SAN JUAN COUNTY COMMISSION MINUTES FEBRUARY 16, 1988

The regular session of the San Juan County Commission convened at the hour of 10:00 a.m. at the San Juan County Courthouse, Monticello, Utah.

Commissioner Calvin Black was excused to meet with the Utah Legislature.

Comnissioner Maryboy made a motion to approve the minutes of February 8, 1988 as corrected. Commissioner

Bailey seconded the motion. UNANIMOUS.

ADMINISTRATIVE ASSISTANT RICK BAILEY'S REPORT

Community Development Block Grant Application - Administrative Assistant Rick Bailey presented the application for Community Development Block Grant funds to be signed. Notice was received this morning that $80,913.00 would be available

for the County. Commissioner Maryboy made a motion to approve the application and authorize Acting Chairman Kenneth Bailey to sign the document. Commissioner Bailey seconded the motion. UNANIMOUS. State Farm Bureau Federation/BLM San Juan Resource Management Plan - The State Farm Bureau Federation staff has been in contact with Administrative Assistant Rick Bailey to voice their opposition to the BLM San Juan Resource Management Plan. The Farm Bureau will try to get the congressional delegation to work on it.

CURRENT BUSINESS

Tax Anticipation Notes - County Clerk Gail D. Johnson presented the Tax Anticipation documents for formal signature. The Commission accepted the resolution at their regular Commission meeting on January 19, 1988.

Heckla & Union Carbide Leases - County Attorney Craig Halls discussed the possibility of combining the Heckla and Union Carbide mine leases. The mines are near production and the companies would like to enter into a single lease agreement with the County and all parties concerned. One problem that might prohibit this action is that one lease calls for a higher royalty than the other. Mr. Halls was asked to discuss the issue with Commissioner Black before going ahead with the lease.

Forest Service - Moab District Ranger Ray Carling, Monticello Assistant Ranger Joe Bistryski, and District Engineers Ted Fitzgerald and Brent Barney met with the Commission to update the Schedule A Cooperative Roads Agreement between the Forest Service and San Juan County. The County would like to be able to have all the roads on the Schedule A designated as B roads to be put on the B Road System but they do not meet the criteria as the County does not have sole responsibility of maintenance of these roads. They asked the Forest Service to look at the roads on the Schedule A to see if the County could be given a right-of-way easement which would meet the criteria of the B Road System. The Forest Service stated that the roads have to serve primarily private, commiercial or County interest groups rather than Forest Service interests before they can give an easement to the County. The County feels that in every area that has a Forest Service road that is a connecting link on the present B Road System would be advantageous for the County to have the right-of-way.

The County would like to have road #163 added to the Schedule A along with a road leading to a mining operation of Mike and Dick Shumway. The Forest Service designates these roads as the Pine Ridge Road and the Martha Claims road. The Forest Service agreed to include the entire section of road from the State Highway across the private property to the forest boundary as well as the road to the mine on the Schedule A indicating that the Forest Service has an intent to cooperate on that road. Maintenance responsibilities will be shared by both agencies. An EPA study by the Forest Service indicates the road to the mine needs to be graveled to control erosion and dust. The County will not gravel any road that does not meet County standards but will apply pit run to the road which will be acceptable to the Forest Service. The County agreed to maintain the road.

County Engineer Doug Pehrson will meet with the Forest Service to discuss other county roads that need to be placed on the Schedule A Cooperative Agreement. Mr. Pehrson will also contact the Utah Department of Transportation to obtain a copy of the requirements that need to be met in order to place a road on the B Road System.

Mr. Fitzgerald said that according to US Code 932 that if a road existed before the Forest was established then that road can be considered a public road by a public road agency outside the Forest Service and the Forest Service would have to give the road back to the agency upon claim.

Mr. Carling asked what the County was doing on the OHV Regulations and Interstate Law. Commissioner Bailey said they are all closed at the present time. The BLM, Forest Service and State Lands would like to meet with the County the first part of March to decide this issue.

Hart's Draw Road - Contnissioner Bailey was concerned about the cost involved with removing the top soil and stockpiling it for rehabilitation of the area on the Harts Draw Road project. The Forest Service indicated the top soil only needs to be removed where there is good topsoil and stockpiled in that same area for rehabilitation of that particular area. Those areas of clay soil or rock will not have any top soil so would not need to be rehabilitated by the County.

Dry Wash Reservoir Road - The San Juan Water Conservancy District has made application to rebuild the Dry Wash Reservoir Dam but the Forest Service still needs the specs to finish the environmental assessment before they can approve the project. If there is indication that the dam will be updated in the future, the engineering is already available and that as soon as a decision is reached to approve the project, work can begin on realigning the road.

Refund of Property Tax - County Treasurer Marian Bayles requested approval of a refund on property tax that jumped from $4.30 to $585.57. Mrs. Bayles felt that this was too much of a discrepancy and should be refunded. Commissioner Bailey stated that the reason for the discrepancy should be discussed with County Assessor Barbara Montella before a refund is granted.

Annexation Request/Blanding - Blanding City Engineer Phillip Palmer asked the Commission to review the current annexation process. Interpretation of the revisions of the "Annexation Process Of Your Local Government", Act of 1979 passed by the 43rd General Session of the Utah State Legislature would indicate that the County Commission takes the lead in establishing the "Boundary Conmission". If the "Boundary Commission" is required and not presently established, then Blanding would like assistance in establishing the commission. They have listened to annexation proposals that would annex a minimum of 1/3 block to 4 and 1/2 blocks plus 80 acres west of Blanding.

Hospital Board Meeting - Hospital Administrator John Fellmeth asked the Commissioners to look at an agreement to lease back from the doctors at the Blanding Clinic the lab, xray, urgent care and operation of the Clinic prior to discussing it at the Hospital Board meeting this evening. The emergency care

scheduling will also be discussed.

Tax Litigation Billing - Commissioner Maryboy made a motion to approve the payment of $11,036.75 to Anderson & Anderson, P.C. on the oil companies litigation. Commiissioner Bailey seconded the motion. UNANIMOUS.

COMMISSIONER MARK MARYBOY' S REPORT

Library Board Request - The Library Board requested approval to go ahead with the renovation of the

upstairs room in the Monticello Library. Commissioner Bailey will contact Gaylen Schaugaard to obtain

cost estimates for the project.

Utah Chapters/Commodity Foods - The Utah Chapters of the Navajo Nation have requested that the Commodity

Foods be distributed from Montezuma Creek as a central location. Administrative Assistant Rick Bailey

reported that the County does not have the authority to distribute foods on the reservation. The Navajo

Tribe is responsible for distribution on the reservation but the Utah Navajo's are not getting their share

of the commodities. Commissioner Maryboy will contact Navajo Tribe Council members to get these

commodities to the Utah Navajo's. Mr. Bailey stated that the conmodities have been drastically cut and he

feels that they will not be available after March.

Mexican Hat Sewage Problem - The Commission was asked if they could help with the sewage problem at

Mexican Hat. When the project was put in the Commiission was not asked to help but stated" that the

residents could apply to Farmers Home Administration for another project to get the additional ponds

needed.

Mexican Hat Business Development - Mexican Hat would like to obtain additional land for business

development. The Mexican Hat Association, a legally organized group, can apply to the BLM for lease or

sale of the exact area they want to have for expansion. County Engineer Doug Pehrson would be available

to make a survey of the area if needed.

Trash Barrels - Commissioner Bailey reported that the trash barrels to be placed by the Twin Rocks near

Bluff will be ready next week and will be delivered to Bill Davis in Bluff.

COMMISSIONER KENNETH BAILEY'S REPORT

Bluff Roads - The trenches have been dug and filled with rock so the water in the ponding areas can be

drained. County Engineer Doug Pehrson has approved the application of two inches of gravel on all Bluff

roads.

County Equipment Purchase/Boettecher & Company, Inc. - Dwight Osborn contacted the Commission and

indicated that an issue of $500,000 in bonds through the Boettecher and Company, Inc. is available for the

purchase of county equipment.

The bonds would have an 8 year payoff. Contact either Mr. Osborn at 364-0600 or Kim Young at 364-0607.

Public Safety Building - Commissioner Bailey reported that the architects are in Monticello to supervise

the pouring of 300 yards of concrete at the Public Safety Building.

Copper Canyon Road - Commissioner Bailey wrote to UDOT District Engineer Dyke Lefever requesting the

assistance of Frank Ularich in deciding the best possible solutions for the drainage problems on the

Copper Canyon Road Project.

Indigent Death - Coimiissioner Bailey approved the payment of $250 to the mortuary for an indigent death at

the Nursing Home.

Service Truck Bed - Coimiissioner Maryboy made a motion to approve the purchase of of a bed with pumps,

tanks, etc. for the service truck at a cost of $7,000. Commissioner Bailey seconded the motion.

COMMISSIONER CALVIN BLACK'S REPORT

Economic Development - Coimiissioner Black reported that a notice was received for application by a county

to EDA for $500,000 for an Economic Development Revolving Fund loan program. It could be a program the

County is interested in looking at.

Monticello Chamber of Commerce - Coimiissioner Black will be speaking at the Monticello Chamber of Commerce

annual dinner meeting Thursday evening.

Legislative Lobbying - Commissioner Black will be in Salt Lake Tuesday and Wednesday to lobby with the

Utah Legislature on the Mineral Lease, Payment in Lieu of Taxes, and B & C Road Fund bills.

Timber Sale - A request has been received from Brenda Stocks asking for a timber sale on BLM lands.

Commissioner Black recommended that the County support Ms. Stocks request.

Burr Trail - A propaganda letter has been received from Terri Martin requesting funds to continue fighting

the Burr Trail.
