NOVEMBER 3, 1986

The San Juan County Commission met in regular session on November 3, 1986 at the hour of 10 a.m. at the San Juan County Courthouse, Monticello, Utah.

The following members were present: Commissioner Black, Chairman

Commissioner Bailey Commissioner Holliday

Minutes of the October 27, 1986 Commission meeting were approved with the corrections on the motion of Commissioner Holliday and seconded by Commissioner Bailey. UNANIMOUS.

EASTLAND COMMUNITY WELL - ROAD ACCESS

Billy Richardson, representing the Eastland community, met with the Commission to discuss the county road department upgrading a road for access to the new well on Travis Johnson's land. The Commission agreed that since it is a public water facility and Eastland paid for the well the county would participate in the road improvement. Commissioner Bailey made the motion for that the county upgrade and rock this road and Commissioner Holliday seconded the motion. UNANIMOUS.

The Commission will have Bruce Halliday, county attorney, draft the right of way agreement between the county and Mr. Johnson and will have Doug Pehrson, county engineer, supply the description and design for the road.

FIRE WARDEN - END OF FIRE SEASON

George Kensley, fire warden, met with the Commission to give an end of the year fire report. Mr. Kensley said there were three fires last week; one, a police car at Devil's Canyon; two, an arson fire at Pack Creek Ranch; and three, a fire on upper Deer Flat. The county responded to approximately 70 fires this season with a fire loss of about $150,000 and the combined state and county fire suppressant cost may run over $32,000. Mr. Kensley said he will have fire training during the winter months.

RECORDER'S OFFICE - OLIVIA BLAKE - FULL TIME

Mary Lou Mosher, Recorder, met with the Commission to ask that Olivia Blake, who is now a permanent part-time employee, be approved as a full-time employee. Mrs. Mosher said the work load in her office has increased and Mrs. Blake is needed. The Commission said that in the future the county will have to look at a rotating secretary agreement between all the offices in the courthouse. Commissioner Bailey made the motion to approve Olivia Blake as a full-time employee. Commissioner Holliday seconded the motion. UNANIMOUS.

COPY MACHINE - IBM

Mary Lou Mosher, Recorder, gave the Commission a proposal from IBM on a new copy machine for the courthouse. IBM will give the county a trade in and also a government discount which will amount to about $12,000 off the machine. The county has owned the present copy machine for four years. The Commission told Mrs. Mosher to get at least one more bid.

HALLS CROSSING AIRPORT - Consulting team

The following letter was received from Buzz Hunt, Phase II, concerning the Halls Crossing Airport.

Dear Commissioners Black, Bailey and Holliday:

Thank you for your letter of October 4, informing the consulting team of your concern about timely completion of the Halls Crossing Airport Master Plan.

We appreciate your patience, and realize that we have gone three months beyond our estimated time frame for completion.

Every effort will be made to complete the remaining work tasks and to submit a draft copy of the final report for your review by November 20, 1986. We will also prepare appropriate grant applications for construction funding and submit them to you for your approval on that date. Upon approval, we will submit the applications and draft final report to the FAA and UDOT.

We sincerely apologize for the length of time it has taken to complete this project. We also understand that out commitment to complete this project in a short period of time was an integral of your decision to select our consulting team. We are disappointed that we have failed to meet our initial schedule; however, we believe we can submit a draft final report and funding applications to you by November 20.

In terms of time delays, our biggest source of difficulty was in site selection. Available data were not adequate, and unfortunately, our first survey uncovered problems with the initial alignment of site 2 ( the site where UDOT's wind-monitoring station is located). In addition, even after our second survey and re-alignment of site 2, we perceived potential disagreements over which of the two sites (site 1 is nearest to the lake and just south of the Halls Crossing Village) should be preferred. We have discussed these issues with UDOT planners, Division of Aeronautics and FAA. Although these discussions and additional work caused serious time delays, we believe that we have ultimately identified a site that is best justified in terms of data and will be supported by all parties concerned.

I am enclosing a recent letter from UDOT to FAA which summarizes many of the conclusions reached in site selection. In addition to those contained in the letter, we also have preliminary cost estimates of the two sites. While these numbers are preliminary and will be further refined, site 2 appears to be the least-cost site. Total costs for tie-down apron, runway, taxiway, access road, vehicle parking and terminal building are estimated (preliminary) at $1.680,600, and are some $40,000 less than estimated costs for site 1.

We are now in the process of finalizing master plan components (airport lay-out plan, etc.) and are approximately mid-way in the environmental assessment. The last major work task is the financing plan which will be completed quickly upon refinements and finalizing of cost estimates.

Again, the entire consulting team sincerely apologizes for going beyond our scheduled time frame, and appreciates your patience with this project. We believe we will have a quality product to you by the time

you have requested. We have also discussed funding availability with UDOT and FAA, and believe that the Halls Crossing airport remains a high priority and will receive funding for construction.

SAN JUAN WATER CONSERVANCY DISTRICT BOARD MEMBERS

The Commission will appoint the new members to the San Juan Water Conservancy District Board at the December 22, 1986 Commission meeting.

NANCY PATTERSON ARCHEOLOGICAL SITE

The following letter was sent by the Commission concerning the Nancy Patterson archeological site:

Dear Senator Garn:

The San Juan County Commission has received a letter from Mr. Joel Janetske and a copy of a letter from Superintendent Hyden of Mesa Verde National Park requesting support for designation of the Nancy Patterson Archeological site as a National Monument.

After consideration, the San Juan County Commission would support such a designation subject to the following conditions:

1. That it never exceeds 100 acres.

2. That the law be written so as to prohibit the National Monument from precluding any activity outside the boundaries of the Monument.

3. That Mr. Evans either donates his private property or that not more than $40,000 be paid for the property.

4. That any artifacts removed be displayed at the site or the Edge of the Cedar Park in Blanding and that no artifacts leave San Juan County.

5. That Hovenweep, National Bridges, the Needles Section of Canyonlands National Park and the proposed Nancy Patterson Monument be operated and managed from an office in San Juan County.

The following letter was received from Congressman Howard C. Nielson:

Dear Cal:

Thank you for your letter regarding the Nancy Patterson Archeological site.

I have reviewed the conditions, which the San Juan County Commission has outlined for the designation, and I feel that I can strongly support conditions 1, 2 and 3. In my opinion, these three provisions are in the best interest of the residents in San Juan County.

I am concerned, however, with conditions 4 and 5. In regard to #4, I feel that it's somewhat unreasonable and it would be difficult for the Federal Government to agree to. I also feel that such a requirement would prohibit the artifacts from being displayed at a number of locations both in and out of Utah on a temporary basis. And, I'm confused as to why condition 5 would make sense from a public policy stand point. I would greatly appreciate an in-depth explanation about this and how I could justify taking such a position.

In closing, I want you to know that I support many of your conditions, however, I would appreciate further explanation of numbers 4 and 5.

Again, thank you for writing. I appreciate your good work and I look forward to hearing from you again.

LAKE POWELL - RANGER - DIVISION OP STATE PARKS & RECREATION

The Commission received the following letter from John Straus, Division of Parks & Recreation Ranger:

Dear County Commissioners:

The State of Utah, Division of Parks & Recreation has recently replaced the Utah Boating Office position at Lake Powell. This position is being filled by a Utah Division of Parks & Recreation Boating Ranger working out of the Wahweap Marina area. As a State Law Enforcement Officer, I, John Straus will be enforcing State Boating Regulations, Wildlife Resources Regulations, and other miscellaneous offenses within your county. I feel the high number of out-of-state contacts which will require citations, could be a problem for your county and our Division if we fail to collect a performance bond for the offense.

I would, therefore, like to request permission to be a Bail Bondsman in your county. I will have insurance coverage for this activity through the Utah Insurance Company "Risk Management". Risk Management will provide you with a performance endorsement if I can work within your system.

I would like to present the following explanation of how this performance bond would be explained to the defendant and then routed through your county system.

1. An individual will be stopped and talked to about a violation. I will make a determination as to whether a written citation, written warning, or oral warning will be executed to deal with the severity of the offense.

2. If the defendant has domicile out of Utah, I will explain the following:

(a). Due to the individuals present address being out-of-state, I am going to request he/she post a performance with me which will be held with the specific court for a certain amount of time. I will explain that this is not a plea and that a trial date can be set concerning the offense but that the performance bond, according to uniform bail schedule, will be forfeited if no contact is made with the court in the time specified.

(b) . I will note on the defendants citation the amount of the performance bond collected and provide them with a separate receipt of the performance bond as well.

(c) . I will make out a separate postal money order made out to y our county on the next most convenient work day for the exact amount of the performance bond. A magistrates copy of the citation with a separate receipt and a postal check will be sent to your justice clerk.

(d) . I will also attempt to use a separate bank money pouch for cash deposits so no money is on my person.

(e) . I will also show the defendant a State Identification Card and a copy of my bail bond authority (if granted) when requested or questioned by the defendant.

This system is lengthy, but I feel it provides the defendant with adequate knowledge of my authority and assurance of where their money is going.

The Commission will set up a meeting with Mr. Straus, the Sheriff, and the County Attorney to determine if the county should grant this request.

UAC - APPRAISAL TRUST

There will be an UAC Appraisal Trust meeting this week on Friday, November 7 and Barbara Montella, Assessor, said she is planning to attend this meeting. Mrs. Montella said she budgeted $12,000 for the 1987 county's reappraisal and is also putting together a sales-ratio study starting next year. The Commission suggested that she use local appraisers and also use the bank's appraisals to save money and

also have a comparison to validate the assessor's appraisals.

LOCAL SALES & DSE TAX AGREEMENT

Bruce Halliday, county attorney, met with the Commission to discuss the memo from UAC concerning Salt Lake County Amendments to the Proposed Agreement between counties and the State Tax Commission regarding sales and use taxes. The county does not have a business license ordinance, but the county could amend this agreement to simply provide that anybody with a sales and use tax number be put on the sales tax report each quarter. The Commission suggested that any business in the county with a state sales tax license number be reported to the county or the city in which it is located. Mr. Halliday will follow up on this with Brent Gardner, UAC, and the State Tax Commission.

SHERIFF'S OFFICE - INSURANCE CLAIM

The Commission asked Bruce Halliday, county attorney, about the insurance claim from Brenham Express concerning the incident on July 9 when the City of Monticello and San Juan County set up a roadblock to stop a high speed chase. Mr. Halliday said he will check the accident reports and the evidence to verify the facts of the matter and follow up on this.

PUBLIC SAFETY BUILDING - ROAD RESOLUTION

Rick Bailey, Administrative Assistant, told the Commission the county needs to approve a bond resolution (for the grant money from the State Community Impact Board) for the Public Safety Building. The County needs to designate a bank as the depository and a separate account and also name an escrow agent. The Commission agreed to move fast on this agreement and will have the county attorney look at it.

MAX DALTON - LONG CANYON POINT - ROAD

Max Dalton met with the Commission to discuss a road on his private land at Long Canyon Point. Mr. Dalton said the road is about 30 years old and considers it a private road and wants to know what he can do to close it. This road is not the only access to public land and when the public does use it they damage the land and disturb the cattle. Mr. Dalton said the main problem is around deer season and this year he was ordered to open his locked gate by the sheriff's office. The Commission told him to get all the historic information on this road, put it in writing and to work with the county attorney and submit such information to the Commission for review.

COMMUNICATIONS - SHERIFF'S DISPATCH

Bill Bayles, communication engineer, met with the Commission to report that the transmissions from the Colorado Montrose County's Sheriff's dispatch and mobile units are interfering with the county's signal from the sheriff's office. Mr. Bayles said he will work with Montrose county on this problem and report it to the FCC.

MONTEZUMA CREEK SCHOOL - ALARM

Rick Bailey said that UNDC wants to know if the county would like to participate in a security alarm system at the old school in Montezuma Creek. (The county leases part of the school for storing the ambulance and fire truck.) The Commission told Mr. Bailey to find out what kind of system it is and how much the cost will be.

AGING DEPARTMENT

Rick Bailey, Aging Director, said he is meeting with Bruce Shumway, Social Services, tomorrow to discuss the aging department recommendations and will have a final report next week.

FIRE PROTECTION AGREEMENT

Rick Bailey gave the Commission a sample agreement of the Wildland Fire Protection Agreement between San Juan County and the Utah State Forester.

UTAH STATE RETIREMENT BOARD

The county will be holding a public hearing for all county employees concerning the Utah State Retirement Noncontributory Retirement System on November 5 at 6:30 p.m. in the Commissioner's room. The Commission will be meeting with the representative Bonnie Sweat prior to the meeting.

BLM DRAFT RESOURCE MANAGEMENT STATEMENT FOR THE SAN JUAN RESOURCE AREA

The Commission sent a letter to Mr. Ed Sherick, San Juan Resource Area Manager of the BLM, with their comments on the draft resource management plan/environmental impact statement for the San Juan Resource Area.

NATIONAL BLM ADVISORY COUNCIL

Commissioner Black asked the Commission to support his re-appointment to the BLM National Public Lands Advisory Council. Commissioner Bailey said he would write a letter supporting the appointment of Calvin Black.

SPECIAL SERVICES for DISADVANTAGED STUDENTS program - San Juan Center

The Commission wrote a letter to Dr. Michael Peterson, President of College of Eastern Utah, supporting the application for continuation of the Special Services for Disadvantaged Students program at the San Juan Campus.

HOSPITAL ADMINISTRATOR AGREEMENT

John Fellmeth, hospital administrator, met with the Commission with a draft employee agreement for the hospital administration position. The Commission will review it and approve it at the next health care meeting.

BOOKMOBILE - STATE LIBRARY DIVISION

Commissioner Bailey made the motion to approve $25,874.00 for the State Library Bookmobile and authorized Commissioner Black to sign the Letter of Intent. Commissioner Holliday seconded the motion. UNANIMOUS. The San Juan School District will participate by paying $4000.00 to t he county.

CONSORTIUM BOARD

Commission Halliday will be attending the Consortium Meeting on Wednesday at 1 p.m. and will give a report next week.

BRADY & TAYLOR - AUDITORS

Duane Taylor, CPA, met with the Commission to discuss the 1985 audit report. Mr. Taylor said that the revenue for 1985 decreased by $573,000 when compared to the general fund of 1984 which was due to the fall of property taxes of $439,800. The county's expenditures also increased $378,000 during this time.

COCONINO COUNTY BOARD - IMPROVED COMMUNICATION COOPERATION - NAVAJO NATION

The Commission received a letter from Coconino County Board of Supervisors inviting them to a meeting on Friday November 14 in Flagstaff. The meeting is to discuss improved communication and cooperation of the Navajo Nation. The meeting will start at 10:00 a.m. for all county supervisors in the four-state area. Commissioner Holliday said he will try to attend this meeting.

NAVAJO MOUNTAIN - ROAD

Commissioner Bailey reported that he, Doug Pehrson, engineer, and crew are going to Navajo Mountain this Friday to begin a survey for the Navajo Mountain to Oljato road off Pauite Mesa.

PUBLIC SAFETY BUILDING - ARCHITECT

Commissioner Bailey said that Dana Larson Roubal and Associates, architect and engineers, billed the

county $53,500 for the first phase of completed work done on the public safety building. The four stages

are: the Schematic Design Phase which is 25%, the Design Development Phase 20%, the Construction Documents Phase 35%, and the Bidding or negotiation phase and construction phase which is 20%. Rick

Bailey said there is an advantage if the county pays this out of this year's budget, then the Sheriff can use it for Federal Task Force matching funds.

DR. CARROLL GOON - RECEPTION

There will be a reception for 30 years of service for Dr. Carroll Goon at the Monticello Library on November 15 from 2 to 5 p.m.
