The San Juan County Commission met in regular session May 26, 1987 at the hour of 10 a.m. at the San Juan County Courthouse, Monticello, Utah.
The following members were present: Commissioner Black, Chairman
Commissioner Bailey Comnissioner Maryboy
Minutes of the May 26, 1987 Commission Meeting were approved with the corrections on the motion of Commissioner Maryboy and seconded by Comnissioner Bailey. UNANIMOUS.
COMMISSIONER CALVIN BLACK'S REPORT
Utah Counties Finance Coop. - Commissioner Black reported that the Utah Counties Finance Cooperative Board
(Commissioner Black sits on the executive board) met with representatives of Morrison and Knudson. MK
indicated that they have buying power with respect to all purchases and will help and advise the counties
on these. Commissioner Black said the board went to New York last Friday and met with several bonding
companies. The first monies to be available will be in August.
UDOT Extension 163 - Commissioner Black received a letter from UDOT stating that the proposal for
extension of Highway 163 was not submitted soon enough. Comnissioner Black said he will submit a proposal
next year.
Housing Urban Development - The Commission received a letter from Department of Housing and Urban
Development (HUD) stating that they have $99 million in Housing Development Grant funds available.
COMMISSIONER KENNETH BAILEY'S REPORT
Mexican Water Chapter Resolution - Commissioner Bailey discussed the Mexican Water Chapter Resolution for
road repairs and installing of culverts. Commissioner Bailey said there is a problem because there is no
place for the water to go if culverts are installed. The road department plans to crown the requested
road and put shale on top of it.
Reservation Roads - The Commission said that every chapter needs to pass a resolution recommending road
repairs in their area and submit it to the UNDC Board. Then, the UNDC board submits the resolutions to
the county, the BIA and County Commission have to approve them before any roads can be added to the
cooperative roads agreement. The Commission agreed that a time should be set each year for the chapters
to do this.
Deer Flat Road - Commissioner Bailey said that Bernal Bradford, south road superintendent, is in the
process of grading the roads at the Deer Flat area. The Commission agreed that if the road is going to be
used it should be opened up and upgraded so it can be put back on the county road system.
Road Department Employees - Commissioner Bailey reported that Oley Black, south district shop foreman,
deceased last week. Also, Kathy Rogers a secretary at the Monticello road office has submitted her
resignation.
Early Retirement - Rick Bailey, Administrative Assistant, called the Utah State Retirement office and
verified that county employees must notify their employer by September 30 and terminate by December 15 for
the early retirement incentive program (HB 142).
Austin Western Patrol - Commissioner Bailey made the motion to approve the sell of the Austin Western
Patrol for the high bid of $4000 to Bernal Bradford. Commissioner Maryboy seconded the motion.
UNANIMOUS.
Forest Service Roads - Commissioner Bailey said the road department plans work on the Johnson Creek road
but the Forest Service will not let the county go around the Dry Wash Reservoir. Commissioner Black said
he will talk to Bill Boley, Forest Supervisor, in Price about this and other various problems.
Dust Guard - The Commission approved the road department testing three different types of dust guard on
three different miles on the Paiute Farms road.
COMMISSIONER MARK MARYBOY'S REPORT
Library Blanding - Commissioner Maryboy reported that he met with the Library Board and it was reported
that the north side wall at the Blanding library is falling apart, the roof gutter needs repaired and
there is graffiti on the bathroom walls. Commissioner Bailey said he will have someone repair these
damages.
Recreation Director - Commissioner Maryboy said he would like the Commission to consider giving Eddie
Allred, recreation director, a salary increase. Commissioner Bailey said he would like Mr. Allred's
request and other salary requests to be put on the agenda for action in two weeks.
Fire Trucks - Commissioner Maryboy said he met with a Tribal representative who is in charge of revenue
sharing for the fire truck purchases. Commissioner Maryboy said the Tribe indicated that a letter will be
submitted to the Commission notifying then whether the money is available or not.
UNDC and UDIA Board Meeting - The UNDC and UDIA boards are meeting today to decide whether to cut back
UNDC's budget by 40% or 15%. UNDC will also be honoring Herb Clah, director, who has resigned.
LEASED LAND - STATE SCHOOL SECTION
Mike Jones, of Moab, met with the Commission to review his proposed lease of a state school section near U.S. 191 south of LaSal Junction for residential purposes. The Commission said they have no objections if Mr. Jones meets all state and local laws, rules and regulations. The Commission will write a letter to the Division of State Lands expressing their approval of the lease and development.
RETIREMENT PUBLIC SAFETY EMPLOYEES
Gail Johnson, clerk, reported to the Commission that the 1987 Legislature passed legislation which repeals the disability retirement provisions in the Public Safety Retirement System. The repealed provisions are replaced by an authorization for local governments to provide their own long-term disability programs. Mrs. Johnson recommended that the county pick up the difference rather than find another company. Commissioner Bailey made the motion to approve the county to pick up the 5.87% for county public safety employees for the long-term disability. (The total member rate is 12.29%) Commissioner Maryboy seconded the motion. UNANIMOUS.
COUNTY TAX SALE
Gail Johnson, clerk, discussed with the Commission the county tax sale that is tomorrow. The Commission agreed to sell some of the property at market value and others for just the taxes owed plus interest.
REGIONAL CORRECTIONS FACILITY
Joe Slade, Monticello City Council, thanked the Commission for their support of the proposal for the Regional Corrections Facility. Mr. Slade asked for the Commission's continued support and to contact the Department of Correction's committee that is evaluating the proposals. Mr. Slade said the Committee is proud of the support that San Juan County received, especially from the Colorado areas. Rick Bailey, Administrative Assistant, said that the Salt Lake Tribune said it would be narrowed to six sites in the next two weeks. The Commission asked Mr. Slade to get a list of the committee members.
COMMUNICATIONS - NAVAJO MOUNTAIN - ROAD DEPARTMENT SYSTEM
Navajo Mountain - Bill Bayles, communication engineer, reported to the Commission that last Monday he went
-to the communication-site- at Navajo -Mountain-and said the readings-were not good-enough to work-with. The— Navajo Mountain clinic is picking up signals from Abajo Peak.
Abajo Peak - Mr. Bayles said the communication tower on Abajo Peak has been effected by lightning the last couple of days and all the Salt Lake channels have been out.
Road Department - Mr. Bayles said the road department radio system has been out for three months because they are replacing the multi-plex unit. The unit has been shipped but now they need an extra power supply and it will be installed shortly.
Montezuma Creek - Mr. Bayles said that one of the antennas at Montezuma Creek has been stolen and Aneth can not receive channels 7-13. Mr. Bayles said he reported the theft to the sheriff's department. Another antenna has been hooked up so that Montezuma Creek has TV reception. The Commission authorized Mr. Bayles to replace the antenna and also see about having the tower fenced in.
DISTRICT COURT FUNCTIONS - SB-56 - STATE FUNDING
Steve Love, District Court Administrator, Tim Simmons, Regional Director, and Gordon Bissegger met with the Commission to discuss State Funding of District Courts. Mr. Love explained that the Judicial Council appointed a Task Force to study the State District Courts funding and as a result recommendations organized SB-56. During the Legislative Session SB-56 was modified a number of times and the bill consolidated two or three other bills recommending security and bailiff services within all courts and secondary fee issues. However, SB-56 died on the floor of the Senate. Mr. Love said they have been directed by the Judicial Council to meet with each of the 29 county commissions to view the final result of the bill and get more specific input from each of the counties. It is the intent of the Judicial Council to reconsider whether or not to reintroduce SB-56 either in the 1988 general session or in a special session. This will depend of the attitude of the counties.
Mr. Love said the final bill included full funding for facilities and for the State to pay for equipment on a lease arrangement and only equipment that was used exclusively by the District Court would be transferred at no cost. Exceptional issues will be negotiated through a committee that will be established with a Judiciary and Commission. The bill is in the process of being modified and will be available for review within 30 days.
Mr. Bissegger gave the Commission a copy of a summary of the county's expenditures for District Court calendar year 1985. The bill does not call for the state to pick up sanity hearings, service of process, or public defender expenses but will pick up transcripts, civil jury fees and continue to support criminal jury fees. The summary showed that with SB-56 an annual savings to the county would be $31,700.
Gail Johnson, clerk, said she is opposed to contracting because of the two boss system the Circuit Court has now. Mrs. Johnson said if she hires and pays the salary of the clerk of the District Court she does not want the State to say they will only pay so much money make sure it's a full-time job. Mrs. Johnson said if there is a discrepancy in the filings of the District Court who has the liability if a lawsuit is filed against the clerk, the State or the County. The Commission expressed that they would like flexibility in the contract. Mrs. Johnson said that if she ever agrees to contract with the State she expects better service out the State Administrator's office. Commissioner Black said this could be negotiated before the contract is signed.
Mr. Love said the information they have received today will be taken into consideration. They will provide a copy of the revised SB-56 and request that the Commission, clerk and whoever else is involved to review it and make recommendations.
GARBAGE PICKUP - BAKER SANITATION - RURAL AREAS
Les Baker, Baker Sanitation, Inc, met with the Commission to discuss residential and commercial garbage pickup. Mr. Baker said they are presently in Blanding and plan to pickup rural routes in the county. The Commission told Mr. Baker the county has no business requirements and to contact the cities because they own the dumps. Mr. Baker said they will be hiring local help and will training in driving. The Commission said they have no problems with Mr. Baker proceeding with this.
BUS DRIVER - SENIOR CITIZEN
Commissioner Bailey made the motion to approve the hiring of Morris Swenson as part-time senior citizen bus driver at $5.12 per hour (grade 4 step 1). Commissioner Maryboy seconded the motion. UNANIMOUS>
HOSPITAL ADMINISTRATOR - Education Towards a Masters Degree
John Fellmeth, Hospital Administrator, met with the Commission to discuss his employment contract with the County. Mr. Fellmeth said the contract states that during his first four years of employment he may undertake additional educational efforts to obtain a Masters Degree in Hospital Administrator, and the County will reimburse him for expenses incurred, but not to exceed the sum of $8000 for the total four-year period. Mr. Fellmeth said he has selected a program that is a three year program which requires two weeks of on-campus training every summer in Minneapolis. The remainder would be a once a month visit with a local preceptor and correspondence work including a study master thesis. Mr. Fellmeth said he needs a letter of support from the Chairman of the Hospital Board. The Commission approved signing a letter of support for Mr. Fellmeth.
PUBLIC SAFETY BUILDING - AWARD OF BID AND GROUND BREAKING
At 3 p.m. the Commission will attend the ground breaking for the Public Safety Building. Commissioner Bailey made the motion to approve the bid awarding to Valley Builders and also approved the agreement and authorized Commissioner Black to sign the contract. Commissioner Black seconded the motion. UNANIMOUS. The agreement was also signed by Valley Builders which states that the Contractor shall perform the general, mechanical, electrical and elevator work and the work shall be performed and completion be no later than 450 calendar days from the date. San Juan County shall pay the contractor $3,304,000. Commissioner Bailey made the motion authorizing Commissioner Bailey to sign any necessary documents on the Public Safety Building. Commissioner Black seconded the motion. UNANIMOUS. Commissioner Bailey will report all actions to the Commission.
