MINUTES OF THE SAN JUAN COUNTY COMMISSIONER'S MEETING HELD

JUNE 14, 1982

Time: 8:00 a.m. in the Commissioner's room at the Monticello Courthouse.

Members Present: Chairman Calvin Black and Commissioner Robert Low. Commissioner Kenneth Bailey was

excuesed as he was out of town.

The minutes of the prevouus week were read and approved with the stipulated correction upon the motion of Commissioner Low and the second of Commissioner Black and it carried unanimously.

FOREST SERVICE COOPERATIVE AGREEMENT FOR ROAD MAINTENANCE SIGNED:

District Ranger, Ron Dickemore, presented the Forest Service Cooperative Agreement for Road Maintenance as was agreed upon in the regular Commission meeting on April 19, 1982. Chairman Black verified with Mr. Dickemore that the County will determine the level of road maintenance. Commissioner Low moved to approve the Forest Service Cooperative Agreement for Road Maintenance on National Forest Service Land. The motion was seconded by Commissioner Black and it carried unanimously. The Agreement was then signed by Commissioners Black and Low.

FOREST SERVICE AGREEMENT TO REIMBURSE SHERIFF PATROL:

District Ranger, Ron Dickemore presented an agreement to reimburse the County Sheriff Department $10.00 per hour for patrol work carried out on National Forest Service Land through September 1982. Commissioner Low moved to approve the Agreement with the Forest Service to reimburse the Sheriff patrol. The motion was seconded by Commissioner Black and it carried unanimously.

At this time, Mr. Dickemore arranged to meet again with the Commission on June 24, 1982, at 3:00 p.m. in the Commissioner's room.

J.J. STEFFENS MEETS REGARDING HORSESHOE TOURNAMENTS:

Mr. J.J. Steffens reported to the Commission that he will be in charge of the horseshoe pitching tournaments for the July 4th and July 24th celebrations sponsored by Blanding and Monticello. He would like permission to set up more horseshoe pegs for both cities' tournaments. Mr. Steffens was advised to contact Dennis Jones and the Recreation Board for their approval and authorization of funds to purchase additional pegs. Mr. Steffens said that he would not charge the County to put in the pegs.

LASAL PUBLIC USE APPLICATION TO BLM FOR SOLID WASTE DISPOSAL SITE;

Commissioner Low reported that he has gathered most of the information to complete the BLM Recreation and Public Purposes Application to acquire public lands suitable for a solid waste disposal site for the community of LaSal. The form will be completed by the Clerk's Office and returned to the BLM, Moab District Office.

HEALTH CARE SERVICES BOARD MEETING REPORT:

Commissioner Low reported that at the recent Health Care Services Board meeting the Board adopted a recommendation to the County Commission to transfer the funds budgeted for the County's Health Care Services from the County to the Health Care Services Board. Before a decision is made the Commission will ask the Clerk's office to determine the Health Services unexpended balance for their 1982 budget.

RECAPTURE RIGHT-OF-WAY REPORT:

Commissioner Low reported that Annette Jamison is now working in the Monticello BLM Office, and will

be helping to complete the right-of-way process for the Recapture project.

RODEO MAINTENANCE DISCUSSED:

Mr. Al Haskins requested authority to purchase poles and posts to repair fences and gates at the County rodeo grounds. The Commission felt that this would be fine, but advised Mr. Haskins to take his request to the Fair Board for their approval and authorization of funds from the State and County Fair budget.

STATE LAND BOARD MEETING REPORT:

Chairman Black reported on his attendance at a meeting in Moab, June 9th, with the State Land Board and representatives of county commissions from the Eastern part of the State. The group discussed State Land Board policies concerning public entities. It was agreed that the participating counties would jointly support and sponsor changes in State laws enabling the State Land Board to grant sales, special use permits, right-of-ways, etc., to public bodies similar to BLM policies. A program for State payments in lieu of taxes was also discussed.

On June 10th, the Commission met with Ralph Backer of the State Land Board, Mark Walsh a public land specialist for the Utah Association of Local Governments, and Don Chase a State wide county representative to the advisory Committee on project "BOLD." During the meeting the areas for possible selection or changes in regards to project "BOLD" were identified. Chairman Black reported that the commission requested that Cedar Mesa be blocked for cultivation; Hall's Crossing be blocked for resort status; the County's important highway junctions be blocked for future commercial use; the lands around the County's existing communities be blocked for their future development. Chairman Black stated that the commission would approve these changes contingent upon certain changes in State Land Board policies.

COMMUNITY BLOCK GRANTS DISCUSSED:

Chairman Black reported that because the Community Block Grants for the four-county area will be allocated to the individual counties rather than considering the four counties as one unit, this will enable the City of Monticello to receive $23,000.00 toward the fire station. If Grants were to have been allocated to the four counties as one unit, the city fire station project would not have received enough points to qualify for Community Block Grant funds this year.

SCHOOL DISTRICT REQUESTS ASSESSED VALUATION FUGURES:

Mr. Mel Walker, Assistant Superintendent for the San Juan School District, met with the Commission at 9:00 a.m. He reported that the School Board will meet at 4:00 p.m. today to set their mill levy and they need to know what the County's assessed valuation is for 1982. Chairman Black reported that the most accurate assessed valuation figure known to date for the San Juan County is $215,687,470.

TAX COMMISSION APPROVES EXTENSION ON MILL LEVY DEADLINE:

Chairman Black telephoned the Utah State Tax Commission at 9:15 a.m. and spoke with the Chairman, Dave Duncan. Chairman Black requested an extension of the June 15th deadline for setting the County's mill levy as the County's taxing units have not had an opportunity to set and submit their mill levies. As per the telephone conversation, Mr. Duncan gave the approval to extend the deadline for setting the County's mill levy to June 21, 1982.

MONTICELLQ URANIUM MILL TAILINGS MANAGEMENT PROGRAM UPDATE:

At 10:00 a.m. the Commission met with Utah Department of Health representative Larry F. Anderson; South-eastern Utah District Health representatives Robert L. Furlow and Wayne Ball; Department of Energy (DOE) representative Mike Tucker; Bendix Field Engineering Corporation (BFEC) representatives Wayne Gisler, Lisa Zimmermann, Thomas Carter, Nick Abramuch and Bill Frost. The Monticello City Council was also invited to the meeting and was represented by Mayor Kieth Redd, City Manager, Rick Terry, and Councilman Jack Young. This meeting was scheduled to provide the County Commission and local authorities with an update to the DOE Surplus Facilities Management Program for the Monticello Remedial Action Project. Mr. Furlow made the introductions and reported that Mike Tucker has replaced John Themelis as the DOE representative to the project.

Mr. Turner reported that BFEC will begin the field survey in Monticello on June 16, 1982. The purpose of the survey is to determine if mill tailings were used or transported to any Monticello properties. Sample test hole drilling at the Monticello Uranium Mill site will also begin on June 16th, in order to study the hydrology.

Mr. Gisler presented an overview of the Monticello Remedial Actions Project and a history of the Monticello Uranium Mill. The geology, hydrology, and meterology analysis represent the major portion of work to be conducted. Mr. Gisler also reported that each member of the gama screening crew that will be conducting the surveys on local properties will have a pictured identification card to present to the property owners. I In response to questions on the test holes at the mill site, he explained that hydrology monitoring equip-ment will be installed in 45 test holes which may be from 30' to 100' deep. Seven of the test holes will be drilled to the bedrock.

Mr. Frost, as supervisor of the gama screening crew, will keep the Monticello City Office informed of findings and help put the information into perspective.

Mr. Carter reported that BFEC would like to provide the County and City with project updates approximately every six months.

Chairman Black asked if the DOE was aware of a private uranium mill tailing site in Fry Canyon.

Mr. Anderson said that he was not aware of the site, but would check the site before returning home.

The Commissioners expressed appreciation for the report on the history of the Monticello Uranium Mill and the report on the beginning of this phase of the remedial actions project. The Commissioners also stated they were in support of BFEC efforts to complete the project. Upon the motion of Commissioner Low and the second of Commissioner Black, it was unanimously voted to grant DOE and its designees (BFEC) the right to enter on the County Courthouse property for the purpose of conducting radiologial surveys.

RETIREMENT PARTICIPATION CHANGE AUTHORIZED;

A letter was received from the Utah State Retirement Board informing the County that under the amended provisions of the Utah State Retirement Act, employers have an option to pay all or part of the employees' retirement contribution in the State Retirement system, effective July 1, 1982. This optional pick up payment of employees' contributions is in addition to the required employer retirement contributions. If the County were to also pay the public employee contribution share of 3.95% and the police employee con-tribution share of 2.75%, it would have the effect of giving a net total increase in pay without additional deductions required. In view of this benefit for the County employees, Commissioner Low moved to approve the County paying all of the employees' retirement contribution and to consider it as part of the pay increase when adjustments for the year are made. The motion was seconded by Commissioner Black and it carried unanimously.
