SAN JUAN COUNTY COMMISSION MINUTES JANUARY 25, 1988

The regular session of the San Juan County Commission convened at the hour of 10:00 a.m. at the San Juan County Courthouse, Monticello, Utah.

A motion to approve the minutes of January 19, 1988 was made by Commissioner Maryboy and seconded by Commissioner Bailey. UNANIMOUS.

CURRENT BUSINESS

Halls Crossing Dump - Bill Duckett, Manager of Halls Crossing met with the Commission to find out the status of the Halls Crossing Dump. Administrative Assistant Rick Bailey reported that the proposed sale has been sent to the BLM District Office in Moab for the signature of Gene Nodine, District Manager. It will then be published in the federal register and have a 45 day comment period before final approval can be made. The earliest possible date for approval would be March 15. Mr. Duckett asked the Commission what the proposals and plans for the landfill would be once it is approved. The Commission indicated the entire area would need to be outlined with corner poles and stakes every 200 or 300 ft. and the area of immediate use would be fenced to contain any rubbish that may be blown around. The Commission indicated a locked gate would also be necessary. The County will be responsible for digging the trenches and either have the area compacted and/or station or sell some equipment to Halls Crossing to use in compacting and covering the refuse. Details will need to be worked out when the Road Department find out what equipment will be available and when the sale of the property is approved. Other users will be charged a fee to help cover the costs of operation. Halls Crossing will be responsible for the fencing and operations. Dry Wash Reservoir - Chairman Norman Nielson of the San Juan Water Conservancy District reported that an application has been submitted to the Forest Service for expansion of the Dry Wash Reservoir. The Commissioners feel that permission to realign and upgrade the road around the reservoir can be obtained from the Forest Service now the application has been filed.

Blanding Clinic Lease Agreements - Hospital Administrator John Fellmeth asked Chairman Black to sign original copies of the lease agreement for each of the doctors for the Blanding Clinic. The lease has previously been discussed and approved. Commissioner Black signed the leases.

Mi Vida Ore Cars - Bob Musselman met with the Commission to inquire as to their decision on the disposition of the ore cars at the Mi Vida mine. Mr. Musselman also indicated there is some track at the mine he would be interested in purchasing. The Commiissioners want to wait for good weather so an inventory of the property can be made and other details can be checked on. Mr. Musselman also asked about a pile of scrap iron on the County Fair Grounds. The County will offer that for sale at the tax sale later this year.

Communications - Communications Engineer Bill Bayles met with the Commission to explain problems connected with the television reception in the area. Channel two has problems with the Orangeville transmitter station. The Channel 20 signal hasn't come in since the changeover. Other channel problems are attributed to individual television sets or to particular areas where reception is of poor quality. Mr. Bayles will check further on the possibility of establishing a single repeater station for the Montezuma Creek, Aneth and Bluff areas.

Uniform Building Code - County Building Inspector Greg Adams met with the Commission to request authorization to renew membership for the 1988 Uniform Building Code. The Commissioners authorized the membership fee of $70.

Sheriff's Department - Sheriff Claude Lacy presented a recommended budget and personnel requirement for the Sheriff's department in the new Public Safety Building. The expected revenues will be $284,000 with an estimated budget of $275,000. It will take 4.3 Deputy Sheriff/Correction Officers and 4.3 Dispatch/Matron/Secretary to operate the new Jail. The new Jail with state prisoners will need to be operated in a professional manner and will need better personnel than in the past.

Because of the new tone system that is being installed in the Public Safety Building the present RCA and Motorola radios in the Sheriff's department will be obsolete. This will only affect the Sheriff's frequency so the radios can be utilized in fire trucks and other County equipment. A motion to purchase four Maxtrac 300, 16 frequency, 45 watt w/scan radios at $697.00 each was made by Commissioner Bailey and seconded by Commissioner Maryboy. UNANIMOUS.

Ucolo Road - Bryan Johnston met with the Commission to request a lift of the 20 ton weight limit on a Ucolo road. Union Carbide is planning to reopen a mine in that area in three or four months and would like permission to haul the ore over the road to Blanding. The weight limit was put on that road to try and save the oil until it can be overlaid. Mr. Johnston will check back with the Commissioners when the mine is reopened.

Monticello City Council - Monticello City Councilman Winn Wescott met with the Commission to discuss mutual problems and how the city can support the County in its programs: impact money, R.N. program and Community Development Block Grant funds.

Title 20 Funding - Winn Wescott and Carol Hall explained the Project Good Work being used in the San Juan County School system. It is a program where the students assemble or build project to be sold on the local market. The schools are trying to teach marketing and entrepreneurial skills through the program. Mrs. Hall indicated the program should be self-supporting within approximately six months with proceeds from the sale of the projects. Mr. Wescott asked if there was any Title 20 monies available for use in the program. The Commissioners indicated the Title 20 program is administered by the Human Services Board and application for funding would need to be made through them.

ADMINISTRATIVE ASSISTANT RICK BAILEY'S REPORT

Pay Phones - A Contel representative felt that it would not be cost efficient for the County to own a pay phone in the new Public Safety Building. Revenues are minimal and upkeep and repairs would probably cost more than the revenues.

Montezuma Creek Road Shed Lease - Administrative Assistant Rick Bailey presented a lease agreement for the Montezuma Road Shed with the BLM. Commissioner Bailey made a motion to accept the lease and authorize Chairman Black to sign it. Commissioner Maryboy seconded the motion. UNANIMOUS.

COMMISSIONER MARK MARYBOY'S REPORT

Stranded People - Commissioner Maryboy reported that people east of Red Mesa and on McCracken Mesa are

still snowed in since the severe snow storm last week and need their roads plowed out.

UNDC - UNDC made a request of $25,000 from UDIA to pay Dr. Nicholes salary when he works at the Montezuma

Creek Clinic. UDIA approved $10,000 and suggested that UNDC approach other sources for the additional

funds.

BUI Lands Available for Grazing/farming - The Navajo Tribe has requested information on any BLM lands

available for grazing or farming in the Long Canyon area. Commissioner Maryboy will contact the BLM on

this matter.

Bluff Community Meeting - Commissioner Maryboy will attend a Bluff Community meeting tomorrow night. COMMISSIONER KENNETH BAILEY'S REPORT

BLM Interagency Meeting - Commissioner Bailey reported the following highlights of the BLM Interagency meeting held last week:

Dyke LeFevre said that the Department of Transportation has received complaints on County roads that need to be signed as primitive roads. People leaving state roads reported damage to vehicles when driving on county roads.

The road from Recapture Dam to Cow Canyon is #3 on the State's priority list and is approximately three years away from construction.

The DOT is going to control the noxious weeds along the state highways in San Juan County. They will be using more chemicals and less mowing.

The State wants to put interpretive signs in Rest Stops on I-70 to tell people where to go and what to see in the area at a cost of about $50,000.

The Cortez Chamber of Commerce is highlighting Hovenweep as a one-day trip out of Cortez.

Harvey Wickware reported they have $400,000 for planning the housing and visitors center at the Needles area. Mr. Wickware hopes everything will be complete up to the construction stage this year.

Some reorganization at Canyonlands is expected; Natural Bridges and Hovenweep will have more autonomy. Conmissioner Bailey interpreted this to mean they will put park superintendents in both areas.

Raymond Carling report there is a deep wildcat well being drilled east of the LaSal Mountains just over the border in Colorado. They are testing the over thrust formation.

Mike Grosjean says they are very close to an agreement with the BIA for reimbursement on wild fires on the reservation.

Don Andrews of SCS said they do not have any responsibility for noxious weeds in the County. Snow Removal - Commissioner Bailey reported there are still roads within the County that have not been plowed out since the recent snow storm and people are still stranded in their homes. School officials reported a severely handicapped Navajo boy on Douglas Mesa hasn't been to school since the storm. The BIA in Tuba City plowed out the roads in the Navajo Mountain area and the County will reimburse then for the overtime they would have to put in. The County is getting to the rest of the roads as soon as possible.

Department of Transportation Meeting - The Department of Transportation will meet with San Juan County Commissioners and the Road Department on March 10 at 9 a.m.

BLM/Blankenagel Property - Commissioner Bailey met with Jim Blankenagel to get more information of the property in question. Lucien Tangren homesteaded the land and was paying taxes on it. The property was later sold for delinquent taxes and San Juan County assumed ownership. Joe Redd bought it in 1953 and received a tax deed. Because the homestead was apparently not proved upon, it is still legally BLM land. The County was taxing him on it and when he went bankrupt they sold it to Joe Redd in 1953 for $950. Mr. Redd sold it to Jim Blankenagel for about $78,000. The BLM now wants to charge Mr. Blankenagel $16,000 for the property. He has been paying property taxes and a BLM lease on it for the past few years. Mr. Blankenagel has made considerable improvements on the property and does not want to lose it but can't afford to pay the BLM. Commissioner Black asked Administrative Assistant Rick Bailey to contact Pete Christensen of the BLM office in Moab to see if there isn't some administrative way the property can be deeded to Mr. Blankenagel. Another alternative would be to introduce a bill into the U.S. Senate and House of Representatives for action. Another possibility would be for Mr. Blankenagel to deduct the amount he has to pay the BLM from the amount still owing to Mr. Redd.

COMMISSIONER CALVIN BLACK'S REPORT

CNS - A letter from Jan Treml of the Community Nursing Service stated that CNS would not be able to

provide hone nursing care in San Juan County without assistance from the County. Mrs. Tremel felt the

best solution to the problem would be to transfer the services to the Southeast Utah Health District.

Commissioner Black will attend a meeting of the Southeast Utah Health District tomorrow night and

recommend the transfer of services be made.

BLM, Moab District, Advisory Council - Commissioner Black has received a letter dated January 7, 1988 from

Secretary of Interior Hodell appointing Mr. Black to another three-year term on the Moab District BLM

Advisory Council ending December 30, 1990.

Stream/Channel Alterization Meeting - A meeting will be held Wednesday, January 27th at 1:30 p.m. in the

Carbon County Courthouse to review the new state program general permit issued by the U.S. Army Corp of

Engineers, State of Utah, to establish new regulation guidelines for stream/channel alterizations made in

the State.

Mineral Lease Fund Lobbying - A letter explaining the lobbying efforts of Creamer & Noble Engineers in

behalf of the Mineral Lease Road Program was received. Legislation has been prepared to create a "Mineral

Lease Road Program" similar to the "B" Road System. The counties would receive from the State quarterly

payments of up to 25% of the mineral lease funds generated in their own county. This money will be

administered through the Utah Department of Transportation and

will be for construction and maintenance of industrial, mineral, and energy related roads. If the

legislation passes, San Juan County would receive $283,200 in 1988, $708,000 in 1989, and $1,160,000 in

1990 and 25% of Mineral Lease Funds generated thereafter. San Juan County's portion of the lobbying

effort is $5,665.00. Representative David Adams indicated that he felt the bill would be passed.

BLM Resource Management Plan - Commissioner Black met with State Representative David Adams to discuss

some legislative issues. Representative Adams is very concerned about the BLM Management Plan and has met

with Reed Searle and Dee Hanson at the State level in getting them to work on a response and a protest to

the plan. If the Plan is given final approval, the State may even have to go to court because it would

have an impact on State Lands in the area.
