SAN JUAN COUNTY COMMISSION MINUTES August 4, 1986
The San Juan County Commission met in regular session on August 4, 1986 at the hour of 10 a.m. at the San Juan County Courthouse, Monticello, Utah.
The following members were present: Commissioner Calvin Black, Chairman
Commissioner Kenneth Bailey Commissioner Jerry Holliday
The Minutes of the July 28, 1986 Commission Meeting were read and approved on the motion of Commissioner Bailey; seconded by Commissioner Holliday. UNANIMOUS.
PERSONNEL POLICY - JIM HEATON
Mr. Jim Heaton, Weed and Rodent Control, met with the Commission regarding the Commission's concern of the hours Mr. Heaton has reported. The Commission reminded Mr. Heaton of the County's policy of no overtime. Mr. Heaton suggested that the Commission consider putting him on a salary basis of 40 hours a week. Motion was made by Commissioner Holliday to put Mr. Heaton on a salary basis beginning August 1, 1986. He would be at a Grade 6, Step 4 at a monthly salary of $1,086.00. Because Mr. Heaton is seasonal help, he would not qualify for regular benefits. The Motion was seconded by Commissioner Bailey. UNANIMOUS. The Hire Request Form for Mr. Heaton noting this change was approved and signed.
DISTRICT FIRE WARDEN - REGARDING GEORGE KENSLEY
Mr. Bruce Sillitoe, District Fire Warden, met with the Commission to discuss the reported abuse of the fire truck driven by George Kensley. Mr. Kensley has been reported driving this vehicle throughout the county. Mr. Sillitoe said he was not aware of this, but would check into the matter and report back to the Commission. The Commission suggested that a mileage report be filled out each day by Mr. Kensley.
PERSONNEL DEPARTMENT - HIRE REQUEST - ROAD DEPARTMENT
The Hire Request Forms for the road department were discussed by the Commission and approved as follows:
Todd M. Hurst at $7.06 Clark M. Grover at $7.06
Boyd J. Laws at $7.06 Wanda R. Franklin at $965.00 a month Robert M. Pugh at $5.12 Kurt J. Dean at $5.12
It was decided that Hurst, Grover, and Laws would all start at the same rate of pay and the change on Hurst and Laws' rate of pay would be reflected on next month's checks.
PERSONNEL DEPARTMENT - HIRE REQUEST - COUNTY ASSESSOR'S DEPARTMENT
Motion was made by Commissioner Holliday for the approval for the hiring of a new employee to take the place of Kathy Simpson in the County Assessor's Office. The Motion was seconded by Commissioner Bailey. UNANIMOUS.
COUNTY ASSESSOR - ASSESSING & COLLECTING
Gail Johnson, County Clerk/Auditor, met with the Commission to get their feelings on charging a 25% of direct costs on assessing and collecting this year. The Commissioners felt that this should be charged for 1986 as that was the plan agreed to by all parties. Commissioner Bailey requested Mrs. Johnson obtain a letter from Brent Gardner of Utah Association of Counties, stating the policy other counties have adopted with regard to charging a fee this year. Mrs. Johnson said she would do this.
COUNTY POLICY - PROCUREMENT & PURCHASING
It was brought to the attention of the Commission that a time clock had been purchased by the Recorder's Office without the approval of the Commission. Mary Lou Mosher, County Recorder, represented to the Commission that bids had been received and because it was imperative that she have this equipment in her office immediately, she ordered the time clock from Salt Lake Stamp was the ad immediately availability. Her reason for ordering from Salt Lake Stamp was the availability and quick maintenance. Mrs. Mosher said that in the future, when at all possible, she would get prior approval before ordering equipment.
COUNTY CLERK'S OFFICE - ELECTIONS PROCEDURE
Gail Johnson requested the Commission make the official appointment of Emily Begay as the new registration agent for Bluff. Motion for the approval was made by Commissioner Bailey and seconded by Commissioner Holliday. UNANIMOUS.
Mrs. Johnson presented a list of JUDGES AND INTERPRETERS to be used in the election to the Commission for their approval. They will be paid $45 per day. After reviewing the list, Motion was made by Commissioner Bailey for the approval of the Judges and Interpreters and seconded by Commissioner Holliday. UNANIMOUS.
COMMUNICATIONS - COURTHOUSE TELEPHONE SYSTEM
Mrs. Gail Johnson, County Clerk/Auditor, reported to the Commission that the representative of the Mae Systems should be here this weekend to make the necessary changes. She also said that if the Mae Systems falls through, then there is a company out of Price we can contact.
HEALTH CARE SERVICES - SAN JUAN COUNTY HOSPITAL RN SHORTAGE
Mrs. Marilee Bailey, Acting Director of Nurses and Quality Assurance Coordinator, met with the Commission regarding the RN shortage at San Juan Hospital. Mrs. Bailey presented a Wage and Salary Survey and a comparison to San Juan County, and suggested some possible solutions:
1. That the County encourage local residents to take a RN training course out of Farmington. The County would help subsidize the expense in turn for a contract of a certain period of time.
2. There is the possibility of an alternate pay scale, wherein an employee could receive a higher hourly rate of pay without benefits.
3. There is the possibility of getting contractual help at the rate of $18.75 per hour. This type of help is usually very temporary.
4. The hospital could offer a differential for shift work.
Commissioner Bailey suggested another possibility would be to start an RN at a higher rate and forego the probationary increase. Rick Bailey, Administrative Assistant will compute the possibilities and have

these figures ready for the Commission to make a decision on August 20, 1986.
Mrs. Bailey also recommended to the Commission that they recruit a full-time professional for the position
of Director of Nurses and Quality Assurance Coordinator. Mrs. Bailey said she is presently filling this
position, but didn't have the time or desire to continue in this capacity; that she is a part-time employee, and this position requires someone on a full time basis.
PROPOSED NEW JAIL FACILITY
Rick Baileyf Administrative Assistant, reported that the Impact Board will be meeting this Thursday at 10:30 a.m. The Commissioners, Rick Bailey, Sheriff Wright and John Peterson will attend.
ROAD DEPARTMENT - EQUIPMENT
Commissioner Bailey reported that in each district UDOT has been furnished with a dual drum and vibrating roller. It has been observed this improves efficiency and production by at least three to four times. Commissioner Bailey will check into the availability and costs.
DEMOLITION FOR BUILDINGS ON NEW JAIL FACILITY SITE - BID OPENING

Bids were received for the demolition of the Fred Jensen home, the storage shed of the Fred Jensen home, and the Paul Strong Home. The following bids were received:

After considering the bids, Motion was made by Commissioner Bailey to award the bid to Blake Enterprises and the Motion was seconded by Commissioner Holliday. UNANIMOUS. Rick Bailey, Administrative Assistant, will issue a formal letter to proceed after the County has received an insurance certificate from Blake Enterprises in the amount of $300,000. The Clerk will notify the bidders of the decision of the Commission.
PROPERTY TAX - MURPHY MINING COMPANY
Commissioner Black reported that Murphy Mining Company has ore and equipment at the mine which has delinquent taxes. They maybe moving the ore and equipment out. They were supposed to send Commissioner Black a copy of reports for the last three years; these reports, as of this date, have not been received. The Commissioners suggested to Barbara Montella, County Assessor, that she work with the county attorney and treasurer to place a lien on the equipment and ore.
UTAH STATE TAX COMMISSION - Evidence of Sale Price
The following letter was received from J. Mike Monson, Director, Property Tax Division:

RE: Evidence of Sale Price
Numerous inquiries have been received from taxpayers who claim to have been told that the market (sales) price cannot be used as the basis for assessing personalty for which the Tax Commission has provided a valuation schedule.
The Tax Commission has not mandated the use of any schedule in preference to the verified "arms length" purchase price actually paid for personalty. When presented with proof of an open market sale at the retail trade level, that purchase price may be used by the county assessor or the County Board of Equalization as the basis for assessment of the property.
This does not mean that the Board of Equalization or the County Assessor must accept a bill of sale, or other document showing the actual sales price, as proof of market value. An individual sale may not be representative of market value.
The commission wishes to stress that the purchase price or other evidence obtained from the market may be used as the basis for assessment of personal property in lieu of the recommended schedules.
The Deputy Clerk will post this notice on the Courthouse Bulletin Board and make a copy for the County Assessor.
COUNTY-WIDE RECREATION DEPARTMENT — Supplies Request
Mr. Eddie Allred submitted a request for approval of purchase of PVC pipe along with the two bids he received - one from Conely Company in the amount of $571.20 and one from Jarmon Irrigation in the amount of $495.60. Motion to approve the purchase and award the bid to Jarmon Irrigation was made by Commissioner Holliday. The Motion was seconded by Commissioner Bailey. UNANIMOUS.
DIVISION OF AGING - Equipment Request
Mr. Rick Bailey, submitted two bids for two vacuum cleaners for the Senior Citizens Centers to the Commission and requested approval to purchase same. After reviewing the bidsf Commissioner Holliday made the motion to approve the purchase of the Hoover vacuum cleaner and the motion was seconded by Commissioner Bailey. UNANIMOUS.
COUNTY TRAVEL POLICY - Direct Bill Hotel/Motels
Rick Bailey, Administrative Assistant, presented a list of hotels and motels throughout the state along with rates which will bill the county direct.
WILDERNESS - PROPOSED RESOLUTION
Commissioner Black presented the following proposed resolution which he is going to submit to the Moab BLM District Advisory Council for their consideration.
RESOLUTION ON WILDERNESS
A RESOLUTION OF THE MOAB DISTRICT BUREAU OF LAND MANAGEMENT (BLM) ADVISORY COUNSEL OPPOSING ANY FURTHER DESIGNATION OF WILDERNESS AREAS IN UTAH; AND ASKING CONGRESS TO MODIFY THE FEDERAL LAND MANAGEMENT POLICY ACT.
WHEREAS, the BLM embarked in 1978 on a study of 20 million acres administered by the Utah Bureau of Land Management to determine if these areas should be designated as wilderness areas as required by law;
WHEREAS, the BLM's draft environmental impact statement (DEIS) lists seven alternatives, six of which recommended designating new wilderness areas in the state;
WHEREAS, the BLM has proposed as its preferred alternative that 54 of the 82 areas studied, representing 1.9 million acres be designated as wilderness areas;
WHEREAS, the BLM's preferred alternative would hamper economic development in Utah and preclude economic vitality by withdrawing almost two million acres of land from multiple use sustained yield;
WHEREAS, Utah Already has a vast amount of land in its five national parks, five national monuments, two national recreation areas, Department of Defense bombing and gunnery ranges and forest service wilderness which compromises 3,756,148 acres and which is 10 3/4 per cent of the total federal land in the State f Utah and is already designated as single use areas and cannot be developed or follow the multiple use concept;
WHEREAS, the reserved water right decision rendered in the Colorado district court mandates a reserved water right to any designated wilderness area, thereby jeopardizing water rights on other public lands and on privately held property if new wilderness areas are designated;
WHEREAS, by designating these wilderness,s the state will be unable to service these lands, fight fires, develop water for wildlife and livestock, range reclamation and reseeding, or build roads to make these areas accessible to tourists or industry;
WHEREAS, utility lines and pipelines to service vast areas of Utah cannot be build economical if these lands are designated as wilderness;
WHEREAS, the BLM's DEIS does not reflect the most current, state-of-the-art energy and mineral data provided to the BLM by industry over the last several years, meaning that minerals evaluation and assessment information within the statement is insufficient for determining the mineral potential of the wilderness study areas;
WHEREAS, the DEIS indicates that approximately 50% of the potential oil and gas
resources in the wilderness study areas, and 40% to 50% of the locatable minerals
would be forever lost to the state, which loss would adversely impact mineral and
energy production in an area of the state that desperately needs new development;
WHEREAS, revenues from developable natural resources in the proposed wilderness areas will be lost, thus denying much-needed revenue that could help pay for the education of our children, the state's most precious resource;
WHEREAS, local economies are delicately crafted and balanced by wise use of available natural resources and respect for the land;
WHEREAS, local and state economies are heavily dependent and necessarily protected under multiple use sustained yield;
WHEREAS, scenic, aesthetic, cultural and other values can be protected under current law without wilderness designation;
NOW, THEREFORE, BE IT RESOLVED that the Moab District BLM Advisory Council is opposed to any further designation of wilderness in Utah.
BE IT FURTHER RESOLVED that the Moab District BLM Advisory Council strongly disagrees with the Colorado District Court decision rendered in Sierra Club vs. Block (the so-called reserved water right decision), as being counter to the interests f Utah and its citizens.
BE IT FURTHER RESOLVED that Moab District BLM Advisory Council urges Congress to modify the Federal Land Management Policy Act to exclude any state with greater than 30% federal ownership from the provisions of the 1964 Wilderness Act.
BE IT FURTHER RESOLVED that a copy of this resolution be prepared and sent to the director of the State Bureau of Land Management, the director of the Federal Bureau of
Land Management, the members of Utah's congressional delegation, the President of the United States Senatef the Speaker of the United State House of Representatives, and the chairmen of the United States House Senate Interior Committees, and the Chairman of the United States Senate Committee on Energy and Natural Resources.

COUNTY PERSONNEL POLICY - OVERTIME/COMP TINE
The present policy on comp time was discussed along with the possibility of increasing the accumulated hours. It was decided that no change was necessary at this time.
SHERIFF'S OFFICE - PHIL BOLDUC GRIEVANCE LETTER
The Commission received a grievance letter from Deputy Phil Bolduc against Sheriff Rigby Right. Rick Bailey, Administrative Assistant, will discuss this matter with Bruce Halliday, County Attorney, and arrange for a hearing with a merit board. This matter is tabled for next week.
COMMUNITY NURSING SERVICE - LEASE ON VEHICLE
Rick Bailey, Administrative Assistant, reported that he has sent the vehicle lease to the Community Nursing Service for their approval. They have indicated concern regarding the portion that places the responsibility of on-going maintenance on them. They would like "on-going maintenance" more clearly defined. Also, since that vehicle would still be under county ownership, could that maintenance be provided at their cost through the County Road Shed? Commissioner Bailey said on-going maintenance provides for normal wear and tear; all gas, oil, tires. Commissioner Black said he would like a general description of the vehicle; the present general condition, etc., at the time it is leased. The Commission said they would be willing to give them an Option to Purchase at the end of the lease.
COMMUNITY NURSING SERVICE - EQUIPMENT
Rick Bailey reported that the Community Nursing Service would like to purchase the equipment in three monthly payments. The Commission agreed to this payment arrangement.
SECONDARY WATER SYSTEM - STATEMENT FROM KEN BAILEY
Commissioner Bailey issued the following statement regarding the Secondary Water System being implemented in Monticello:
1. The County is not going to get in the middle of any arguments between the contractor, the City, the engineers, or the testing laboratory.
2. The County Engineer, Doug Pehrson, in accordance with the Agreement between the City of Monticello and San Juan County will accept all tests run to date by Lambert Engineers and San Juan County.
3. San Juan County will run random density tests at various depths throughout the project. Testing by San Juan County will be performed as weather and work schedules permit.
4. Any area not meeting the 95% density test will result in that block of city street being deleted from the cooperative agreement.
HALLS CROSSING AIRPORT
Commissioner Bailey reported that he received information from Monte Yeager on the Halls Crossing Airport area giving wind directions and speed. Commissioner Bailey said the report was very comprehensive and they are doing a excellent job.
ROAD DEPARTMENT - RIGHT-OF-WAYS (BIA & Reservation Roads)
Commissioner Bailey reported that the right-of-ways the County is working with the BIA on getting for Reservation roads will be accomplished through a cooperative arrangement between the BIA and the County Engineer. They will survey the existing roads and the County will survey all the areas that the roads are being realigned.
ROAD DEPARTMENT - PERKINS ROAD
Commissioner Bailey reported that he has received the archeologist report on the Perkins Road. An application for right-of-way will be submitted to the BLM.
