MINUTES OF THE SAN JUAN COUNTY COMMISSION MEETING HELD
NOVEMBER 15, 1982
The Board of County Commissioners met in regular session on Monday, the 15th day of November at the hour of 10:00 a.m. in the Courthouse at Monticello, Utah.
On roll call the following members were present: Commissioner Calvin Black, Chairman
Commissioner Robert Low
Commissioner Kenneth R. Bailey
Minutes of the previous week were read and approved with the specified corrections upon the motion of Commissioner Low and the second of Commissioner Bailey and it carried unanimously.
NUCLEAR WASTE REPOSITORY - LEGISLATIVE SUB-COMMITTEE MEETING IN MOAB:
Commissioner Bailey reported that the Legislative Sub-committee on Pulbic Lands meeting that he and Commissioner Low attended on November 13th in Moab was handled very well. Those in attendance were asked for their responses on nuclear waste repository issues and Commissioner Bailey felt good about the meeting,
ROAD DEPARTMENT AUTHORIZED TO PURCHASE LATE-MODEL TRUCKS:
Upon the recommendation of Commissioner Bailey the Commission authorized the Road Department to look for three to four late model ten-wheel dump trucks to purchase as replacements for some of the department's older trucks.
UCOLO ROAD:
Commissioner Bailey reported that the holes in the Ucolo Road have been patched, but some minor damage to
a section of the road was recently caused by a "Cat" which was driven along the edge of the road.
DEPARTMENT OF TRANSPORTATION ANNUAL MEETING SCHEDULED FOR FEBRUARY;
Commissioner Bailey reported that the Utah Department of Transportation has scheduled their annual meeting
with the county for February 3, 1983 at 9:00 a.m. in the Monticello Courthouse.
MULTI-COUNTY AIRPORT DISCUSSED:
The Commission felt that now would be an opportune time to write a formal letter to the Grand County
Commission and Development Board regarding cooperative planning and development of an airport to serve
both counties. The Commission will request that the San Juan Development Board correspond with Grand
County to see if they would be receptive to such a plan. The Commission will also correspond with the Grand
County Commissioners.
BLUFF TO MONTEZUMA CREEK ROAD PROJECT CONTRACT AGREEMENT SIGNED:
The County Attorney, Bruce Halliday, reviewed the contract agreement between San Juan County and Summit,
Inc., for road construction on the Bluff to Montezuma Creek road Project, and advised the commission that
it met all the county's requirements. The agreement was then signed by each of the three commissioners,
Calvin Black, Robert Low, and Kenneth R. Bailey.
JIM ALLRED REPORTS ON COUNTY COMMUNICATION SYSTEMS:
Communications Engineer, Jim Allred, met with the Commission to discuss the status of the electrical equipment at the airports and T.V. reception throughout the county. Mr. Allred reported that he still is waiting for clearance from the Tribe to build the T.V. translator tower near Bluff and he requested that Commissioner Black contact Alfred Dehija in Window Rock, Arizona regarding this matter, and to see if anything could be done to speed up the approval process.
Mr. Allred reported that the transmission problems at Mexican Hat were probably caused from the out-let cable being jerked out. He has installed a new translator-amplifier, and is having the old unit repaired to use as a spare.
Mr. Allred presented a map showing the snowmobile route to the Abajo tower proposed by himself and Road Superintendent, Bernal Bradford. He reported that Mr. Bradford estimated to would cost $1,600 to cut a terrace into the hillside through the timber as the road nears the tower site. A new route is necessary because the steepness of the present road and winter snow drifts make it impassable to even snowmobiles. Mr. Allred said he would be filing the necessary application with the Forest Service today for the new route, but it will not be possible to complete the route this winter.
The Commission asked what caused the variations in the county's T.V. reception from Abajo Peak and why 7 was the clearest channel. Mr. Allred reported that problems in variation of signal strength occur at Orangeville, Utah before transmission to the Abajo tower, and channel 7 is received the best because it is transmitted to Abajo on a 6 ft. dish. He stated that there are plans to transmit all the channels on two 10 ft. dishes by next summer.
Mr. Allred reported that he will repair the Monticello Airport lights today and he will find out who should be responsible for servicing the "vassie" lights at the Blanding Airport.
The Commission reviewed Mr. Allred's time sheets and requested that he also keep track of which department his work mileage should be charged to. It was also requested that he summarize each month's work and turn it in to the Commission along with he monthly time sheets.
PROJECT BOLD MEETING REPORT;
Commissioner Low reported that he, Commissioner Bailey and Mr. Carl Eisemann attended the public meeting in Moab on Project "BOLD." Commissioner Low felt there was more opposition than expected, but no new facts were brought out for discussion.
HEALTH CARE SERVICES REPORT;
Commissioner Low reported that the San Juan Hospital has been able to purchase an ultrasound and a chem-istry analyzer. He also reported that the nursing home needs a car to transport patients to the San Juan Hospital and to Cortez, and he asked if there was a possibility of getting a trade-in from the Sheriff's Department.
Commissioner Low reported that the present emergency generator at the hospital is not adequate and Commis- sioner Bailey suggested that the hospital prepare the specifications on a generator that would be adequate and the Road Supenintendent, Bernal Bard ford, can check for a used one on the market while he is checking for used trucks.
Commissioner Low reported that the county's share of operating costs for the Southeastern Utah Health District will be increased over last year's share due to an increase in the county's assessed valuation. Commissioner Low stated that the Health Care Facilities Board would like the county's matching funds to the Health District to go through them as it will aid them in getting a total perspective of the health care needs of the county.
The County Attorney, Bruce Halliday, reported that the County has a year form August 1, 1982, to file a Notice of Claim with the State Retirement Fund regarding the hospital employees who were not accepted back into the State Retirement program. Mr. Halliday reported that he would like to wait a few months before filing the Notice of Claim to see how lawsuits now pending against the State Retirement Fund are
resolved.
BUILDING PERMIT APPROVED:
A building permit was approved for Hole 'N The Rock for a commercial building. The permit was signed by
Commissioner Bailey.
DIVISION OF AGING CONTRACT AMENDMENT;
Upon the motion of Commissioner Low and the second of Commissioner Bailey it was unanimously voted to approve an amendment to the Utah State Division of Aging Contract authorizing a 2% cut in funding. Mr. Al Haskins signed the amendment as the authorized agent of the county and reported that the total amount in funding to be cut from the State will be $222 and $23 from the county in matching funds.
SU-CAP BOARD REPORT:
The Commission agreed that they will support Mr. Al Haskins in his efforts, as a member of the SU-CAP Board, to either have the allegations of misconduct of staff members substantiated or to quiet the rumors, The Board should work to solve any problems, so that it can focus on delivering services. Mr. Haskins reported that he has recommended the Board approve the Association of Local Governments contract to manage the SU-CAP programs, except Head Start. He also reported that the Board has voted to reduce its membership from15to9members.
DEVELOPMENT BOARD REPORT:
Mr. Cleal Bradford, Chairman of the San Juan Development Board, presented the report on goal setting from | the October 28th meeting, and requested input from the Commission on which specific assignments they feel should be given priority. The Commissioners stated that they would like the Board to work on the promotion of U-95 as a scenic route across the state, and also work on a possible land exchange for agricultural and recreational purposes near Lake Powell.
Upon the recommendation of the San Juan Development Board, Commissioner Bailey moved to appoint Don Vanhautean to replace Tom Murphy as a member on the Development Board, his term to expire December 31, 1985. The motion was seconded by Commissioner Low and it carried unanimously.

COUNTY LIAISON COMMITTEE MEETING REPORT;
Chairman Black reported on his attendance at the recent County Liaison Committee meeting in Phoenix, Arizona. A guide book was prepared by the committee on ways to increase good working relations between counties and the BLM.
NATIONAL ASSOCIATION OF COUNTIES BOARD MEETING REPORT:
Chairman Black reported on his attendance at the National Association of Counties (NACO) Board meeting held in Washington, D.C. In order to defray unanticipated expenditures for the new NACO office building in Washington, D.C., the association has cut its staff approximately 50% and has assessed each state and county member a one time only special fee. Chairman Black reported that San Juan County has been assessed half of the cost ot its annual dues which is equal to $100.00.
GRAVEL REMOVAL FROM VEGA WASH SETTLEMENT APPROVEB:
Upon the recommendation of the County Attorney, Commissioner Bailey moved to approve a settlement and release between John Codner and San Juan County for the amount of $150.00 for damages pertaining to his removal of gravel from the Vega Wash pit. The motion was seconded by Commissioner Low and it carried unanimously. The settlement and release was signed by Chairman Black in behalf of the county.
DEBORAH HARVEY REPORTS ON STATE AND COUNTY FAIR SEMINAR:
County Fair Chairman, Beborah Harvey, reported on the State and County Fair training seminar she attended with County Agent Bob Thompson. Surveys show that the first three ingredients for a successful fair are entertainment, socialization, and exhibits. There is a specialist available through the State to help counties with planning their fairs and the only charge to the county for this service is reimbursement for his travel expenses. Mrs. Harvey discussed possible entertainment ideas for the fair and it was suggested that the High School Rodeo be coordinated with the fair activities this year. Commissioner Low reported that he would like to request a higher fair budget for 1983 for needed maintenance and repairs at the county fair grounds.
COMMISSION TO VISIT MONTEZUMA CREEK FOR PUBLIC MEETING;
At the request of a citizens group from Montezuma Creek, the Commission would like to meet with the public in Montezuma Creek on the evening of November 30, 1982. The Commission will also request that the County Sheriff Rigby Wright, County Attorney Bruce Halliday and Representative Hardy Redd also attend the public meeting to discuss local problems relating to the sale of beer.
BEER ORDINANCE RECOMMENDED FOR ABOPTION:
Commissioner Bailey reported that after studying various county and city ordinances, he would like to recommend that the county adopt a Beer Ordinance similar to that of the City of Monticello with provisions to have all the beer licenses come due at the same time each year, and to specify the fees for Class A, B, C, and Seasonal retail licenses. Commissioner Bailey will ask the County Attorney to prepare a new Beer Ordinance for the county, using Monticello City's as a model and present it for the Commission's approval on November 22, 1982. The Commission and the County Sheriff, Rigby Wright, discussed the fee schedule for the various classes of Beer Licenses. It was felt that the fees should possibly be set as follows:
Class A Retail License (consumption off the premises only)..............$500.00
Class B Retail License (consumption on or off the premises).............$750.00
Class C Retail License (may sell beer on draft for consumption on or off premises).....$1,500.00
Seasonal License........................................................$200.00
PRISON FACILITY FOR SOUTHERN UTAH REGION BISCUSSEB;
Utah State Prison Warden, Ken Schulsen, and Mr. Glen Freestone met with the Commission to respond to the County and City of Monticello's expressed interest in locating the State's proposed medium/minimum security prison facility for the Southern Utah region in this area. Mr. Schulsen reported that because of current prison over crowding, and in an effort to create a prison environment where younger violators can be isolated from the "career" criminals, the State is planning to build three 288 bed medium/minimum security facilities in different regions of the state. Mr. Schulsen felt that one of the positive affects assici-ated with locating such a facility in the community would be an additional 100 to 128 full time jobs, of which 90% could be filled by local people. It was Mr. Schulsen's opinion that a 288 bed facility would be excessive for this location and population, but the decision for locating the facility will be made by either the State legislature or State Board of Corrections. Sheriff Wright was also present for the discussion and he and Mr. Schulsen both felt that a 50 to 75 bed facility would be more in keeping with the county's present and immediate needs.
SALARY INCREASE APPROVED FOR NETTA McDONALD:
Upon the recommendation of County Treasurer, Marian Bayles, Commissioner Bailey moved to approve the probationary increase for Treasurer's deputy, Netta McDonald, from a grade 1.1 to 1.2 and to make the increase retroactive to January 13, 1982. The motion was seconded by Commissioner Low and it carried unanimously. The increase will be calculated on the old pay schedule prior to July 1, 1982 and on the new schedule after July 1, 1982.
1983 BUDGET HEARING DATE SET:
The Commission set the date for the public hearing on budget requests for 1983 for the evening of Becember
7, 1982, at 6:00 p.m. in the Courtroom of the Monticello Courthouse.
