SAN JUAN COUNTY COMMISSION OCTOBER 20, 1986

The San Juan County Commission met in regular session on October 20, 1986 at the hour of 10 a.m. at the San Juan County Courthouse, Monticello, Utah.

The following members were present: Commissioner Black, Chairman

Commissioner Holliday Commissioner Bailey

Minutes of the October 13, 1986 Commissioner's Meeting were approved on corrections by the motion of Commissioner Holliday and seconded by Commissioner Bailey. UNANIMOUS.

MONTEZUMA CREEK FIRE BUILDING - burglarized

George Kensley, fire warden, reported to the Commission that the Montezuma Creek fire station was burglarized last week. Mr. Kensley said the person must have gone down the open hallway irt the building, up through the ceiling, and kicked the ceiling in. A battery charger and extension cord were taken and the estimated damage of the ceiling is about $300.00. Mr. Kensley said the building needs to be more secure and the doors in the hall need to be chained and/or padlocked. The ambulance is also in this building and there has not been an inventory done to see if anything was taken from it. The sheriff's department is investigating this.

MERIT COMMISSION - ALTERNATE MEMBER APPOINTED

There will be a Merit Commission meeting tomorrow October 21, for the grievance of Phil Bolduc, deputy sheriff. Due to the absence of R.J. Fellmeth, merit commission member, the Commission need to appoint an alternate. Commissioner Bailey made the motion to appoint Edward Boyle as an alternate to the Merit Commission. Commissioner Holliday seconded the motion. UNANIMOUS.

ELECTED OFFICIALS MONTHLY MEETING

Assessor - Barbara Montella said that everything in her office was just fine. The corrected tax notices

have been put on the computer and sent out in the mail.

Recorder - Mary Lou Mosher told the Commission that she needed two new typewriters in her office. It was

brought up that the Sheriff's office and the Clerk's office also need new typewriters. Commissioner

Bailey said he would like Ron McDonald (an IBM typewriter repairman) to look at and evaluate all of the

typewriters in the courthouse before a final decision is made.

Mrs. Mosher reported that she was appointed to the Lands Record Committee of the National Association of

County Recorders and Clerk for 1987.

Sheriff Rigby Wright said the opening week-end of the 1987 deer season started with problems of hunters

gaining access to public and private lands on certain roads. A policy needs to be set before next year to

prevent this from happening again. The Commission said if it was a county road the county's regulations

prohibit locking of gates. Commissioner Bailey said he would provide Mr. Wright with a list and a map of

the county's B and D roads.

Mrs. Johnson said that the Democrat and Republican parties may want to have poll watchers at some of the voting places because of the write-in candidates in this county election.

UTAH STATE REPRESENTATIVE DISTRICT 74 - DAVID ADAMS Trust Fund

David Adams, state representative, met with the Commission to discuss various topics. The Commission asked Mr. Adams about the amendment to the Trust Fund and how it was standing as of now. Mr. Adams said there should be no problems in getting it started again this year. Last year, the Trust Fund amendment went through the committee and to the board, but it never got it into the Senate. Mr. Adams said he will have it prefiled and ready for early consideration and a full hearing. Roads Needs Study

Commissioner Bailey told Mr. Adams that he would like to discuss the statewide road needs study contract between UDOT and the Joint roads comnittee. Mr. Bailey said he is going to provide some information to the study people on the gravel and dirt road maintenance because UDOT assumes it's not available in the state. Commissioner Bailey gave Mr. Adams some information on this. Automobile taxes

Mr. Adams said he is on a committee that is considering some legislation that Barbara Montella, Assessor, might want to give some input on this. A couple of years ago there was a proposition for in-lieu tax on automobiles and the committee is formulating legislation on this. If the proposal to the State Tax Comnission is accepted in its entirety, the state employee in the county assessor's office may be lost. The State Tax Commission's argument is that the reason the state should take it over is that they can do it more efficiently and save money. Mrs. Montella said the state only pays the county $200.00 a month and believes it will not work as proposed. There would only be one regional office for the southern area and that would be in Price. The Commission said they would like to see it implemented so that everyone would have to pay a fee on their automobiles. If it changes to in-lieu-tax instead of the assessed evaluation, it would probably be figured on the highest valuation in the state. Driver's education in the school system

Mr. Adams said there is a push to eliminate driver's education from the public school system. Mrs. Montella said the money that the Assessor's office collects from automobile licensing for driver's

education goes directly into the state driver's education fund. Mr. Adams said he is not sure if

eliminating the driver's education from the state school system is right because this money comes from

automobile funds. A private training course would have to be set up in each community and it could be

costly to the individual.

Mined Land Act

Commissioner Black said he would like to see an amendment to the Mined Land Act, to repeal it's

application on all federal lands. It should be repealed because the state law is a duplication of the

federal regulations on mining claims on federal lands. This hurts the small miner in the state, causes

conflicts and is a waste of money.

Driving under revocation

Bruce Halliday, county attorney, asked Mr. Adams that if someone has their license revoked for driving

under the influence in another state and if they come into Utah and drive (without a license) can Utah

charge them for driving on revocation. The statute reads that if they are charged on revocation they have

to be revoked under the Utah law, so if they lose their license in one state then they can't be tried in

another state. Mr. Halliday said the statute language needs to be changed so that these problems don't

arise.

Local Option Gasoline Tax

Commissioner Black said there is a proposal in the state for local option gasoline tax. The bill has been

prefiled and will permit local entities to impose a gasoline tax. This has a lot of support and will

provide a back door to get more money from the B & C road funds.

Social Services

Rick Bailey, aging department, explained the county's feelings on the Social Services proposal to join the

alcohol, drugs and mental health programs and turn the operating authority over to the counties. The

Commission is opposed to this because the state has the expertise to operate this. The rural areas will

have a hard time locating competent people to administer this program. The Commission support the aging

and adult services program to remain in tack.

STATE SCHOOL BOARD EDUCATION CANDIDATES

Harold S. Jensen and Valerie J. Kelson, candidates for state school board met with the Commission to give a little of their backgrounds and qualifications.

SOUTHEASTERN UTAH ECONOMIC DEVELOPMENT DISTRICT

There will be a Development District Board meeting tomorrow at 5 p.m.

NEEDLES - NATIONAL PARK SERVICE

Carl Eisemann reported that the San Juan Development Board selected Buddy Redd to represent the board in working with the National Park Service on the planning for a new visitor center and campground at the Needles.

COMMUNICATIONS - TEMPORARY HELP - BILL BAYLES

Bill Bayles, communication engineer, met with the Commission to request temporary help. Mr. Bayles said he needs help in going to Abajo Peak this winter. Mr. Bayles said the new building on Abajo Peak will not be finished until next sunnier. The Commission approved the temporary help.

SAN JUAN WATER CONSERVANCY DISTRICT - EXECUTIVE SESSION

At 1 p.m. the Commission went into an executive session to discuss the San Juan Water Conservancy District.

The Commission came back into session and discussed the need to appoint three new members. The Commission will look at the recommendations and make the appointments before next year. The Commission and the District agreed to meet annually to review and recommend new members and also to review the projects and audits. The Commission and the District will also send each other their meeting minutes where each are concerned. Recapture Lake

Norman Nielson, a member of the District, said that the upkeep of Recapture Lake is getting out of hand. Commission said that a private individual would not have much interest in it. The Commission will discuss this problem with the BLM.

SALES AND USE TAXES - UAC

The Commission received a memo from UAC stating that Salt Lake County Amendment to Proposed Agreement Between Counties and the State Tax Commission Regarding Sales and Use Taxes. The Commission will ask Bruce Halliday, county attorney, to review the amendments.

HOSPITAL ADMINISTRATOR - JOHN FELLMETH

The Commission hired John Fellmeth as the new county hospital administrator. Mr. Fellmeth reported that he had met with most of the hospital employees and asked for their support and help. The Commission met with Mr. Fellmeth to discuss the hospital policy of cash payment due upon the time of the service. Commissioner Black said he received a call from a concerned resident who had insurance but was required to pay cash and there has been several other complaints on this. Mr. Fellmeth said he would review the policy.

Ambulance Mr. Fellmeth asked the Commission if Rick Bailey, administrative assistant, could continue working with the county's ambulance service, maintenance, and also meeting with the EMT associations. Mr. FelLmeth said he would take over the finance end of them. The Commission asked for an explanation of this to be presented to the Health Board.
