SAN JUAN COUNTY COMMISSION MINUTES JUNE 16, 1986

The San Juan County Commission met in regular session on June 16, 1986, at the hour of 10 a.m. at the San Juan County Courthouse, Monticello, Utah.

The following members were present: Commissioner Black, Chairman

Commissioner Bailey Commissioner Holliday

Minutes of the previous meeting were approved on the motion of Commissioner Holliday and seconded by Commissioner Bailey. UNANIMOUS.

WILDERNESS TASK FORCE

The San Juan County Task Force on Wilderness will be meeting on Thursday, June 26, 1986. L. Robert Anderson has agreed to serve as chairman of the task force under appointment of the county commission. Bill Howell, executive director of SEU-AOG, will attend this meeting to assist the task force in preparing written responses on the wilderness proposals.

OLYMPUS INSURANCE AGENCY

The Commission received a check from Olympus Insurance Agency for $6873.25. This is a refund to the county for the auto and liability insurance that was cancelled in January 1986 but had been paid in full.

MONTEZUMA CREEK SWIMMING POOL - SNO-CONE

Leonard Howe asked the Commission if he could set up a sno-cone machine and sell at the Montezuma Creek swimming pool. The Commission discussed whether the county's lease with the Tribe gave permission for this. The Commission decided not to oppose letting Mr. Howe sell at the pool and let him work out any problems there may be with the Tribe.

ELECTED OFFICIALS MEETING - Tax Rates

Gail D. Johnson - clerk presented to the Commission the county's total assessed valuations and the

proposed tax rates. The Commission discussed the certified tax rates with the other elected officials.

The Commission will hold a public hearing next week to open the budget and set the tax rates.

Rigby Right - sheriff told the Commission he needed to buy a bar light for the new car. Mr. Wright said

he will get bids before purchasing one.

Mary Lou Mosher - recorder gave the Commission the acreage that is in the proposed Spanish Valley

Annexation. The total acreage is 17,729. 15,831 is government, 1,762 is private, and 136 acres belong to

Grand County.

Barbara Montella - assessor said everything was fine in her department.

Marian Bayles - treasurer said everything was going fine.

LAW ENFORCEMENT COOPERATIVE AGREEMENT - FOREST SERVICE

Commissioner Bailey made the motion to approve two cooperative agreements between the U.S. Forest Service and San Juan County and authorized Commissioner Black to sign them. One is that San Juan County agrees to furnish personnel with equipment to adequately patrol National Forest Land and the other is San Juan County has the authority to enforce the state and local laws for San Juan County on such lands and waters. Commissioner Holliday seconded it. UNANIMOUS.

RECORDING CONTRACTS, DEEDS, ETC,

Commissioner Bailey said he would like the clerk to search for all of the county's contracts, right of ways, quit-claim deeds, etc. and make sure they are recorded in the recorder's office. And that all deeds in the future are recorded.

KILNS - SHELTERED WORKSHOP

The county kilns were sold to the Sheltered Workshop/San Juan Center for $1600.

COUNTY EQUIPMENT - FIRE CONTROL

Commissioner Bailey said the sheriff's office called the road department this morning and asked when the county equipment was going to be sent to the fire at Boulder Point. The BLM wanted to use the county's cat to fight the fire. The Commission discussed what the policy is on this between the county and the BLM. The Commission would like to meet with the BLM, State Fire Warden, and the Forest Service to review the agreements they have with the county.

INSPECTION STATION

Commissioner Bailey said the road department will be getting the inspection station back sixty days from the day it was suspended.

BLM AGREEMENT - WEED MEETING

Commissioner Holliday reported on the weed meeting that was last Wednesday night. The BLM has agreed to fund sane money to help fight the weeds on BLM land. The BLM will provide some help if Jim Heaton, county weed supervisor, will supervise them. The Commission instructed Mr. Heaton to supervise the help.

MONTICELLO - CULVERT WATER DRAINAGE at hospital

Commissioner Bailey said the road department is going to work on the intersection below the hospital. Commissioner Bailey said they are planning to build a catch basent at end of the gutter and run a twelve-inch pipe down behind past by Gary Young's. The school district owns the land behind Bud Rasmussen's place where the water runs in the ditch. The county is responsible for this water runoff because it comes from the hospital parking area sprinkling system. Commissioner Bailey feels that the county should pay 70% of the costs and the school district pay 30%. Commissioner Black said he feels the pipe should be larger then twelve-inch to prevent clogging.

COUNTY ROAD YARD FENCING - SUPERIOR FENCE COMPANY

Commissioner Bailey said the road department received two bids for partial fencing at the county road yard in Monticello. Superior Fence Co. quoted for fencing material and labor at $7156.00 and a company out of Farmington quoted $8400.00 (both bids included the razor top). Mr. John Fogg, Superior Fence Co., made a proposal to replace all of the chain-link fence at the yard for $18,000. Commissioner Bailey said he would like to go ahead and have the yard newly fenced with the razor top and to save the 11-gauge fencing material for the Montezuma Creek road shed. Commissioner Bailey made the motion to approve the new fence and Commissioner Holliday seconded it. UNANIMOUS.

UNDC - TOLLY LAMEMAN

Tully Lameman, UNDC, met with the Commission. Mr. Lameman asked if Rick Bailey, Administrative Assistant, had done anything about distributing commodities on the reservation. The Commission said they would have Rick Bailey get in touch with him next week.

Wilderness Task Force - Mr. Lameman said UNDC had been contacted to serve on the county's task force on wilderness. Mr. Lameman said that Herb Clah and Jonas Mustache said they would not have much time to work on this task force but someone will be appointed.

Road Projects - Mr. Lameman asked how the road project to Piute Farms was going and what the cost will be. Conmissioner Bailey said they are planning to work on this road and will bill the Tribe every quarter. Mr. Lameman asked if the county had received the permit from the Tribe for materials for the Aneth to Ismay road. Conmissioner Bailey said they received the permit and will continue working on this road.

Budget - The UDIA board cut the budgets for 1986/1987 by 20%. The UDIA board set the budgets for UNI, The San Juan Center, and UNDC. All projects have to be separately presented to the board by each chapter on a special project basis. Mr. Lameman said he is concerned about the road projects since their budget was cut. Commissioner Bailey explained that the county has a cooperative road agreement with the Tribe for the reservation. The county puts these roads on their "B" road program which helps with the funding and UNDC participates by paying 25% of the costs. This has enabled the county to double the amount of road work done on the reservation. The county intends to continue this road program, but it will curtail if UNDC does not participate.

RESOLUTION 1986-5 - UTAH ASSOCIATION OF COUNTIES - FINANCE COOPERATIVE AGREEMENT An agreement and resolution for membership in the Utah Counties Finance Cooperative Agreement was approved on the motion of Commissioner Bailey and authorized Commissioner Black to sign it. The motion was seconded by Commissioner Holliday. UNANIMOUS.

RESOLUTION APPROVING THE UTAH COUNTIES FINANCE COOPERATIVE AGREEMENT

Resolution No. 1986-5

WHEREAS, representatives of San Juan County (the "County") have been advised by the Utah Association of Counties of a proposal whereby counties would contract with each other to form a separate legal or administrative entity pursuant to the Interlocal Co-operation Act, Title II, Chapter 13, Utah Code Annotated 1953, as amended (the "Act"); and

WHEREAS, such legal or administrative entity, to be designated as the Utah Counties Finance Cooperative (the "Cooperative") will be authorized pursuant to the Act to issue tax-exempt governmental obligations, the proceeds of which will be used to assist participating counties (the "Participants") in their attempt to provide efficient governmental services for their citizens by making loans or by leasing property to such Participants; and

WHEREAS, the Cooperative is empowered by the Act to (a) own, acquire, construct, operate, maintain and repair any facility or improvement as provided for in the agreement forming the Cooperative; (b) borrow money or incur indebtedness, issue revenue bonds or notes for the purposes for which it was created, assign, pledge or otherwise convey as security for the payment of any such bond or indebtedness the revenues and receipts from such facility, improvement or service; (c) sell or contract for the sale of the product or the service or there benefit frcm such facility or improvement to public agencies within or without the state on such terms as it deems to be in the best interest of its participants; and

WHEREAS, the County desires to form the cooperative with the powers specified above and with all other powers granted or exercisable by such Cooperative under the Act; and

WHEREAS, the proposed form of the Utah Counties Finance Cooperative Agreement to be dated as of June 1, 1986 (the "Cooperative Agreement") has been presented to the County and the County believes it is in its best interest to approve the Cooperative Agreement by this resolution; and

WHEREAS, the County desires to appoint a duly elected official of the County to act as its representative ("Representative") for the purpose of electing the governing board of the Cooperative;

NOW, THEREFORE, BE IT RESOLVED BY THE GOVERNING BODY OF THE COUNTY AS FOLLOWS:

Section 1. All action not inconsistent with the provisions of this resolution heretofore taken by the governing body of the County directed toward creating the Cooperative for the purpose of issuing obligations to finance various facilities, services or improvements of the Participants, are hereby ratified, approved and confirmed.

Section 2. The Cooperative shall issue bonds ("Bonds") for the purpose of providing funds (i) to loan to the Participants to acquire needed facilities, services or improvements; and/or (ii) to purchase or otherwise acquire such facilities, services or improvements and lease or sublease or sell them to the Participants or own and operate the same for Participants pursuant to operating or management contracts.

Section 3. The Cooperative Agreement, in the form presented to this meeting, is hereby approved, and Calvin Black is hereby authorized and directed to execute and deliver the Cooperative Agreement, in substantially the form presented to this meeting, but with such changes therein as he or she shall deem necessary and appropriate, his or her execution thereof constituting conclusive evidence of the County's approval of any and all such changes.

Section 4. The County agrees, subject to the conditions contained herein and in the Cooperative Agreement, and subject to compliance with all provisions of law, as follows:

(a) The County will adopt or cause to be adopted such further proceedings, if any, authorizing the execution and delivery of documents as may be necessary or advisable for the authorization and execution of the Cooperative Agreement and compliance with any of the terms and conditions thereof.

(b) The officers and employees of the County are hereby authorized to take such further action as is necessary to carry out the intent and purposes hereof and the execution of the Cooperative Agreement and to carry out the purposes of the Cooperative Agreement.

Section 5. The County hereby appoints Calvin Black , a duly elected official of the County as its Representative for the purpose of electing the governing board of the Cooperative. Such board shall adopt bylaws, oversee the issuance of the Bonds and conduct all other business as may be required to carry out the functions of the Cooperative in accordance with the Cooperative Agreement. An administrator shall assist the governing board of the Cooperative with all administrative matters but shall have no vote in the governance of the Cooperative.

Section 6. This resolution constitutes an approval of the Cooperative Agreement. As stated therein, the County shall not incur any pecuniary liability upon the adoption of this resolution or the execution of the Cooperative Agreement. Liability shall exist only after and to the extent that the County either borrows money from the pool of available funds or purchases or leases or subleases or contracts with respect to property acquired with the proceeds of the

Bonds.

Section 7. The duration of the Cooperative shall be as provided in the Cooperative Agreement but in no event to exceed 50 years.

Section 8. All orders, ordinances and resolutions with respect to this transaction heretofore adopted, or parts thereof, which are in conflict with any of the provisions hereof are, to the extent of such conflict, hereby repealed, except that this repeal shall not be construed to revive any act, order or resolution, or part thereof, heretofore repealed.

Section 9. If any provision of this resolution shall be held or deemed to be or shall, in

fact, be invalid, inoperative or unenforceable for any reason, such reason shall not have the effect of rendering any other provision or provisions hereof invalid, inoperative or unenforceable to any extent whatever, this resolution and the provisions of this resolution being deemed to be the separate independent and severable act of the governing body of the County.

Section 10. Immediately after its adoption, this resolution shall be signed by Calvin Black, as Commissioner of the County, shall be recorded in the official records of the County and shall take immediate effect.

STATE WILDERNESS SUB-COMMITTEE - LETTER FROM CHAUNCEY POWIS

Commissioner Black reported he received a letter from Chauncey Powis thanking him for the trip the state wilderness sub-committee took to see the proposed wilderness areas in the county.

FIVE-COUNTY MASTER PLAN

Commissioner Black said a five-county master plan draft has been published. Carl Eisemann wrote a response on this that was real good.

Department Of Energy - ENRICHMENT

Commissioner Black said he received a letter from Bob Beverly of Umetco. The letters says Judge Karigan of the 10th District Court in Denver, in an attempt to expedite action by the Department of Energy of his order issued last September, plans to issue an order hauling DOE enrichment of foreign uranium. This should persuade the DOE that the Judge is serious and also encourage the utilities and DOE to give more thought of support to Senator Domeneci's new proposed bill on Uranium Revitalization and Tailings Reclamation Act.

UTAH STATE ADVISORY COUNCIL on AGING AND ADULT SERVICES

A motion to re-appoint LaRay Alexander to the Utah State Advisory Council on Aging and Adult Services and Al Haskins as alternate was made by Commissioner Bailey. The motion was seconded by Commissioner Holliday. UNANIMOUS.

JIM KEYES - COUNTY AGRICULTURE AGENT

Jim Keyes, county agriculture agent, met with the Commission to discuss various items. The extension

office is planning on sending out a newsletter each month that will give a list of what services are being

provided in the extension office, the workshops, and the information that is available.

Last month Mr. Keyes said he was contacted by 131 people in the county and hopes for more this month. A

lot of soil and wheat samples were sent to the state. Mr. Keyes said he is enjoying meeting with the

people on their farms and helping them.

Fairgrounds - Mr. Keyes asked who was in charge of the fairgrounds. The Commission said it is usually

done on a volunteer basis. Mr. Keyes said the 4-H would like to work on cleaning it up. Commissioner

Bailey said the road department would help if they are notified in advance.

Junior Livestock - Mr. Keyes said he would like to work with the Junior Livestock Show. Mr. Keyes feels

the show should be held the same time as the county fair. Commissioner Holliday said he would talk to

Maurice Pugh, manager of the livestock show, to see if he will coordinate with the county fair. The county

fair is scheduled for August 14.

Mr. Keyes told the Commission he appreciates the support they have given him.
