SAN JUAN COUNTY COMMISSION FEBRUARY 2, 1987

The San Juan County Commission met in regular session on February 2, 1987 at the hour of 10 a.m. at the San Juan County Courthouse, Monticello, Utah.

The following members were present: Commissioner Black, Chairman

Commissioner Bailey Commissioner Maryboy

Minutes of the February 2, 1987 Commission Meeting were approved on the motion of Commissioner Maryboy and seconded by Commissioner Bailey. UNANIMOUS.

COMMISSIONER CALVIN BLACK'S REPORT

State's response to draft San Juan Resource Management Plan and EIS

Commissioner Black gave the Commission a draft letter from Bill Howell, AOG, that was written for the Governor to review for comments on the BLM San Juan Resource Management Plan and EIS. Commissioner Black said that Mr. Howell wrote an excellent letter and will contact Rep. Adams to see if the Governor signed a letter retracting the state's first response.

HB 6 - State Land Law Bill - Commissioner Black said that HB 6 - the State Land Law Bill is being rewritten. In this bill there is a provision that would return 25% of the mineral leasing money to the county where its originated. Rep. Tom Christensen who is from Sevier County is now trying to take this provision out saying the bill won't pass because of the fiscal impact. Commissioner Black said the people in the rural areas position is that if this is going be taken out they don't want the bill to pass. The people in his voting district are trying to get Rep. Christensen to leave the bill the way it is now. Burr Trail - Editorial - Commissioner Black said there was an editorial in the Salt Lake Tribune last week against the Burr Trail. Commissioner Black said the proposal of the Burr Trail is a very low standard designed road with a 26 foot travel way where there is an existing dirt road. The editorial states that a new road would disturb the environment and other problems.

Canyonlands Expansion - Commissioner Black reported that Congressman Owens introduced a bill that could almost double the size of Canyonlands National Park. Commissioner Black will write a letter on behalf of the Commission to Congressman Owens opposing this expansion.

UNI - Henry Hillson Manufacturing - The Commission received a letter from Lloyd Kartchner, manager of Henry Hillson Manufacturing UNI, thanking the Sheriff's Department for their concern and help during a security problem at one of their plants in Montezuma Creek.

COMMISSIONER KENNETH BAILEY'S REPORT

Development Board Meeting - Commissioner Bailey reported that he attended the Development Board last week

in which they reviewed the Southeastern Development Plan. Mr. Bailey said he commented to the board that

the reference in the plan on Halls Crossing; "the possible development at Halls Crossing was not

adequate" should be broader and explain more of what the concept and benefits are. The development at

Halls Crossing is more of a promise than any other development in the county and is hardly mentioned in

this plan. Commissioner Bailey said the plan needs to be corrected and sent to Bill Howell, AOG, for

reprinting.

Halchita Dump - Commissioner Bailey said he met with Herb Frazier and Larry Mose to discuss the Halchita

dump. The road department was not aware of this dump but will be working with the people in Halchita to

take care it. Commissioner Bailey said the people in Halchita would like to hold a meeting to discuss

various concerns and set a date with Commissioner Maryboy. Commissioner Bailey said he will have Doug

Pehrson, surveyor, go down and recommend signing by the schools in Halchita and other places in the

community.

Blanding City Road Meeting - The Commission will be meeting with the Blanding City Council tomorrow at 7

p.m. to review the road program for 1987.

UTAH ROAD NEEDS STUDY

Commissioner Bailey reported that he is having a conference call Friday at 7 a.m. with Martin Rissel who

has been hired by Wilbur Smith Associates to work on the road maintenance on the Utah Road Needs Study.

Commissioner Bailey said Mr. Risselle was very complimentary on the information Commissioner Bailey sent

to the roads needs study. Mr. Rissel's responsibility is to provide guidelines on an appropriate level

of service for all classes of road maintenance. Commissioner Bailey said he will work with Mr. Rissel in

outlining the level of road maintenance needed in rural Utah.

Truck Hiring Policy

MEMORANDUM

TO: ALL COUNTY ROAD DISTRICT FOREMAN AND LOCAL TRUCKERS FROM: SAN JUAN COUNTY ROAD COMMISSIONER SUBJECT: SAN JUAN COUNTY TRUCK HIRING POLICY

A roster for hired trucks shall be established. Dayne Shumway, Kenneth Miller, Junior Cosby and Tony Brandt shall be put on the top of the list and shall be given preference because of past performance in being dependable, setting hauling for the county as their first priority, turning down other jobs to be available to haul for the county and in following the directions given them by the county.

Other truckers who are interested in hauling for the county will be added to the roster.

When other trucks are needed they will be hired on the basis of the work being evenly scheduled between the trucks on the balance of the roster. Any truck on the roster that is not available for the county when needed, does not show up, leaves or takes on other jobs when needed by the county or does not follow county directions will be placed at the bottom of the roster and will be called after the ones that do show up, are available, dependable and follow the directions given them by county personel are used. The hiring, scheduling and accounting for all hired trucks shall be the full responsibility of the District Foreman for his district. This responsibility can be assumed across district lines when agreed upon in the regular county road meetings. It will be the responsibility of each foreman to hire local trucks and schedule them fairly. All trucks are to be scheduled as to the needs of the county and not at the pleasure of the truckers. As much as possible all hired trucks shall work at the same time county crews are working. Foreman shall make scheduling notes for future reference in examining billings. All billings shall be on San Juan County billing forms, signed by the trucker and confirmed by the foreman before coding and submission for payment.

The hauling time for hired trucks starts when they intersect the hauling route. The county pays no dead head time.

COMMISSIONER MARK MARYBOY'S REPORT

Navajo Tribe Land Administration - Commissioner Maryboy reported that he met with several people from the

Navajo Tribal Land Administration with respect to the West Water Land Sale. The people of Blue Mountain

Dine would like to purchase the land first and then discuss the issues of taxation, jurisdiction, and

services to the people.

Window Rock - Chairman's Assistant - Commissioner Maryboy said he talked to Senator Henderson from

Arizona last week with respect to the West Water Land Sale. Senator Henderson has been appointed to the

Tribal Intergovernmental Relations and indicated that he is willing to talk to the Commission and other

interested parties to address the concerned issues after the land is purchased.

Montezuma Creek - curb & gutter - Commissioner Maryboy reported he talked to Bill Todacheenie about

installing curb and gutter at Montezuma Creek. Mr. Todacheenie will meet with the appropriate people to

discuss this and Commissioner Maryboy said he will follow up with a report at a later date.

Out-Of-State Travel - The Commission approved Commissioner Maryboy to travel out-of-state to Window Rock

when needed.

HOSPITAL ADMINISTRATOR - HIRING NURSE DIRECTOR

John Fellmeth, Hospital Administrator, told the Commission that the advertising for the position of a nurse director has only brought in three applicants. Mr. Fellmeth asked the Commission if they would like to hire through a recruiting crew which would be costly and then there is no guarantee the employee would stay. The Commission told Mr. Fellmeth to continue to advertise and to expand it to all areas.

NURSING HOME - HEALTH CARE FACILITIES - HILL-BURTON OBLIGATIONS

Rick Bailey, Administrative Assistant, reported that he met with Ted Stagg, CPA developer, last week in Salt Lake concerning the Hill-Burton obligations on the nursing home. Mr. Bailey said he sent the requested documents to the Hill-Burton people for them to review. Mr. Stagg said he would like to meet with them as soon as possible and will be calling them today to set up a meeting.

HALLS CROSSING AIRPORT MASTER PLAN - NATIONAL PARK'S COMMENTS

Rick Bailey, Administrative Assistant, gave the Commission a copy of the National Park Service's comments on the draft Halls Crossing Airport Master Plan and EA. The letter said the EA is sketchy and inadequate but agrees with the Management Plan.

EMS CONTRACT - AMENDMENT

Commissioner Bailey made the motion to approve an amendment and authorized Commissioner Black to sign the EMS Contract #87-2191 which will give the county $682.00 more for the period January 15 to June 30, 1987. Commissioner Maryboy seconded the motion. UNANIMOUS.

PUBLIC SAFETY BUILDING - BONDS - CLOSING DATE

Rick Bailey, Administrative Assistant, reported that he met with Sheryl Clark of the Community Impact Board last Wednesday to finalize a closing date on the issuance bond documents for the Public Safety Building. The GIB board's attorney did not approve the agreements that were prepared by Blaine Carlton, county's attorney. Mr. Bailey said he met with Mr. Carlton and Mr. Carlton said he will work with the CIB's attorney in rewriting the agreements. Mr. Bailey said he will keep in contact with Mr. Carlton.

PUBLIC SAFETY BUILDINGS - EMPIRE ELECTRIC - POLES

Rick Bailey, Administrative Assistant, reported that he, Commissioner Bailey, and John Peterson, architect, met with a gentlemen from Empire Electric last week to discuss moving the power poles at the public safety building site. Mr. Bailey said that he is meeting with Empire Electric this afternoon to finalize the plans.

HOUSING PRESERVATION GRANTS FOR RURAL UTAH

The Commission received a notice stating that the State of Utah is making application for $149,000 in Farmers Home Administration Housing Preservation Grants which will be administered through the Division of Community Development.

SHERIFF'S DEPARTMENT - PERSONNEL POLICY - HOLIDAYS

The Commission, Sheriff Lacy, Rudy Cook, and Jerry Guthrie, jailer, met to discuss the policy change in the sheriff's office. Commissioner Black reviewed Mr. Guthrie's claim that he and others in the sheriff's office have been allowed to carry over their unused holidays from year to year. Sheriff Lacy said that if the Commission allows Mr. Guthrie to use his holidays then there are several other deputies who want to use theirs. Mr. Cook said there has never been anything about this in writing from the Sheriff. The Commission said that when the county made this policy change every employee was given a Personnel Policy and was told to read and understand it. The Commission asked Mr. Guthrie who keeps the records of the payroll. Mr. Guthrie said that each employee in the sheriff's office keeps their own record and time is also logged on the radio board. Commissioner Bailey made the motion to go into a executive session to discuss this with Sheriff Lacy. Commissioner Maryboy seconded the motion. UNANIMOUS.

After the discussion in executive session Commissioner Maryboy said that there is a county personnel policy and it's the employee's responsibility to know these policies therefore he made a motion to deny

Mr. Guthrie's claim. Commissioner Bailey seconded the motion. UNANIMOUS.

MOTORCYCLE PROBLEMS IN BLUFF

Deputy Rudy Cook told the Commission that there is a problem with motorcycle drivers riding up and down the cemetery hill in Bluff which is destroying the area. Mr. Cook asked the Commission if an ordinance could be passed so that a fine could be given to trespassers. The Commission said that if this land is private and no permission is given or public property then they are in fact trespassing and can be fined. The Commission told Mr. Cook and Sheriff Lacy to review this with the County Attorney to see what can be done.

BLM LAND SALE TO NAVAJO TRIBE - WEST OF BLANDIHG

The Commission discussed the proposed BLM land sale (West Water) to the Navajo Tribe. Wesley Oshley, representative of Blue Mountain Dine, explained to the Commission that the goal and dream of the people in the West Water area is to have a place to build an office and chapter house of their own. This will help the people get funding from the Tribe for housing, health, education and give them the right to participate in Tribal elections. Commissioner Maryboy said that he initially didn't understand the goals of Blue Mountain Dine and what they are trying to establish. But the lifestyle of the people at West Water is a high rate of illiteracy, alcohol, and drugs and the Tribe's intent of purchasing this land is to eliminate some of these problems with services provided by the Tribe. Commissioner Maryboy said that after talking to Senator Henderson he realizes that the only way to serve these people adequately will be to establish a chapter and organize officials to work with the people. Commissioner Black said that over the years there have been problems with child abuse and others abused from those who are intoxicated. Commissioner Black said that possible problems of the land sale are police jurisdiction, taxation, health with respect to water and sewer, sanitation, septic tank installation, and waste. The state and county are in control of these now but if the Tribe purchases the land who is in control on these issues. The Commission told Mr. Oshley to organize a meeting with representatives from the County Commission, City of Blanding, State Health Department, BLM, Blue Mt. Dine, Governor's office, and Navajo Tribal Council and discuss the real problems and effects. An agreement on these issues needs to be resolved before the land is purchased.

COUNTY AUCTION - SURPLUS

Gail Johnson, clerk, told the Commission that the county needs to hold a surplus auction. Mrs. Johnson said she will send a memo to each department head asking them to get a list of what they would like to sell at the auction.

RECORDER'S OFFICE - GRADE INCREASE FOR DEPUTY

Louise Jones, recorder, met with the Commission requesting grade increase for Edna Rogers, deputy recorder. Mrs. Jones said that Mrs. Rogers does all the platting for the county and feels the position should be increased by a grade. The Commission asked Mrs. Jones to get more information from other counties on what they pay platters.

BLM LAW ENFORCEMENT AGREEMENT WITH COUNTY

Ed Sherick and Gary Hansen from the BLM met with the Commission and Sheriff Lacy to discuss the law enforcement agreement between the BLM and the County. Commissioner Bailey made the motion to approve the agreement and authorized Commissioner Black and Sheriff Lacy to sign it. Commissioner Maryboy seconded the motion. UNANIMOUS.

BID QUOTES - ROAD DEPARTMENT

Two bids were received for regrouser D8 22" "ES" shoes 2" parts and labor from Wheeler's for $1893 and from Century Equip for $2093.10. The Commission approved the bid to Wheeler because of low bid.
