MINUTES OF THE SAN JUAN COUNTY COMMISSION MEETING AUGUST 27, 1984

The San Juan County Commission met in regular session on Monday, August 27, 1984, at the hour of 10:00 a.m. in the San Juan County Courthouse at Monticello, Utah.

The following members were present: Commissioner Calvin Black, Chairman

Commissioner Kenneth R. Bailey Commissioner Robert Low

Minutes of the previous meeting with the specified corrections on the motion of Commissioner Low. The motion was seconded by Commissioner Black and carried unanimously.

BUILDING PERMIT DISCUSSED

LeRoy Bright from Blanding met with the Commission to discuss his building permit application. Mr. Bright reported that when he started the foundation of his home two years ago he tried to find out who to contact to get a building permit and was unable to find out any information. Mr. Bright is now being charged a penalty fee. Mr. Wayne Ball also met with the Commission to discuss this problem. Commissioner Bailey made a motion to waive the penalty fee based on the fact that Mr. Bright did make an effort to obtain a permit when construction began. The motion was seconded by Commissioner Low and carried unanimously.

COUNTY ASSESSOR MEETS

Barbara Montella, County Assessor, met with the Commission to discuss a letter received by Commissioner Black regarding lands in San Juan County. Commissioner Black reported that he received a letter from Margaret Bird of Bird Land and Minerals, Inc. reporting that through research of state land ownership records she has found that numerous lands throughout the state have been sold, and payment has been completed with title transferring to the purchaser. Ms. Bird also reported that she has compiled a list of 260.41 acres in San Juan County that do no appear on the county tax records. The Commission asked Mrs. Montella to contact Ms. Bird regarding her information.

CANYONLANDS YOUTH HOME ADVISORY MEETING ATTENDED

Commissioner Low reported that he attended the Canyonlands Youth Home Advisory meeting last week. Commissioner Low also reported that there is legislation being initiated that would put detention centers under State Youth Corrections. If the program is placed under the State Youth Corrections Program it would mean more funds for the program but the facility would have to be run by state guidelines. State guidelines would not allow this facility to be used as a shelter. San Juan County has a contract with Montezuma County, Grand County, and the Tribe. At the present time the State Youth Corrections is funding 50% of the program.

RETIREMENT OPTIONS DISCUSSED

Commissioner Bailey reported on his meeting last week with Cal Gibbs regarding the 401-K Retirement Plan. Options for elected and appointed officials regarding withdrawal from the State Retirement Program were reviewed. Mr. Gibbs would also like to meet with the employees to explain how the 401-K Retirement Plan before a decision is made by them regarding the 3.35% reduction in the State Retirement Program.

UTAH STATE HIGHWAY PATROL REPRESENTATIVES MEET

John Cartwright and Doug Slakowski from the Utah Highway Patrol met with the Commission to report that the new officer for this area will begin in January.The Commission stressed the need for stricter enforcement of Utah license and registration. Officer Cartwright reported that the Utah Highway Patrol would be willing to work closely with the other law enforcement agencies on this problem.

JOINT HIGHWAY SUBCOMMITTEE MEETING ATTENDED

Commissioner Bailey reported on the Joint Highway Subcommittee meeting he attended last week. A copy of the minutes of the meeting were reviewed. The next meeting is scheduled for September 13th.

COMMISSIONER DISTRICTING DISCUSSED

Hardy Redd met with the Commission to discuss the method of electing Commissioner's from districts but voting on them on an at-large basis used in Colorado. The Commission feels that the Justice Department would be opposed to this. Commissioner Black reviewed a letter he received from Peterson Zah and signed by Edward Begay of the Navajo Tribe. The letter stated that on behalf of the Navajo Nation he was protesting the contents of the opinion survey. Commissioner Black is drafting a letter of response to the letter. According to the results of the opinion survey the majority of the County would like to elect County Commissioners by Districts and most prefer Proposal A.

AMBULANCE DISTRICT DISCUSSED

Scott Frost and Bill Francom, Jr. met with the Commission to discuss the proposal for an ambulance district, Mr. Frost reported that those involved feel they would now like to work with the Health Care Services Board on this matter. Also discussed were sane of the problems the volunteer EMT's face. Maintenance problems regarding the ambulances was also discussed. The Commission feels that it is the Ambulance Director's responsibility to handle all arrangements for ambulance maintenance.

At a seperate meeting in the afternoon Bruce Terry, an EMT from Montezuma Creek met with the Commission to discuss the problems with the ambulance service in that area. Mr. Terry reported that it is 60 miles from the nearest hospital which creates a very large bill for anyone needing ambulance service as the cost is based on a fee plus mileage costs. Rayburn Jack, Health Care Services Executive Director, reported that the ambulance charges are following state guidelines.

MONTEZUMA CREEK LIONS CLUB REPRESENTATIVE MEETS

Bruce Terry representing the Montezuma Creek Lions Club met with the Commission to discuss the fee charged by the Montezuma Creek Pool for the use of electricity during a fund raiser. Commissioner Black will check into the circumstances regarding this matter.

DISTRICT FIRE WARDEN MEETS

John Baker, District Fire Warden, met with the Commission to discuss a training session scheduled for the week of Sept. 17th regarding accidents relating to trucks and their various cargos.

Four Corners Solar & Construction The bid proposals will be studied by Commissioner Bailey before a final decision is made.

MONTEZUMA CREEK BRIDGE DISCUSSED

Commissioner Bailey reported that there has been some problems obtaining the right-of-way for the bridge at Montezuma Creek. The DOT needs the right-of-way before the 1st of October so that the funding can come out of this years budget.

GAS CARD AGREEMENT

Commissioner Bailey reported that when the gas card fee was set it was for gas keys which are more expensive. It was decided by the Commission to lower the fee to $10.00 instead of $50.00.

AIRPORT OPERATING AGREEMENT - MONTICELLO

Commissioner Bailey made a motion to accept the airport operating agreement signed by the Mayor of Monticello, and authorize Commissioner Black to sign it. The motion was seconded by Commissioner Low and carried unanimously.

ELECTION RETURNS CANVASSED

Gail Dalton - Johnson, County Clerk, met with the Commission to canvass the election returns from the August 21st primary election. The results are as follows:

HEALTH CARE SERVICES

Rayburn Jack, Executive Director of Health Care Services, and John Fellmeth, Chief Deputy Auditor, met with the Commission to discuss some of the problems relating to the physicians group. Mr. Fellmeth presented the Commission with a comparison of revenue and expenses for the physicians group for January - June, 1983 and January - June, 1984. Also presented was a cost per visit comparison of the present contract and the tentative contract for the Dove Creek Clinic visits. The Commission

is scheduled to meet in Blanding at the Nursing Home tonight with representatives from the Health Care Services Board and the physicians to discuss their new contract. The physicians are asking for increased benefits and salary.

The Commission also reviewed the balance sheets for all of Health Care Services ending July 31st. A copy of a letter to Mr. Jack from Mr. Fellmeth was presented to the Commission.

The letter expresses Mr. Fellmeth's opinion on who has the authority to amend the operating and capital budgets of the San Juan Health Care Service entities. Mr. Fellmeth believes that modifications

to the approved Health Care budgets should be suggested by the Health Care Board and approved by the County Commission.
