MINUTES OF THE SAN JUAN COUNTY COMMISSION MEETING JANUARY 14, 1985

The San Juan County Commission met in regular session on Monday, January 14, 1985, at the hour of 10:00 a.m. in the San Juan County Courthouse at Monticello, Utah.

The following members were present: Commissioner Calvin Black, Chairman

Commissioner Kenneth R. Bailey Commissioner Jerry Holliday

Minutes of the previous meeting were approved with the specified corrections on the motion of Commissioner Holliday. The motion was seconded by Commissioner Bailey and carried unanimously.

CANYONLANDS NATIONAL PARK - BACKCOUNTRY MANAGEMENT PLAN REVIEWED

Al Haskins met with the Commission to review the Backcountry Management Plan for Canyonlands National Park. Among the topics discussed were:

1. Minimal development.

2. Possibility of restricting the number of visitors.

3. Vehicle tours.

Commissioner Black stated that this does not change the management plan but is a reinforcement of the fact that the management plan will be no development, no improvement and no facilities. Commissioner Black further stated that without development, the use of the Park will be limited. Commissioner Bailey presented the following statement for the record:

"Quoting from the last paragraph of Canyonlands Park letter from Superintendent Pete Parry concerning the draft of the Backcountry Management Plan for Canyonlands National Park,'public involvement has been a vital part of the planning process for Canyonlands, and your comments play an important part in developing a plan which will effectively serve all users of Canyonlands Back-country. '

"May I express my opinion of this statement, the process and administration of Canyonlands National Parkf the above referred paragraph is a total absolute lie. I participated in the workshops referred to, these workshops were packed with Park Service personnel and backpackers, they were a total farce with no comments except those from the rigged packed personnel were considered or implemented.

"Pete Parry is an enemy to Canyonlands National Park and he is an enemy to San Juan County.

"In my opinion every effort has been made by Pete Parry to kill development of the Needles Area, to limit the number of tourists and minimize any economic benefits in the Southern area of Canyon-lands National Park and the Communities near by."

Commissioner Black and Commissioner Holliday concurred with this statement.

The Commission has instructed Al Haskins to draft a response to the Backcountry Management Plan for review next Monday.

DIVISION OF AGING COMMITTEE MEETING ATTENDED

Al Haskins reported that he attended a Division of Aging committee meeting in Salt Lake last week.

DEVELOPMENT BOARD MEETING REPORT

Carl Eisemann reported on the Development Board Meeting held last week. Mr.

Eisemann reported that the Development Board will support the application of Community Development Block Grant Funds for a new County Jail, if the jail meets the criteria. This will also be supported by the City of Monticello. If the jail does not meet the criteria the Development Board would like to see the funds used for some of the following projects.

1. Mexican Hat Recreation Area

2. Development of utility services to the UNI Printing Plant.

3. Restrooms at County recreational areas.

4. Development at Monticello Ski Area.

ENERGY AUDIT FOR COURTHOUSE DISCUSSED

Dell Hunter met with the Commission to report on his meeting with representatives from Payson Sheet Metal regarding an energy audit of the Courthouse. Mr. Hunter reported that the cost would be approximately $3,000 and it may be possible to get a grant to fund it. The Commission approved the audit if grant funding for it can be obtained.

DECEMBER JUSTICE OF THE PEACE REPORT REVIEWED

Commissioner Black reviewed the following report from the Justice of the Peace for the month of December.

LAW ENFORCEMENT DISCUSSED

Commissioner Black stated that he feels that the Commission should suspend any increase for the Sheriff's Department until they increase their performance. Commissioner Black further stated that he feels the Commission should be provided with a monthly time log for each Officer. The Commission has previously requested monthly report from the Sheriff's Department.

Commissioner Bailey offered the Law Enforcement commission assignment to Commissioner Black. Commissioner Bailey will continue to work on the jail acquisition.

Commissioner Black stated that he would take Law Enforcement if he would have the co-operation and support of the Commission. Commissioner Holliday and Commissioner Bailey stated that they would support Commissioner Black in this position.

The Commission further stated that they feel the lack of co-operative work between the cities and the Sheriff's Department is a problem.

Gail Johnson, County Clerk, stated that all aspects of law enforcement should be looked at such as the County Attorney, Public Defender, and Adult Probation and Parole.

BEER LICENSE APPLICATION - MEXICAN HAT TEXACO

The Commission reviewed a request for a beer license from Mexican Hat Texaco. The Commission deferred action on this matter until the January 21st Commission Meeting.

GOVERNOR'S TASK FORCE ON ARCHAEOLOGICAL PRESERVATION MEETING ATTENDED

Commissioner Holliday reported that he attended the Governor's Task Force on Archaeological Preservation meeting. There are approximately 35,000 archaeological sites in San Juan County. Commissioner Holliday reported that the State Representatives were unable to attend due to the weather but a tape of the comments was sent to them. The next meeting will be held on March 5th at 7:00 p.m. in Monticello.

UNI SEWING FACTORY OPEN HOUSE

An open house will be held at the UNI Sewing Factory in Montezuma Creek on January 28th.

MEETING WITH STATE DIRECTOR OF NATURAL RESOURCES

Commissioner Black reported that he had a meeting last week with Dee Hansen, who is the new State Director of Natural Resources.

NUCLEAR WASTE REPOSITORY SITE DISCUSSED

Commissioner Black reported that he met with Governor Bangerter's Administrative Assistants last week and reviewed the proposed Nuclear Waste Repository Site near Canyonlands National Park.

Commissioner Black also reported that there are new Department Heads for both the Nuclear Waste Policy Work Group and the Technical Review Group.

PROJECT BOLD DISCUSSED

Commissioner Black reported that Governor Bangerter is willing to meet with the Commission to discuss their concerns regarding Project Bold prior to taking a position on this matter

TAX FACTORING ORDER DISCUSSED

A meeting held in Provo last week to discuss and review the appeal process for the State Tax Factoring Order was attended by the County Attorney, County Assessor, and Commissioner Black.

Commissioner Black reported that if the factoring order can't be changed it will cause an increase of 24% on residents homes and businesses. The reason for this is the small portion of locally assessed property to our total tax base. The Commission expressed concern regarding increase in locally assessed and decreases in State Assessed. The Tax Commission is using the sales ratio study, which the Commission does not believe is a fair method of evaluating property.

The formal hearing with the State Tax Commission has been scheduled for January 29th.

SUE COOK MEETS

Sue Cook, Representative Aide for Congressman Nielson and Senator Garn met with the Commission. Among the topics discussed were:

Island in the Sky Road

Canyonlands National Park development

Nuclear Waste Repository

Glen Canyon National Recreation Area

Increase in cost of gravel from the BLM for private citizens

Elimination of a Social Security Representative in Monticello

LUNCHEON MEETING WITH THE GRAND COUNTY COMMISSION

The Commission recessed for lunch at 1:00 p.m. for a luncheon meeting with the Grand County Commission and Sue Cook, Representative Aide for Congressman Nielson and Senator Garn. The minutes written by Sue Cook of that meeting are as follows.

San Juan and Grand County Commissioners met on January 14, 1985, in Monticello, Utah.

San Juan County Commission Chairman, Cal Black, mentioned to those present that Governor Bangerter will meet with the Joint Commissions and that they need to prepare an agenda of items that they want to present to him at this meeting. Some items are: Nuclear Repository, Intregal Vista, etc.

Commissioner Jimmy Walker of Grand County wants to present the views of this area. He feels the elected officials of the Wasatch front don't really understand our needs or what we want. The fear people have in the testing isn't really any different than what would be done to explore for gas and oil.

If Utah happens to become one of the top three areas for consideration then both County Commissions want to play an active role in the technical review and policy by having two members of each County serve on the technical review and policy board.

San Juan County will submit an application for funding along with Grand County, to hire a qualified individual to address the EA's. They want to make sure this individual addressess their views and does substantial investigation to adequately represent the feelings of the people of this area. They also want to be unified in a stand to make Gibson Dome a more attractive area to the DOE for a future repository.

The Needles Area was discussed and San Juan Commissioners made it clear to Grand County Commissioners they were using the Island in the Sky Road as a leverage for the original promises made by the National Park Service to develop the Needles area of the Park.

After the luncheon meeting the Commission reported that they will try to hold joint meetings with the Grand County Commission on a quarterly basis. The Commission expressed their appreciation to the Grand County Commission for the opportunity to meet with them and discuss common concerns.

Cal Black recommended the name of John Baden to replace Ray Arnett as new Assistant Secretary of National Parks, Recreation and Wildlife.

SOCIAL SECURITY REPRESENTATIVE VISITS TO MONTICELLO ELIMINATED

The Commission received a letter from Peggy Jorgensen from Social Services regarding the elimination of a Social Security Representative in Monticello. Individuals needing his services will have to either travel to Blanding, 22 miles away or have to drive to Cortez, Colorado, to meet with him.

The Commission feels that if he is visiting Blanding on a monthly basis he could continue to visit Monticello at no additional cost.

LETTER RECEIVED RE: RICHARD FARABEE'S WRECKING YARD

The Commission received a letter from William Simpson regarding his opinion that Richard Farabee's wrecking yard is in violation of state safety regulations. The Commission was unable to contact Al Richens from the UDOT. The Commission will draft a letter to Mr. Richens requesting he look into this problem. A copy of Mr. Simpson's letter will also be sent to Mr. Richens.

1985 COMMISSION ASSIGNMENTS

The Commission decided that Commissioner Black will have Law Enforcement and Commissioner Bailey will be in charge of Fire Control.

SOCIAL SERVICES CONTRACT AMENDED

Commissioner Bailey made a motion to approve the amendment to Contract #78-8013 between the Utah State Department of Social Services and San Juan County and authorize Commissioner Black to sign it. The motion was seconded by Commissioner Holliday and carried unanimously.

JOINT MEETING WITH THE GOVERNOR SCHEDULED

The San Juan and Grand County Commissions will hold a joint meeting with the Governor on January 23rd at 10:00 a.m.
