SAN JUAN COUNTY COMMISSION MINUTES MAY 16, 1988

The regular session of the San Juan County Commission convened at 10:00 A.M. at the San Juan County Courthouse in Monticello, Utah.

A motion to approve the minutes of May 9, 1988 as corrected was made by Commissioner Maryboy and seconded by Commissioner Black. UNANIMOUS.

COMMISSIONER CALVIN BLACK'S REPORT

State Land Board Meeting - Commissioner Black attended a State Land Board Meeting where several resolutions were adopted concerning land sales and other management. The resolutions will be effective July 1st when the new law goes into effect.

Hospital Administration - Commissioner Black spoke with Dave Jeppsen of IHC concerning the administration of the San Juan County Hospital. Mr. Jeppsen will discuss the San Juan County Hospital situation with the IHC Board and let the Commission know whether they will be interested in working something out. Hill-Burton Bill - Judy Jaussi of Congressman Nielsen's office called Commissioner Black to report that, the bill for the Hill-Burton obligation has been drafted and a copy sent to Mr. Black for him to review. Lake Powell Land Exchange - Commissioner Black has drafted a letter to Reed Ivins in Congressman Nielsen's office, Bob Weidner in Senator Garn's office, Ron Madsen in Senator Hatch's office and Howard Rigtrup in Congressman Hansen's office with the legal descriptions and information for the preparation of a bill on the Lake Powell Land Exchange proposal.

National Inholders Association - A letter from Charles Cushman of the National Inholders Association, a multiple use organization, indicated that the association would be glad to assist the County in any way that they can with regards to the San Juan Area Resource Management Plan. They have a nationwide network that supports multiple use issues.

San Juan Substance Abuse Authority - A letter from the State Department of Social Services is requesting a list of all contracts, a schedule of all 1099 income, a list of the 15 highest paid employees, a list of expense account, car allowances, credit card expenses, and a list of all related party payments. A copy of the letter will be sent to Mark Lyman, State Social Services, asking that they respond accordingly for the information they have.

White Mesa Ute Council - A letter from the White Mesa Ute Council requests the Commission's attention to three issues: 1. A 40 acre site at Hammond Canyon, 2. Road improvement at White Mesa, and 3. Road easement in Cottonwood Wash. Commissioner Bailey was authorized to work with the White Mesa Ute Council to draw up an agreement for road improvement at White Mesa and to get the roads on the County B road system if they aren't already on it and an agreement to provide the County with the authority to maintain the road in Cottonwood Wash. Commissioner Black will write a letter of support to Senator Garn and Congressman Nielsen regarding the 40 acre site at Hammond Canyon.

COMMISSIONER KENNETH BAILEY'S REPORT

Contract for Truckers - Commissioner Bailey presented the completed contracts for Lyman Palmer, Mike Christensen, H.F. Cosby, Honest Dollar Construction and Nicky Black, the truckers doing contract work for the County. The reference to requirement for cargo insurance was deleted from the contract. The contracts for Dayne Shumway, Jack Tate, and Kenneth Miller still need a Workman's Compensation certificate. A motion to authorize Chairman Black to sign the contracts was made by Commissioner Bailey and seconded by Commissioner Maryboy. UNANIMOUS.

Oljato to Navajo Mountain Road - Fred Polenz from the Navajo Tribal Community Development Office called to report that their Washington office had met with Senator Garn and Representative Nielsen's staff and the requested funding for the engineering on the Oljato to Navajo Mountain road looks very favorable to receive the $950,000 grant.

Long Canyon Cattle Guard - Coitmissioner Bailey reported that the Long Canyon cattle guard has been installed and the signs will be put up as soon as possible.

Paiute Creek Bridge - County Engineer Doug Pehrson met with Creamer and Noble at Navajo Mountain regarding the engineering for the Paiute Creek bridge. Creamer and Noble are preparing a proposal to present to the County.

Cayman Lane Agreement - A motion to approve the agreement for oiling a portion of the Guymon Lane with Petrolane Gas Service, Ltd. was made by Commissioner Bailey and seconded by Commissioner Maryboy. UNANIMOUS.

Paiute Farms Road - The shale needed to mix with the dust guard is being crushed finer before being mixed and will then be applied to the Paiute Farms road.

Montezuma Creek Police Station - A revised plan for the Montezuma Creek Police Station was discussed and Commissioner Bailey will proceed with the specs for the bid proposals.

Gravel/Lloyds Lake - The road department will haul some gravel to Lloyds Lake where it will be used on paths leading to the lake.

Road Department Requests - Procurement requests from the road department were: SPR-H Flaherty - Power Equipment Company for $62,692.00

W.H. Manufacturing with trade-in $56,195.60 Extending 3-phase electricity for the 5-ton hoist and necessary switches -

Abajo Electric for $687.60

Northern Electric for $1,000

A motion to approve the purchase of the Flaherty from W.H. Manufacturing and for Abajo Electric to install the needed electricity was made by Commissioner Bailey and seconded by Commissioner Maryboy. UNANIMOUS. Road Department Employees - Commissioner Bailey presented a request to hire Jose M. Herrera and Robert Pugh for the patching crew for the road department. They will be hired at grade 5 step 1, $6.02 per hour. A request to correct the grade and step of Robert Laws was also presented. Mr. Laws was hired as a light equipment operator and his salary should be based on grade 10 step 1, $7.35 per hour. This adjustment will be retroactive to when he was hired on a full-time basis. A motion to approve the requests was made by Commissioner Bailey and seconded by Commissioner Maryboy. UNANIMOUS.

Road Department Crawler/Dozer - The road department reported that a crawler/dozer is in the shop for repairs again and there is concern as to whether it should be repaired or replaced. The Commissioners requested more information before making a determination.

COMMISSIONER MARK MARYBOY' S REPORT

Sheriff's Office Hiring - Commissioner Maryboy will be involved with interviews for hiring new employees for the Sheriff's department this afternoon.

BLM Resource Management Plan Meeting - The meeting for the BLM San Juan County Area Resource Management Plan will be held at the Red Mesa Chapter House on Friday, May 20th at 5:00 p.m. The residents will be given information with which to make comments to the Bureau of Land Management for the San Juan County

Area Resource Management Plan.

Bus Route - Bus driver Clemma Johnson has made a request to have one of the roads

graveled. Mrs. Johnson also requested that the area where she parks the bus at her home be graveled but

Commissioner Bailey stated that the County cannot put gravel on private property but he will check out the

requested road.

Red Mesa Registration Drive - The Red Mesa residents are requesting a registration drive for the area.

The Commission stated that there is a registration agent for that area that will have the forms in August

and that mail-in forms can be obtained from the county clerks office to give to those elgible residents

requesting them.

Graduations - Commissioner Maryboy reported that he would attend the Head Start graduations, high school

graduations and adult education graduations this week.

ADMINISTRATIVE ASSISTANT RICK BAILEY'S REPORT

Community Development Block Grant Project - Administrative Assistant Rick Bailey attended a workshop for the Community Development Block Grant funds. He reported that the administration of the funds for a County Revolving Loan Fund is going to be very difficult and time consuming if the loans are small. If the entire amount is loaned to one business or individual it would not require as much. Every application would require a loan package that requires proformas, three-year tax statement and probably more than the average bank requires for a similar loan, and then sent to the state where a consulting company would review it even before it could be considered for funding through the Revolving Loan Fund. Every project also has to have an environmental review completed. Mr. Bailey will check with the AOG to see if an alternative project can be used for the money.

CURRENT BUSINESS

San Juan County Development Board - Executive Director Peggy Humphreys met with the Commission regarding the term of members for the board of directors. The Development Board by-laws state the individual can only serve four years and then lay off for a year before being reappointed. The County resolution adopted by the Commission does not state that the terms cannot be continuous. The by-laws may be amended by the board if they desire, to reflect the continuous terms. Commissioner Black stressed that the board members need to represent both the business and private sector.

Mrs. Humphreys made a request to let Diane Nielsen, Economic Development Director for Monticello City, use the spare desk in the Travel Council office. approximately 20 hours per week as the two work closely together on various projects. The Commission approved the request.

Monticello City Managr - Monticello City Manager Rick Terry reported that the Church of Jesus Christ of Latter-day Saints, whose building is located next to the courthouse, has requested that the city put in a new sidewalk in front of the church. The city agreed to the request on a 50/50 cost dispursement. Mr. Terry stated that the sidewalk in front of the courthouse is deteriorating in spots and asked if the County would be interested in replacing it at the same time. The Commission authorized Commissioner Bailey to check out the condition of the sidewalk and make a decision and let the city know.

San Juan County Fair Board - Joan Wilcox, Tauna DeGraw, Holly Tatnall and Jim Keyes, representing the San Juan County Fair Board, presented a five-year improvement plan for the fair grounds in Monticello. The fair board reviewed the plan and answered any questions the Commissioners had. The critical repairs needed immediately are: Replace the back panels, cross brace the sides and replace the rails at the top of the grandstands; repair holding pens; add lighting; add hot water heater and sink and place screens on the windows of the concession stand; sod the area east of the concession stand; general repair of the bathrooms; repair the roof of the exhibit building; a portable entertainment stage; make wash racks in the junior livestock area; a building to house steers to be done as a Jr. Livestock Project; additional parking for contestants and to provide water and drainage for the fairgrounds. The Cormiission asked the Fair Board to get cost estimates on the projects. Cormiissioner Bailey and Commissioner Maryboy will follow through and work with the fair board to get the projects completed. The Commission commended the board for the excellent plan.

Sheriff's Department - Sheriff Claude Lacy reported that the use of the spikes approved by the Commission last year were very effective in stopping a fugitive last week. Sheriff Lacy also reported that the Pauite Farms Marina problem is being worked out between UNI and UNDC.

Utah Counties Finance Cooperative - County Clerk Gail Johnson stated that Jack Palmer and Wheeler Machinery Company have had problems getting paid for the trucks and D8N cat purchased by the County through the Utah Counties Finance Cooperative. Mrs. Johnson presented the invoices and requisitions to be signed by Chairman Black to facilitate the payments.

Hovenweep Road Project - County Attorney Craig Halls reported that the oil company will be responsible for removing the rock located close to an oil line at their own expense so that the Hovenweep road project can be completed.

County Property - County Attorney Craig Halls stated that property acquired by the County through a tax sale may be sold for whatever compensation desired. It can be sold just for the amount of the taxes. Commssioner Black stated that the statute was designed to be able to compensate a property owner if they lost the property for taxes. If the property was subsequently sold for fair market value then the property owner could apply for and get the difference between the taxes and the fair market value. The Commission stated that the County has no need for property and that the previous owner could redeem the property for payment of the taxes, penalties and interest.

Mr. Halls also stated that there is another statute that indicates that the County doesn't have authority to sell any ground without getting reasonable compensation for it which would apply to the Bluff property owned by Rosalie Goldman but has a dedicated right of way to the County.

Lisbon Valley Road/Weight Limit - Highway Patrolman Mark Millet asked the Commission if there was a waiver of the weight limit on the Lisbon Valley road. The Commission was not aware of the weight limit being rescinded and that the individual truck drivers would have to apply to the Department of Transportation for the waiver.

Recreation Department - Recreation Director Eddie Allred met with the commission to request an increase in the salary of the Monticello swimming pool manager and the grounds keeper supervisor for the baseball fields. The individuals have worked for the Recreation Department for three years and have not had an increase in salary. The Commission asked Mr. Allred to work with Administrative Assistant Rick Bailey to get them on a grade and step level that will be in line with other seasonal workers. Mr. Allred also said that the Blanding Golf Association has asked that a person be hired to collect green fees in the mornings and evenings. The golfers have been on an honor system but the association feels that not everyone is paying the fees. They feel that if a person were there to collect the fees that the additional fees collected would pay the salary. The Commission authorized Mr. Allred to advertise for a person for that position.

Mosquito Control - Jim Keyes reported that the mosquito fogging machine has arrived and a person needs to be designated to be responsible for the maintenance and operation of the machine. A meeting will be arranged with the Bluff Mosquito Commtittee and UNDC at the Bluff Elementary school on May 23rd at 6:00 p.m. to train the people who will operate the machine and arrange for someone to be responsible for the maintenance.

Bluff Gravel Pit - County Engineer Doug Pehrson reported that gravel is being removed from the Bluff Gravel Pit. All the gravel has been crushed except one corner that was retained to be used as pit run. That is the area where the gravel is being removed. Mr. Pehrson will check to make sure the boundaries of the pit is in line and notify those responsible for removing the gravel.

San Juan Area Resource Management Plan Meeting - A meeting was held with special user groups to discuss the various aspects of the BLM San Juan Area Resource Management Plan. The BLM has asked that the various groups comment on the draft plan as to the areas that will affect them adversely and why. These comments will be taken under advisement in drawing up a management plan for the area.
