MINUTES OF THE SAN JUAN COUNTY COMMISSIONERS MEETING HELD
MARCH 12, 1984
The San Juan County Commission met in regular session on Monday, March 12, 1984, at the hour of 10:00 a.m. in the San Juan County Courthouse at Monticello, Utah,
The following members were present: Commissioner Calvin Black, Chairman
Commissioner Kenneth R. Bailey Commissioner Robert Low
Minutes of the previous meeting were approved with the specified corrections on the motion of Commissioner Low. The motion was seconded by Commissioner Bailey and carried unanimously.
STATE TAX COMMISSION DISTRIBUTION OF SALES TAX
Commissioner Black reported on the sales tax distribution from the State TAx Commission and that the improper allocation of monies still has not been corrected although apparently the three (3) year period through the 2nd quater of 1982 was corrected and the adjustments have been made to the cities and the County. ONe of the problems was that the County was getting local option sales tax from a number of businesses but because of the uniqueness of the situation where the incorporated Cities within the County still retain the radius agreement of the 5 mile area from the Cities boundaries the monies should haveE gone to the Cities. The other problem reviewed was that Blanding has been getting revenue that should go to the County and Monticello has been getting revenue from some of the businesses in Blanding. These errors are still continuing and the last 2 quarters of 1982 and all of 1983 will have to be reconciled. Commissioner Black further reported that he has been in contact with Mr. Hope of teh State Tax Commission who inidcated this matter will be taken care of. The Commission reviewed several examples of how these problems distort the revenue that is going to the Cities.
RIO ALGOM ROYALTY CHECK
Gail Dalton, County Clerk, met with the Commisison to report that San Juan County has received the royalty check from Rio Algom for the month of February, 1984, in the amount of $7,255.77.

OLD MEDICAL CLINIC IN BLANDING DISCUSSED
Cleal Bradford met with the Commission to discuss a letter received by the Commission from Bruce Parry in regards to the use of the old medical clinic in Blanding. Mr. Parry is requesting the use of the facility either through a conveyance of the building to the Board of Indian Affairs, a long term lease, or to sell the facility for a mutually agreed upon price. Mr. Parry's letter stated that the off res-ervation Navajo Corportation is in need of a facility from which services can be delivered to the off reservation Navajos. The Commission has also been approached by the San Juan County School District about the possibility of using the facility as a school and sheltered workshop for the mentally dsiabled. The Commission would like to further review the requests before making a decision.
LIQUOR LAW ENFORCEMENT DISCUSSED
A meeting was held to discuss ways to improve the enforcement of liquor laws. The following people were in attendance:

The enforcement problems and suggestions on how to improve enforcement were discussed. Some of the problems discussed were:
underage drinkers
DUI
not checking I.D.'s
public intoxication
alcohol sales to intoxicated persons
alcohol related crimes
Sgt. Cook advised the Commission of the difficulty with the existing hours of the bars in the Southern end of the County due to the fact that there is not enough law enforcement covering the required area. Sgt. Cook also asked the Commission if they would back the law enforcement officers if at the time of a violation the officers pulled the violaters beer license. The Commission assured Sgt. Cook and Sheriff Wright of their support. Commissioner Black stated that that authority was given and has been in effect since the signing of the 1983-1 ordiance pertaining to the sale and distribution of alcoholic beverages in the unicorporated limits of San Juan County. Commissioner Black also stated that the information was passed to the Sheriff at that time. The suggestion was made to hold a meeting of the liquor license holders in San Juan County to review the terms and conditions of the San Juan County Ordianance prior to the strict enforcement of said ordinance. Judge Crist proposed the following as a possible solution to some of the problems:
(1) A court order be initiated at the time of sentencing of repeat offenders of alcohol violaters stating in effect that these offenders are advised there name will be made known to all San Juan County alcohol outlets probhibiting their purchse of any type of alcohol for a period not to exceed six (6) months.
(2) A proclomation be drafted by the County Attorney's office for each of the folliwng types of sales: liquor store, retail and bars. A copy of this proclamation would then be posted in each liquor outlet throughout the County.
There was much discussion on these two points and the Commission as well as the County Attorney's office will further research their feasability.
Sgt Hillgartner of the Navajo Tribal Police also reported that they have an alcohol task force and would be willing to work with the San Juan County Sheriff's Office on these problems.
The Commission thanked those in attendance for their contributions to this meeting. BRUCE SHUMWAY MEETS
Bruce Shumway, Director of the San Juan Community Social Services met with the Commission to discuss the $90,500.00 San Juan County has been budgeted for the fiscal year of 1984-85, of local discretionary money for San Juan County Social Services Block Grant Funds. Present projections indicate a carry over ov $737.00 or a total amount availabe for 1984-85 of $91,237.00. Mr. Shumway reported that the San Juan Humab Services Board has been receiving requests for the available money from various agencies. One request from UNDC was rejected by the Board as being inappropriate. Teh other requests are as follows with the recommendation of the Board to the Commissioners:

Commissioner Low made a motion to approve these recommendations and to authorize Commissioner Black to sign the contracts when they are drafted. The motion was seconded by Commissioner Bailey and carried unanimously.
COMMUNICATIONS ENGINEER MEETS
Jim Allred, San Juan County Communications Engineer, met with the Commission to submit his resignation effective April 30, 1984. Mr. Allred and the Commission discussed the qualifications applicants will need for this opening. Mr. Allred stated that he feels at least 2 weeks of on the job training will

be needed. A copy of the job description will be submitted to Harold Lyman at Job Service. PROPOSED ANTELOPE TRANSPLANT
Commissioner Bailey reported that Daryl Redd is opposed to the proposed antelope transplant because BLM permittees permits were cut 66% and the permittees were promised that when the range came back they would be increased. Mr. Redd feels that if the transplant takes place the permits will not be increased.
FAIR BOARD CHAIRMAN DISCUSSED
Commissioner Low reported that Debi Harvey, San Juan County Fair Board Chairman has moved and the Com-mission will need to appoint another chairman. The Commission requested the Deputy Clerk send Mrs. Harvey a letter thanking her for her many hours of dedicated service.
DATE FOR OPENING OF HEALTH CARE SERVICE BIDS
Commissioner Low reported that the Health Care Services bid opening for the addition to the Nursing Home will be April 9, 1984 at 11:00 a.m.
RESOLUTION CONCERNING DISPOSITION OF COUNTY SURPLUS PROPERTY
Commissioner Low made a motion to adopt Resolution No... 1984-3 concerning the disposition of County surplus property. The motion was seconded by Commissioner Bailey and carried unanimously.
RESOLUTION 1984-3
WHEREAS, the Utah State Legislature by the laws of Utah, 1980, repealed and reinacted Section 17-5-48, Utah Code Annotated, 1953, as amended, providing for the acquisitation, management, and disposal of property by Counties, and
WHEREAS, San Juan County desires to provide a uniform system for the orderly disposition of real and personal property pursuant to the terms of said statute, and provide public notice to all interested parties therein, of any proposed dispostion,
NOW THEREFORE, be it resolved by the Board of San Juan County Commissioners that any disposition of real and personal property by San Juan County shall occur only after public notice is given as follows:
1. Notice of the proposed disposition describing the property to be disposed, the date of proposed distribution, any minimum bid necessary, if required, be published in a newspaper of general circulation in San Juan County, at least once, no less than 5 days prior to the date of said proposed disposition.
This resolution shall take effect immediately upon its passage.

COPY OF LETTER TO STATE LIQUOR COMMISSION RECEIVED
The Commission received a copy of a letter from Mark Peterson to the State Liquor Commission concerning the proposed State Package Agency in Bluff. The letter is as follows:

Dear Commissioners:
During the past decade, the citizens of Montezuma Creek, Aneth, and Red Mesa have made several attempts to eliminate the sale of alcohol in their communities. The most recent effort was in the fall of 1982 when they placed a proposition on the ballot that would have stopped all beer sales in unincorporated areas of San Juan County. Despite the tremendous opposition to the initiative, the voters of these three precintcts turned out in record numbers to support the proposition. The initiative failed.
Representative Hardy Redd introduced a bill in the following legislative session that would have made it possible for a voting precinct to stop beer sales in their communiry. This also failed.
The County Commission has made efforts in the past year to increase the quality of law enforcement in the area to help alleviate some of our problems, many of which are provoked by the presence of a beer outlet in the community. The law enforcement by both the Navajo Tribe and the county Sheriff is still grossly inadequate.
The addition of a liquor outlet in the southeastern region ofthe County would be inappropriate for the following reasons: (1) It would be in direct opposition to the wishes fo the citizens of the communities to the east of Bluff; (2) It would subvert the laws of the neighboring reservation, which has voted itself dry; and (3) It would compound the law enforcement problems, which are yet unsatisfactory,
I ask that the Commission not permit the placement of a liquor outlet in the Bluff community.

LIQUOR CONTROL COMMISSION PUBLIC MEETING IN BLUFF REPORTED ON
Commissioner Black reported the Liquor Control Commission held a public meeting in Bluff on March 6th regarding an application by Bill Jenkins for a State Package Liquor Store in Bluff. Commissioner Black stated that approximately 100 people were in attendance and that teh majority of those in attendance were opposed to having a State Package Liquor Agency in Bluff.

DATA PROCESSING AGREEMENT WITH KERMIT BLAKE
Commissioner Bailey made a motion to accept the agreement with Kermit Blake for Data Processing Services. The motion was seconded by Commissioner Low and carried unanimously.
BEER LICENSES APPROVED
Commissioner Bailey made a motion to approve the following beer licenses. The motion was seconded by Commissioner Low and carried unanimously.

BLM PROPOSALS FOR THE SALE OF PUBLIC LAND
The Commission received letters from the BLM stating the following proposals for the sale of public land: The Moab District is proposing to dispose of 25.4 acres of public land near Montezuma Creek,
Utah in San Juan County.
The Moab District is proposing to dispose of 44.94 acres of public land in Grand and San Juan
Counties by public sale.
The Commission has no objections to these proposed sales adn will send a letter to the BLM stating this.
COMPUTER MAINTENANCE AGREEMENT DISCUSSED
John Fellmeth, Chief Deputy Auditor/Data Processing Manager, emt with the Commission to discuss the possibility of discontinuing the County's maintenance agreement with IBM fcr the Health Care Services computer. Several maintenance options were reviewed and discussed. The Commission instructed Mr. Fellmeth send a letter to IBM stating that we want to discontinue our maintenance contract with them.
LETTER OF SUPPORT TO CITY OF MONTICELLO RE: COMMUNITY DEVELOPMENT BLOCK GRANT
Sue Halliday met with the Commission and requested a letter of support be sent to the City of Monticello regarding an application for Community Development Block Grant Funds. A letter was drafted and will be sent to the City of Monticello.
