MINUTES OF THE SAN JUAN COUNTY COMMISSIONERS MEETING HELD

MARCH 15, 1982

Time: 10:00 a.m. in the Commissioner's Room at the Monticello Courthouse.

Members Present: Chairman Calvin Black, Commissioner Kenneth Bailey, and Commissioner Robert Low.

Minutes of the previous week were read and approved upon the motion of Commissioner Low and the second of Commissioner Bailey and it carried unanimously.

GOVERNOR MATHESON'S POSITION ON NUCLEAR WASTE REPOSITORY DISCUSSED;

Commissioner Low presented a copy of Governor Scott Matheson's Position on a High Level Nuclear Waste Repository. After reviewing the Governor's position, the Commissioners reaffirmed their position in favor of a nuclear waste repository in the County if an adequate and safe site can be found. The Commissioners felt the State could be more supportive in this matter, as uranium production is so important to San Juan County and the nuclear waste repository is an important part of the chain of nuclear power.

HEALTH CARE SERVICES BOARD MEETING REPORT;

Commissioner Low reported that at the request of Harold Young, Heath Engineering has evaluated the San

Juan Hospital's heating and cooling systems and will present recommendations on cutting utility costs.

Commissioner Low reported that the Health Services Board discussed an extension on the south end of the Nursing Home for a 5,300 square foot medical clinic; and another possible addition to the Nursing Home for 13 more beds was also discussed by the Board.

HEALTH CARE SERVICES BOARD MEMBER APPOINTED;

Upon the motion of Commissioner Low and the second of Commissioner Bailey it was unanimously voted to appoint Mr. Ernest Sonderegger to the Health Care Services Board to serve out the term of Harold Young. Harold Young has resigned from the Board as he is moving to St. Geroge. The Commission wanted to pub-licly thank Mr. Young "for the terrific job he has done," and the outstanding service he has given to the County while serving on the Health Care Services Board.

RAISE APPROVED FOR SUE MORRELL:

Extension Agent, Jim Stevens, requested a salary increase for his office secretary, Sue Morrell, as she has satisfactorily completed her probationary period. The Commission approved the raise request from grade 1, step 1 to grade 1, step 2, as it should be given automatically to employees who have performed satisfactorily during their probation period.

GASOLINE AND DIESEL BID TO BE POSTPONED;

Comm. Ken Bailey reported that the bid opening for gasoline, diesel, tires, culverts and cattle guards

will be postponed for 30 days to allow gasoline prices to stabilize. The bid opening will be in April.

ROAD GRADING IN DRY VALLEY;

In response to the concerns of Clem Washburn that the roads in Dry Valley not be graded at this time, Commissioner Bailey reported that the Road Superintendent, Bernal Bradford, authorized the road at Heart Point to be graded after he had inspected it and determined it was necessary for proper maintenance. Mr. Bradford reported to Commissioner Bailey that dirt was pulled from the bar-ditches, but the grass was not graded, and the road should now be stabilized for approximately 5 years.

MEXICAN WATER ROAD RIGHT-OF-WAY THROUGH RIVER RANCHES;

The Commission authorized the County Clerk, Clytie Barber, to sign the corrected deed for the Bluff to Mexican Water road right-of-way across River Ranches. Having given its authorization to transfer the right-of-way to the actual location of the road, the previous deed will revert back to the River Ranches.

BLUFF TO MONTEZUMA CREEK ROAD REPORT;

Commissioner Bailey reported that the Utah Department of Transportation office has given the Bluff to Montizuma Creek road project top priority. They will be making some changes in the road alignment and this will set the bid date back somewhat.

REQUEST RECEIVED FOR PAVING COUNTY ROADS #206 & #219;

To; San Juan County Commission

From: Residents Southeast of Blanding

We the undersigned residents of San Juan County would like to request the paving of County roads #206 and #219.

Beginning with the road by Blue Mountain Dairy, #206, east, then south to the junction with #219, then west to the highway.

In conjunction with this request, we would like to know if we could have the following questions answered? Preferably in writing. #1 What problems exist to curtail the improvement of #206, 219?

#2 What time period can we expect before any work will be done? j

#3 Will the County pave the above mentioned road, or any part thereof? #4 What can we as citizens do to expedite the process?

Commissioner Bailey and Bernal Bradford will inspect the roads #206 and #219, and make recommendations for actions to be taken at the next commissioners meeting.

ROAD FOREMEN APPROVED FOR NORTH DISTRICT;

Upon the recommendation of the County Road Superintendent, Commissioner Bailey moved to hire Mr. Merz Hugentobler as Road Foreman for the North District, at grade 14, step 5, on a six month probation with no raise to be given at the end of the six months probation other than the annual cost of living increase usually given in July. The motion was seconded by Commissioner Low and it carried unanimously.

SAN JUAN SPECIAL SERVICE DISTRICT #1;

The County Attorney, Bruce Halliday, advised the Commission to not authorize any further payments on the San Juan Special Service District #1 water project until JONCO'S bankruptcy status is settled.

In the matter of County funds being used to pay for some of the Service District's expenses, Chairman Black stated that the County served as the sponsoring organization for the Service District only to enable it to become a legal entity. It was never intended or agreed for the County to be under any financial obligation for the Service District. The Service District should reimburse the county out of a general tax levy any money the County has paid for its water and sewer projects.

1982 OPERATING BUDGET PRESENTED;

Mr. Bill Francom presented the Commissioners copies of the County's Operating Budget for 1982, as they

were submitted by the Clerk's office to the State.

PROJECT "B.O.L.D." ;

Chairman Black reported that he will be attending the Association of Governments meeting and will present the County Commission's position on Project "B.O.L.D." as follows: The Commission supports the transfer of most Federal lands to the State; "Checkerboard" lands should not be traded at this time; the Commis-sion supports a State payment in lieu of taxes program; the Commission feels State Land Board members should be elected.

AGING PROGRAM RECEIVES MORE CHEESE;

Mr. Al Haskins reported that an additional 3,000 pounds of cheese will again be available for distribution for the Aging program. The County will also be receiving 1,200 pounds of turkey, 1,100 pounds of various cheese, and 5,600 pounds of butter and milk products for Aging program meals, as well as cheese for the Low Income program. The Commission approved Mr. Haskins request for use of a County truck to bring the produce in from the Salt Lake warehouse.

ELECTED COUNTY OFFICIALS PAY RAISES DISCUSSED:

Mr. Haskins presented a report of the 1981 salaries of Utah's elected county officials. The Commission compared the salaries and it was felt that the salaries for San Juan County's elected officials are in line and should remain unchanged for 1982 except for the annual cost of living increase to be equivalent to the other county employee raises.

The salary for the County Attorney was specifically discussed by the Commission and Bruce Halliday. it was felt the work load for the Attorney's office has increased and Mr. Halliday requested that the Comm. con-sider making the County Attorney a full time office and increase the salary. When compared to other County

Att'y salaries with equivalent-work-loads, San Juan.County's Att's salary is lower. No action was taken at this time to change the status or the salary of this office.

FIRE PROTECTION AGREEMENT FOR SPANISH VALLEY APPROVED:

Upon the motion of Commissioner Bailey and the second of Commissioner Low, it was unanimously voted to approve an Interlocal Co-Operational Agreement between Moab Valley Fire District and San Juan County for Moab Valley Fire District to provide for fire protection to the protion of Spanish Valley situated in San Juan County and for San Juan County to pay Moab Valley Fire District a sum of money equal to the current year mills of the Moab Valley Fire District. The agreement was then signed by the full commission.

BEER LICENSE RENEWED FOR SAN JUAN TRADING POST;

Upon the motion of Commissioner Bailey and the second of Commissioner Black it was unanimously voted to approve a renewal of the Class "A" Beer License for Jerold G. Baum d/b/a San Juan Trading Post in Mexican Hat, Utah, and authorize Chairman Black to sign the license.

BEER LICENSES FOR HALLS CROSSING RESORT AND MARINA APPROVED:

Upon the motion of Commissioner Bailey and the second of Commissioner Black, it was unanimously voted to approve a renewal of a Class "A" Beer License for Halls Crossing Resort & Marina, and to approve a second, Class "A" Beer License for Halls Crossing Resort & Marina Center Store, both in behalf of Del Webb Recreational Properties and to authorize Chairman Black to sign the licenses.

BEER LICENSE FOR LASAL JUNCTION SERVICE & CAFE APPROVED;

Upon the motion of Commissioner Bailey and the second of Commissioner Black, it was unanimously voted to approve a Class "A" Beer License for the Service Station only at LaSal Junction Service & Cafe in behalf of McDougald Oil Corp., Inc. and to authorize Chairman Black to sign the license.

BEER ORDINANCE DISCUSSED:

When the Commission denied a Beer License to Howard Valle in May 1981, a committment was made to reaffirm or revise the present County Beer Ordinance. The Commission requested that the County Attorney, Bruce Halliday, draft a letter to Mr. Valle acknowleding the Commission's committment. It was also requested that the County Attorney research and prepare recommendations for a new Beer Ordinance.

BUILDING PERMIT SIGNED;

The Commission approved a building permit for Dan Welch for a mobile home at LaSal, Utah. The permit

was signed by Commissioner Bailey.
