SAN JUAN COUNTY COMMISSION MINUTES AUGUST 11, 1986

The San Juan County Comnission met in regular session on August 11, 1986 at the hour of 10 a.m. at the San Juan County Courthouse, Monticello, Utah.

The following members were present: Commissioner Black, Chairman

Commissioner Holliday

Commissioner Bailey - absent

The minutes of the August 4, 1986 Commission Meeting were read and approved with the corrections on the motion of Commissioner Holliday and seconded by Commissioner Black. UNANIMOUS.

FREIGHT TRUCKING IN SAN JUAN COUNTY

Mike Lyman, Lyman Truck Line of Blanding and Mark Ewart, a truck delivery service in Monticello, met with the Commission concerning the delivery service in the county. There are three companies that haul freight to the county, FBI, ANR, and Milne Corp. Mr. Lyman said that Milne provides service Tuesday through Saturday but they have a weight restriction of 100 pounds per item and 1000 per load. FBI and ANR do not have a weight restriction but do not provide daily service. This is creating a lot of problems and they asked the Commission to talk to the Public Service Commission to see if any pressure can be put on FBI and ANR to serve the county everyday or remove the weight restriction on Milne. Commissioner Black said that PSC is a regulatory agency, not an advocate. The Commission suggested that they write a letter to FBI requesting daily service and the Commission will support their efforts.

KELMINE CORPORATION - LISBON VALLEY

Mel Swanson of Kelmine Corporation thanked Commissioner Black for his efforts with the State Land Board on getting the KeLmine Corporation project in Lisbon Valley approved. Mr. Swanson said the project should begin the first of September but he hasn't received any formal correspondence yet. Commissioner Black said he would follow up on this.

HUMAN SERVICES BOARD

Rick Bailey, Administrative Assistant, said that Bruce Shumway recommended Francis Shorty of Oljato to be appointed to the Human Services Board. Commissioner Holliday made the motion to appoint Mr. Shorty and Commissioner Black seconded it. UNANIMOUS.

KEN'S LAKE BOATING REGULATIONS - PUBLIC MEETING IN MOAB

The Commission will be attending a public meeting in Moab Wednesday, August 13 at 7 p.m. to discuss the

boating regulations atKen's Lake.(Minutes of that meeting on pages 128-130)

EMS GRANTS - UTAH DEPARTMENT OF HEALTH - Contract Agreements

Commissioner Holliday made the motion to approve a Contract Agreement with the Utah Department of Health Public Health Services for the EMS Grants Program and authorized Commissioner Black to sign them. Commissioner Black seconded the motion. UNANIMOUS. The contract shall be effective August 15, 1986 until June 30, 1987. The grant is for $15,016 which $14,266 is for an ambulance and $750.00 is for training.

BLM MEETING

The Commission will be meeting with the BLM today to discuss the management development proposal at 3 p.m. at the BLM office.

GRAZING ON PUBLIC LANDS - Environmentalists

Commissioner Black said the Environmentalists are making a big move to eliminate all grazing on public lands. They claim that the government costs are more to subsidize to allocate planning for grazing. He also observed that most of these costs are not related to grazing but to requirements brought about by legislation and environmentalists groups. Commissioner Black said the backpackers don't pay any money to go on this land but the cattleman has to lease the land to use it.

PROPOSED PUBLIC SAFETY BUILDING - IMPACT BOARD

The Commission attended the Impact Board hearing last week and the Board put the county's grant application for the proposed public safety building on next month's agenda. The board did not give the grant to the county that was requested and they asked the county to revise their proposal to either consist of a scale down facility with fewer cells, at less cost, or a provision to pay back some of the cost. To reduce the capacity that would provide for 40 inmates will meet the present needs, but this will not allow for state prisoners. Revenue from housing state prisoners could help pay part of the cost of operation and reduce the grant request, and keep the facility the same.

JAIL in FORT COLLINS - JOHN PETERSON

Rick Bailey reported that he, Commissioner Bailey, Sheriff Wright, and John Peterson visited the Fort Collins jail facility in Colorado and said they were impressed with the facility. Mr. Bailey said that John Peterson, architect, will meet with the Commission next Monday with the revised plans for the proposed public safety building.

DISTRICT FIRE WARDEN - FIRE TRUCKS

Bruce Sillitoe, District Fire Warden, met with the Commission concerning the tires on the two fire trucks. The tires are in bad shape and some have chunks out of the them and it is important that the front tires are in good shape. Mr. Sillitoe said that George Kensley is set up on a mileage report and will be on standby duty for the state on week ends. Mr. Sillitoe said the Montezuma Creek fire door is still broken. Commissioner Holliday said that Jay Nelson was suppose to fix the door and will follow up on this.

CIRCUIT COURT CONTRACT

Gail Johnson, clerk, presented the Commission the contract between the State Circuit Court and the County to provide services for $19,108.00. Commissioner Holliday made the motion to approve the contract and authorized Commissioner Black to sign it. Commissioner Black seconded the motion. UNANIMOUS.

ABAJO PEAK TELECOMMUNICATIONS USER ASSOCIATION

Commissioner Holliday made the motion to approve the final "Constitution and Bylaws" for the Abajo Peak

User Association and authorized Commissioner Black to sign the signature letter. Commissioner Black seconded it. UNANIMOUS.

HUMAN SERVICE BOARD - CANYONLANDS YOUTH HOME ADVISORY BOARD

Commissioner Holliday reported that there is a combined meeting August 14, at 2 p.m. in Blanding for the Human Services Board and the Canyonlands Youth Home Advisory Board.

DOE - ENRICHMENT CRITERIA

Commissioner Black reported that DOE has issued and published in the Federal Register their enrichment criteria which continues to ignore the law and the judge's decision. There have been resolutions

introduced both in the House and Senate which if passed will disapprove the proposed criteria. Today is the mark up hearing in the House Committee under Chairman Markey and the mark up will be in the Senate on Thursday under Senator Domenci. Commissioner Black said he contacted Congressman Nielson's office and was told that he is a co-sponsor of the resolution. Commissioner Black said he will send letters to sane of the committee members.

PARK SERVICE OFFICE IN MONTICELLO

Commissioner Black reported that the Monticello Park Service office will not be closed. Pete Parry put out a release on the radio saying they are not going to close the office. Commissioner Black said he talked to Bob Weidner of Senator Garn's office, and he assured him that they will not close the office but may change some personnel.

AMOCO DRILL SITE ON LA SAL MOUNTAINS

Commissioner Black said that a couple of weeks ago he asked the Division of State Lands to rethink their decision on reclaiming the road to the drill site on the La Sal Mountains and requested that item be put on the State Land Board agenda. It was not on the agenda for action but was discussed and Commissioner Black said he requested that they not spend the money to destroy the road and to look at alternatives but they chose not to do so. Commissioner Black said he and Representative David Adams visited the site last Friday and they both felt that the road should not be destroyed and the drill pad could be reclaimed to be reseeded and still be made available for a parking and turn around area. Also, eventually the road could go about 1/4 mile beyond this point and intersect the upper road to Dark Canyon. Rep. Adams called Ralph Miles after returning home and he indicated they would be willing to work something out. The contract for the reclamation has been let but Commissioner Black said he talked to the contractor and he is willing to make some changes. Commissioner Black said he also called Mike Grosjean this morning and he said they are negotiating with the parties involved to leave the road open. Commissioner Black said this is a dead end road, a nice area, and a beautiful view and if the road was destroyed it would still be a dead end road only one mile shorter with a bard turn-around area.

MOAB BLM DISTRICT ADVISORY COUNCIL MEETING

Commissioner Black reported he attended the Moab BLM District Advisory Council meeting last Thursday. They adopted a resolution opposing any more wilderness on a seven to two vote. They also adopted a resolution asking Congress and the Administration of the BLM to allow the fees that are collected from river running to stay in the area they are collected in. A resolution was passed proposing several turn outs and information signing at various points on Interstate 70 to explain and promote the multiple use of BLM lands. Commissioner Black said he will be taking these resolutions to the National BLM Advisory Committee meeting on August 21 & 22 for their consideration.

BLM RIGHT OF WAYS

Commissioner Black said he talked to Pete Christensen, manager BLM, with respect to the notice on the BLM right-of-ways. Mr. Christensen said that they did not intend to take these away from the county, that it would be a dual right-of-way situation, and he will send a letter clarifying this.

BLANDING CITY - LETTER - FRONTIER THEATER

The Commission received the following letter:

Dear Commission:

At the July 9, 1986 meeting of the Blanding City Council a discussion was held relative to the unsightly and unsafe structure just north of the Blanding City limits, known as the Frontier Theater.

The Council feels it is a health hazard, area for public nuisance and deterant to the City and County beautification.

The Council, in an unanimous vote, requested assistance from the County Commission and other County agencies to take whatever action is necessary to correct the problem.

Your help and assistance will be greatly appreciated.

UTAH WATER POLLUTION CONTROL COMMITTEE

The Utah Water Pollution Control Committee will conduct a public hearing on Thursday, August 28, 1986 in Salt Lake. The purpose of the hearing is to solicit public comment on adoption of the Utah Pollutant Discharge Elimination System.

Dear Commissioners:

Re: Radio and Equipment Failures

The following is a list of equipment failures we have with patrol vehicle radios and Sheriff's office dispatch radios and paging systems.

1. Rudy Cook's radio will not receive, transmit, or intermittent

2. Bill Pierce,s radio same as above

3. Steve Stovall's radio same.

In the interest of officer's safety, it is imperative that these deficiencies be corrected.

The EMS radio and paging system are not operating, which places County residents, tourists, and others in grave jeopardy.

The County paging system on channel four is also not operating, as well as the county paging system for contacting the Fire Dept.

The Sheriff's dept is the central link in the county for rendering emergency services and without our emergency equipment working in full operation we not only place people in danger, but San Juan County is in a serious liability situation.

Your prompt attention to this matter of mutual concern would be greatly appreciated.

The Commission talked to Bill Bayles, communication engineer, and he said there is a real problem with Bill Pierce's radio because it is old and parts are hard to get. The Sheriff's pager is fixed but the EMS pager is not working. Mr. Bayles said he checked the hospital radio system and it is working fine. The main problem with the radio system is getting parts in.

WILDERNESS BLM PROPOSAL

Here is an update on Texaco's activity regarding the BLM Wilderness proposal in the State of Utah.

With the assistance of Rick Bailey, plus our own records, we have generated, two mailings contacting a total of 78 companies and/or individuals who have various interests in oil and gas activity in San Juan County.

Additionally, Texaco has filed written comments with the proper officials and has also met with a BLM task force in Salt Lake City to review geological data.

For your information I have attached a short article regarding a wildcat we recently spudded in Emery County. This well is adjacent to one of the WSA's and we have reviewed specific date with the BLM of this prospect.

We appreciate the material the county has made available to the task force to include in the mailings.

DIVISION OF FINANCE - SALES TAX ON IN-STATE LODGING

The Commission received a memorandum from the Utah State Division of Finance dated July 10, 1986 regarding the tax exemption policy for state employees on state business. Effective immediately, employees of the State of Utah on State business will no longer be exempt from sales or transient room taxes charged on the accommodations including meals and other charges. All appropriate taxes will be charged on accommodations, meals, etc. and remitted by the hotel/motel to the tax collecting governmental agency. These collections will not require any special handling or segregation but may be co-mingled with all other taxes you remit.
