Minutes of the Board of County Commissioners meeting held May 12, 1980.
Present: Chairman E.S. Boyle, Commissioners Bill Dunow and Calvin Black. Also present Al Haskins and Pearl Whittaker, Deputy Clerk.
Time: 10:00 a.m.
Minutes of the meeting of May 5, 1980 were read and approved on a motion from Commissioner Dunow and a second from Commissioner Black.
UTAH ASSOCIATION OF WOMEN REPRESENTATIVE: Leola Naylor attended this meeting as an observer for this womens group.
CRISIS INTERVENTION: Deana Scorup advised the Commission that the maximum income level for qualification for this program has been changed to $4,730.00 for one person with the graduated scale changed accordingly. She submitted two applications which were approved.
MONTEZUMA CREEK SWIMMING POOL: Lynn Adams has been instructed to obtain prices for fiberglass sections to be used to enclose the pool in an effort to cut down on the amount of dirt blowing into the pool.
HOSPITAL: In connection with possible management changes for the hospital Commissioner Boyle advised of a meeting with the Advanced Health Group the evening of May 27, 1980. Details will be furnished by Arlow Freestone. All the Commissioners indicated they would try to be there. There was some discussion of the Hospital Affiliates group also. A decision will be made later about making additional appointments to the Hospital Advisory Board.
PEDDLERS - MEXICAN HAT: T.J. Knight has shown some concern with this problem and has asked about county policy in this area. Mr. Knight will be advised that the county has no ordinance covering this situation.
OLJATO AIRPORT: The clerk was directed to check the agreement between the county and the State Division of Aeronautics for details concerning gas tax monies being returned to the County and also to determine if any such amounts have been received by the County.
ROAD TO SAND ISLAND BRIDGE: Commissioner Boyle reported that the problem on this road which involved Ben Hess
has been solved.
BUILDING PERMITS: Commissioner Dunow reported that a local contractor had asked about the number of building inspections required on pre-built homes coming from Salt Lake or other places when they have signed inspection reports with them. It was decided that such houses should have inspections for the foundation and the actual electrical hook-up. These inspections may be made at the same time if practical.
ROADS: The damage on Ucolo Road can probably be repaired by county crews. Commissioner Dunow will meet with Ace Hoi den about this road and a water crossing on the Cedar Point road at Coal Bed Canyon whiph O.scar Semadeni brought to the attention of the Commission. Commissioner Dunow also reported that the Forest agreement that the county can grade a Forest Service road in the LaSal area. He will also check into the need for a culvert on Tarb Road at Hickman Flat. LIBRARY - BLANDING: Commissioner Black reported that the groundsat the Blanding Library are in bad shape. He
will contact Sam Lewis, the custodian, about getting it taken care of and will follow up the situation.
NEWSPAPERS: Curtis Pehrson sent word that he has canvassed the businesses in Monticello and Blanding and has a total of 324 newpapers needed. This does not include those being received through the mail at this time. He has not received any information from Moab or Greenriver. Commissioner Black indicated that he has heard no more from Patrick Cessions of the Newspaper Agency Corporation to date.
ZONING PROBLEMS: Commissioner Black indicated that there are two areas near Blanding that should be included by the people exploring zoning recommendations to the Commission. He advised Al Haskins of these locations.
B.L.M.: Commissioner Black reported on some recent meetings where he spoke on the Sagebrush Rebellion. He also presented to the Commission a newspaper clipping outlining a proposal just out of Committee in Washington which would allow any B.L.M. employee to write citations on B.L.M. administered land. These citations could bring about fines to a maximum of $500.00 and up to 6 months in jail upon conviction. The Commission delegated Commissioner Black to write a letter of protest to the appropriate officials about this proposed amendment to to the B.L.M. Organic Act. A letter from Energy Fuels to Commissioner Black was also presented which outlined the problems that company is having with the State archeologist concerning the archeological sites on their mill site. Among other things covered in the letter was the apparently exorbitant bid from the State Archeologist and a comparison with a bid received from the University of Arizona for the same work. A copy of the letter is being sent to the Governor. Commissioner Black related some personal observations to the Commission about B.L.M. artifact disturbance trials. He said that it appeared to him that not in any of the 4 cases he is aware of was there enough evidence to convict and that he feels that such cases are harrassment. He cited one case which was plea bargained to a lessor charge and the defendant entered a plea of guilty; two cases that were bargained from felony to misdemeanor charges and settled with guilty pleas, All of these cases were settled without trial because of economic reasons of the defendants. The one case which did come to trial ended with acquittal for the defendant.
NON-COMMERCIAL RADIO STATION: Ben Hendricks of Four Corners Community Broadcasters, Inc. presented information concerning a proposed non-commercial FM public radio broadcasting station to be established at Blanding. He asked the Commission for a letter of support and a financial contribution. The Commission will write a letter of support but cannot make a contribution to a private organization.
BUILDING REPAIRS: Young Builders, Inc. was awarded the bid for repairs to the small exhibit building at the fair grounds which will be used to house the county fire trucks and equipment. Bid was for $1,428.90. Commissioner Dunow will notify Young Builders and John Baker.
SOUTH THIRD RECREATION PROGRAM: Bruce Shumway, deal Bradford and Notah Tahe presented a proposal and contracl; from UNDC for management of this program for 1980. After discussion and some changes the contract was signed by the Chairman and will be returned when it is signed by UNDC. Motion to accept the proposal and sign the contract was made by Commissioner Dunow with a second from Commissioner Black. Bills for White Mesa swimming program will be handled as in the past.

JUVENILE DETENTION BUILDING: Bruce Shumway advised the Commission that $2,000.00 is available from "justice" money for preliminary architectural design.
MENTAL HEALTH: The salary for Barbara Penn at the Activity Center in Monticello will be taken from the Senior Citizen Program in the future instead of the Mental Health program. Jim Scheer reported on the Alcohol related program in the county.
B.L.M. WILDERNESS STUDY: Dean Robinson and Ty Lewis from the Farm Bureau met to ask the Commission what needs to be done to help protest the Wilderness Proposals of B.L.M. at this stage. They will set up public meetings in Monticello and Blanding to inform people of the status of the proposal and help with another letter writing campaign. The meeting in Monticello will be on May 29 at 8:00 in the High School and the meeting in Blanding will be on May 30 at 8:00 p.m. in the High School. Robinson and Lewis will meet again with the Commission on May 19 at 3:00 to revue the up-dated information on the areas involved.
HERBICIDE BID: On a motion of Commissioner Dunow and a second from Commissioner Black the Bid of $6,631.60 from Johnson's Spraying Service for herbicides for the 1980 weed season was accepted. Lynn Adams will notify Keele Johnson.
MEXICAN HAT SERVICE DISTRICT #1: Western Design Consultants has advised Bruce Halliday that a fiscal agent to monitor funds for the Mexican Hat Service District #1 is needed and the County is the only such agent available to the Service District. On a motion from Commissioner Black and a second from Commissioner Dunow, the Commission authorized the Chairman to sign the application as fiscal agent only. The County is under no obligation because of this action. The following resolution was signed by all Commissioners regarding this matter.

Be it resolved that Edward S. Boyle, Chairman of the San Juan County Commission, be authorized to act for all matters concerning the Proposed Utility Improvements Projects for Service Area #1 (Mexican Hat), as Fiscal Agent.

SENIOR CITIZEN BUS: A request from Fred Blackburn, a bus driver, for oxygen equipment on the Senior Citizen buses was denied.
NANCY PATTERSON AREA: Correspondence from the Division of State History concerning designation of this area as an historical site was handed to Al Haskins to handle.
NATIONAL ASSOCIATION OF COUNTIES: A request from the County Clerk to attend the annual conference of this association in Las Vegas from June 29 to July 3 was approved.
MONTICELLO AIRPORT: Correspondence from Van's Service advised that parts needed for the fuel filter system cannot be found and recommended new filters be installed. This recommendation will be followed and Van's Service was authorized to make the necessary installation.
BLUFF COMMUNITY BUILDING: Bruce Shumway advised the Commission that the people of Bluff have raised $700.00 toward finishing this building. The County will match 1-to-l the money raised by the community up to a maximum of $1,000.00. The Commission authorized Mr. Shumway to go ahead with the work and that materials should be purchased through the Utah Navajo Industries when possible.
MSHA CITATION: On a motion of Calvin Black and a second from Commissioner Dunow the Commission directed Bruce Halliday to correspond with MSHA and take appropriate action to minimize the situation.
