MINUTES OF THE SAN JUAN COUNTY COMMISSIONERS MEETING HELD
OCTOBER 17, 1983
The San Juan County Commission met in regular session on Monday, October 17, 1983, at the hour of 10:00 a.m. in the San Juan County Courthouse at Monticello, Utah.
The following members were present: Commissioner Calvin Black, Chairman
Commissioner Kenneth R. Bailey Commissioner Robert Low
Minutes of the previous meeting were approved with the specified corrections on the motion of Commissioner Low. The motion was seconded by Commissioner Bailey.
MONTICELLO CITY ADMINISTRATOR MEETS
Rick Terry, Monticello City Administrator, met with the Commission to discuss the road to the elementary school. Commissioner Bailey reported the road department plans to patch the holes before winter.
Also discussed was 1st North from Main to 1st West. It will be a dead end street through the winter and will be rebuilt next summer. This meets with the Commission's approval.
COUNTY ROAD STANDARDS AND POLICY REVIEWED
The Commission reviewed a discussion held last week concerning the Canyon Terrace Road. Commissioner Bailey also reported that the Recorder's office has a copy of the County Road Standards and Policy now so if any inquiries are made they will have the information.
JUSTICE DEPARTMENT LETTER REVIEWED
Bruce K. Halliday, County Attorney, met with the Commission to review a letter Mr. Halliday received from James M. Schermer horn of the United States Justice Department, concerning an investigation into voting practices in San Juan County. Mr. Schermerhorn feels an at-large method of electing County Commissioners denies the Navajo residents meaningful access to the political process and, as a result, violates Section 2 of the Voting Rights Act, 42 U.S.C. 1973 et seq. In addition he feels the county has failed to satisfy the requirements of Section 203 (c) of the Voting Rights Act, as amended, 42 U.S.C. 1973 aa-la, in that it conducts elections effectively only in the English language. Mr. Schermehorn believes that to remedy these violations it would be necessary for the County to replace its at-large methold of electing Commissioners with a firmly drawn single-member districting plan, and that the County must develop an effective plan to communicate all voting, election and registration information to the Navajo residents of San Juan County. Mr. Schermerhorn has also requested a meeting with Mr. Halliday and the Commissioners for October 18, 1983, in Mr. Halliday's office at 9:30 a.m. Inquiries were made to Mr. Halliday concerning the possibility of this being an open meeting. The Commission stated they had no objections to thsi being an open meeting. The Commissioners are limited by state law as to the election of the Commission Board.
MI VIDA MINE ROYALTY CHECK RECEIVED
Gail Dalton, County Clerk, met with the Commission to report that the first royalty check from Mi Vida Mine since Rio Algam began operation has been received. The check is for the month of September and was $2,372.00.
PARK SERVICE MEETING BEING HELD
Commissioner Bailey will attend a Park Service Public Meeting concerning Canyonlands National Park. The meeting will be held in Monticello, October 18, 1983, at 7:00 p.m. Commissioner Bailey will express the Commission's opinion that the Park needs to be developed.
FINLEY BAYLES, JERRY HOLLIDAY LAWSUIT DISCUSSED
Bruce K. Halliday, County Attorney, met with the Commission to discuss the Finley Bayles, Jerry Holliday lawsuit. Mr. Halliday reported that the County has stipulated that it would not enforce the County zoning ordinance in regards to Jerry Holliday until the hearing on the injunction which will be on November 8, 1983.
CLYDE SANCHEZ ROAD DISCUSSED
Commissioner Bailey reviewed the letter the Commission received from Milton Oman concerning the Clyde Sanchez Road. Commissioner Bailey reported that the culvert is high and not in a very good place but has been there for approximately 15 to 20 years. This could cause a problem on 2 to 3 acres but not on 15 acres. The cul-vert can be lowered or an additional culvert can be placed in a better location. The Commission will recom-mend to Mr, Oman that an additional culvert be installed.
STATE TAX COMMISSION HEARING REPORTED ON
Barbara Montella, County Assessor, and Bruce K. Halliday, County Attorney, met with the Commission to report on the State Tax Commission hearing they attended Thursday, October 13, 1983. The State Tax Commission is charging that Mrs. Montella is not in compliance with state law because of failure to implement Proposition 1 that says all residential property will be valued at 15%, and all commercial property will be valued at 20%. Mrs. Montella and the Commission feel San Juan County is already in complience with Proposition 1 according to the sales ratio study. The State Tax Commision has ordered Mrs. Montella to factor anyway and to send out additional tax notices on locally assessed property based on a mill levy increase of 23.25 mills to go into the Uniform School Fund. There are four other counties which are not in complience with Proposition 1. They are; Juab, Wasatch, Iron, Cache. A meeting will be held in Provo with these County Assessors, County Attorneys, and County Commissioners to further discuss this matter.
HEALTH CARE SERVICES WAGE PLAN DISCUSSED
Gail Dalton, County Clerk, and Rayburn Jack, Executive Director of the Health Care Services, met with the Commission to review the Health Care Services wage plan. Health Care Services would like to adopt a pay plan that will conform with the existing County plan.
PROJECT BOLD DISCUSSED
C. Hardy Redd met with the Commission to duscuss Project Bold. The Commission reviewed their position on Project Bold. The Commission also feels that the BLM is trading land to the State that the BLM does not want because the location of the majority of these areas would make it difficult to earn any substantial revenue from them. The Commission reviewed the resolution on page 133 and Commissioner Low made a motion

that the Commission adopt the resolution. Commissioner Bailey seconded the motion and it was carried unanimously.
Commissioner Black reported that he met with Senator Fred Finlonson last week to discuss Project Bold. COMMISSIONER LOW REPORTS
Commissioner Low reported that at the UAC Commissioners Workshop a service for Compensation Cost Management was presented. If all the counties participate the service will cost San Juan County approximately $448.00 per year. Commissioner Low made a motion that San Juan County participate at this price. The motion was seconded by Commissioner Bailey and carried unanimously.
COMMISSIONER BAILEY REPORTS
Commissioner Bailey reported that he is working with Bernal Bradford and Doug Pehrson to report on the condition and use of the following roads and the possibility of giving them to the state. The roads are:
