MINUTES OF THE BOARD OF COUNTY COMMISSIONERS' MEETING HELD IN REGULAR SESSION ON MONDAY, THE 3rd DAY OF FEBRUARY, 1975

PRESENT: Calvin Black, Chairman Case D. Broderick, Member Edward S. Boyle, Member Clytie Barber, Clerk

Meeting opened at 10:20 O'clock A. M. with Chairman Black presiding.

Minutes of the previous meeting were read and approved. Motion for approval was made by Commissioner

Broderick, seconded by Commissioner Boyle and carried unanimously.

LEASE TO LARRY SHUMWAY TO BE MODIFIED

Lease on Mr. Shumway of Spanish Valley met with the Commission to request changes in the Mining claims he had

previously signed with the County.

Mr. Shumway desired a longer period of time than two years and also a renewal option. The Commissioners have no objections to either of these provisions or both. Attorney Bennion Redd will prepare an Amendment to the lease.

REPAIRES IN T. & E OFFICE DISCUSSED

Grant Leavitt advised the Commissioners of the paint peeling off in the Tourist & Publicity office. He was given permission to proceed with painting the wall- possibly an off-white tone.

GRAND COUNTY'S SHARE OF EXTENSION SECRETARY'S SALARY DISCUSSED.

Payment from Grand County was received, but was shorted in the amount of $188.01.

The Clerk was instructed to contact Grand County and find out the reason. She was also instructed to

forward the check from San Juan County in payment of road maintenance work performed by Grand County on

San Juan County roads adjacent to Grnnd County line. This has been completed.

In discussing the matter with Allen Edwards, Extension Agent, it was determined that Grand County's

budget was depleted and payment should be forth coming on the amount due from 1974.

COMMUNICATIONS SITE ON BALD MESA REQUESTED FOR COUNTY EMERGENCY SERVICES

The Special Use application was signed by the Commission and Albert R. Haskins, Director of Emergency Services.

HUMANE SOCIETY SENDS NOTICE

A document entitled "Special Notice" was received by the Commission giving notice of restriction or placement on any animal under its control. (?)

NAVAJO CHAPTER LETTER RECEIVED

An unsigned letter from the Navajo Chapter was received by the Commission. Said letter related to seating of Navajos on the Association of Governments council. Commissioner Black will respond to this letter.

UTAH EMULSIONS SUBMIT PRICE SCHEDULES

DIVISION OF FAMILY SERVICES PROPOSES ALCOHOL & DRUG STUDY, ETC.

Bruce Shumway requested a letter of support from the County Commission on this proposed study and

schooling. (or treatment)

The Commission will respond with the requested letter.

SPEED PROFILE STUDY TO BE CONDUCTED IN VARIOUS AREAS OF COUNTY

Notice was received from James L. Deaton, District Engineer, that a speed profile study is requested in Mexican Hat, La Sal and Aneth. Also, evaluation of the flasher in Mexican Hat is requested.

COLLECTOR ROAD #427 - PLANS REVIEWED.

This letter, addressed to Donald V. Blake, Surveyor, and by copy to Commissioner Black, stated that the

District office had reviewed the plans on the Ucolo Road project and indicated corrections necessary to

these plans to the design stage for a plan in hand inspection.

Mr. Albert Spenski, District Materials Engineer also reviewed the soil profile in the plans. It is

recommended that a modified bituminous surface course and gravel base course specifications be written

and that the project be advertised to contract withour an optional material source indicated.

Minor suggestions are penciled in on the soil profile.

ORDINANCE GRANTING FRANCHISE

Ordinance No. 1974-1 has been accepted in all required respects: publication and acceptance is completed.

ORDINANCE NO. 1974-1

GRANTING TO UTAH GAS SERVICE COMPANY, A UTAH CORPORATION, ITS SUCCESSORS OR ASSIGNS, A FRANCHISE FOR THE CONSTRUCTION AND OPERATION OF A GAS DISTRIBUTION SYSTEM IN SAN JUAN COUNTY, STATE OF UTAH, FOR A TERM OF FIFTY YEARS, AND FIXING AND PRESCRIBING CONDITIONS AND TERMS THEREOF.

THE BOARD OF COUNTY COMMISSIONERS OF THE COUNTY OF SAN JUAN ORDAINS AS FOLLOWS:

SECTION 1, That there is hereby granted to UTAH GAS SERVICE COMPANY, its successors and assigns, hereinafter called, "the grantee", the right, privilege, and franchise, for the period of fifty (50) years from and after the passage of this Ordinance, to lay, construct, operate and maintain gas mains, service pipes and lines, curb boxes and other necessary attachments and appliances in the present and future roads, highways, streets, alleys, lanes and other public places in the County of San Juan over which the Board of

County Commissioners has jurisdiction, for the purpose of conveying, distributing, supplying and selling gas to said county, the inhabitants thereof and property owners and users therein, and to persons and corporations beyond the boundaries thereof, for all useful purposes.

SECTION 2. That all mains, service pipes and lines shall be so laid as to interfere as little as possible with traffic. Grantee, its successors and assigns shall lay and construct all gas mains and pipes under this grant with dispatch in accordance with established practices with respect to gas line construction, and so as not to unnecessarily interfere with water pipes or other pipes which may have been previously laid in said roads, highways, streets, alleys, lanes and other public places, having regard to the safety and con-venience of said county and its citizens. The location of mains, service pipes and lines may be fixed under the supervision of the governing authorities of San Juan County.

SECTION 3. That all roads, highways, streets, alleys, lanes and public places that may be

opened by the grantee for the aforesaid purposes shall be filled in and put in as good repair as they were

prior to the opening thereof and so as to present the least possible obstruction and inconvenience to the travelling public.

SECTION 4. That permission is hereby granted unto the said Utah Gas Service Company, its successors or assigns, to assign this franchise and all rights hereunder and upon assignment of this franchise in accordance herewith, said successors or assigns, whether individuals or corporations, shall become entitled to all the rights and privileges herein granted and shall assume all the obligations and duties herein provided.

SECTION _5. That said county shall in no way be liable or responsible for any accident or damage that may occur in the construction, operation or maintenance by the grantee of its pipe lines and appurtenances hereunder, and the acceptance of this franchise shall be deemed an agreement on the part of said grantee, its successors and assigns to indemnify said county and hold it harmless against any and all liability, loss, cost, damage or expenses which may accrue to said county by reason of any neglect, default, or misconduct of the grantee in the construction, operation or maintenance of said pipe lines and appurtenances.

SECTION _6. This franchise is granted in consideration of the mutual covenants and purposes herein contained and the acceptance by the grantee, of the terms and conditions of this ordinance as herein provided, together with the payment by the grantee to the County within ninety (90) days after the effective date of said ordinance of the total sum of Fifty Dollars ($50.00). It is understood and agreed by and between SAN JUAN COUNTY and Utah Gas Service Company that the considerations above provided shall be in lieu of any and all other franchise, occupation, privilege, license, excise, revenue or similar taxes, and all other exactions (except ad valorem property taxes and special assessments for local improvements) upon the revenue, property, gas mains, gas supply and distribution pipes, equipment, fixtures, or other appurtenances of said company, and all other property or equipment of said company, or any part thereof, including but not limited to any tax levies, license fees, charges, assessments, fees or payments imposed or which may hereafter be imposed during the term of this franchise.

SECTION 7. That said grantee shall, within ninety (90) days after the passage of this Ordinance, accept in writing, duly filed with the County Clerk of San Juan County, this franchise and the grants and privileges herein given, together with the conditions binding upon said grantee.

SECTION _8. This Ordinance shall be published in the San Juan Record, a newspaper of general circulation within San Juan County, for one publication on November 14, 1974 and be in full force and effect upon the expiration of twenty (20) days following the date of publication.

Passed by the Board of County Commissioners of San Juan County, Utah, this 29th day of October, 1974, the vote on said Ordinance being as follows:

FIRE HYDRANTS - CORRESPONDENCE FROM FOUR CORNERS REGIONAL COMMISSION

This controversial matter was settled when Chris Jouflas's office advised the Commission that said hydrants were picked up by Blanding City officials some time ago. The transfer of Title, in duplicate was signed by the Chairman of the Commission and returned to the Four Corners Regional Commission office in Albuquerque, as per instructions.

GOVERNOR'S LETTER RE: LAND EXCHANGE

San Juan County Commission Monticello, Utah 84535

ATTENTION: CALVIN BLACK, CHAIRMAN Gentlemen:

This will acknowledge receipt of your letter of January 21, 1975, in which you expressed your opposition to a proposed land exchange on the Bluff Bench between the State and the Bureau of Land Management.

I have discussed this matter with members of our Division of State Lands, and they feel that this is an equitable exchange for the State. We are exchanging 14,880.66 acres of State land appraised at $506,000.00 for 11,464.23 acres of Federal land appraised at 516.000.00 Thus, the lands are being traded at approxi-mately 1.25:1.00, but the appraisals of the lands are actually $10,000.00 in the State's favor. The offered land consists of rough county that is not useable for anything but grazing. It may be that since this is in a primitive area that the Federal Government would keep the land in a primitive condition. The land which we would receive is located just north of the town of Bluff and runs along Highway 163. Studies have been made which indicate approximately 9,000 of the acquired acres could be adapted to cultivation through drip irrigation or sprinkling irrigation. Because the land would be blocked along the highway and be more level, we feel that the land would be more adaptable and more profitable for the State's operation than would be the land which we are offering in trade.

The Division of State Lands has temporarily agreed to not accept any applications under the Carey Act until more studies have been made and until some changes are made in the State companion act. We hope to have such a bill approved by the Legislature this year.

We thank you for your interest, but feel that everything considered it will be to the State's advantage to proceed with the exchange.

NORTH CREEK ROAD - LOAD LIMIT SET

It was moved by Commissioner Broderick, seconded by Commissioner Boyle and carried unanimously that a letter be written to Sonderegger Construction Company advising that the County has imposed a gross load limit of 12000 pounds on all vehicles using North Creek road from the west city limits to Dalton Springs, effective immediately and until further notice.

PAVEMENT MARKING PROGRAM DISCUSSED

Mr. Richens of the Highway Dept. discussed the pavement marking program and County-wide zoning along primary highways.

The Commission reviewed and discussed the Head Start Program and the idean that resulted from the meeting of last Friday.

WATER DISTRICT MEMBERS MEET WITH COMMISSION.

In discussing projects and interests, it was decided that Culinary development should have top priority.

Recapture Project was agreed as the next project to be worked on.
