SAN JUAN COUNTY COMMISSION MINUTES FEBRUARY 1, 1988
The regular session of the San Juan County Commission convened at the hour of 10:00 a.m. at the San Juan County Courthouse, Monticello, Utah.

A motion to approve the minutes of January 25, 1988 as corrected was made by Commissioner Maryboy and seconded by Commissioner Bailey. UNANIMOUS.
ADMINISTRATIVE ASSISTANT RICK BAILEY'S REPORT
Bus Route - Director of Capacity Management & Traffic of Greyhound Lines, Inc. Gregory Alexander has been
suggested as the person to work with to obtain a Greyhound bus route through San Juan County to Phoenix,
Arizona. The State Division of Public Utilities is willing to work with the County to obtain bus service
in the area.
Transient Room Tax/Uniform Local Sales & Use Tax - Administrative Assistant Rick Bailey reported that for
the third quarter of 1987 the Transient Room Tax for San Juan County was $15,049.13. The Uniform Local
Sales & Use Tax was $47,438.33 for the same period. The Commission recognized that about 58% of the local
sales taxes were raised in the Lake Powell area.
Public Safety Building - There will be a meeting between the architects, Valley Builders Supervisor and
San Juan County on the new Public Safety Building next Monday, February 8, at 3:00 p.m. Commissioner
Bailey will represent the Commission at the meeting.
The sound system for the Public Safety Building was not included in the original plans. Administrative Assistant Rick Bailey has worked out a proposal with Mark Tressler in getting the system included. General Communications Sound System will install the system for $6,082.00. Commissioner Bailey made a motion to approve the system from General Conmunications for $6,082.00. Commissioner Maryboy seconded the motion. UNANIMOUS.
BLM San Juan Resource Management Plan - Administrative Assistant Rick Bailey will meet with Bill Howell, Executive Secretary of the Southeastern Utah AOG tomorrow to work out a draft of detailed oppositions to the BLM San Juan Resource Management Plan to be submitted to the BLM.
Surplus Equipment - Chairman Black signed a pick-up order on the surplus equipment purchased by the County. Rick Bailey will check Wednesday while he is in Salt Lake on when more surplus equipment will become available.
Community Services Block Grant - A contract was signed by Chairman Black between Southeastern Utah AOG and San Juan County which is an amendment and is reducing the Conmunity Services Block Grant by $2,500 for the year. The purpose being to provide the County with FY-87-88 Community Services Block Grant funding for the provision of those service activities identified in the FY-87 Southeastern Utah Community Services Block Grant Work Plan Program.
Federal Hazardous Material Workshop - Administrative Assistant Rick Bailey will attend a Federal Hazardous Material workshop to be held in Moab from Tuesday through Friday of next week.
Ambulance Radios - The radios in the ambulances need to be replaced to carry the new frequency being put in the Public Safety Building. Commissioner Maryboy made a motion to accept a bid of $6,623 to purchase radios for the ambulances. Commissioner Bailey seconded the motion. UNANIMOUS.
CURRENT BUSINESS
Blanding City Street Improvements - 1988 - Blanding City Manager Norman Johnson presented a written plan for 1988 street improvements for the City of Blanding. Mr. Johnson also requested permission to investigate the possible use of the old Blanding Clinic for Blanding City offices. The present site of the Blanding City offices is in need of extensive repairs.
San Juan County Historical Picture Collection - Corrine Roring showed the Commissioners a sample of the historical pictures being prepared for a permanent collection to be housed in the county libraries. Sam Goodman is enlarging the pictures to a uniform 5X7 size at the lab at the CEU in Blanding. The pictures are then mounted and labeled and filed under the contributors name. The Historical Committee is progressing as rapidly as possible to complete the project but so far have only completed the Bluff area with a few others that have been turned in.
UNDC Health Division - Lester Lansing, Russ Stevenson and Worthy Glover of the UNDC Board met with the Commission requesting $15,000 from San Juan County to help cover additional medical staff costs within the Utah Navajo Development Council's Health Division. The Commissioners explained the subsidies already being given to the local doctors and felt the County could not extend further help. Commissioner Black suggested that a special service district might be formed in the southern area and needed funds could be obtained through limited taxation. Mr. Black also said the Navajo Tribe is collecting royalties and oil and gas taxes in the Utah area of the reservation that should be available for use by the Health Division. Mr. Glover indicated that the UNDC Board is checking into other possibilities and appreciated the help the Commissioners are giving to the Navajo people.
San Juan County Beer Ordinance - The Commissioners, County Clerk Gail Johnson and County Attorney Craig Halls discussed amending the County Beer Ordinance. The County Ordinance will be amended to require the schooling consistent with the state law and to include that the owner and/or manager of off-premise consumption establishments be required to attend the schooling. A statement indicating that beer cannot be sold to an intoxicated individual will also be added to the Ordinance. After passing the schooling the person receives a 3-year certificate which will need to be presented at the time the beer license is renewed. San Juan County Social Services is requesting certification so that they can teach the required schooling. At the present time the only certified instructors are located in Salt Lake City. The County will make every effort to have the schooling in San Juan County.
Blanding Rodeo Grounds - A new lease will be drawn up by County Attorney Craig Halls giving the administration of the Blanding Rodeo Grounds to San Juan County from the Blanding American Legion. Road Department - Oil & Grease Bid - A discussion was held on the increased billing of oil and grease from Black Oil Company over the contract price for the Road Department. The bill will not be paid until the problem can be worked out with the Black Oil Company.
County Attorney Craig Halls indicated that the IRS has revoked the counties right to get gas and fuel without paying the federal tax on it. The tax has to be paid then each quarter a reimbursement form will need to be filed. Mr. Halls stated that the County could apply for an exemption.
Variance Request - Robert Knight - Robert Knight met with the Commission to request a variance on an overweight permit on the county road in the Mi Vida mine area to Rio Algom. The Commissioners requested that Road Foreman Merz Hugentobler go check the condition of that road and others in that area before the Commissioners will give their permission.
Mr. Knight also said he is going to apply for a lease on some state land near the road to Canyonlands for a camp ground and motel unit. The commissioners gave their approval for Mr. Knight to proceed with the application.
Television Reception - County Communications Engineer Bill Bayless reported that the interference on Channel 5 has been bad since KSL changed to stereo transmitters. They are working to correct the problem between
between Salt Lake and the Emery translator which should clear up the problem in San Juan County. Mr. Bayles is going to submit an article to the San Juan Record and the radio station explaining the process of getting TV into the area and the problems associated with reception on individual sets. Mr. Bayles has also been checking on a possible area to put a transmitter site for the Montezuma Creek, Bluff and Aneth areas.
Executive Session - Commissioner Bailey made a motion to go into Executive Session for the purpose of discussing County Health Care problems. Commissioner Maryboy seconded the motion. UNANIMOUS.

CDBG Funds Hearing - The hearing on the CDBG funds was convened to hear public comments on the Commission's proposal to set up a revolving loan fund from the CDBG funds. Harold Lyman met with the Commission to express his support of their proposal. The Commissioners are not in favor of making loans to a new business that would compete against existing businesses but other businesses that will provide new products, services and employment for the area. Commissioner Bailey made a motion to apply for the CDBG Funding to be used as a revolving loan fund. Commissioner Black seconded the motion. UNANIMOUS.
COMMISSIONER MARK MARYBOY'S REPORT
UNDC Board Meeting - Commissioner Maryboy has asked attorney Lyle Anderson to meet with the UNDC Board to
explain the lawsuit with the oil companies.
Senior Citizens Vans - The Navajo Tribe want to purchase new vans for the senior citizens as the Tribe is
having maintenance problems with the present vans.
Bluff Community Meeting - The Bluff citizens are requesting more chemicals to control the mosquito problem
in the area.
Bluff Community Building - The senior citizens would like to have complete control of their space in the
Bluff Conmunity Building. Other groups go in for meetings and parties and don't clean up afterward. The
Commissioners felt a cleaning deposit should be charged and forfeited if the group using the facilities
doesn't clean up. The main problem is that no one person has been responsible for scheduling the
building. Administrative Assistant Rick Bailey will work with Mark Lyman, Social Services Director, and
the senior citizens to try and alleviate the problem.
North Central Navajo Labor Committee - Commissioner Maryboy reported that a new committee called the North
Central Navajo Labor Committee has been formed to deal with all labor problems on the Utah portion of the
reservation.
COMMISSIONER KENNETH BAILEY'S REPORT
Highway Bill No. 157 - Commissioner Bailey reported on the trip he made to the Legislature as a member of the Joint Road Committee to testify for Highway Bill No. 157 changing the formula for the road money. The bill got hung up in committee so it couldn't be heard. Mr. Bailey sent his written report in to be distributed to the members of the committee. Clyde Naylor, Pete Coleman and Bart Barker of the Joint Road Committee will be prepared to testify when called upon.
Copper Canyon Road - The County Road Department is preparing a request for a special planning appropriation for the Copper Canyon Road. County Engineer Doug Pehrson will figure the estimated costs for the application.
Metal Cutting Band Saw - Commissioner Bailey presented bids for a metal cutting band saw for the Road Department. The bids were from Granger for $1,525.47 and Industrial Supply for $2,345 plus $120 for freight. Commissioner Bailey made a motion to accept the bid from Granger's for $1,525.47. Commissioner Maryboy seconded the motion. UNANIMOUS.
COMMISSIONER CALVIN MACK'S REPORT
Halls Crossing Airport - A copy of a circular sent by environmentalists urging people to oppose the Halls Crossing Airport will be forwarded to the FAA in Denver. The circular states, "Along with the Burr Trail, the proposed Halls Crossing Airport is clearly part of the transportation infrastructure necessary to complete developer's dreams for major resort expansion along Lake Powell. And like the Burr Trail, the project would directly impinge on wild country in this case, by encouraging ever-increasing numbers of overflights of the canyons by ever larger and noisier aircraft....Thus, Lake Powell has not only swallowed the incomparable Glen Canyon, but now development on its shores threatens to destroy the surrounding wilderness with pavement and overflights."
Highway Bill No. 157 - Commissioner Black met with the UAC to discuss Highway Bill No. 157. The proposals still favor urban and city areas and were unacceptable to the UAC.
Mill Levy - The bill to kill the present mill levy for property tax assessment and collection was killed. That may go into the courts after the legislative session is over.
BLM San Juan Resource Management Plan - Legislative Assistant Bob Weidner called and read a letter from Senator Jake Garn to Bob Burford, Director of the Bureau of Land Management, protesting the San Juan Resource Management Plan and asked Mr. Burford to review the plan. Ralph Coates, of Mountain Fuel, will also send a letter opposing the plan. Mr. Coates is chairman of the Moab BLM Multiple Use Advisory Council will schedule a meeting with the Council to address that issue.
CNS - Commissioner Black met with the Southeastern Utah Health District Board last week and asked that the Health District take over the home health care in the southern part of San Juan County. Chairman Bob Furlough was not at the meeting because of surgery. Mr. Black asked that the proposal be reviewed with Mr. Furlough and that he contact Jan Treml to work out the details.
Mexican Hat Special District - Luther Risenhoover from Mexican Hat requested help from the Commissioners in the purchase of Section 7 land by the Mexican Hat Special District from the BLM. Commissioner Black will check with the BLM on the matter.
UAC - A letter from the UAC asked San Juan County to contribute $500 for lobbying against the tax limitation group. Commissioner Black felt in recognizing the responsibility of governments and schools to provide education and other services, it is difficult even with the present tax structure and to roll taxes back would be a disaster. However, the Commission did not feel it was proper to use taxpayers money to lobby against such iniatives. Commissioner Black will write a letter declining the contribution and the reasoning behind the denial.
Southeastern Utah Health District - A letter was received from Rayburn E. Jack
resigning as a member of the Southeastern Utah Health District because of other commitments. Another member will need to be appointed.
Justice Court Revision Bill - The Justice Court Revision Bill was discussed at the UAC meeting last week. The Commissioners were not in favor of the revision as written at this point in time. A letter from Judge Harold Muhlestein indicated areas of the revision he had concerns with.
Utah Counties Finance Corporation - A letter received from the Utah Counties Finance Corporation asked whether the County would be making any capital improvements for 1988-89. The Commission felt the application should be sent in as a recourse to help with the County cash flow for purchasing equipment for the next six months.
R.W. Harmon & Sons - A letter was received from Ben J. Black, manager of R.W. Harmon & Sons, Inc. commending Bill Pierce and the sheriff's department for their concern over a disabled bus at Wilson Arch. Upon finding no occupants in the bus, the sheriff's department checked with the driver to make sure
everything was all right. Mr. Black expressed appreciation for this kind of concern. BILLS APPROVED FOR PAYMENT
