MINUTES OF THE BOARD OF COUNTY COMMISSIONERS MEETING HELD MAY 15, 1978

Minutes were read and approved on a motion by Commissioner Guymon and seconded by Commissioner Black.
MEETINGS
The following greetings will be attended by the Commissioners: The Alcohal and Drug abuse meeting, May 18, 1978, Mental Health Meeting, May 16, 1978, Public hearing in Bluff on the Bluff Multipurpose Center May 23, 1978 at 7:30 in the Bluff Elementary School, the Fair board meeting, May 18, 1978.
Commissioner Black has a Tax study committee meeting and a Power Plant Siting meeting on May 16, 1978 and a Blm advisory meeting designed to get imput for Wilderness Planning Procedures.
BLANDING SENIOR CITIZENS CENTER
There were no formal bids for the renovation of the Blanding Library so Commissioner Guymon was given the go ahead on getting informal bids or negotiating for a bid to get the work done.
Commissioner Guymon also stated that the Governor's Conference on Aging was a great success. AREA DEVELOPMENT ASSISTANCE PLANNING GRANTS
The AOG prepared a letter in support for their application for funding under the Farmers Home Administration "Area Development Assistance Planning Grants" Program. Commissioner Guymon made the motion to approve the letter and to authorize the chairman to sign the letter. This was seconded by Commissioner Black.
MONTICELLO SENIOR CITIZENS
Commissioner Guymon stated that the Monticello Senior Citizens still want the County to purchase the building which now houses the Activity Center. Commissioner Boyle stated that it wasn't adequate for a Senior Citizens Center and that it would be too crowded for the things that they would like to do. He stated that he had discussed at length the present BLM building bid that the county has in with the BLM for their building when they complete the construction of their new building. Mr. Gene Day, Regional Director, stated that the county has a good chance of acquiring this building. Commissioner Boyle also stated that the City of Monticello has received several complaints on the parking problem in front of the Activity Center and they are considering changing the zoning. The Commissioners felt that this would also preclude the county purchasing this building.
SAN JUAN COUNTY MUSEAUM
Mrs. Nell Dalton, and Mrs. Leona Markosek met with the commissioners to discuss the Museum in the basement of the Monticello Library. Mrs. Dalton stated that the Monticello Senior Citizens had been down measuring the room that houses the museum. The commissioners stated that the Senior Citizens had done this on their own responsibility. Mrs. Dalton asked for some guarantee that the Museum would not be moved in the future. Commissioner Black stated that the present commissioners could not bind a future commission legally. However, he also stated that only

an overwelming need would cause the Museaum to be moved and then the Museum board would probably concur. Mrs. Dalton also asked about getting new lights for the Museum room. Commissioner Guymon stated that he knew where he might be able to get some used lights. He stated that he would follow up on this.
CRISIS INTERVENTION
Mrs. Marsha Keele met with the commissioners to discuss and present for approval the following names in the Crisis Intervention Program. The following names were approved pending further checking:

CONTRACTS
Mr. Bruce Shumway met with the Commissioners to present the following contracts for approval. The Alcohalism and Drug contract was approved on a motion by Commissioner Black and seconded by Commissioner Guymon and passes unanimously.
Title XX Purchase of Service Contract
This agreement is between the Utah State Department of Social Services, Office of Community Operations (State Title XX Agency), hereinafter referred to as STATE and San Juan Community Social Services hereinafter referred to as PROVIDER and the Department of Social Services, Division of Alcoholism and Drugs, hereinafter referred to as DIVISION.
1. PERIOD OF PERFORMANCE
This contract shall be effective July 1, 1978, or the date this contract is executed, whichever is later, and shall terminate on June 30, 1979.
2. CONTRACT COSTS
Cost of purchased services authorized by this contract shall not exceed $23,500.00 and shall be funded in accordance with Attachment A.
3. METHOD AND SOURCE OF PROVIDER PAYMENT
The State will transfer funds to San Juan Community Social Services from Federal Title XX funds (75%) and from the Division (25%) as required up to the appropriate percentage of the total amount of the contract.
4. AUTHORITY
Provisions of this contract are pursuant to the authority granted by the regulations as set forth in 45 CFR 228, Subpart G - Purchase of Services; 45 CFR 74.159, 74.174, and Apprendix F -Principals for Determining Cost Applicable to Grants and Contracts with Non-Profit Institutions (organizations); and Sections 55-15B-7 and 63-35-10, Utah Code Annotated 1953 as amended which permits STATE to purchase certain specified services, and any other relevant Federal regulations and any relevant provisions of the STATE.
5. ADMINISTRATIVE AND REPORTING REQUIREMENTS
PROVIDER shall maintain or supervise the maintenance of records necessary for the proper and efficient operation of the program, including records regarding applications, determination of eligibility (when applicable), the provision of services, and administrative costs; and statistical, fiscal and other records necessary for reporting and accountability required by STATE and shall retain such records for such periods as prescribed in DFR 74, Subpart D-Retention and Custodial Requirements for Records. Ret: P. L. 93-647, Section 2003 (a) CFR 45-228.70 (a) and 74 Subpart D.
6. ACCESS TO PROVIDER RECORDS
PROVIDER shall meet conditions required by CFR 45-228.70 (a); CFR 45-74, Subpart D (Retention and Custodial Requirements for Records Subpart); 74-23 (Access to Records); and 74-24 (Restrictions on Public Access). PROVIDER shall allow STATE and Federal auditors to have access to its records for audit and inspection on request.
7. LICENSING AND STANDARD COMPLIANCE
All licensing or other standards required by Federal, State, or local units of government where the services are provided must be complied with in full for the duration of this contract.
8. EQUAL EMPLOYMENT OPPORTUNITY CLAUSE

The PROVIDER agrees to abide by provision of Title VII of the Civil Rights Act of 1964 (42 USC 2000e) which prohibits discrimination against any employee or applicant for employment because of race, religion color or national origin. In addition the PROVIDER agrees to abide by Executive Order No. 11246, which prohibits discrimination because of sex (Refer to Attachment B)
9. GRIEVANCE PROCDURE
PROVIDER agrees to establish a system through which recipients of the purchased services may present grievances about the operation of the program as it pertains to and affects said recipients. The PROVIDER will advise recipients of this right to present grievances and of the' right to appeal a failure to recognize his choice of services and to a fair hearing by the Department of Social Services in these instances. Applicants will be advised in writing of rights and the procedure to appeal a denial or exclusion of the program.
10. INDEMNITY CLAUSE
PROVIDER will at all times, during the existence of this contract, idemnify and save harmless the STATE against any and all liability, loss, damages, costs, or expenses which the STATE may hereafter sustain, incur or be required to pay by reason of any act or omission of any employee or person retained by PROVIDER, and arising out of services furnished by PROVIDER under this contract. Proof of PROVIDER'S liability insurance or financial capacity to indemnify STATE may be required.
11. MONITORING
STATE will monitoring the services griven by the PROVIDER for each eligible consumer and the results obtained using this contract as criteria.
12. CONSULTATION AND TECHNICAL ASSISTANCE
STATE will supplu appropriate consultation and technical assistance as indicated or requested by the PROVIDER to assure satisfactory performance in providing the contracted services.
13. SERVICES PROVIDER agrees to:
A. supply those activities specified in Attachment C.
B. Maintain individual codumentation for each consumer regarding services provided and the results achieved.
14. ELIGIBILITY
PROVIDER, will assist STATE in obtaining completed application forms from applicable consumers. Payment for services will not be made by STATE prior to eligibility determination by the STATE.
15. RATES
PROVIDER guarentees that rates charged for services to eligible recipients will not be higher that rates charged others for comparable services. Payment will be made only for services actually provided.
16. FEES
PROVIDER will not impose any fees upon consumers given services under this contract except as determined by STATE.
17. AUDIT EXCEPTIONS
Expenditures under this contract determined by audit to be ineligible for reimbursement, and for which payment has been made to PROVIDER, Will be refunded to STATE by the PROVIDER.
18. RENEGOTIATION OR MODIFICATION - ADDITIONAL SERVICES
Any alteratiohns, variations, modifications, or waivers of provisions of this agreement shall be valid only when they have been reduced to writing, duly signed and attached to the original signed copy of this agreement. No claim for services furnished by the PROVIDER, not specifically provided in this Agreement, will be allowed by the STATE nor shall the PROVIDER do any work or furnish any material not covered by this Agreement, unless such work or material is approved in writing by the STATE.'
19. ALL TERMS AND CONDITIONS ARE INCLUDED IN THSI AGREEMENT: ALL ATTACHMENTS INCORPORATED BY REFERENCE ARE PHYSICALLY ATTACHED
This agreement contains all the terms and conditions agreed upon by the parties and included in Attachements A, B, and C. All attachments incorporated by reference are attached. No other understandings, oral or otherwise, regarding the subject matter of this agreement, shall be deemed to exist or to bind any other parties hereto.

Cost of the I & R services authorized by this contract shall not exceed $17,000.00 and shall be funded in accordance with Attachment A, Budget Sources of Funds

SAN JUAN COUNTY ROAD MEETING HELD MAY 15, 1978

PRESENT: E. S. Boyle, Commission Chairman, David Guymon, Calvin Black, Engineer Doug Pehrson,
Foremen LaVar Lyman, Bernal Bradford, Ace Holden, and Lynn Adams.
Minutes were read and approved
Doug reported the State had inspected the Ismay to Aneth Road and had approved of the work that
had been done there.
Ace said he needed another loader to operate the Crusher. Lynn was asked to check on availability of a
yard loader. Lynn was also asked to get prices on contract crushing gravel.
Bernal reported he had started patching pot holes.
Teek reported he was thru hauling gravel on the Ismay road and was moving to Cross Canyon.
Lynn reported the B.L.M. had approved the Free Use Permit at Mexican Hat.
Lynn reported he had purchased serveral pieces of equipment at the UDOT sale in Salt Lake City.
Lynn and Doug were instructed to set up a meeting with the Ute Tribe to get an agreement
on maintaining roads on the Ute Lands in San Juan County,
