SAN JUAN COUNTY COMMISSION MINUTES JUNE 2, 1986

The San Juan County Commission met in regular session on June 2, 1986, at the hour of 10 a.m. at the San Juan County Courthouse, Monticello, Utah.

The following members were present: Commissioner Bailey, Acting Chairman

Commissioner Holliday Commissioner Black was in Moab speaking at the Western State Forester Foundation and returned at noon.

Minutes of the May 27 meeting were approved on the motion of Commissioner Holliday. Commissioner Bailey seconded the motion. UNANIMOUS.

BID - CRACKERS

Rick Bailey, Administrative Assistant, said he received two bids for the salvation crackers. The bids were received from George Kensley for $20 and Tim Perkins for $105.00. The Commission approved the high bid of Tim Perkins.

COUNTY QUEEN PAGEANT - BUDGET

Becky Young, director of the County Queen Pageant, met with the Commission concerning the pageant's budget. Mrs. Young said she would like the pageant funds to be separate from the county fair budget. Commissioner Holliday said he would talk to Carol Sallee, county fair chairman, and tell her that $3,000 of the $10,000 that is in the county fair budget would be allocated for the Queen Pageant. Mrs. Young said this would be okay.

UPHOLSTERY MACHINE - EXTENSION OFFICE

Sheri Christensen, secretary of extension office, met with the Commission concerning the upholstery machine. Mrs. Christensen said she talked to Phyllis Heaton who is a partial owner of the machine and Mrs. Heaton said they would donate it to the county.

LETTER OF DONATION

Let it be known that on June 2, 1986, a group of women in San Juan County donated to the County Extension Office one upholstery machine. The serial number TS 188R machine is freely given to San Juan County with the understanding that it will be maintained by the Extension Office and will be made available for public usage.

By so donating this machine to San Juan County, the women surrender any and all claims to said upholstery machine. It is with this understanding that the County Commissioners gratefully accept this donation.

KILN - county

Commissioner Holliday said several people have contacted him about the kilns that the county owns and is now in the courthouse basement. The Commission discussed either donating the kilns to the sheltered workshop or to declare them surplus. The Coinnission asked Rick Bailey, Administrative Assistant, to talk to Reese Thomas about the sheltered workshop.

STATE HEALTH DEPARTMENT - INDIGENT MEDICAL ASSISTANCE PROGRAM

Gail Johnson, county clerk, informed the Commission that the payment for State Health Department Indigent Medical Assistance Program from July 1, 1985 through June 30, 1986, is due. Coinnissioner Holliday made the motion to approve the payment of $45,399 and authorized Commissioner Bailey to sign the contract for the next year - July 1, 1986 through June 30, 1987. Commissioner Bailey seconded it. UNANIMOUS.

NURSING HOME EMPLOYEES ACCRUED BENEFITS

Rick Bailey, Administrative Assistant, reported that the nursing home employee accrued benefits have all been paid. Mr. Bailey said he talked to Reuel McPhie at the nursing home last week and said everything is going well. Mr. McPhie said he is looking for a dietician and may work out a contract with Grand County hospital and San Juan County Hospital on rotating the dietician.

HOME HEALTH EMPLOYEE ACCRUED BENEFITS

Rick Bailey said the county home health employee accrued benefits will amount to about $1700. Commissioner Holliday made the motion to approve this payment of these benefits and Commissioner Bailey seconded it. UNANIMOUS.

HILL BURTON OBLIGATIONS

Rick Bailey said that Ted Stagg, CPA developer, has sent the Hill-Burton people five alternatives for the county on the Hill-Burton Obligations. Hill-Burton is allowed fifteen to twenty days to study them before notifying the county what they can do. Mr. Bailey said Mr. Stagg indicated the negotiations are going well with Hill- Burton.

JACK TANNER - COUNTY EMPLOYEE EVALUATIONS

Rick Bailey, Administrative Assistant, said he met with Jack Tanner in Salt Lake last week. Mr. Tanner told Mr. Bailey the county employee evaluations are going well but need additional work. Mr. Tanner will meet with the Commission on June 23, 1986.

PUBLIC SAFETY BUILDING - HISTORIC PRESERVATION - Jensen Home

Rick Bailey reported he received a letter from the Advisory Council on Historic Preservation concerning the Community Development Block Grant for the construction of the new Public Safety Building. A Memorandum of Agreement signed by the Utah State Historic Officers specifies that the Fred Jensen House can now be demolished. The Commission decided to wait on bidding the removal of the house until next week.

CITY STREETS - COMPACTION TESTING

Commissioner Bailey reported that Doug Pehrson, county engineer, is still having problems with the Monticello city secondary water contractor, Arix Corporation, on having them do the compaction right. Mr. Pehrson is meeting with the president of the Arix Corporation and trying to work this out.

LEMS DRAW GRAVEL PIT

Commissioner Bailey reported that Doug Pehrson, county engineer, will be meeting with Bob Turri, BLM, today to review how they are going to work the Lems Draw gravel pit.

BLACK STEER ROAD

The oil companies will need to participate with the county on building the road around by Black Steer which is about four miles. Commissioner Bailey said they want to avoid crossing at Montezuma Creek. Commissioner Bailey said it is an important necessity that an all-weather road be built and maintained for this area because of the oil production.

WILDERNESS

K.C. Benedict met with the Commission to ask what their views were on the wilderness issue. Mrs. Benedict said she is doing a paper on wilderness issues for her Masters Degree and needs information. Commissioner Black told her that from now until August 15 the BLM will receive written comments on their draft environmental study. The BLM draft environmental statement is five volumes and can be obtained at the BLM office in Monticello. The county is forming a wilderness task force. Commissioner Bailey said that people who haven't lived in the area and been faced with the problems of trying to administer money for taxation really don't know how the people feel. Commissioner Holliday gave her a copy of the county's statement that was submitted to the EIS. Mrs. Benedict thanked the Commission for their comments.

AMBULANCE BIDS

The bids for a new county ambulance were opened at 1:30 p.m. The following bids were received:

Dave Nielson from Fire-Med was present and gave his three different bids. The Commission reviewed each bid and went with Rick Bailey's recommendation for the 1986 Ford Braun Ambulance from Fire-Med for $48,800. Commissioner Bailey made the motion to purchase this ambulance and Commissioner Holliday seconded it. UNANIMOUS.

ATLAS MINERALS

Commissioner Black said he received a report from Atlas Minerals on the analysis of the proposed Uranium Revitalization and Tailings Reclamation Act of 1986, on what it will do if it's passed. They also gave the analysis on what they consider the back lash or other factors that might result from the Chernobyl. They don't think this will have a lasting effect on nuclear energy in this country. Commissioner Black said everyone needs to encourage our congressmen and senators to support this, so it will pass.

SOCIAL SERVICES - CHILD SUPPORT COLLECTIONS - Contract #78-8013

Commissioner Black said he received a letter from Social Services stating that their funding has been cut.

As of October 1985, the Federal Regulation governing the payment and distribution of incentives resulting

from collection of child support obligations has been totally revised. The criteria on which incentives

payments are computed has been completely changed by Federal Law and Regulation.

It has been determined that the counties' incentive participation rate has been reduced from twenty-nine

to ten percent. The Commission will refer this to Bruce Halliday, county attorney, before signing the

contract.

BLM - WILDERNESS DRAFT - LETTER from Washington County - BILL HOWELL,

Commissioner Black said he received a copy of a letter from Washington County Commission to Bill Howell, Executive Director Southeastern Utah Association of Local Governments. The letter compliments Bill Howell on the work he has done in preparing Part I of the proposed Local Government Response to the BLM Draft Wilderness EIS.

BID - CONCRETE COURTHOUSE

The following bids were received for concrete filling east of the courthouse.

Bunker Construction - $485.83 Young's Builders - $475.00

Sonderegger - $440.00

Dell Hunter, courthouse custodian, said he dug the grass out of the areas where the concrete is to be placed. Commissioner Bailey made the motion to award the bid to Sonderegger, the low bidder, for $440.00. Commissioner Holliday seconded it. UNANIMOUS.

ENERGY FUELS letter of appreciation

The Commission received a letter from Ron Nusman of Energy Fuels expressing appreciation for the efforts made in getting the local business people and citizens of the community to write letters to the BLM and Forest Service in support of the Pinenut and Canyon projects. Mr. Nusman said it was very clear that the letters from your area were very effective in communication to the decision makers on how important these projects are. The BLM received 184 letters of comment on the Pinenut project with 178 in favor and only 6 in opposition. The Forest Service received 195 letters on the Canyon project with 160 in favor and 35 in opposition.

COUNTY MINING CLAIMS

Commissioner Holliday said someone asked him if the county would lease the mining claims in Lisbon Valley

that the county now owns following the May tax sale, commissioner Black said the county will advertise to accept proposals on leasing these mining claims for a bonus and royalty basis. The ad should describe the property.

UNDC - USDA FOOD DISTRIBUTION - MEXICAN HAT CHAPTER HOUSE - UNDC DAY

USDA Commodities Food Distribution

Tully Lameman of UNDC met with the Commission. Mr. Lameman said Rick Bailey wrote a letter to Herb Clah

concerning the USDA Commodities Food Distribution. The letter said the program was cut, involving

personnel, and some help will be needed from the Tribe to distribute the commodities on the reservation.

Rick Bailey said Bruce Shumway, Social Services, has agreed to transport the commodities, but Mr. Bailey

said he will need to find locations and set up good record keeping. Mr. Bailey said the program was

recently audited and the record keeping was found to be very poor. Mr. Lameman said the Tribe gets public

service funds and could help the chapters distribute the commodities. Mr. Bailey will work with UNDC and

UNDC will find someone who is responsible in record keeping.

UNDC Budgets - UDIA Board

Tully Lameman said UNDC's budget has been turned into the UDIA board. The UDIA board will meet June 18,

1986, to decide the final budget. UNDC, UNI and San Juan Center have their budgets all combined.

Projects - Mexican Water Chapter House

There are some new projects on the reservation. The Mexican Water Chapter House is being remodeled.

There are senior citizen programs being created and new pre-school projects.

UNDC Day

Mr. Lameman said UNDC is planning on having a UNDC day on August 8 and 9, 1986. The purpose of UNDC day

will be to show, through demonstrations, what UNDC is doing in providing programs on the reservation.

There will be different activities and field events, an open talent show, the Miss Utah Navajo Pageant, a

parade, barbecue, horse races, and a traditional Navajo dance contest and show. Mr. Lameman asked if the

county could clear off some land that UNDC owns in Bluff for this event. Commissioner Bailey said he

would contact Bernal Bradford and have him see what needs done. Mr. Lameman said everyone is invited.

Mr. Lameman said UNDC hopes that in the future this turns into the Utah State Navajo Fair.

Bookmobile - Tribe

Commissioner Bailey asked Mr. Lameman to find out when the Tribe's bookmobile is on the reservation so

that he can visit the bookmobile librarian and see what the bookmobile is like. Mr. Lameman said he would

do this.

COMMUNITY IMPACT BOARD - PUBLIC SAFETY BUILDING

The Commission met with the group of local people who are going to Salt Lake on June 5 to present the county's need to build a new public safety building to the Community Impact Board. Both Blanding and Monticello representatives will be with the county. Discussed was what points need to be made to the board to prove the need of a new county jail.

HALLS CROSSING AIRPORT CAPITAL PROJECT FUND - BUDGET APPROPRIATION INCREASE

The county has received $100,000 from Federal Aviation Administration and Utah Department Transportation of Aeronautics for the feasibility study and engineering of the Halls Crossing Airport. Commissioner Bailey made the motion to re-open the budget and adopt the new budget of $100,000 for revenue and expenditure on the Halls Crossing Airport Project. Commissioner Holliday seconded it. UNANIMOUS.

PROBATIONARY RAISE - GLEN JACKSON

Commissioner Bailey made the motion to approve a probation raise for Glen Jackson from a grade 4, step 1 to a grade 4, step 2. Commissioner Holliday seconded it. UNANIMOUS. The salary increase will be effective from when his schooling was completed on February 20, 1986.
