MINUTES OF THE SAN JUAN COUNTY COMMISSIONERS MEETING HELD
NOVEMBER 1, 1982
The Board of County Commissioners met in regular session on Monday, the 1st day of November at the hour of 10:00 a.m. in the Courthouse at Monticello, Utah.
On roll call, the following members were present: Commissioner Calvin Black, Chairman
Commissioner Robert Low Commissioner Kenneth R. Bailey
Minutes of the previous week were read and approved with the specified corrections upon the motion of Commissioner Low and the second of Commissioner Bailey and it carried unanimously.
BLUFF-MONTEZUMA CREEK ROAD PROJECT BID AWARDED;
Having reviewed and varified all unit prices and totals on the nine bids received for the Bluff to Montezuma Creek Project, County Engineer, Doug Pehrson, reported to the Commission that the bid from Summit, Inc. was the lowest.
Commissioner Bailey moved to award the bid for the County Road #216 Bluff-Montezuma Creek Project to Summit, Inc., of Rapid City, South Dakota, for the total bid price of $2,362,770.44. The motion was seconded by Commissioner Low and it carried unanimously.
Mr. Pehrson reported that Summit, Inc. will begin work on the project from the Montezuma Creek side approximately 10 days after they receive the Notice to Proceed. He also reported that George Thompson will send the advance construction authorization to use "B" & "C" Collector Road funds.
BLM APPLICATION - AUTHORIZATION FOR COUNTY ENGINEER TO SIGN RIGHT-OF-WAYS:
Upon the motion of Commissioner Bailey and the second of Commissioner Low it was unanimously voted to authorize Chairman Black to sign the application to the BLM for the right-of-way on the adjustment for the Bluff-Montezuma Creek Road Project, and to authorize the County Engineer, Doug Pehrson, to sign right-of-way applications on all county roads with the BLM. Chairman Black, then signed the right-of-way application for the Bluff-Montezuma Creek Project.
DEPARTMENT OF TRANSPORTATION COOPERATIVE AGREEMENTS APPROVED ON BLUFF TO MONTEZUMA CREEK PROJECT: Upon the motion of Commissioner Bailey and the second of Commissioner Low, it was unanimously voted to approve the Cooperative Agreement between San Juan County and the Utah Department of Transportation for Construction Engineering - Bluff to Montezuma Creek Project No. NF-0408(1), and the Cooperative Agreement #2 - Bluff to Montezuma Creek Project for peliminary engineering including location, roadway design, quantities, hydraulics and materials report, and authorize Chairman Black to sign the agreements in behalf of the County.
PACK CREEK ROAD:
Commissioner Bailey reported that trucks have been running over-loads on a section of the Pack Creek Road,
and he has insturcted Road Superintendent, Bernal Bradford, to report the violations to the Sheriff's office.
COUNTY ROADS NEAR COLORADO BOUNDARY;
Commissioner Bailey reported that the majority of complaints concerning the county's roads near the Colorado
boundary have been made by individuals driving vehicles licensed in Colorado.
HEALTH CARE SERVICES REPORT ON STATE RETIREMENT SYSTEM, BLANDING CLINIC, AND HOSPITAL UPDATE; Health Care Service Administrator, Bill Reger, reported that the hospital employees which were not accepted back into the State Retirement Fund have been surveyed and all opposed being reinstated in the program and they would probably support actions to obtain the balance of the funds invested in their behalf with the State Retirement Fund if the cost were not too high. The Commission considered the report and requested that the County Attorney give the State Retirement Fund notice that the County will be submitting a claim in this matter.
Mr. Reger, the County Attorney and the Commission reviewed the lease agreement for the new Blanding Clinic and the agreement was satisfactory except for a few minor changes which will be made.
Mr. Reger reported that the hospital is currently operating at a 28-33% occupancy rate. Plans are being prepared to make room #14 into a two-bed emergency room and the old emergency room will be remodeled to accommodate a two-bed intensive care unit. Mr. Reger also reported that he is continuing efforts to recruit physicians of various specialties and a radiologist to the county.
PERSONNEL POLICY CONCERNING HEALTH INSURANCE BENEFITS;
Upon the proposal of the Health Care Service Board to standardize the waiting period before receiving health care insurance benefits for all county employees, Commissioner Low moved to provide medical and hospitalization health care insurance for the county employees and their families after the first 30 days of employment, the employee will also have the option to begin such coverage before the first 30 days of employment have passed if he agrees to pay the entire premium for the first 30 days. The motion was seconded by Commissioner Bailey and it carried unanimously.
COMMUNICATIONS REPORT:
Chairman Black reported that communications engineer, Jim Allred, has been informed about the lights at the Monticello Airport and he will repair them. Jim Allred has also checked the T.V. reception problem at Mexican Hat, but he cannot make the necessary repairs until the parts he has ordered arrive. The Commission requested a meeting with Mr. Allred on November 15th to discuss various communication problems.

SEVEN TOWERS SITE DEVELOPMENT DISCUSSED;
Commissioner Bailey requested that a representative from the Development Board meet with the County Road Superintendent and show him which access route to the Seven-Towers site they would like the Road Department to develop.
UNION CARBIDE CLOSES OPERATIONS AT LASAL;
Chairman Black reported that Union Carbide has closed their operations at LaSal and 80 employees have
been laid off.
FIRE WARDEN REPORT ON 1982 SEASON;
Fire Warden, John Baker, reported that from January 1 - October 31, 1982, the county had 41 fires which caused a little more than $100,000 in structure loss, most of which was one house fire in Blanding, and a little less than $4,000 in wildlands loss. Because of the heavy rains and new growth late in the summer, Mr. Baker predicted a more serious fire season in 1983.
SAN JUAN COMMUNITY CHURCH EQUALIZATION DAY REQUEST DENIED;
Mr. John Baker asked if the Commission had come to adecision on San Juan Community Church's request of September 20th for a tax exempt status for the parsonage owned and supported by the Chruch. The County Attorney, Bruce Halliday, reported that Salt Lake County prorates a portion of the assessed value of a parsonage, as set by its church officials, as tax exempt for religious purposes. Treasurer, Marian Bayles, reported that to her knowledge all the parsonages located in the county, except certain areas of the Reservation, are now on the tax rolls. The Commission then discussed the ramifications of providing a tax exempt status to the parsonage. Chairman Black felt that to give the parsonage a tax exemption would create an inequity in taxes for clergymen who own their own homes. Commissioner Low moved that the San Juan Community Church parsonage be given a 25% reduction on property taxes for religious purposes. The motion died for lack of a second. The tax assessment will remain the same.
SAN JUAN SPECIAL SERVICE DISTRICT #1 DOCUMENTS SIGNED;
County Attorney, Bruce Halliday, presented some documents for Chairman Black's signature and reported that additional documentation is needed before the San Juan Special Service District #1 Sewer project can be finalized. Chairman Black then signed the Certificate of Payroll and Contract Change Order #1, #2, #3, #4,.& #5 that have been effected.
TREASURER REQUESTS PAY INCREASE FOR DEPUTY;
County Treasurer, Marian Bayles, reported that she was not aware that her deputy could be given a probationary increase at the end of her first 90 days of employment and she would like to request an increase for her deputy, Neta McDonald, from grade 1.1 to 1.2, retroactive to January 13, 1982. The Commission took the request under advisement until the next meeting as there is not a precedent set on making such increases retroactive.
EMERGENCY MANAGEMENT PROGRAM REPORT;
Mr. Al Haskins reported that the State's tentative allocation for the Emergency Management Program for FY 1983 will be only 43.5% of the 1982 allocation. The Commission responded that for that amount of funding, the county may consider withdrawing from the program.
HUMAN SERVICES BOARD MEMBERS APPOINTED;
Mr. Al Haskins presented the Title XX/CAP Board's recommendations for a ten member Human Services Board.
Upon their recommendations, Commissioner Low moved to appoint the following members to the Human Services

The motion was seconded by Commissioner Bailey and it carried unanimously. The three Commissioners will serve as ex-officio members on the Board.
FOREST SERVICE CONTRACT FOR SHERIFF'S DEPARTMENT SERVICES;
Upon the motion of Commissioner Bailey and the second of Commissioner Low it was unanimously voted to approve the contract with the Forest Service for reimbursement of the San Juan County Sheriff's Department for services requested for 1982. Chairman Black signed as the authorized agent of the County.
MEMORANDUM OF UNDERSTANDING ARRIVES FROM THE BUREAU OF INDIAN AFFAIRS;
The Commission received the signed Memorandum of Understanding for road maintenance from the Bureau of Indian Affairs, Navajo Area Office, Gallup, New Mexico as requested by the County May 12, 1982. Commissioner Bailey reported that an addendum is presently being added to the memorandum.
BLANDING GOLF COURSE REPORT;
Chairman Black reported that the Blanding Golf Course Association has invited the Commission to visit the Blanding Golf Course and see what has been accomplished this past summer. The association has collected $1,382.47 in revenues from greens fees, etc., and spent $940.60 for supplies and materials to improve the course. Chairman Black feels they have done an outstanding job.
BID SET FOR OIL & GAS LEASE;
Mr. Brian McCabe, representing Raymond T. Duncan, Duncan Oil Company of Denver, Colorado, met with the Commission to request two oil and gas top leases on property which is currently leased from the County by Mountain Fuels. He requested that the leases take affect in May 1983 when Mountain Fuels' leases expire, but the Commission was not in favor of acting on the request until May. Mr. McCabe also requested an oil and gas lease on approximately 8.4 acres east of Blanding which is presently open of record. Commissioner Low moved to advertise for a bid on November 22, 1982 at 2:00 p.m. to lease the approximately 8.4 acres in Township 35 South, Range 25 East, Section 20 for the primary term of 5 years, for a bonus amount per acre to be paid in advance with an annual rental and a royalty amount as a percentage of gross revenues. Commissioner Black released the Chair to second the motion and it carried unanimously.
NUCLEAR WASTE REPOSITORY - HOUSE INTERIOR SUB-COMMITTEE MEETING;
Chairman Black reported that the State House Interior sub-committee on Public Lands will be holding a hearing concerning nuclear waste issues in Moab on November 13th. Seventeen representatives from Grand County and three representatives from San Juan County have been invited to speak at the hearing and Chairman Black has requested that more equal representation be allowed from San Juan County.
