MINUTES OF THE MEETING OF THE SAN JUAN COUNTY COMMISSION
JUNE 10, 1985
The San Juan Commission met in regular session mon June 10, 9885 at the hour of 10 a.m. in the San Juan County Courthouse at Monticello, Utah.
The following members were present: Commissioner Kenneth R. Bailey
Acting Chairman Commissioner Jerry Holliday
Commissioner Calvin Black was excused from the meeting.
Minutes of the previous June 3, 1985 meeting were approved as corrected on the motion of Commissioner Holliday. The motion was seconded by Commissioner Bailey and carried unanimously.
LETTER FROM UNITED STATES POST OFFICE RE, MAIL BOX ON BLUE MOUNTAIN ROAD IN BLANDING
The Commission received a letter dated June 4, 1985 from Merridy K. Cross, Postmaster of the Blanding Post Office regarding a request from Ervin Oliver to move the neighborhood delivery and collection box unit located near his corrals on Blue Mountain Road in Blanding. Mr. Oliver feels the unit is located on private property, and Postmaster Cross feels it is on county right-of-way.
The Commission feels that it is not the responsibility of the County to survey and determine whether property in question is on private land or county right-of-way, as there was no encroachment permit issued by the County Road Department, and we have no knowledge as to whether they have the private landowner's permission. Commissioner Holliday will discuss this further with Blanding Postmaster.
GIBBONS COMPANY - COUNTY UNEMPLOYMENT
Mr. Rick Bailey, Assistant to the Commissioners, reported that he has reviewed the contract with Gibbons Company and The Association of Counties, and it is his opinion that the County will not be able to get out of this contract. Mr. Rick Bailey will prepare a letter for Commissioner Black's signature to be signed at the next regular Commission meeting. The letter states the County's dissatisfaction with their performance on the County's behalf. Mrs. Rick Bailey also said he will be meeting with Gibbons Company next to review their procedure and performance.
STATE AGING DEPARTMENT
Mr. Rick Bailey, Assistant to Commission, reported he received a letter from the State Aging Department indicating a discrepancy on the number of minorities we are servicing in this area. Mr. Rick Bailey will prepare a statement showing the names, social security numbers, and address of all minorities being served in the San Juan Area.
COUNTY AGING DEPARTMENT - HIRING POLICY
Mr. Rick Bailey, Assistant to Commission, reported that there has been some question as to the hiring practices for the County Division of Aging. Rick Bailey has prepared a memo to all those concerned stating that all personnel hired by the Aging Department will be approved by Mr. Rick Bailey. Also, all position openings will be advertised according to County policy.
COUNTY AGING DEPARTMENT - BUS SERVICING
Mr. Rick Bailey, Assistant to the Commission, reported that he notified the bus drivers employed by the County Aging Department they are responsible for the maintenance of the bus they are driving. After some discussion, the Commission requested Mr. Rick Bailey set up a regular schedule for maintenance on all buses.
SAN JUAN COUNTY ADVISORY AGING COUNCIL
Commissioner Holliday made a motion to have LaRay Alexander appointed as State Advisory Council and Al Haskins as alternate. Commissioner Bailey seconded the motion which carried unanimously.
SOUTH RECREATION DIRECTOR - TRANSPORTATION VEHICLE
Commissioner Jerry Holliday suggested Mr. Dennis Jones, South Recreation Director, meet with Bernal Bradford of the County Road Department for a possible exchange of pickups.
SOUTH RECREATION - MAINTENANCE EQUIPMENT
Mr. Dennis Jones, South Recreation Director, requested approval for lawnmower improvements. The Commission authorized Mr. Jones to secure bids for additional lawnmower equipment.
BURNING OF STATE SCHOOL SECTIONS
The Commission received a copy of a letter to the Utah State Division of Lands and Forestry from Lisle G. Adams, et. al., regarding their concern that the necessary burning of the State School Sections in question has not yet been started. In the letter Mr. Adams requested a meeting with the Utah State Division of Lands and Forestry to discuss this problem. In a telephone conversation with Mr. Adams during the Commission Meeting, Mr. Adams stated that he would like to meet with the Commission to discuss the outcome of this meeting which is scheduled for June 11, 1985.

Please accept these comments regarding your letter dated April 15, 1985 regarding the establishment of boundaries of National Historic Landmarks.
The San Juan County Commission is opposed to the establishment of boundaries in the Alkali Point area for the following reasons:
1. There is considerable oil and gas development in this area at the present time. These compan-ies have expended a great deal of money and time in development and production and will continue to do so in this area if they are permitted. Our area is in a very depressed economic area, where every benefit that we can obtain is necessary in order to provide services required by the citizens of this area.
2. The Commission is not in agreement with the statements of significance in that the area's cultural resources have been destroyed and damaged by opening the area up with the industry's road development. The pot hunting and other damage has occurred with or without this.
3. The power line and pipeline are in place and provide needed services to the areas and indu-stry. Many of the same explanations listed in number one are also justified in this comment.
4. The Commission believes that the statements as to the destruction of the cultural resources and the impacts are grossly overstated.
The Commission has always felt and will continue to state that there is a needed balance in which the most significant sites can be preserved without locking up the entire area. These single-use areas are not beneficial and do not serve the majority of the citizens.
Therefore, we again state that we are opposed to this selection and specific boundaries being placed around the Alkali Point.

SOUTHLAND SUIT
County Attorney, Bruce Halliday, reported to the Commission that he has talked with the Attorney General's Office this day regarding the recent Montana court decision regarding taxing jurisdiction of mineral resources on Indian reservations. The Attorney General's Office stated that the case in Montana is substantially different than our case and the Minerals Leasing Act of 1938 which gives the County authority to tax oil and gas on the reservation. Mr. Halliday further informed the Commission that if the case is the State of Montana cannot tax the tribe's royalty, then that will not affect San Juan County. Mr. Halliday said he should have more concrete information by next week regarding this Montana decision.
NORTHWEST EMERGY VS. SAN JUAN AND OTHER COUNTIES
Bruce Halliday, County Attorney, received a bill which settled the Northwest Energy Company lawsuit, wherein we agreed to pay $3,740 in refunds to Northwest Energy in settlement for the return of taxes paid under protest on a pipeline. The Commission instructed Mr. Halliday to make out a voucher for payment of this settlement.
PRIVATE FENCE CONSTRUCTED ON COUNTY ROAD NO, 175
Commissioner Bailey informed County Attorney, Bruce Halliday, of a complaint that had been received regarding a fence across an existing county right-of-way . The Commission asked the County Attorney to look into the matter.
HONDALAND/SAN JUAN COUNTY PROPERTY DEED DISCREPANCY
The Commission discussed with the County Attorney, Bruce Halliday, the problem of a property line discrepancy between San Juan County and Hondaland.
CONTRACT WITH DOUT GARNER TO CRUSH GRAVEL
Commissioner Bailey reported Merz Hugentobler is having problems trying to use filler out of Spring Creek trying to use it on the city streets. Rather than pushing and hauling off oversized rocks, it was decided to consider crushing. Motion was made by Commissioner Holliday authorizing Doug Garner to crush $5,000 yards of 3 inch at $1.80. Motion was seconded by Commissioner Bailey and passed unanimously.
EMPIRE ELECTRIC ASSOCIATION-RELOCATION OF POWER POLE AT GOLF COURSE
Commissioner Bailey presented a bill to Bruce Halliday, County Attorney, regarding the relocation of a power pole at the San Juan County Golf Course. The bill is approximately $1,000 more than the original amount agreed upon. The original figure was $1,907. Mr. Halliday will write Empire Electric regarding this matter along with a check in the amount of $1,907.
LETTER FROM BIA REGARDING FREE-USE SAND AND GRAVEL PERMITS
The San Juan County Road Department received a letter from the Bureau of Indian Affairs stating the County will have to provide archeological clearances and environmental assessments for permits for sand and gravel on the Indian Reservation.
JUNE 22 COUNTY SURPLUS AUCTION
Rick Bailey, Assistant to the Commission, discussed the June 22 auction with the Commission regarding the availability of titles to equipment that will be auctioned. Items auctioned will be sold on an "as-is", "where-is" basis. Bills of Sale and titles will be provided where possible.
SAN JUAN COUNTY AMBULANCES
The policy for ambulance maintenance was discussed. Rick Bailey, assistant to the Commissioners reported that each local association is responsible for the local maintenance on the ambulance. They are to submit their needs to Mr.
Rayburn Jack, San Juan County Hospital Administrator. The Commission requested that Rick Bailey follow up on getting these ambulances serviced.
COUNTY SALE OF USED EQUIPMENT TIRES
The Commission agreed that the County Road Department could sell used large-equipment tires to the public for a price of $10 each. The tires may be purchased at the Bland ing Road Department.
HEARTS DRAW ROAD
The County received an approved special use permit for a gravel pit for the construction of the road

from county road No. 101 to U-211, Hearts Draw Road, from the US Forest Service dated June 7, 1985.
SAN JUAN COUNTY ASSESSING AND COLLECTING PROCEDURES
The Commission met with the School Board to discuss the possibility of a compromise solution to the
financing of tax collection. The Commissioners deferred action at this time.
LIBRARY BOARD APPOINTMENT
Commissioner Holliday made a motion that Mr. Harold R. Allen and Mr. Oleen Hatch be appointed to the
Library Board. The motion was seconded by Commissioner Bailey and passed unanimously.
COUNTY DEPOSITS
Gail Johnson, County Clerk/Auditor, further discussed the problem of keeping tract of deposits made by
the County. This matter will be discussed further during the Elected Officials Meeting next week.
MONTEZUMA CREEK SWIMMING POOL
Commissioner Holliday said he will check into why the swimming pool in Montezuma Creek has not been opened.
COUNTY OVERTIME POLICY Clarification
The County's overtime policy was discussed. Bruce Halliday, County Attorney, stated that the current
policy is that the County will allow travel one way.
