MINUTES OF THE SAN JUAN COUNTS-COMMISSIONER'S MEETING HELD

FEBRUARY 28, 1983

The Board of County Commissioners met in regular session on Monday, the 28th day of February, 1983, at the hour of 10:00 a.m. in the County Courthouse at Monticello, Utah.

On roll call, the following members were present: Commissioner Kenneth R. Bailey

Commissioner Robert Low

Commissioner Black was excused.

Minutes of the previous meeting were read and approved with the specified corrections upon the motion of Commissioner Low. The motion was seconded by Commissioner Bailey and carried unanimously.

REPORT ON LASAL ROADS MADE

Commissioner Bailey reported that Doug Pehrson, County Engineer and Bernal Bradford, County Road Superinten-dent, have met with persons in the LaSal area to outline road standards required by the County. LaSal area residents have borrowed equipment from Union Carbide and are putting rock on roads to bring them up to County standards so these roads may be accepted for County maintenance.

BEER LICENSE RENEWAL DISCUSSED

Commissioner Bailey reported that his motion was to prorate all new and existing beer licenses under the current license fee schedule through the end of 1983. The new rate schedule would then go into effect January 1, 1989 and all licenses would expire at the end of the calendar year. Legal clarification is needed on this matter before a final decision may be made.

ROAD DEPARTMENT ACCOUNTS RECEIVABLE DISCUSSED

Commissioner Bailey requested that County Clerk, Gail Dalton, work with Leona Markoseck, Road Department Secretary, to develop a better system for Road Department Accounts Receivable. Commissioner Bailey suggested that the Road Department provide a monthly summary of all Accounts Receivable. Payments should be recorded on this summary sheet as they are received by the Clerk's office, with a copy returned each week to the Road Department office.

AMENDED HOUSE BILL 48 DISCUSSED

Mark Sword, owner of the San Juan Inn, and Jerry Baum, owner of the San Juan Trading Post, both located in Mexican Hat, appeared before the Commission to voice their opposition to House Bill 48 as ammended. Both of these businesses are threatened, if House Bill 48 becomes law. It was learned during the meeting that HB 48 had passed in the House of Representatives with only 6 opposing votes, and that it had passed in the State Senate with 27 votes in favor and 0 opposed. The bill has now been submitted to Governor Matheson. According to Representative Hardy Redd, the bill as passed did not include either a "grandfather" clause to provide for existing businesses or a self-determination clause. As amended, the bill would prohibit beer sales within 1,000 feet of a reservation which itself prohibits beer sales.

It is anticipated that at least 2 businesses in Mexican Hat would lose revenue from beer sales if HB 48 becomes law and that 4 to 5 businesses in the County could be greatly affected by passage of this bill.

The only related idea ever supported by the Commission was to allow self-determination in areas where this was desired by local citizens, but this concept was not included in the bill as passed. The San Juan County Commission is very much opposed to passage of HB 48 as amended. It is felt that the effects of the bill on businesses would be very detrimental to the County with no positive effect in solving alcohol related problems in the Montezuma Creek area. In fact, from information submitted by Doug Pehrson, County Engineer, it appears that the beer outlet in Montezuma Creek is 1,350 feet from the Reservation boundary and would not be affected by HB 48.

The Commission is to send maps showing businesses which would be affected by the bill and their location in relation to the Reservation boundary. Representative Redd will then determine whether or not he desires to request the Govenor to veto HB 48. Mr. Redd will inform the Commission of his decision at the earliest possible date so that the Commission may contact the Governor before the bill is signed to request his veto of the bill.

Mark Sword and Jerry Baum asked Commissioner Bailey to notify them as soon as word is received from

Representative Redd. Mr. Baum also asked who would notify businesses that they could no longer sell

beer. Commissioner Bailey replied that, should the bill become law, the County Attorney would be

contacted and responsibility for notification would be determined.

SAN JUAN HEALTH CARE SERVICES BOARD MEETS

Commissioner Low reported on a meeting of the Health Care Services Board held on February 22. The San Juan Hospital has contracted for Dietetic Services with a Dietician from Rapid City, Iowa. The Dietician visits the Hospital once each month for 3 days and is paid $10.50 per hour worked. She is not paid for any travel time or mileage. Apparently the Dietician and her family would like to relocate to this area. Due to an oversight the former Dietician may not have been contacted about the change and she is to be notified by the Hospital Director immediately.

SPECTRUM, INC. TO PROVIDE DOCTORS FOR WEEKEND CALL AT SAN JUAN HOSPITAL

Health Care Services plans to execute a trial agreement with Spectrum, Inc. who will provide doctors for weekend call at the San Juan Hospital. Spectrum, Inc. charges a flat fee to provide public relations and advertising services, train EMT's and nurses and provide for doctors to staff the Hospital emergency room on weekends. Local doctors have been contacted and all are in favor of the proposed agreement with Spectrum, Inc. The cost of this service is projected to be $87,000 for one year (or 52 weekends). Physician fees charged would be payable to the Hospital. It is anticipated that costs to the County could be reduced under such an agreement; therefore the Hospital plans to draft an agreement with Spectrum, Inc. for a nine-month trial period.

SOUTHEASTERN UTAH HEALTH DISTRICT AUDIT RECOMMENDED

Commissioner Low reported that Mr. William Reger, Executive Director of the San Juan Hospital, has been appointed to work with Bob Furlow of the Southeastern Utah Health District. Mr. Reger recommends that an audit be conducted with Southeastern Utah Health District to track funding uses.

BYLAWS WRITTEN FOR SAN JUAN HOSPITAL AND SAN JUAN HEALTH CARE SERVICES

Separate bylaws have been written for the San Juan Hospital and San Juan Health Care Services. These bylaws are basically identical and will be discussed at a future meeting of the Commission.

RESPONSIBILITY FOR REPAIRS AT MONTICELLO AIRPORT DISCUSSED

A request was made as to who is responsible for repairs when they are needed on the Monticello airport building. Commissioner Bailey pointed out that the Operator or Jon Hunt is responsible for securing repair services and the County will pay the cost of repairs needed.

REOUEST TO CONTACT KEYSTONE-WALLACE DISCUSSED

Al Haskins has repeatedly attempted to contact Keystone-Wallace regarding requests by oil companies to dump salt water in Keystone-Wallace ponds in Lisbon Valley. Mr. Haskins has been unable to make any contact with Keystone-Wallace.

COUNTY PERSONNEL POLICIES TO BE EVALUATED

A special review committee of the Health Care Services Board is to meet on March 21st at 4:00 p.m. to discuss County personnel policies. A copy of the minutes of the February 22 Commission Meeting in which the sick leave policy was discussed, are to be sent to Mr. Reger, Hospital Director.

APPARENT OVERPAYMENT TO FOUR CORNERS MENTAL HEALTH DISCUSSED

Mr. Haskins reported that he has had difficulty making contact with Mr. Gordon Hicks of Four Corners Mental Health regarding the apparent overpayment discussed previously. Mr. Haskins will continue to work towards resolution of this matter.

AGING PROGRAM FUNDING FORMULA PROPOSAL WITHDRAWN

Al Haskins reported that Salt Lake County has withdrawn their proposal for allotment of Aging Program monies on the basis of population. This will mean that San Juan County will maintain its present level of funding under the Aging Program.

FIRE TRAINING TO BE HELD IN SOUTHERN PART OF COUNTY

John Baker, County Fire Warden, reported that on the 28th, 29th and 30th of March, instructors from Utah Technical School will conduct basic fire training at the Mexican Hat Fire Station. This will complete one-half of the planned training program. The week of April 4, simulator training will be sponsored by the State Forest and Fire Control agency. Simulator training will be held on Monday in Montezuma Creek, Tuesday and Wednesday in Monument Valley, and Thursday and Friday in Bluff.

Mr. Baker plans to apply for Rural Community Fire Protection Agency matching federal funds to be used in the County fire prevention program.

REVISED TELEPHONE MAINTENANCE AGREEMENT APPROVED

Commissioner Low made a motion to authorize Commissioner Bailey to sign the Telephone Maintenance Agree-ment, as revised. The motion was seconded by Commissioner Bailey and carried unanimously.

COUNTY ROADS DISCUSSED

Various complaints have been received about muddy roads in the County. There is alot of deep mud on roads in the County, but many roads cannot be worked on until they get drier. In many cases nothing can be done about these muddy roads. The County has authorized an oil company to use a muddy road near the Colorado state line as long as they regrade the road at their own expense. Bernal Bradford, County Road Superintendent, has been authorized by Commissioner Bailey to close this road to truck travel should the oil company fail to maintain this road in good condition.

AGREEMENT APPROVED WITH KERMIT BLAKE FOR COMPUTER CONSULTATION

A motion was made by Commissioner Low to approve an Agreement for computer consultation with Kermit Blake. The motion was seconded by Commissioner Bailey and passed unanimously.

LETTER OF AUTHORIZATION TO BILL FRANCOM APPROVED

A letter was signed by the Commission authorizing Bill Francom to withdraw monies from one of the line accounts in the general fund to be paid on the San Juan Special Service District No. 1 Sewer Project, and further authorizing the return of the money to that account upon the County's receipt of reimbursement monies from the EPA account on this project.

EMPLOYEES ELIGIBLE FOR RETIREMENT COVERAGE

A policy statement was received from the Utah State Retirement Office outlining eligibility for retire-ment coverage. According to these guidelines the following employees are eligible for retirement cov-erage.

1. An employee who works at least 20 hours per week and who works at least 9 months of each year.

2. An employee who works 30 or more hours per week should be enrolled immediately upon hire.

3. A temporary employee who is employed more than 4 cumulative months should be enrolled at the beginning of the 5th month.

4. Elected or appointed officials paid $30 or more per month must be covered.

5. Retired employees who receive a monthly benefit from the Retirement Office and who work parttime, must contribute to the program if they work 20 or more hours per week.
