less that 1/2 mile down this road.

2.When Mr. Chartrand closes the road it forces us to detour at least five miles. 3.This road is part of the school bus route. 4.Mr. Chartrand uses a forklift to load trucks that completely park across the road. If parked parallel, one lane of traffic could be left open. This would cause Mr. Chartrand to drive his forklift only another 20 feet.

5.At times, employee vehicles are parked so close to the corner and far enough onto the roadway to obstruct the view when making a right hand turn on to road 149 causing a hazzard.

6.Other People who live and work on this road have been forced to turn around when they reach Mr. Cha-rtrand' s business and go to the turn around when they did not know when he was closing the road.

7.The fast "temporary" closing was October 26, 1985 and

lasted from 8:50 a.m. to 1:20 p.m. closings of this type

have been happening on and off for the last year.

8.There are times it is necessary to our business

that this road, not an alternate route be used. i.e. Oil

tanker trucks going to well location to load and

leave.

9.In the event of an emergency, time needed to reach

locations south of Mr. Chartrands would be increased

since no one ever knows until it happens that the road

is closed.

Since we have been assured by Mr. Chartrand that he has had official permission for the last year to close the road, I feel it is the Commission looked further into the problem and reconsider their approval.

Commissioner Bailey said that on the week October 21, 1985 Jack Kirby, chief deputy called him from La Sal saying that he had a complaint on a moving van blocking the road. Assuming that someone was moving, Commissioner Bailey felt that two or three hours would be allowed to finish loading the moving van. A couple days later, Commissioner Bailey received a phone call from Ralph Ramstetter, complaining about Commissioner Bailey giving Mr. Chartrand permission to block the road for the last year or so. Commiss-ioner Bailey replied that he only gave Mr. Chartrand permission for this one day only. Commissioner Bailey will have Merz Hugentobler and Dale Fuller from the road department go talk to Mr.Chartrand explaining the situation concerning this problem and also send him a letter.

DEPUTY RECORDER

A motion to approve a change in grade from Grade 1 to Grade 2 for Edna Rogers, Deputy Recorder was approved on the motion of Commissioner Bailey and seconded by Commissioner Halliday. UNANIMOUS.

RESCIND- BEEF BASIN ROAD

About 5 p.m. Mr. Mike Quailey from the Attorney Generals office called about the Commissioner's decision to close the road to Beef Basin. Mr. Quailey indicated it would seriouly interfere with a special hunt Wildlife Resources has set for the same time. After considerable discussion and based on a committment Mr. Dee Hansen, Director of Natural Resources had made with Commissioner Black and further assurances from Mr. Quailey that in the future San Juan County Commissioners and the public would be more involved in the process of determining and setting future hunts and management policy. A letter would be forthcoming confirming this based on the above information. Commissioner Holliday made a motion to rescind a previous decision to close the road for repairs at this time. Motion was seconded by Commissioner Bailey. UNANIMOUS

CANYONLANDS REGION TRAVEL COUNCIL

Commissioner Black reported that he attended the Canyonlands Region Travel Council meeting. There was a propsal for a Lake Powell brochure to bring traffic into Utah's Lake Powell from California and points east. Peggy Humphrey and Marion Eason were appointed to be representatives from our region to meet with other regions to work on a Southern Utah brochure.

BLUE CROSS/BLUE SHIELD

Conmissioner Black reported that county employees have had problems Blue Cross/Blue Shield. Rick Bailey,-Administrative Assistant will talk with Al Price,Representative of Blue Cross/Blue Shield to see what can be done to clear this.
