The San Juan County Commission met in regular session on April 13, 1987 at the hour of 10 a.m. at the San Juan County Courthouse, Monticello, Utah.

The following members were present: Commissioner Black, Chairman

Commissioner Bailey Commissioner Maryboy

Minutes of the April 6, 1987 Commission Meeting were approved with the corrections on the motion of Commissioner Maryboy and seconded by Commissioner Black. UNANIMOUS.

COMMISSIONER CALVIN BLACK'S REPORT

US Highway Numbering - Commissioner Black wrote a letter on behalf of the San Juan County Commission to

Mr. Ron Delis, P.E., Engineer for Transportation Planning, requesting an action to extend US highway

numbering for US-666 from Monticello to I-15 at Sigurd, Utah. Also, to extend US-163 west of Bluff to US-

160 southwest of Cortez, Colorado and US-163 from Kayenta, Arizona to I-15 near St. George, Utah.

Hermit Mine - Energy Fuels - Commissioner Black said he is going to write a letter to G. William Lamb,

Arizona Strip District Manager of the BLM, stating that he is in favor of the Hermit Mine Proposal of

Energy Fuels Nuclear, Inc. (south of Fredonia, Arizona) Commissioner Bailey and Commissioner Maryboy will

also write a letter in favor of the project.

Nuclear Waste Repository - Commissioner Bailey made the motion authorizing Commissioner Black to procede

with any financial commitments needed to support the Nuclear Waste Repository being built in San Juan

County. Commissioner Maryboy seconded the motion. UNANIMOUS.

Land Board Meeting - Commissioner Black left for Salt Lake at 10:30 to attend a special Land Board

Meeting.

COMMISSIONER KENNETH BAILEY'S REPORT

LaSal Town Meeting - Commissioner Bailey reported that he and Eddie Allred, recreation director, attended

the LaSal town meeting. They discussed the proposed cemetery district, roads, recreation, and the

county's taxation litigation.

Utah Road Meeds Study Steering Committee Meeting - Commissioner Bailey said he attended the Utah Road

Needs Study Steering Committee meeting last week. They discussed the entrance to the freeways being

changed over to the state system instead of keeping them on the county system. This proposal was not

approved.

Public Safety Building - Commissioner Bailey said he went to Salt Lake last week and met with the

architects on the Public Safety Building. He talked with the mechanical engineer and finalized the plans

on the mechanical system.

Sprinkling Systems at Monticello Recreation Area and Blanding Golf Course - Commissioner Bailey said he

contacted three places about replacing the sprinkling system at the Monticello Recreation area and the

Blanding Golf Course. Doug Pehrson, engineer/surveyor, has surveyed the areas and made drawings of the

present system.

COMMISSIONER MARK MARYBOY'S REPORT

UNDC Cut in Budget Postponed - Commissioner Maryboy said that the UNDC board met last Tuesday and

discussed the 40% cut in their budget. UNDC will hold a special board meeting tomorrow to discuss the

budget. Also on the agenda to discuss is Project Bold and the state school section at Monument Valley

that is going to be sold. Commissioner Maryboy said that UDIA will attend UNDC's board meeting next

month and he will get on the agenda to discuss the road program on the reservation.

Navajo Mountain - Commissioner Maryboy reported that he went to Navajo Mountain last Tuesday to meet with

the chapter officials. They will send a written request to Commissioner Bailey on what they would like to

have done. Some of the items are: training in planning and zoning, information on putting in a sewer

system and also a land fill (city dump) . Commissioner Maryboy said they received materials (metal

structure) for a community center at Paiute Mesa and some of the pieces are missing and it can't be put

together. Commissioner Bailey said he will talk to Rick Bailey about this matter to see what can be done.

Library at Navajo Mountain - The BIA school has provided space to the Navajo Mountain community for a

library. The community figure they will need about $1000 to buy books and materials and asked if the

county can help with the funding. Commissioner Bailey said he will talk to Russel Davis, state librarian,

to see what funds are available.

Recreation Board Meeting - Commissioner Maryboy said that he plans to attend a recreation board meeting

tomorrow and will discuss the summer recreation activities at Navajo Mountain.

Bridge at Oljato Wash - Commissioner Maryboy said the people are concerned about the road between Navajo

Mountain and Oljato and the bridge that is to be built at Oljato Wash. Commissioner Bailey said that he

and Doug Pehrson, engineer, are following up on the bridge replacement at Oljato Wash.

Historical Committee - Commissioner Maryboy said he met with the Historical Committee last week. They are

still interested in finding a storage space for documents and materials. A request was made to get the

old documents and papers that the county has. The Historical Committee is in favor of CEU-San Juan Center

taking over the Blanding library services. The committee hired an individual at Navajo Mountain to

collect old pictures and Tom Austin will take pictures of them.

Bluff Meeting - Commissioner Maryboy said he met with residents of Bluff last Thursday and there was a

good turn out. They discussed the need for a new fire truck and are considering about writing a proposal

to get a grant to buy a fire truck. Commissioner Maryboy said he will see if the Navajo Tribe will

contribute half the cost of fire truck. Also discussed was the Burr Trail, Halls Crossing Airport and

mosquito problem in Bluff.

UDOT - Dyke LeFevre - Commissioner Maryboy said that Dyke LeFevre, UDOT director, is going to meet with

him in Montezuma Creek on Thursday at 9 a.m. Commissioner Maryboy said that Mr. LeFevre will review the

state roads on the reservation and determine where maintenance and new roads are needed.

Old Montezima Creek School - Police Station - Commissioner Maryboy said that Henry Hillson Company called

him about leasing the old Montezuma Creek School. The county has a lease on half of the building and plan

to coordinate with the Navajo Tribal Police in putting in a police station. Commissioner Maryboy said he

talked to the Executive Director of the Navajo Police Director and he said that because of a shortage of

funds they are not able to go ahead with this project. Commissioner Bailey said the Tribal Police need to

write a plan of what they want in remodeling the school for offices and a holding cell and get a cost

estimate. The county intended to make the proposal to the CIB for funding of this project. Commissioner

Maryboy said he will contact the NTP and invite them to the Commission meeting next Monday to discuss

this.

Bus Route at Bluff - Commissioner Maryboy said that the school bus driver at Bluff told him the school bus

route on the state highway is really narrow and is not designed for a turn-around.

BLANDING LIBRARY - CEP

The Commission received the following letter from CEU-San Juan Center regarding library services:

Dear Commissioner Black:

Some time ago, following an Inter Agency Meeting we had a brief discussion regarding the feasibility of consolidation of services, specifically library services. You indicated an interest in the possibility of the San Juan Center assuming the operation of the county library in Blanding. I did present this concept to some of out staff, who subsequently provided me with a list of questions. However, due to other pressures, I did not pursue it any further at that time.

Recently, the idea emerged again through a discussion with Tom Austin. Feeling that this is something which is worthy of consideration, I presented it in a staff meeting. The consensus was that it should be pursued.

Should the San Juan County Commission agree, I would like to suggest a formal meeting and the appointment of a committee to begin studying the ramifications and concerns which might arise from either side.

I have discussed this with President Michael Petersen and have his concurrence to proceed. Please advise me at your earliest convenience as to the position of the Commission.

The Commission will look at this request and it will also be considered by the library board. Commissioner Bailey said he will contact Russel Davis, State Library, and follow up on this request.

SENIOR CITIZENS - BUS EXPENSES

Three senior citizens met with the Commission to request to take two senior citizen buses to Carlsbad Caverns, New Mexico. They said they would pay the bus drivers and all of the expenses. The Commission approved this.

REGIONAL CORRECTIONS FACILITY

Joe Slade and Winn Wescott met with the Commission to discuss the request for proposals of a site selection for a regional corrections facility. The Utah Department of Corrections and the Division of Facilities Construction and Management are authorized by the Legislature to design and secure a site for a 2,000 bed regional prison. Mr. Slade said they are doing this on behalf of the San Juan County Development Board and the Monticello and Blanding city councils. Mr. Slade said the Commission has to endorse the proposal before it can be submitted to the state. The Commission agreed that someone qualified should be hired to write the proposal. Mr. Slade said they invited Mr. Shulsen, Department of Corrections, to come down and assist them in this matter. All responses must be received by May 15, 1987. The Commission said they are in support of this project and told Mr. Slade and Mr. Wescott they should hire someone to write the proposal.

SEU-CAP BOARD MEMBER

The Commission agreed that since Rick Bailey has other commitments that he be replaced on the SEUCAP board and will recommend Carl Eisemann to replace him. Commissioner Bailey made the motion recommending that Carl Eisemann replace Rick Bailey on the SEU-CAP board. Commissioner Maryboy seconded the motion. UNANIMOUS. The following letter was written:

Due to other programs and commitments we have asked Rick Bailey to handle, we have found it necessary to ask him to set aside the appointment to the SEUCAP Board representing the San Juan County Commission. We would ask that this be effective immediately.

We are recommending to the SEUCAP Board the name of Carl Eisemann as his replacement. Mr. Eisemann has served many years in the public school system including the position of superintendent. He has also been involved in the headstart programs in other areas of the nation.

SHERIFF'S DEPARTMENT - PROBATIONARY RAISES

Claude Lacy, Sheriff, met with the Commission to request a probationary raise for Bill King and Monte Dalton. Commissioner Bailey made the motion to approve a probationary raise for Bill King and Monte Dalton. (Grade 5 Step 1 to Grade 5 Step 2) Commissioner Maryboy seconded the motion. UNANIMOUS.

EMPLOYEE PERSONEL - BACK PAY

Paul Foreman, former county employee, presented the Commission the following letter:

I was hired in May 1980 as a truck driver for San Juan County Roads. In AUgust 1981 the San Juan County Road Superintendent, Dick Traister, created the position of sign Shop Foreman and promoted me to that position. I was promised a raise of $.50 (fifty cents) an hour which was to became effective October 1, 1981. I never received that raise, but I was required to work in that position for the next 5 years

and 6 months.

The following is my claim for back pay to me by the County:

The Commission told Mr. Foreman that they accepted his petition and if he has any additional documentation to have it submitted by next Monday. The Commission said they will consult the county attorney and make a decision on his claim next Monday.

COMPUTER UPDATE - JOHN FELLMETH

John Fellmeth met with the Commission to discuss computer upgrade for the hospital and courthouse computers. Mr. Fellmeth said that the county needs a disc upgrade that would add more storage space in the computers and would cost from $10,000 to $12,000 for both. The Commission agreed to let Mr. Fellmeth get proposals for upgrading the computers.

COMMUNICATIONS - BLUFF & NAVAJO MOUNTAIN

Bill Bayles, Communications Engineer, met with the Commission to update them on several items. Mr. Bayles said there are a lot of people in Bluff who have their TV antennas hooked up wrong which is the reason they are getting bad TV reception. The Commission stressed the importance of getting this information to the people. Mr. Bayles said he is waiting for parts to fix the translator at Montezuma Creek and said he has all the parts to finish at Bluff. Commissioner Maryboy said there was a request from Navajo Mountain have the translator fixed because the channels are snowy. The Commission authorized Mr. Bayles to work with Leo Manheimer, Vice Chairman of Navajo Mountain, to select a translator site on Navajo Mountain and the old translator will be returned to the county.

Full-Time Help - Mr. Bayles asked the Commission if they would consider hiring a full-time technician to help with the phone systems, computers, etc. The Commission said that the county does not have the money to hire another full-time person.

HUMAN SERVICES BOARD - TITLE XX FUNDING

Bruce Shumway, Social Services, met with the Commission for approval of the Human Services Board request for the Title XX funding. Commissioner Maryboy made the motion to approve $99,500 for the Block Grant Allocation. Commissioner Bailey seconded the motion. UNANIMOUS. CEU-San Juan Center $34,000 - Educational Counseling San Juan County $32,000 - Transportation Career Center $10,000 - Vocational Counseling San Juan Health Care $3,500 - Detoxification San Juan School District $20,000 - Sheltered Workshop

CANYONLANDS YOUTH ADVISORY BOARD

Mr. Shumway said the Commission needs to appoint someone to serve on the Canyonlands Youth Advisory Board. Commissioner Maryboy said that he would serve on this board. Mr. Shumway said that the board meets quarterly and the next meeting is Wednesday.

BLUFF - MOSQUITOS - WEEDS - EXTENSION AGENT

Jim Keyes, county extension agent, met with the Commission to discuss the mosquito problem in Bluff. Mr. Keyes said it is not economically feasible to spray the Bluff area for mosquitos. It's expensive and the spots that need to be sprayed are not next to each other, it would be better for a person to spray the spots where the mosquitos are. Commissioner Maryboy said he will set up a workshop in Bluff and asked Mr. Keyes to train interested people in spotting these areas so that they can be sprayed.

Weeds - Mr. Keyes said the county needs to have the weeds sprayed as soon as possible before they get too big. Commissioner Bailey told Mr. Keyes to advertise and hire someone to do the spraying. Mr. Keyes said Jim Heaton, weed supervisor, will be here on the 20th to follow up on this.

TEXACO - FILED BANKRUPTCY

Marian Bayles, Treasurer, told the Commission that Texaco, Inc. has filed for bankruptcy. Ms. Bayles said that this may affect the county because Texaco is the biggest tax payer.

MONTICELLO AIRPORT - UPGRADING

The Commission discussed the engineering project at the Monticello Airport. Armstrong Consultants, Inc. were present to see what the Commission's decision on who the engineering firm would be. The Commission said they would like to talk to Ron Theobald, UDOT Division of Aeronautics, before making a final decision and this will be put on the agenda next week for action.

PUBLIC DEFENDER

Commissioner Maryboy presented the Commission a proposal from Steven Boos, attorney, for the position of county public defender. The Commission discussed this with Craig Halls, county attorney, and will put this on the agenda next week for action.

NOXIOUS WEED AGREEMENT - BLM

Nick Sandberg, BIM, presented the Commission a draft memorandum of understanding between San Juan County and the BLM which establishes the procedures and condition for noxious plant control within the portion of San Juan County lying within the BLM/Moab District. Mr. Sandberg asked the Commission to make their corrections before it is approved.

ROAD ON ALKALI RIDGE & MONTEZUMA CREEK - BLM

The Commission received the following letter from the BLM in regards to the road on Alkali Ridge and the Montezuma Creek areas:

Gentlemen:

Over the past year or two the heavy increase in oil and gas activity on Alkali Ridge and the Montezuma Creek areas have caused San Juan County to expend an all-out effort to improve the road system in that

area. In spite of this effort traffic in the area is greater than road conditions can safety accommodate. As a result numerous two-vehicle accidents are occurring that not only involve the oil and gas interests

but Bureau of Land Management, Indian and county vehicles, as well. To the best of our knowledge many of these accidents occur because one or both vehicles are traveling faster than road conditions can safely accommodate.

We would like to petition the county to either increase law enforcement in that area or post speed limits, or do whatever else you feel appropriate in hopes that accident frequency and severity may be reduced. We are willing to support you in whatever way we can. Thank you for your consideration in this matter.
