MINUTES OF THE BOARD OF COUNTY COMMISSIONERS MEETING HELD

DECEMBER 28, 1981

Time: 10:00 a.m. in the Commissioner's Room of the San Juan County Courthouse.

Members Present: Chairman Calvin Black, Commissioner Kenneth Bailey, and Commissioner Robert Low.

Minutes of the previous week were read and approved with the stipulated correction upon the motion of Commissioner Low and the second of Commissioner Bailey and it carried unanimously.

PERRY MCDONALD CONSTRUCTION COMPANY MAKES CLAIM AGAINST COUNTY;

Commissioner Bailey reported that Perry Me Donald Construction Company was blading County Road #459 in July 1981 without permission form the County when they broke a Texaco pipeline. Perry Mc Donald Construc-tion Company is claiming the County did not have enough cover over the pipeline, however, Commissioner Bailey feels there should not be any liability for the County in this matter and the County Insurance agent will be contacted in this regard.

ACTING ADMINISTRATOR FOR HEALTH CARE SERVICES APPOINTED;

Mr. Cleal Bradford and Mr. Rayburn Jack met with the Commission to report on the status of the hospital and other health care services as the County prepares to take over their management January 1, 1982. An admin- istrator has not yet been hired and the Health Care Services Board will re-advertise and applications for the administrator position will be accepted until February 28, 1982. Upon the recommendation of the Health Care Services Board, Commissioner Low moved to appoint Mr. Rayburn Jack as Acting Administrator for the County's Health Care Services beginning January 1, 1982, until a permanent administrator is selected. The motion was seconded by Commissioner Bailey and it carried unanimously.

MR. AND MRS. JOHN W. NEWMAN MEET WITH THE COMMISSION;

Mr. and Mrs. John W. Newman met with the Commission regarding the leasing of their share of mineral and oil rights on 40.08 acres at La Sal, Utah. The Commission will ask the County Attorney to review their lease agreements and address their questions.

SENIOR CITIZENS BUS INVOLVED IN AN ACCIDENT:

Mr. Al Haskins reported that one of the Senior Citizens busses was involved in an accident with a U.N.D.C Head Start bus on the Reservation December 22, 1981. Amy Howard, a passenger on the Senior Citizens bus, is in the hospital at Durango, Colorado. Mr. Haskins reported that the bus was "totaled" and he is waiting to receive an official accident report from the Navajo Police.

SALMON LOVATO TO RECEIVE STEP INCREASE;

Upon the recommendation of Surveyor Doug Pehrson, Commissioner Bailey moved to increase Sal Lovato from Survey Grade 9.3 to grade 9.5, effective January 1982 pay period, as the record of Mr. Lovato's qualifications and experience show he is presently under-classified. The motion was seconded by Commissioner Low and it carried unanimously.

BEER LICENSE FOR JAY D. MUELLER RENEWED:

The Commission approved the renewal of the Beer License for Jay D. Mueller d/b/a TOP OF THE HAT in Mexican

Hat, Utah. The license was signed by Chairman Black.

TRUST FUND DEPOSIT;

The Commission approved a voucher presented by the County Treasurer,Marian Bayles, for $750,000.00 to be

deposited in the County's 1981 Tax Stability and Trust Fund.

COURTHOUSE PHONE SYSTEM DISCUSSED;

County Clerk Clytie Barber reported that the Clerk's Office will take phone numbers for other offices, but

not lengthy messages, as that puts too much of a burden on her office.

Commissioner Bailey will look into the possibility of obtaining a seperate Watts line specifically for the Southeastern Utah District Health offices located in the County Courthouse. It is felt Southeastern Utah District Health Department will reimburse the County for the Watts line costs each month and this will ease the load on the County's present Watts line. Mr. Robert Furlow will be contacted in this matter, before a final decision will be made.

FIRE INSURANCE FOR THE U.N.D.C. OFFICE BUILDING TO BE REQUESTED:

The Commission reviewed the County's agreement to lease the "old Blanding Clinic" to U.N.D.C. for office space. The Commission felt it would be in the best interests of the County to request that U.N.D.C. provide fire insurance for this building as they are responsible for reimbursing the County for any losses to the building.

BLANDING AIRPORT ADMINISTRATION BUILDING PROJECT TO RECEIVE FUNDS;

The Commission reviewed a written proposal from the City of Blanding for a project to build an airport administration building. It was proposed by Blanding that the project be financed on a 50/50 cost sharing basis between Blanding City and San Juan County. Commissioner Bailey moved to pay Blanding City an advance to the cost of the Airport Administration Building of $52,000; and pursuant to the Statement of Revenues and Expenditures relative to the Blanding Airport operation for fiscal year ended June 30, 1981, to refund to Blanding City the $8,276.11 now due. The motion was seconded by Commissioner Low and it carried unani-

SCHOOL BOARD REPRESENTATIVE DISTRICTS REAPPORTIONED: The Commission reviewed the 1981 census of San Juan County and the present School Board Representative Districts with Mr. Al Haskins. As the County's population has increased in the last ten years, Commissioner Bailey moved to reapportion the School Board Representative Districts as shall follow in the minutes. The motion was seconded by Comm. Low and it carried unanimously. The School Board Representative Districts are to be reapportioned as follows:

1. Beginning at a point on the Colorado border on the line between Ts 30&31 South; then North along the Colorado Border to the San Juan County line; then West to NW corner of the County; then Southerly along the Green River to the Colorado River; then Southerly along the Colorado River to a line between Ts 32& 33 South; then East along this line to Beef Basin road; then Southerly along Beef Basin road to North Elk road; then Southeasterly along North Elk road to Johnson Creek road; then Southeasterly along Johnson Creek road to a line between Ts 3S&36 South; then East along this line to a line between Rs 24&25 East; then North along this line to a line between Ts 30&31 South; then East along this line to the point of beginning.

2. Commissioner Kenneth Bailey moved to adopt by Resolution the following General Budget adjustments pursuant to Section 17-36-23, Utah Code Annotated, 1953. The motion to adopt the Resolution was seconded by Commissioner Robert Low, and it carried unanimously.
