MINUTES OF THE SAN JUAN COUNTY COMMISSION MEETING FEBRUARY 12, 1985

The San Juan County Commission met in regular session on Tuesday, February 12, 1985, at the hour of 10:00 a.m. in the San Juan County Courthouse at Monticello, Utah.

The following members were present: Commissioner Calvin Black, Chairman

Commissioner Kenneth R. Bailey Commissioner Jerry Holliday

Minutes of the previous meeting were approved with the specified corrections on the motion of Commission-er Bailey. The motion was seconded by Commissioner Holliday and carried unanimously.

ROAD WORK COMMENDED

Mr. LaFont from the Gould ings Trading Post in Monument Valley thanked the County for the road work that is being done in that area. Mr. LaFont also complimented the road department for their efficency.

NURSING HOME ADDITION DISCUSSED

Bruce Johnson, from Northern Electric, met with the Commission to review proposals for the generator that will be installed at the Nursing Home.

UTAH DIVISION OF WILDLIFE RESOURCES REPRESENTATIVE MEETS

Richard Mann, from the Utah Division of Wildlife Resources, met with the Commission. Mr. Mann reported that special hunt permits for buffalo, mountain goat, big horn sheep, and moose will be available in the area at the local license agents in Monticello and Blanding later in the week. The cost for these permits is $200 and up.

Also discussed was Commissioner Bailey's complaint regarding the handling of a road kill deer. Mr. Mann reported that the disposition of a road kill animal is up to the discretion of the officer. Mr. Mann stated that the decision is based on the condition of the meat and location of the injury. Mr. Mann further reported that in the last 18 months he has gone out on approximately 41 road kill calls and approximately 6 of those were salvagable. Commissioner Bailey felt that Mr. Mann's judgment in the handling of the deer he road killed was poor.

Mr. Mann reported that approximately 15,000 fish of catchable size will be stocked in Recapture Reservoir in June.

SHERIFF'S OFFICE - RAISES REFUSED

Gail Johnson, County Clerk/Auditor, met with the Commission to report that Deputy Halliday returned his cost of living raise last week. Deputy Halliday stated that if the Sheriff was not getting a raise he did not want his. Mrs. Johnson further reported that she requested Deputy Halliday put his request in writing to the Commission and have his department sign it. The request is as follows:

SAN JUAN COUNTY COMMISSIONERS: DEAR SIRS:

I would like to request that you take the raise off my paycheck and return it to the Sheriff's Office budget. Thank you for your assistance.

Deputy Jack Kirby met with the Commission to present the following letter as a show of support for Sheriff Wright from the Deputies.

Gentlemen:

We the deputies of this county, wish to express our thoughts on the manner you are treating Sheriff Wright, the highest Elected Official of the County.

We do not feel that it is fair that you are withholding his raise when all the other Elected Officials have received theirs. Since we are an extension of what he represents, our 4% raise (which should have been 5% according to a budget discussion) should also be withheld. In protest of your action we are returning our raises to the county. We do not feel that we will starve, since all we are realizing with this raise is about $20 to $30 extra a month.

How involved do you get in the inner workings of other departments? Do you ask for progress reports, and the time spent on each of the employees of other departments? We think not! Our jobs are of a con-fidential nature and yet you ask for detailed reports. A good deal of our findings are not the business of anyone but the Sheriff and his staff.

You do not need to remind us of our jobs, as you did in the letter that you sent to Sheriff Wright. We know our jobs better than you, and we feel that the letter was an insult to our intelligence. You should feel fortunate that we get as much done as we do with the handful of deputies that you have covering thousands of square miles. What you propose would take a staff three times the size of what you have now. We each spend many more extra hours, (mostly un-complaining) than we are getting paid for. Then you thank us by taking away vacation time that we do not have time to take, if we accumulate any above

the twenty days alloted per year. There is no realistic way that we can take all the comp and vacation time that we have accrued, that is without leaving the county uncovered. We therefore ask you, do you have a suggestion as to how to solve this problem? Perhaps we can receive some remuneration for our efforts.

We thak you for the raises, but until Sheriff Wright receives his, NO THANKS! Enclosed you will find our cash return of $218.

We challenge any of you to ride with the deputies for a period of one month (around the clock), especial-ly the deputies south of Blanding.

Commissioner Black stated that the only thing the Commission is concerned about is working with Sheriff Wright and the deputies in improving law enforcement services in the County. Commissioner Black asked Deputy Kirby if there was anything additional he would like to discuss. Deputy Kirby stated there was nothing else at this time.

The Commission deferred action at this time.

HEALTH CARE SERVICES DISCUSSED

Commissioner Bailey reported that Dr. Steve Warren has expressed an interest in practicing in Monticello.

BURR TRAIL DISCUSSED

Commissioner Black reported that there is still some opposition to the Burr Trail. The biggest problem is the budget. Commissioner Black feels that it is propably one of the most important pieces of legisla-tion and will have a direct impact on San Juan County.

AIRPLANE HANGAR LEASE APPROVED

Commissioner Bailey made a motion to approve the lease on the following airport hangar. The motion was seconded by Commissioner Holliday and carried unanimously.

SAN JUAN COUNTY DEVELOPMENT BOARD APPOINTMENTS

The Development Board submitted nine recommendations for filling two unexpired terms that are effective until December 31, 1987. Commissioner Bailey made a motion to approve the appointment of Susan LaFont, of Monument Valley to the Travel Council and Leon Behunin of Monticello to the Business Council. The motion was seconded by Commissioner Holliday and carried unanimously.

1984 PRELIMINARY POPULATION ESTIMATES

The 1984 estimate prepared by the Utah Population Estimates Committee is 12,600. This figure is down 300 from the 1983 estimate of 12,900.

PROPOSAL TO AMEND MEMBERSHIP OF THE STATE TRAVEL COUNCIL

Commissioner Black reported on SB172, which is a proposal to amend the State Travel Council. The law presently requires the State Travel Council shall be seven (7) members that shall be appointed geograph-ically with no more than two from each judicial district and not more than four can be from the same party. The proposed amendment would eliminate the geographic balance. Commissioner Black expressed concern that too much representation would then be from the Wasatch Front, with less attention to rural areas.

PROPOSED AMENDMENTS TO THE MINED LAND RECLAMATION ACT

Commissioner Black reported that he is also concerned about proposed amendments to the Mine Land Reclamation Act which presently exempts small mining operations. The amendments would eliminate that exemption and would require them to report monthly, file a plan with the State, etc. Commissioner Black feels that there is no need for the State to spend tax payers money to duplicate what the BLM is now required to do under federal law.

COMMISSIONER BLACK'S REPORT

Commissioner Black reported that he has been asked to serve on a task force regarding Mental Health Facilities.

UNEMPLOYMENT REPORT

Commissioner Black reported that he has received a report from the Department of Employment Security stating the following umemployment rates and changes in the work force in the past year.

Commissioner Black stated that although tourism is extremely important in Southern Utah it is not something that will alone solve our economic problems.

LETTER TO D.O.T. RE; PAY HILLS PASS

Commissioner Black reported that he has sent a letter to the D.O.T. supporting funding for re-construc-tion of Clay Hill Pass.

PROPOSAL TO PURCHASE LAND NEAR MONUMENT VALLEY

The Commission stated that they favored the sale into private ownership the section owned by the Division of Parks and Recreation at the intersection of Hwy. 191 and the Oljato Highway in Monument Valley.

MONTEZUMA CREEK SWIMMING POOL REPARIS

Commissioner Bailey made a motion to accept the estimate submitted by Jay Nelson for repairs at the Montezuma Creek Swimming Pool. The motion was seconded by Commissioner Holliday and carried unanimous-ly. The cost for these repairs will be $9,435.

REPAIRS AT BLUFF COMMUNITY BUILDING

Commissioner Bailey made a motion to approve the estimate for installation of sound panels at the Bluff Community Building to reduce echoing. The motion was seconded by Commissioner Holliday and carried unanimously. The cost for the installation is $2,475.

REMODELING AT THE OLD MONTEZUMA CREEK SCHOOL BUILDING

Commissioner Bailey made a motion to approve the estimate for some remodeling work to be done at the old

Montezuma Creek School. The motion was seconded by Commissioner Holliday and carried unanimously. The cost for the remodeling is $3,809.

B.L.M. LETTER RECEIVED RE: SALE OF LAND

The Commission received a letter from the B.L.M. stating that they are proposing to dispose of 80 acres of public land near Monticello. The Commission will send a written response commending this decision and further stating that they feel more public lands should be classified for private sale.
