SAN JUAN COUNTY COMMISSION MINUTES OCTOBER 19, 1987
The San Juan County Commission met in regular session October 19, 1987 at the hour of 10:00 A.M. at the San Juan County Courthouse, Monticello, Utah.
The following Commissioners were present: Calvin Black
Kenneth Bailey Mark Maryboy
Commissioner Black was excused in the morning to attend a hearing of the Subcommittee on General Oversite Investigations in Cortez.
A motion to approve the minutes of October 13, 1987 as corrected was made by Commissioner Maryboy and seconded by Commissioner Bailey. UNANIMOUS.
COMMISSIONER CALVIN BAILEY'S REPORT
Archaeological Hearing - Cortez - There were two Congressmen, the Chairman from Connecticut and Congressman Campbell from Colorado at the Hearing. Archaeological resources are being lost not only through looting and vandalism but through natural means of time and the elements. The consensus was that enforcement alone of illegal archaeological excavations wouldn't stop the looting and vandalism of Indian artifacts. Commissioner Maryboy commented that many of the Indians would prefer that the artifacts not be dug as most of them were buried at the time of the death of a Tribal member and should remain there regardless of eminent loss of time and nature.
National BLM Advisory Council Meeting - Commissioner Black attended a National BLM Advisory Council meeting in Denver last weekend. He informed the Commission of progress the BLM is making in automating their land records, leases, etc.
COMMISSIQNER KENNETH BAILEY'S REPORT
Small Business Conference - Commissioner Bailey reported that a Small Business Conference will be held at the Monticello Library on Wednesday, October 28, 1987 at 1:00 p.m. with information booths being opened at 12:00 p.m. All small businessmen are encouraged to attend this meeting.
San Juan County Promotion Policy - a paragraph from the County Promotion Policy states: "San Juan County reserves the right to fill or not fill position openings with an in-house or San Juan County Employee, based on the determined San Juan County need and/or priority at the time the position becomes open." When the County advertises for employment needs this specific statement is not used only that the County is an Equal Opportunity Employer. Commissioner Bailey feels that County employees should submit an application for a position opening along with other applicants for consideration by the hiring agency. This will be taken into consideration as the County Personnel Policy is being revised.
Highway Needs Study - A memorandum was distributed to the Commissioners that was issued by David Spatafore. It urged the cities and towns to get behind a proposal to change the distribution formula for expected annual revenue received due to the five cent motor fuel tax increase. This change would give the cities and towns more of the available funds. A brochure telling some of the possibilities or problems that exists concludes with the statement: "Additionally, it is recommended that consideration be given to instituting a minimum local effort criterion in order for local governments to qualify for their respective shares of B and C Funds. This Criterion could be expressed as a minimum local revenue dollar amount per unit of tax base (say assessed valuation or population) or as a minimum matching ratio (B and C Funds compared to local revenues expended on roads) . This will minimize the inequities when some local governments make substantial efforts to raise funds while others fund a greater portion of their road programs with state distributions of B and C Funds." The proposed formula by the cities and urban areas would be to adopt a criteria that no rural road in the State of Utah be paved. That would be accomplished through the adoption of a 300 minimum average daily traffic requirement. Commissioner Bailey feels this proposal is unacceptable to rural Utah.
COMMISSIONER MARK MARYBOY'S REPORT
BIA Schools - Commissioner Maryboy made a public apology to the Aneth BIA Schools. Previously he had indicated that students coming out of the BIA schools were academically deficient to other comparative schools. The Aneth citizens were offended at that statement. Commissioner Maryboy attended the Aneth School Board meeting and the Board Members felt they were providing quality education
especially for those who cannot afford to send their children to public schools. The Aneth School Board also indicated that they will survey the parents of students to get their feelings on the Swimmer Initiative, the transfer of BIA funds to Tribal or State schools. The Tribal leaders are opposed to the transfer. The School Board will make every effort to establish a positive relationship with Whitehorse and Montezuma Creek schools so their will be no duplication of surveys and things will go smoothly.
Flashing Yellow Light - Aneth - An application has been submitted to Dyke LeFever, Utah Transportation Department, for a flashing yellow light by the Aneth school and one by the Safeway store.
Harry Jones Road - The citizens of the Aneth area would like to have Road #208
graveled. Commissioner Bailey stated that the road is not a main road and does not lead into another graveled road. As the local traffic is increasing on that road it may be a possibility to have that road improved.
Utah Chapter Council Delegates Meeting - Commissioner Maryboy reported all people concerned with the Utah Chapter Council Delegates meeting have been notified and are planning to attend. The points of the agenda that Commissioner Bailey will be addressing were discussed. John Fellmeth, San Juan County Health Board Chairman, reported that Lewis E. Tutt, Director of the Indian Health Services from Shiprock, Arizona will be unable to attend the meeting but Mr. Fellmeth will be there to explain San Juan County Health Care problems to the delegates.
ADMINISTRATIVE ASSISTANT, RICK BAILEY'S REPORT
Computer - Public Safety Building - Administrative Assistant, Rick Bailey, presented the contracts for approval to purchase part of the computer system to be installed in the Public Safety Building. As the computer now in use in the Sheriff's Department will become obsolete as of the first of the year the new computer will be temporarily installed in the Sheriff's Department and then moved to the Public Safety Building. Commissioner Maryboy made a motion to approve the signature of Commissioner Bailey on the contracts. The motion was seconded by Commissioner Bailey. UNANIMOUS.
OTHER BUSINESS
Long Canyon Road - A letter received from Richard Lyman indicated that the road should be moved under the rim which would remove it from the middle of his fields. Max Dalton indicated to the Commission that that move would probably cost about $5,000 to $6,000 where an earlier proposal would only cost about $2,000. If the road were moved under the rim Mr. Dalton would need an easement to his corrals which Mr. Lyman agreed to per phone. The Commission will discuss the various proposals and make a recommendation.
Montezuma Creek Fire Truck - Jimmie Tsosie from the Division of Community Development of the Navajo Tribe appeared before the Commission to discuss matching funds for a fire truck for the Montezuma Creek area. He administers a Federally funded program which is the Community Development Block Grant. Rick Bailey said a new fire truck could be purchased for about $70,000. Mr. Tsosie indicated that the Navajo Tribe would put up $20,000 and the Commission felt they could get the additional $50,000 from the Community Impact Board. Mr. Tsosie and Mr. Bailey will work together to get needed information to satisfy both the Navajo Tribe and San Juan County. The Commission suggested the possibility of combining the request for funds for the fire truck be attached to the request for funds for remodeling the Montezuma Creek Police Station. They felt there would be greater opportunity for success if these requests were submitted to the Impact Board before the first of the year.
Sealed Bid Opening - San Juan County Recreation - The sealed bids for materials and labor on installation for the Blanding Golf Course and Monticello Park sprinkler systems were opened. Material only bids were received from:

Some of the bids for materials represent materials other than specified in the plans. If other materials are substituted the labor bids would have to be revised. Eddie Allred, San Juan County Recreation Director, will analyze the bids and talk to Grant Leavitt at the Monticello Golf Course then make a recommendation to the Commission.
Physician Recruitment - Dr. Kelly Nichols of Beatrice, Nebraska is ready to accept employment within the County and Dr. Martin McNeil will consider an offer. The County will offer to the first two physicians who come and meet the County conditions a $25,000 each moving expense and $150,000 each gross salary for the first year. Malpractice insurance coverage will be considered at the Hospital Board Meeting before an offer is extended.
Attorney Bills - The Commission was ask to approve attorney bills submitted by attorneys other than the County Attorney. Craig Halls, San Juan County Attorney, explained the bills after which approval was given for payment of two of the bills. Lyle Anderson will be contacted to appear before the Commission and explain the tax bills presented next Monday.
Recovery Services - The Utah State Attorney General's Office has made a change in the Recovery Services policy. These services will be handled through the Social Services and Utah State Attorney General's Office after the first of the year.
Computer - Law Library - County Attorney, Craig Halls, presented bids for procurement of a PC IBM computer for the Law Library that will be connected to a national legal research system to aid the San Juan County Attorney's office. Commissioner Bailey made a motion to approve the purchase. Commissioner Maryboy seconded the motion. UNANIMOUS.
Salary Increases - San Juan County Courthouse Clerical Employees - The elected officials met with the
Commissioners to request salary increases for the clerical employees within the Courthouse. After considerable discussion, Commissioner Bailey made a motion to approve the following increases:

Commissioner Bailey made a motion to make the increase for the County Attorney Clerk, Julie Woods, retroactive to July per an earlier request approval.
Commissioner Maryboy made a motion to give a salary increase to Bill Bayles, Communications Engineer, at Grade 15 Step 3. Commissioner Bailey seconded the motion. UNANIMOUS.
Amita Copier - Recorder's Office - County Recorder, Louise Jones, presented a request for payment of a copier for the Courthouse. Commissioner Bailey made a motion to approve the request. Commissioner Maryboy seconded the motion. UNANIMOUS.
Land Computer - Barbara Montella, County Assessor, and Louise Jones, County Recorder, requested permission to purchase a computer that will measure land. Commissioner Bailey indicated that the County Surveyor,
Doug Pehrson, also needs a computer of similar capacity. They were directed to talk to Mr. Pehrson to see if one computer can be purchased to meet the needs of each department.
