MINUTES OF THE SAN JUAN COUNTY COMMISISONERS MEETING HELD

FEBRUARY 27, 1984

The San Juan County Commission met in regular session on Monday, February 27, 1984, at the hour of 10:00 a.m. in the San Juan County Courthouse at Monticello, Utah.

The following members were present: Commissioner Calvin Black, Chairman

Commissioner Kenneth R, Bailey Commissioner Robert Low

Minutes of the previous meeting were approved on the motion of Commissioner Low. The motion was seconded by Commissioner Bailey and carried unanimously.

SAN JUAN COUNTY BOOK DISCUSSED

Peggy Humphreys met wiht the Commission to discuss possible additional funds for the San Juan County book to be spent on brochures an advertising. Mrs. Humphreys reported that approximately $2,070.00 has been received from sales and that 1/6 of the total number of books have been sold. The Commission decided they do not want to spend any additioanl funds on promotion at this time.

AL HASKINS REPORT

Al Haskins met with the Commission to report that the meeting with the Community and Economic Board is

scheduled for Thursday at 10:00 a.m. to discuss the following grant applications:

Nursing Home $1,000,000.00

Justice Facility (Montezuma Creek) $200,000.00

COUNTY EMPLOYED PHYSICIANS DISCUSSED

Representative Hardy Redd met with the Commission to discuss the County's policy of hiring their own

physicians. Representative Redd inquired as to whether private physicians can be acreditied at the

hospital. The Commission assured Representqtive Redd that a private physician would have hospital privilages.

Commissioner Low reported that the Health Care Services Board tried to interest private physicians in set-ting up a practice in San Juan County but received very little response, whereas response for County employed physicians have been numerous.

PUBLIC HEARING TO DISCUSS ELECTING COUNTY COMMISSIONERS BY DISTRICTS DISCUSSED

Al Haskins met with the Commission tc review the maps to be available as handouts at the public hearings to discuss the proposal of electing County Commissioners by Districts. One of the maps is of the San Juan County voting precints. The other map is of the proposed Commission district boundaries.

BUILDING PERMIT APPROVED

Commissioner Bailey made a motion to approve a building permit for O.E, Pennfield of Monticello. The motion was seconded by Commissioner Low and carried unanimously.

WILDLIFE RESOURCES REPRESENTATIVE MEETS

Guy Wallace of the Utah Division of Wildlife Resources met with the Commission to discuss the need for supplemental transplants for the Hatch Point antelope herd. If approved it would add approximately 150 antelopes to the herd in 1986. The estimated number of antelope at the present time is approximately 100. Mr. Wallace requested a letter of support be sent by the Commission to the Utah Division of Wildlife Resources if they feel they can support this proposal. Commissioner Black stated he feels there should be more concern about predator control or the herd will contineu to decrease. The Commisison authorized their support and a letter will be drafted by Commissioner Black

DARK AND WOODENSHOE CANYONS DISCUSSED

Ron Dickmore of the United States Forest Service met with the Commission to discuss the Forest Service's recommendation to delete the roads in the proposed Dark-Woodenshoe Canyon wilderness area. This would mean the closure of the only access road into the area, Mr. Dickmore reported that it would be to costly to manage this as a wilderness if the road remained open. Mr. Dickmore also reported that the majority of the people in the County wanted the road closed he later indicated he meant that at the public hearings held in 1975 or 1976 the majority of those attending would like to have the road closed. The Commission stated that they do not feel that the majority of the people in San Juan County would like to have this road closed and suggested that a survey be done. The Commission also requested a copy of the data concerning the public hearings. Commissioner Black stated that the feels that the Forest Service is ignoring the express wishes of the local residents and ignoring the responsibilities the Forest Service has by law to be consistent with land use plans of the County. Commissioner Black also stated that it is his opinion that the Forest Service locally is insensitive to the traditional use of that area by local people and that the Forest Service is trying to close it off for their own administrative convience without regard to their responsibility to serve the public.

PLANS TO ATTEND GET ACQUAINTED MEETING WITH THE NAVAJQ TRIBE DISCUSSED

The Commission received a letter from the Navajo Nation inyiting the County Officials and staff who are directly involved in Navajo Tribal matters to attend a get acquainted meeting at 10:00 a.m. on Wednesday, March 7th in the Navajo Tribal Council Chambers at Window Rock, Arizona. The Commissioners are planning to attend this meeting. Also attending will be Bruce K. Halliday, County Attorney; Gail Dalton, County Clerk and Sheriff Rigby Wright.

APPOINTMENTS TO THE WATER CONSERVANCY DISTRICT

The Commission received the following Notice of Expiration of Term from Craig C,.Halls, Attorney for the Water Conservancy District.

NOTICE OF EXPIRATION OF TERM

RE: In the matter of the organization of San Juan Water Conservancy District, pursuant to Title 74, Chapter 9, Ustah Code Annotated, 1953, as amended. Civil No, 2448

The Terms of three of the directors of the San Juan County Water Conservancy District have expired. Under the old statutes, the Board of Directors of the Water Conservancy District would make applications or recommendations for appointment by the District Court each year. In this year, the three year term of three of the Directors, Norman Nielson, Emery Hunt and Clerama Arthur, have expired.

Pursuant to changes made to Utah Code at 73-9-9, under the Water Conservancy, the Board of County Commissioners are to appoint the new directors.

The statute further specifies that written notice of the expiration of the terms are to be given to the County Commisisoners 60 days before the expiration date. This was not done as it was not realized that there was a change in the act. The Board of County Commissioners would recommend three persons to serve as directors of the District for three year terms.

It appears that the District Court no longer needs to appoint the directors of the Conserv ancy District, bu t the same is to be done by the board of County Commissioners.

It had been our intention to reappoint Norman Nielson, Emery Hunt and Clemma Arthur to these posiitons. However, this task now falls to your discretion. The current directors hold office untile their successors are duly appointed and qualified. We are attempting to complete the necessary documents and contracts for the bidding of the Monticello Project. We do not want to have any type of cloud over authority of directors and would therefore request that these appointmens be made at your earliest convenience.

Commissioner Bailey made a motion to reappoint Norman Nielson, Emery Hunt and Clemma Arthur to the Water Conservancy District for another term. The motion was seconded by Commissioner Low and carried unanimously.

BLM WILDERNESS SCOPING MEETING SCHEDULED

Commissioner Bailey reported that a BLM Wilderness Scoping Meeting is scheduled for March 1st at the BLM office in Monticello. Commissioner Bailey is planning to attend.

BLUFF TO MONTEZUMA CREEK ROAD DISCUSSED

Commissioner Bailey reported that according to the DOT the Bluff to Montezuma Creek Road should be ready to bid in less than a month. Commissioner Bailey also commended Doug Pehrson's efforts to have the Montezuma Creek bridge on the State system. In order to qualify, the bridge has to have an efficency rating of less than 50%. The Montezuma Creek Bridge has been rated at 31% so it has been accepted on the State system.

Commissioner Bailey recommends proceeding on the basis of hiring an engineering firm to design the

bridge and to connect the road from the end of th project to the bridge to the present road. Commissioner

Bialey recommends the firm of Creamer and Noble proceed with the design. The proposed time table is

to have the road oilded this spring and summer and to have the bridge built in the fall or in 1985. The

Commission authorized Commissioner Bailey to proceed as he has outlined.

Commissioner Bailey reported that the Bluff to Montezuma Creek Road grade and drain was built for $162,000.00 under bid. Commissioner Bailey stated that Doug Pehrson is to be highly commended for his and that the State has been very cooperative also,

BULLDOG ROAD DISCUSSED

Commissioner Bailey reported that theBulldog Road will be a 6% grade instead of a 9% grade.

POSSIBLE PURCHASE BY THE ROAD DEPARTMENT OF A WATER TRUCK

Commissioner Bailey reported that the road department is considering the purchse of a 5,000 to 6,000 gallon used water semi-trailer from C & C Construction. If the purchase is made the County will use the existing water truck to keep hot oil in for the patching of airport runways and county roads.

PROJECT BOLD DISCUSSED

Commissioner Black reported that Bill HOwell is doing some research on Project Bold.

Commissioner Black reported that the Utah Mining Association has approved a resolution similar to the one San Juan County adopted.

Commissioner Black also reported that he has an appointment with ARch Madsen, President of Bonneville International, on Friday to discuss Project Bold and the proposed nuclear repository.

PROPOSAL FOR PUBLIC EMPLOYEE DEFERRED COMPENSATION PLAN DISCUSSED

John Black from Equitable Life of New York met with the Commission to discuss a proposal for a voluntary payroll deduction for a public employee deferred compensation plan which is similar to an IRA. The Commisison suggested Mr. Black discuss with the County Clerk/Auditor the minimum number of participants that would be required. Mr. Black can then contact the employees with the information on this plan.

OILFIELD WASTE DISPOSAL PONDS DISCUSSED

Bill Sutherland met with the Commission to discuss the possibility of Sutherland Brothers Drilling Company either putting in waste disposal ponds of their own in the Lisbon Valley area or leasing the exisitn pits from Keystone Wallace,

COMMISSIONER LOW'S REPORT

Commissioner Low reported that Grand County has been contacting the Anhauser-Busch Company about the possibility of relocating a brewery in the area. It would be an approximate $440 million dollar project and would employ approxiamtely 300 to 500 people. The Moab Chamber of Commerce inquired as to whether San Juan County would have any objections to having a Brewery in Moab. The Commission has no objections to this proposal.
