SAN JUAN COUNTY COMMISSION AUGUST 10, 1987
The San Juan County Commission met in regular session on August 10, 1987 at the hour of 10 a.m. at the San Juan County Courthouse, Monticello, Utah.
The following members were present: Commissioner Black, Chairman
Commissioner Bailey Commissioner Maryboy
Minutes of the August 3, 1987 Commission Meeting were approved with corrections on the motion of Commissioner Maryboy and seconded by Commissioner Bailey. UNANIMOUS.
COMMISSIONER CALVIN BLACK'S REPORT
Garfield County - Burr Trail - The Commission received a thank you note from Tom Hatch, Garfield County Commissioner, for the contribution to the Burr Trail defense.
Fires - State Lands & Forestry - Commissioner Black asked Rick Bailey, Administrative Assistant, to write a letter to Mike Grosjean, Regional Manager State Lands and Forestry, requesting the number of acres that have burned, fire fighters net hours and total costs on three specific fires.
GAO gives BLM Wilderness Critics Ammo on Inholdings - In an issue of Public Land News an article states: House Interior Committee Republicans have obtained fresh ammunition to fire at BLM wilderness proposals. The ammo comes from a new General Accounting Office (GAO) report that says nonfederal inholdings and subsurface minerals are found on 1.7 million acres of the 25 million acres BLM is studying for wilderness recommendation. Congress has the prerogative to designate anything it wants as wilderness but the report shows that there are many areas that will be faced with many potential land acquisitions. GAO says that 455 of 860 WSAs contain privately-owned land, state-owned land or minerals that could be developed. BLM says of 374 WSAs studied, about 179 areas face potential development.
Emergency Meeting - As a result of the initial application of the Gramm-Rudman-Hollings Act on budget reduction, the regional offices of the BLM and the Forest Service has proposed significant increases in the rental fees charged for communications sites used for translators, broadcast transmitters, and other broadcast uses. This proposed fee increase would cost Utah broadcasters about $2,000,000 a year. A one-day regional meeting is to be held in Salt Lake on August 31 to discuss a fair lease arrangement for BLM/Forest Service site usage. Commissioner Black said he plans to attend this meeting. Revenue Sharing - Commissioner Black reported that the counties won the court case where NACo required the Federal Government to send out the final $180 million in revenue sharing.
Utah Division of Oil, Gas, Mining & Minerals committee has adopted new rules and regulations that cover Utah Minerals Regulatory Program, Exploration Small Mining and Mining. Commissioner Black has been invited to attend their meetings and also submit recommendations.
Bureau of Air Quality on Integral Vista - Commissioner Black said that Bill Howell, AOG, has written a statement on the State of Utah Bureau of Air Quality's implementation of Integral Vista regulations.
COMMISSIONER KENNETH BAILEY'S REPORT
Airport - Armstrong Consultants - Commissioner Bailey reported that the Commission met with Keith Koler,
Armstrong Consultants Engineer, and he said the contractor is going to slurry seal both the Monticello and
Blanding airports by the end of August which will complete both projects.
Monticello Airport - Payment - Commissioner Bailey made the motion to approve payment #1 to J. M. Sumsion
& Sons for work completed through July 20 for $187,908.46 and authorized Commissioner Black to sign the
application. Commissioner Maryboy seconded the motion. UNANIMOUS.
Public Safety Building - Payment 12 - Commissioner Bailey made the motion to approve payment #2 of
$127,906 to Valley Builders and authorized Commissioner Black to sign the application. Commissioner
Maryboy seconded the motion. UNANIMOUS.
Commissioner Bailey updated the Commission on the inspection of the Public Safety Building.
COMMISSIONER MARK MARYBOY'S REPORT
State Land - Commissioner Maryboy said that Kevin Carter has scheduled a meeting for August 25 in Blanding
to discuss with the Navajo Tribe and Chapter officials the sale of state land on the reservation.
White Shale Permit - Commissioner Maryboy said he will be meeting with the Navajo Tribe to follow up on
the county obtaining a permit for the White Shale near Mexican Water.
Bluff - Grasshoppers - Commissioner Maryboy said that several farmers at Bluff have contacted him about
the problem of grasshoppers. Commissioner Maryboy said he reported it to the county agent.
Bluff Senior Citizen Center - Commissioner Maryboy said he will continue to work with Navajo Tribal agents
in trying to resolve the senior citizen center at Bluff.
Peabody Coal Company -mineral lease approved — Commissioner Maryboy said that the Navajo Tribe has
approved a mineral lease with Peabody Coal Company. Approximately $70 million will go to the Tribe and
requests are being accepted to utilize this funds. The county is encouraged to submit a proposal for funding of road projects on the reservation.
REGIONAL CORRECTIONS FACILITY
The Selection Committee will be making their decision as to where the Regional Corrections Facility will be built. The announcement will be made Friday August 14.
ATTORNEY REQUESTS LEGAL COMPUTER
Craig Halls, county attorney, presented the Commission a proposal to upgrade the computer in his office and also buy another computer that would enable access to legal research, law library, etc. Mr. Halls gave a price list from a local distributor which will give the county a 33% discount. The Commission said they will review it and asked Mr. Halls to talk to John Fellmeth about his view on it.
IMMIGRATION REFORM AND CONTROL ACT
The Commission discussed with several department heads the Immigration and Control Act that was signed into law and affects anyone hired after November 6, 1986. The law says that an employer should hire only American citizens and aliens who are authorized to work in the United States. Anyone who applies for a job needs to complete Form 1-9 which is an employment eligibility verification form. The Commission agreed to adopt the following into the county personnel policy: No new employee begins work before they fill out a W-4 form and a I-9 form.
ROAD DAMAGE - ACCIDENT AT LASAL
Jim Blankenagel met with the Commission to report that he had an accident on a county road at LaSal. The road is in need of repair and damaged his vehicle which he feels is partially the county's fault and partially his. Mr. Blankenagel said the accident was reported to the sheriff. The Commission told Rick Bailey to get a copy of the traffic report from the sheriff's office and submit it to the county's insurance.
WEED CONTROL SUPERVISOR - JIM HEATON
Jim Keyes, county agent, met with the Commission to discuss the hours and benefits of the Weed and Rodent control supervisor. Minutes of the August 4, 1986 Commission Minutes state that when Mr. Heaton was approved to be put on a salary basis of 40 hours a week and would not qualify for regular benefits. The Commission agreed that Mr. Heaton's hours and no benefits stay the same. If Mr. Heaton wants to work less than 40 hours one week and more than 40 the next week it is up to him.
COUNTY FAIR / RODEO
Jim Keyes, county agent, told the Commission that the county fair board is making a radio-type advertisement from several local businesses and will play the tape around town announcing the fair and rodeo.
1987 TAX NOTE PAPERS
Gail Johnson, clerk, said the 1987 Tax Note papers will need to be signed this Wednesday by the Commission Chairman. Commissioner Black said he will be out of town attending State Land Board meetings in Cedar City. Commissioner Maryboy made the motion authorizing Commissioner Bailey, vice chairman, to sign the Tax Notes. Commissioner Bailey seconded the motion. UNANIMOUS.
COMMUNICATIONS - MICBO-WAVE SYSTEM
Rick Bailey, Administrative Assistant, said the communication frequencies will need to be checked to see if they are viable to the micro-wave system. Mr. Bailey requested authorization to work with Motorola in proceeding with the Washington D.C. FCC frequency micro-wave system at a cost of $500.
BROWN'S HOLE - ANDERSON SALVAGING
The Commission received a letter from John E. Anderson who lives at Brown's Hole stating that he has been salvaging old carpets, fencing and garden hoses from the Moab City Dump. He is collecting these things for personal use and a regulation passed by the Grand County Commission requires a permit to continue the recycle of these items. The Commission agreed to have someone from the Sheriff's department go and talk to Mr. Anderson before approving this.
BIDS OPEN LOT 2, MITCHELL SUBDIVISION
At 1 p.m. the Commission accepted bids for Lot 2, Mitchell Subdivision. Alfred Christensen was the only person present and bid $500.00. No other bid was received. Commissioner Bailey made the motion to sell the lot to Mr. Christensen for $500.00. Commissioner Maryboy seconded the motion. UNANIMOUS.
AUDITOR'S MANAGEMENT REPORT
Gail Johnson, clerk, and John Fellmeth, deputy auditor, met with the Commission to discuss the management report from independent auditor, Taylor and Company.
SHERIFF'S EMPLOYEE LETTER OF TERMINATION
Claude Lacy, sheriff, reported to the Commission that he received a letter of termination from Phil Bolduc, deputy sheriff, terminating as of July 31, 1987.
