SAN JUAN COUNTY COMMISSION MINUTES APRIL 25, 1988
The regular session of the San Juan County Commission convened at 10:00 A.M. at the San Juan County Courthouse in Monticello, Utah.

A motion to approve the minutes of April 18, 1988 as corrected was made by Commissioner Bailey and seconded by Commissioner Black. UNANIMOUS.
COMMISSIONER KENNETH BAILEY'S REPORT
Public Safety Building - A proposal was submitted by Delta Geotechnical Consultants, Inc. for additional
investigation concerning slab settlement at the Public Safety building. The cost of the field
investigation, laboratory, work, analysis, engineering, data reduction and report will be from $97,000 to
$13,000. Commissioner Bailey made a motion to approve the proposal and authorize Chairman Black to sign
the contract. Commissioner Black seconded the motion. UNANIMOUS. ,
Stmoke-Free Hospital - Commissioner Bailey reported that the public hearing was held on a smoke-free
hospital and a decision will be considered at the Hospital Board Meeting.
Monument Valley Dump Site - Commissioner Bailey will attend a meeting at Gouldings on April 26th to
discuss the development of a properly fenced and maintained dump site for the Monument Valley area.
Oljato to Navajo Mountain Road/Engineering Appropriation - Commissioner Bailey presented copies of letters
sent to Senator Garn and Representative Nielson regarding a special appropriation for the engineering of
the road from Oljato to Navajo Mountain.
Peters Hill - Letters of appreciation have been sent to Darroll Young and Sam Taylor for their initiative
in getting the alignment problems on Peters Hill straightened out prior to the completion of the present
road construction project.
Road Equipment/hoist - Bids were received for one twin-post electric hydraulic clear-floor hoist, 12,000
pound capacity, from Professional Automotive Equipment for $7,500 installed, except wiring. One four-post
truck lift, 12,000 pound capacity, from F. W. Jones & Assoc. for $3,712 plus freight and installation.
Commissioner Bailey made a motion to approve the bid from Professional Automotive Equipment for $7,500
because of design, warranty and professional interest. Commissioner Black seconded the motion.
UNANIMOUS.
Gas Pump Island Wiring/Blanding Road Shed - Bids for installing conduit and circuits for lights on the gas
pump islands at the Blanding Road Shed were received from A & E Electric for $1,900 including trenching
and from Northern Electric for $850 with the county doing the trenching. A motion to approve the bid from
Northern Electric was made by Commissioner Bailey and seconded by Commissioner Black. UNANIMOUS.
Monument Valley to Oljato Road - County Engineer Doug Pehrson is negotiating with Brazier on mixing road
materials for the Monument Valley to Oljato road.
COMMISSIONER MARK MARYBOY' S REPORT
Bluff Mosquito Problem - USU Extension Agent Jim Keyes met with the commission regarding the mosquito problem in Bluff. Mr. Keyes recommended purchasing a chemical fogging machine to rectify the problem. Bids for a ULV-500 Mosquito Fogger was received from Reliable Labs for $4,850 and Lowndes Engineering Co. for $5,000. Commissioner Maryboy made a motion to approve the bid of $4,850 from Reliable Labs. Commissioner Bailey seconded the motion. UNANIMOUS. The chemicals for the machine will probably run approximately $100 a year.
BLM San Juan Area Resource Management Plan - Commissioner Maryboy will contact the Navajo Nation and Utah Chapter officials regarding the pending dates for discussion of the comments for the San Juan Area Resource Management Plan.
COMMISSIONER CALVIN BLACK'S REPORT
Lake Powell Land Exchange - Commissioner Black attended a meeting of the Lake Powell Region Resource Development Council in regard to the Lake Powell proposed land trade. Dee Hansen opened the meeting by stating that the purpose of the committee was to enhance the management and enjoyment of Lake Powell and provide economic development and economic benefits for Utah. Jay Willey, representing Dave Adams, reiterated the benefits of tourism and resort type facilities in the area. Mr. Willey highlighted those kind of things that would reduce the uncontrolled impact where people just go out without any services or facilities. Pat Spurgin addressed the group on the purposes of the state trust lands and the benefits of exchanging for lands in areas of high potential development and economic purposes and could also meet the requirements of protecting the resources. Jerry Miller spoke on the enhanced recreation opportunities for Utah.
U.S. Forest Service - An article in the Salt Lake Tribune stated that, according to Intermountain Regional Forester Stan Tixier, the U.S. Forest Service is considering charging user fees to sportsmen hunting on public lands. Mr. Tixier said similar user fee experiments are already being conducted on some national forest lands in New Mexico. The money collected would be used to add to or improve wildlife habitat on public lands.
Darrell Nish, chief of the Division of Wildlife Resources resource analyses section said he had problems with such user fees. He stated there is a big difference between those who use the land to make a living and those who use the land for recreation. The public deserves some return for its investments into those lands. That means free access to public lands.
Tom Bingham of the Utah Farm Bureau delivered a stinging anti-wilderness message to the Utah Wildlife Federation delegates and said sportsmen and agricultural interests should sit down and negotiate their differences.
Tax Limitation Initiatives - An article in the Salt Lake Tribune stated that the average property tax in Utah is edging upward. Utah voters amended the Utah Constitution in 1982 to permit a modified classification of the property tax. The average statewide tax level for classes of property in 1987 were: owner-occupied residential, .97 percent; other locally assessed, 1.29 percent; and state assessed or personal, 1.62 percent. Commissioner Black stated that he was not aware that they figured a percentage of market value to assess oil and gas. If that figure is right and the tax limitation initiatives pass, contrary to what was discussed last week, it will affect San Juan County more than any other county in the State. The County would lose, in effect, more than 1/3 of the assessed value from oil and gas without any other consideration. About 25% of the commercial value would be lost and about 22 or 23% on residential. That would be the impact on the County's assessed value and revenues.
Hospital Board - The commissioners commented on an article in the April issue of Trustee magazine regarding medical staff appointments and privileges and the key role of the governing board. According to the article, the decision criteria for granting medical staff appointments and privileges at level one, the applicants must have the following:
A valid license in all states that apply
Evidence of completed training, including undergraduate and medical school
education, residency, fellowship, or other training, if claimed
Current and adequate malpractice insurance
A completed application
Level Two, failure to comply with or adequately address two or more of the following might lead to withholding or restriction of privileges:
No past or pending disciplinary actions by hospitals, professional societies, or specialty boards
Satisfactory recommendations regarding professional performance, clinical skills, ethical character, and ability to work with others
No reductions or revocation of privileges at any hospitals
Good standing at current hospitals
Satisfactory performance and clinical judgment
No patterns of adverse clinical outcome
Compliance with bylaws, rules, and regulations
Satisfactory physical and mental health
Adequate use of privileges previously granted
No past or pending malpractice suits or claims
The liability considerations of denying, modifying, or revoking a physician's privileges were also discussed. The board must ensure that it does so in accordance with the hospital's bylaws and with constitutional or common-law requirements of due process.
ADMINISTRATIVE ASSISTANT RICK BAILEY'S REPORT
Hall's Crossing Dump - A letter from the Monticello District BLM office indicated they would sell a parcel of land, consisting of 20 acres, for the Halls Crossing landfill for the sum of $2,600. The site has been surveyed and brasscapped. Commissioner Bailey made a motion to approve the purchase and Commissioner Black seconded the motion. UNANIMOUS. As soon as the check is received a patent will be issued. The BLM is also proceeding with the requests for landfill sites at Bluff and Mexican Hat. The placer claims on the Montezuma Creek site make it very difficult to acquire. Commissioner Maryboy will check to see if a suitable site can be found on the reservation.
Montezuma Creek Police Station Remodeling - A request has been received from the Navajo Tribal Police for the San Juan County Cornnission to be the agent for the bidding on the remodeling of the old elementary school into a police sub-station.
Aging Contract - A motion to approve an amendment to the aging contract for fiscal year 1987 was made by Commissioner Black and seconded by Commissioner Bailey. UNANIMOUS. The amendment decreases funding in the amount of $4,207.00.
CURRENT BUSINESS
Baker Sanitation - Maintenance Engineer Dell Hunter met with the commission regarding the burning of confidential papers. Baker sanitation will not clean out the incinerator and Monticello City has requested that the burning be suspended. The commission authorized Mr. Hunter to obtain bids for the purchase of a shredder for county use.
Pioneer Estates Sub-division - Keith Rogers, trustee of the Clarence Rogers Trust, met with the commission to try and regain possession of property that was lost because of delinquent taxes. Mr. Rogers asked for the consideration of the commission in that matter and is submitting a letter to County Attorney Craig Halls to make a recommendation to the commission.
Vehicle/Sealed Bids/Surveyor's Department - Sealed bids for the purchase of a Blazer for the Surveyor's Department were opened. Mike Young, Inc. bid $14,800 and Tom Redd, Chevrolet bid $14,678. Because of the two percent county preference to local vendors, Commissioner Bailey made a motion to award the bid to Mike Young, Inc. Commissioner Black seconded the motion. UNANIMOUS.
Road Department Emloyee/Blanding - A motion to approve the hiring of Frank Benallie as a six-month road department employee at grade 5 step 1, $6.02 per hour, was made by Commissioner Bailey and seconded by Commissioner Black. UNANIMOUS.
Bluff Special Cemetery District - A motion to proceed with the advertising on the creation of a special cemetery district for the Bluff area was made by Commissioner Maryboy and seconded by Commissioner Bailey. UNANIMOUS. The public hearing on this issue will be held on June 6.
BLM San Juan Area Resource Area Management Plan - Responses for the BLM San Juan Area Resource Area Management Plan need to be submitted to the BLM by June 13th. The commission scheduled meetings on May 16th in the courthouse and May 19th in Blanding and May 20th in Bluff to meet with people interested in submitting comments.
