The San Juan County Commission met in regular session on June 1, 1987 at the hour of 10 a.m. at the San Juan County Courthouse, Monticello, Utah.
The following members were present: Commissioner Bailey, Acting Chairman
Commissioner Maryboy Commissioner Black, Absent
Minutes of the May 26, 1987 Commission Meeting were approved with the corrections on the motion of Commissioner Maryboy and seconded by Commissioner Bailey. UNANIMOUS.
COMMISSIONER KENNETH BAILEY'S REPORT
Long Canyon Road - Commissioner Bailey said that Doug Pehrson, surveyor/engineer, has a map of the Long
Canyon road with proposed changes and estimations.
Paiute Creek Bridge - Comnissioner Bailey said that Bernal Bradford, road foreman, reported that the BIA
is starting to work on the Paiute Creek bridge. The BIA is planning to use the material the county has
there and will condition it until it's put on the bridge replacement program.
Patch Seminar - Commissioner Bailey reported that the road department is holding a patch seminar in
Blanding and will hold one in Monticello when the county move in to do the city streets.
Public Safety Building - Pre-Construction Conference - There will be a pre-construction conference at 2
p.m. with the contractor and their major sub-contractors to discuss how the construction will be handled,
how it will proceed and to schedule the sub-contractors. The architect is to have the "Notice to Proceed"
and Commissioner Bailey has been authorized to sign it.
Telephone - Public Safety Building - AT&T - Commissioner Bailey reported that he signed a contract with
AT&T to provide the telephone service for the Public Safety Building.
Legislation Passes County's Government - Commissioner Bailey reported that HB #4 was introduced into the
1st special session of the Legislature and the Legislation passed it validating San Juan County1 change in
their form of government.
COMMISSIONER MARK MARYBOY'S REPORT
Navajo Land Administration - Bluff - Comnissioner Maryboy reported that he will be meeting with the Navajo
Tribal Land Administration next Thursday to discuss some land that is west of Bluff.
Navajo Police Housing - Commissioner Maryboy said the two Navajo police houses in Montezuma Creek are
completed and are ready for the police to move into them.
Navajo Police Station - Commissioner Bailey asked Commissioner Maryboy to set up a meeting with the local
Tribal Police and the Commission to look at the old Montezuma Creek school where the Navajo Police Station
is to be built.
Paiute Farms Dump - Commissioner Maryboy said that Walter Atene told him there is a need for a dump at
Paiute Farms. Commissioner Bailey said this was reported at the road meeting and the county will push and
service the dump after it has been prepared. (This is what the road department is doing for other dumps
in the county.) Commissioner Bailey said there is a concern of where the dump is going to be, it's felt
that it should be in a better location.
UNDC Board Elections - Commissioner Maryboy said that all of the chapters on the Utah Reservation are
having elections tonight to nominate candidates to serve on the UNDC board.
Fair board Meeting - There will be a fair board meeting this Thursday night. Commissioner Maryboy said
the people from Blanding want to have the county fair and rodeo in Blanding. Commissioner Bailey said the
county has invested a lot of money into the county rodeo grounds and fair building in Monticello and the
rodeo ground in Blanding is not owned by the county.
Blanding Library - Commissioner Maryboy asked what the status is on the rock repair at the Blanding
library. Commissioner Bailey said he and Vance Seely looked at the building and Mr. Seely will repair it
and also several other places.
HEALTH CARE FUNDS - 1986 AUDIT
Danny Hendrix, Karren Hendrix & Associates (Certified Public Accountants), met with the Commission to discuss the 1986 audit report of the San Juan County Health Care Funds. They examined the financial statements of the Hospital, Health Care Services, Ambulance Service Nursing Home and Home Health Agency for the year 1986. The county saved $453,853 in 1986 compared to 1985 because of the sale of the county Nursing Home and Home Health Agency last April. A few recommendations were suggested by the auditors for accounting purposes at the hospital and better hospital management.
TAXABLE VALUE FOR 1987
Gail Johnson, clerk, presented the Commission the 1987 taxable value. The State Assessed value is $556,749,835 and the local taxable value is $115,518,102 for a total of $672,267,937. This is a decrease of $246,579,381 compared to 1986 which is about a 26% drop. This reflects a short fall in the 1987 budgeted general fund of $474,000, library 12,000, health 9,930 and tort liability 10,000.
SAN JUAN & GRAND COUNTY'S WATER CONSERVANCY DISTRICTS
Gail Johnson, clerk, told the Comnission that on October 6, 1986 the county approved the Grand County Water Conservancy District to annex real property from San Juan County into the Grand County Special Service Water District. The State Tax Commission is requiring that San Juan County set up a special taxing district for the property owners that signed up for the service. Mrs. Johnson said she was not aware of this because the property owners will be taxed by both counties. The Commission advised Mrs. Johnson to check into the matter.
MONTICELLO AIRPORT - ARMSTRONG CONSULTANTS, INC. ESTIMATE POST
Rick Bailey, Administrative Assistant, presented the Commission a copy of letter to UDOA from Armstrong Consultants, Inc. with the cost estimate on the upgrading of the Monticello Airport. The following cost estimate is:
Runway - Pulverize and place 2" asphalt Mat. $227,988
Taxiway - Fog Seal $ 8,000
Runway marking $ 5,000
Engineering $ 39,980
Total Estimated Cost $280,968
PUBLIC DEFENDER - KEITH CHIARA
Rick Bailey, Administrative Assistant, said he talked to Keith Chiara, county public defender, about his contract and Mr. Chiara is concerned because he was assigned JP and Juvenile Courts which is a bigger case load than he anticipated. Mr. Bailey said that Mr. Chiara is presently on Carbon county's insurance program with Utah Local Government's Trust and rather than changing to the county's insurance program he requested to have the county pay his premium cost to Carbon county and remain on their program. The Commission told Mr. Bailey to talk to Carbon county and get more information.
The Commission received a letter from UAC stating that UAC has been actively involved in an effort to change the State statute distributing mineral ease revenues. In the last two general sessions of the legislature, bills have been introduced and two years ago nearly passed, that would bring about a 25% distribution of mineral lease monies to counties. This effort to change State law has been made because the federal stature requires states receiving mineral lease moneys to allocate these moneys giving priority to areas impacted by the generation of these mineral lease moneys. In 1983 the Attorney General's office rendered an opinion on the State's compliance with the federal lease statue in distributing the mineral lease moneys which flowed to it. The Attorney General's office opined that the State is not in compliance with federal law in this regard. A meeting has been set for June 10 at 1 p.m. in Price and Bill Peters, UAC legal counsel, will be in attendance to present the ramifications of such a lawsuit against the State. Rick Bailey, Administrative Assistant, said he plans to attend this meeting if Commissioner Black can not attend.
SENIOR CITIZEN PART-TIME BUS DRIVER
Commissioner Maryboy made the motion to approve the hiring of Dee Black as part-time senior citizen bus driver at $5.13 per hour, (grade 4 step 1) Commissioner Bailey seconded the motion. UNANIMOUS.
HEARING BOARD OF GRIEVANCE - MIKE HALLIDAY
The following letter was received from the hearing board of grievance after the hearing of Mike Halliday.

RE: Halliday v. San Juan County Sheriff Gentlemen:
As requested by the Board of County Commissioners, San Juan County, we convened as a Hearing Board of Grievance on May 26, 1987 to hear the grievance of Michael Halliday against the San Juan County Sheriff regarding Mr. Halliday's job assignment change from a road deputy to the county jail.
Within the grievance, Mr. Halliday requested comp time for the period of time in which he left his home in Blanding to the time he arrived at the jail in Monticello and for his return time to Blanding. Upon review of this request, this Board rejected this claim.
The second issue brought to the Board by Mr. Halliday was his reassignment from the road to the County jail. The Board reviewed this matter and determined that the County Sheriff's Office did not follow County Personnel Policy in this assignment, specifically the section dealing with seniority, based on the fact that Mr. Halliday was required to report to the County jail, by which constituted a clear change of duties. It is the decision of this Board that the Sheriff should have followed this policy in the reassignment and that the Sheriff be required to return and make an adjustment within the department based on the seniority policy.
During the hearing, it was brought up to the Board that the Sheriff's department has authority to make policies and procedures within the department. It appeared to the Board that some of these policies and procedures directly conflict with the County personnel policy. It appears that the County policy would override any inter-department policy and it is recommended that the County Conmission investigate these conflicts and make any changes necessary to assure that property and correct policies are in force in all departments that have different policies and procedures than that from the overall County polices.
