MINUTES OF THE SAN JUAN COUNTY COMMISSIONERS MEETING HELD

May 21, 1984

The San Juan County Commissioners met in regular session on Monday, May 21, 1984, at the hour of 10:00 a.m. in the San Juan County Courthouse at Monticello, Utah.

The following members were present:

Commissioner Calvin Black, Chairman Commissioner Kenneth R. Bailey Commissioner Robert Low

Commissioner Black was excused at the noon recess to enable him to testify in Washington, D.C. at Senate Hearings.

Minutes of the previous meeting were approved with the specified corrections on the motion of Commissioner Low. The motion was seconded by Commissioner Bailey and carried unanimously.

WHITE MESA VOTING PRECINT ESTABLISHED

Gail Dalton, County Clerk, met with the Commission to discuss the establishment of a voting precint in White Mesa. Commissioner Bailey made a motion to create a new voting precint in White Mesa to be known as White Mesa #20. The motion was seconded by Commissioner Low and carried unanimously.

STATE RETIREMENT SYSTEM DISCUSSED

Gail Dalton, County Clerk, met with the Commission to discuss her request to withdraw from the State Retirement Program. Miss Dalton would like to invest the employer and employee share and would like to know if that would be possible. Commissioner Bailey made a motion to allow elected officials and any others provided by state law to withdraw from the State Retirement Program and to allow them to receive the same amount of funds for private investment that goes into the program. The motion was seconded by Commissioner Low and carried unanimously.

POLICIES AND PROCEDURES ADOPTED FOR SHERIFF'S OFFICE

Sheriff Rigby Wright met with the Commission to recommend the adoption of policies and procedures for the San Juan County Sheriff's Office. Commissioner Low made a motion to adopt the recommended policies and procedures for the Sheriff's Office. The motion was seconded by Commissioner Bailey and carried unanimously.

DUI ENFORCEMENT GRANTS APPROVED

Sheriff Rigby Wright met with the Commission to review the approved DUI Enforcement Grants. The following are the requested and approved amounts:

A total of $55,000 in DUI Enforcement funds were approved. Sheriff Wright also reported that a task force is needed to oversee the funds. The following names have been recommended for the task force:

Commissioner Bailey made a motion to authorize Commissioner Low and Sheriff Wright to appoint the above people and to report back to the Commission. The motion was seconded by Commissioner Low and carried unanimously.

OLD CLINIC BUILDING IN BLANDING DISCUSSED

The Commission reviewed the proposals for the disposition of the old clinic building in Blanding. A request has been made by U.D.I.A. for the building to be used as a Chapter House for off reservation Navajos. The San Juan School District has also requested the use of the building for a training school for handicapped children and adults.

Commissioner Black feels the use of the building should go to the U.D.I.A. because he had indicated that they could use it prior to the School Districts request.

Commissioner Bailey also feels the use of the building should go to U.D.I.A. because of a prior commitment before the School Districts request.

Commissioner Low expressed a differing opinion on the matter stating that he does not

feel the prior commitment is binding, as it was not an official decision by the Board.

Commissioner Low is in favor of the School District getting the use of the building because of the need for this type of program.

Commissioner Low made a motion to grant the use of the building to the San Juan School District. The motion died for lack of a second.

Commissioner Bailey made a motion to grant U.D.I.A. the use of the building. Commissioner Black passed the chair to Commissioner Low and seconded the motion. The voting was as follows:

Commissioner Black - Aye Commissioner Bailey - Aye Commissioner Low - Nay

The voting was 2 in favor and 1 opposed. COMMISSIONER BLACK TO TESTIFY AT SENATE HEARINGS

Commissioner Black reported that he will be testifying before the Senate Sub-Committee on Energy and Mineral Resources in Washington, D.C. on May 23rd. Commissioner Black will testify on Senate Bill 2157 which was introduced by Senator Jake Garn. The bill will authorize the B.L.M. to dispose of gravel through free-use permits to local governments and to sell it for private use. Commissioner Black further reported that the U.A.C. will furnish the airline tickets for the trip.

PROSPECTUS FOR CONCESSION PERMITS IN CANYONLANDS NATIONAL PARK RECEIVED

The Commission received a copy of the prospectus for concession permits to provide vehicle tours in Canyonlands and Arches National Park. Commissioner Black reported that any applicants from San Juan County will be excluded due to the permits that are required. The Commission instructed the Deputy Clerk to write a letter to Mr. Pete Parry recommending they consider requests from operators who do not have a current permit form, but if selected be given time to qualify for required state permits.

BIDS FOR COURTHOUSE AIR CONDITIONING OPENED

The Commission opened the sealed bid proposals for air conditioning in the Courthouse. The following bids were received: Abajo Electric $3,680

3-330 cfm coolers as per specifications including electrical. Monticello Plumbing and Heating $4,470

3-330 cfm coolers as per specifications does not include electrical.

Commissioner Bailey made a motion to accept the low bid from Abajo Electric with a completion date of June 30th. The motion was seconded by Commissioner Low and carried unanimously.

WEED CONTROL FUNDS REPORTED

Commissioner Bailey reported that the Weed Board met last week and the County participation will be for a minimum of $100. worth of work with a maximum of $300. worth. The County will reimburse 1/2 of the cost.

PRAIRIE DOG CONTROL EXPERIMENT PLANNED

Commissioner Bailey reported that Bob Thompson and Jim Heaton will conduct a prairie dog control experiment documenting the results of the experiment. On completion of the experiment the results will be reported to the Commission.

BUILDING PERMITS APPROVED

Commissioner Low made a motion to approve the following building permits. The motion was seconded by Commissioner Bailey and carried unanimously.

LA SAL DUMP DISCUSSED

Commissioner Low reported that the dump road in LaSal is in need of gravel. Commissioner Low also reported that a proposal was made by Lane Fuller to push the dump on a monthly basis. Commissioner Bailey reported that before a proposal could be accepted the Commission would have to invite bids on the project.

HEALTH CARE SERVICES

The Commission received a copy of the minutes from the May 15th Health Care Services Board meeting.

Commissioner Bailey as Acting Chairman drafted a letter to the City of Blanding requesting that a water connection fee of $5,262 be waived for the nursing home addition as there is already a water connection. The Commission agreed that the sewer hookup fee of over $4,000 is justified.

LETTER FROM CEO RECEIVED

The Commission received a letter from Mr. Lynn Lee, Director for the College of Eastern Utah - San Juan Center. The Center expressed their appreciation for the donation of gravel from the County.

SPECIAL MEETING FOR THE SALE OF HEALTH CARE SERVICE BONDS

Commissioner Low made a motion to officially authorize Commissioner Bailey to be Acting Commission Chairman at the special meeting for the sale of the Health Care Service bonds. The motion was seconded by Commissioner Bailey and carried unanimously.

COUNTY CLERK MEETS

Gail Dalton, County Clerk, met with the Commission to discuss the Commission's request for room rates in Salt Lake for County employees. Thus far rates have only been received from the Mansion House they are as follows: $25.00 single

STATE TAX COMMISSION FORMAL HEARING DISCUSSED

Barbara Montella, County Assessor, met with the Commission to report on the formal hearing with the State Tax Commission. Mrs. Montella reported that residential property will stay the same but commercial and unimproved property will have to be brought up to market value as required by the 1983 factoring order plus increased an additional 12%. Mrs. Mon-tella further reported that the County Attorney will file a petition requesting another formal hearing so that additional information may be presented.

Commissioner Black reported that he attended the State Tax Commission meeting in Price for County Commissioners. A review of the present tax code and plans for recoding the tax code was discussed.

BLUFF TO MONTEZUMA CREEK ROAD DISCUSSED

Commissioner Bailey reported that there will be a pre job conference on the Bluff to Montezuma Creek Road held in the Commissioners' Room on Thursday.

Commissioner Low made a motion to accept the engineering agreement including the addendum with Creamer and Noble Engineering for the design of the Montezuma Creek Bridge in the amount of $42,000. The motion was seconded by Commissioner Bailey and carried unanimously.

ROAD SCHOOL ATTENDED

Commissioner Bailey reported that the following persons attended the Roads School held earlier this month.

COUNTY SURPLUS AUCTION SCHEDULED

Commissioner Bailey reported that the County Surplus Auction is scheduled for June 16th at 1:00 p.m.

AGREEMENT WITH EMERY COUNTY FOR T.V. TRANSLATOR

Keith Lake, Emery County Communications Engineer, met with the Commission to discuss the agreement between San Juan County and Emery County on the translator. Commissioner Low made a motion to approve the agreement and to authorize Commissioner Bailey to sign it. The motion was seconded by Commissioner Bailey and carried unanimously. The agreement is as follows:

AGREEMENT

This agreement made and entered into on the date hereinafter indicated by and between EMERY COUNTY, a body corporate and politic, hereinafter referred to as "Emery", and SAN JUAN COUNTY, a body corporate and politic, hereinafter referred to as "San Juan";

WITNESSETH:

1. Emery shall order the following described items:

a. three UXL 20 translators

b. one 3-channel combiner

c. one 30-foot tower structure

d. 40 feet of R.F. coaxial cable

e. miscellaneous hardware and concrete necessary for installation of the above items.

2. San Juan shall remit to Emery fifty (50%) per cent of the cost of said items.

3. Emery and San Juan shall each bear fifty (50%) per cent of the cost of instal-lation either by providing labor or by paying fifty (50%) per cent of the cost.

4. The parties hereto acknowledge and agree that the items mentioned herein will be installed at the present site on Horn Mountain in Emery County, Utah.

5. The parties further acknowledge and agree that San

Juan will purchase and install two ten-foot dishes at Horn Mountain site.

IN WITNESS WHEREOF the parties have hereto set their hands the day and year first above written.

BLUE/CROSS BLUE SHIELD INSURANCE

John Fellmeth, Chief Deputy Auditor, met with the Commission to discuss the Blue Cross/Blue Shield insurance proposal. The Commission agreed to accept the proposal for health insurance. The Commission will make a decision on dental or life insurance at a later date.

INSURANCE REPRESENTATIVES MEET

John Swindle from American Families Insurance met with the Commission to present a proposal for group life insurance.

Doug Boyle from Boyle Insurance met with the Commission to discuss the amount of coverage needed on the old elementary school in Montezuma Creek.

MONTICELLO GUIDE DOG CLUB MEETS

The following representatives from the Monticello Guide Dog Club met with the Commission to discuss a Community Pride Project Proposal.

Also in attendance was Sharon Riley and Linda Kilgrow. The project is for setting up

2 flagpoles and 4 flags at the entrance to the County Fairgrounds. The flags to be flown are United States, State of Utah, San Juan County and a 4-H flag. The club is

applying for a grant from Chevron USA for funding for this project. The Commission commended them on a wonderful idea for a community project. The Commission instructed the Deputy Clerk to write a letter to Chevron USA expressing their approval for this project.
